This case is coming before me for final disposal in the presence of learned Assistant Public Prosecutor Sri N. Ramesh, for the State and Sri N.Siddulu, learned counsel for the accused and upon considering the material evidence available on record and having stood over for consideration till this day, this Court delivered the following:

:: J U D G M E N T ::

01.The Sub-Inspector of Police, Bachannapet, filed a charge sheet in

Cr. No.41/2016 against the accused for offence punishable under Section 354 A of Indian Penal Code (IPC).

The case of the prosecution in brief:

02.The criminal law was set into motion on 02-05-2016 at 11:15 hours

PW1 lodged a report in PS Bachannapet, in which she stated that on 01-05-2016, she washed clothes and after drying, she took the clothes into her house for folding the clothes with a view to preserve them in

Almirah, on the same day evening at about 04:00 hours, her villager

Valaboju Venugopala Chary, S/o. Bala Narsimhachary came into her house, told that it is very cold in her house and connected talks with her, at that time her children 1) Aleti Eshwar Prasad, Aged 4 years, 2) Aleti Ekshitha,

Aged 8 months were present in the house. Said person entered the house in the absence of elders and she call him as Babai, on that said person disclosed that why she is calling him as Babai and he wants to kiss her by catching her and used force on her, upon which when she raised hues and cries, he tortured her stating that he will inform her husband badly about her and detained her in the house, used obscene words and forced her to fulfill his desire, when she tried to escape from him, he threatened to kill her and while she was crying, said Venugopala Chary suspected that nighbours will come there and went away. She is having life threat from said person. Thus she requested to take action against him and as per law.

03.On receipt of the above complaint, LW8/N. Ravi Kiran S.I of Police registered a case in Cr.No. 41/2016 Under section 354(A) IPC issued FIR and took up the investigation. During the course of investigation, LW8 has intimated this incident to LW5/K. Sunitha, immediately the LW5 came to

PS and recorded PW1 statements. LW8 has examined and recorded the statement of PW2 at PS Bachannapet. Later he visited the Alimpur Village and conducted scene of offence panchanama before the mediators PW3 and PW4 incorporating the physical features of the scene in CDF, later

LW8 examined and recorded the statement of LW3/M. Suryakala and

LW4/M. Shravani in part-II CD. On 04-05-2016, the accused came to PS and surrendered before LW8 at PS Bachannapet at 10:00 hours. As such took him into custody and interrogated. On interrogation, accused voluntarily confessed to have committed this offence, hence, effected his arrest by issuing arrest form grounds of his arrest has been informed to him and his blood relatives, later the accused produced sureties and released on bail. Finally on completion of investigation LW8 filed charge sheet against accused for the offence 354 A IPC.

04.The case was taken on file by the then presiding officer for the offence Under Section 354 A IPC against accused.

05.On appearance of accused, he was furnished with copies of all necessary documents as required Under Section 207 Code of Criminal

Procedure (herein after referred as Cr.P.C.).

06.Accused was examined Under Section 251 Cr.P.C. for offence Under

Section 354 A IPC by explaining the substance of accusation to him for the

FAIR COPY 4 C.C. No.128/2016 said offence in his vernacular language, for which accused understood the same and pleaded not guilty and claimed to be tried.

07.To prove the guilt of the accused, the prosecution examined PWs 1 to 4 and got marked Ex.P1 to Ex.P5.

08.After closure of prosecution evidence, accused was not examined

Under Section 313 Cr.P.C. as there was no incriminating material appearing in the evidence of prosecution witnesses.

09.Heard. Perused the record.

10.Now the point for determination is as follows:

Whether the prosecution had established the guilt of

accused for the offence Under Section 354 A IPC, beyond

reasonable doubt?

11.Evidence on Record

PW1 the complainant, deposed that LW2 is her husband. She know LW3, 4 and accused. She does not know anything about the case. She has signed at the instance of others about 9 years ago. She stated that the police have not examined her and not recorded her statement. On confrontation with report witness identified her signature but denied knowing the contents of it. Ex.P1 is the signature of PW1 on report. During cross- examination she denied the contents of report filed before police and further denied that police have examined her and recorded her statement.

It is admitted that she had compromise with the accused. EX:P2 is the section 161 Cr.P.C statement of witness.

12.PW2 deposed that PW1 is his wife. He know LW3, 4 and accused. He was at Khammam at the time of incident. He got to know that accused entered into his house when his wife was drying the clothes. He got to know about the same when PW1 called him over phone and informed him.

He does not know anything else. He does not know whether police have examined him and recorded his statement. During cross-examination he denied that police had examined him and recorded his statement, he is admitted to have compromise with the accused. EX:P3 is the Section 161

Cr.P.C statement of witness.

13.PW3 deposed that he know PW1 and PW2 and they belong to same village. He know the accused. LW3 is his wife and LW4 is his daughter. He does not know anything about this case. He signed on white paper at the instance of the police. He do not remember the date of signing. On confrontation crime detail form witness identified his signature and denied knowing the contents. He do not know if any one else signed with him.

Ex.P4 is the signature of the PW3 on crime detail form dated 02-05-2016.

During cross-examination he denied that on 02.05.2016 police conducted crime detail form in his presence. He do not know that the police drawn rough sketch noted boundaries. He do not know if LW7 was present along with him. He denied the suggestion of deposing false and in favour of accused.

14. PW4 deposed that he know PW1 and PW2 and they belong to same village. He know the accused. He does not know anything about this case.

FAIR COPY 6 C.C. No.128/2016 remember the date of signing. On confrontation of crime detail form witness identified his signature and denied knowing the contents. No one else signed with him. Ex.P5 is the signature of the PW4 on crime detail form dated 02-05-2016. During cross-examination he denied that on 02.05.2016 police conducted crime detail form in his presence. He do not know that the police drawn rough sketch noted boundaries. He further denied that PW3 was present along with him. He denied the suggestion of deposing false and in the favour of accused.

15.The learned Assistant Public Prosecutor sought permission to cross- examine PW1 to PW4 after they were declared hostile. However, nothing substantive was elicited during cross-examination that could support the prosecution's case.

16.However, Ex.P1 to Ex.P5 mere marking of their signatures and statements does not amount to proof, as they remain inadmissible evidence unless corroborated by oral testimony.

17.The complainant (PW1) and all other prosecution witnesses (PW2 to

PW4) turned hostile. They denied having any knowledge of the alleged offence and categorically stated that they were not witnesses to the incident. This complete denial by the prosecution witnesses severely weakens the case of the prosecution.

18.The prosecution failed to bring forth any independent or corroborative evidence to substantiate the allegations made against the

FAIR COPY 7 C.C. No.128/2016 accused. The sole reliance on hostile witnesses and unsubstantiated Ex.P1 to Ex.P5 does not meet the standard of proof required in criminal cases.

19.The burden lies on the prosecution to establish the guilt of the accused beyond reasonable doubt. In this case, the evidence is wholly insufficient to prove the ingredients of Sections 354 A IPC. The hostile nature of witnesses and lack of incriminating material exonerates the accused from all allegations.

20. In the absence of any credible evidence, this Court finds that the prosecution has failed to prove the guilt of the accused for the offence alleged under Section 354 A IPC beyond reasonable doubt.

21. In the Result, Accused is found not guilty for the offences 354 A of

IPC. Accordingly, he is acquitted under Section 255(1) of Cr.P.C for the said offence. The bail bond of accused shall stand cancelled and the sureties shall be discharged after the expiry of appeal period.
