This suit is coming on 20-3-14 before me for fnal hearing in the presence of Sri M. Sreedhar Reddy and Smt. M. Satya Sri, Advocates for the plaintif and the defendants having remained ex parte and having stood over for consideration, till this day and this Court delivered the following:

JUDGMENT

This is a suit fled by the plaintif against the defendants on the strength of chit agreement executed by 1st defendant and for costs of the suit.

2. The plaintif submits that the 1st defendant is the subscriber who joined with the plaintif company on 12-1-2009 in chit bearing No.

AMB 06/38 by paying Rs.5,000/- towards the 1st month subscription and the bye law of the chit is 104/2008-09 and got executed a chit agreement in favour of the plaintif company. The said value of the chit is Rs.2,00,000/- consisting of 40 members and each subscriber has to pay sum of Rs.5,000/- per month as subscription for a total period of 40 months.

The plaintif further submits, that on 22-4-2009 the 4th chit auction was conducted by the plaintif company as per the Rules and 2 the 1st defendant participated in the auction and became the successful bidder and agreed to forego a sum of Rs.80,000/- out of the chit value of Rs.2,00,000/-. The same was duly confrmed by the plaintif company. The company deducted the commission from the amount foregone and the balance was distributed among all the subscribers as per rules.

The plaintif further submits that in order to withdraw the prized amount from the plaintif company the prized bidder need to furnish three independent guarantors and therefore, the 1st defendant furnished the guarantors who have executed an agreement of guarantee for the 1st defendant on 28-5-2009 with interest payable at the rate of 18% p.a. towards the collateral security and future liability.

All the defendants are jointly and severally liable to pay the arrears of the amount. It is submitted that the plaintif company was paid a sum of Rs.1,16,150/- after deducting due arrears and incidental charges.

Out of the prized amount of Rs.1,20,000/- and the 1st defendant had to pay 36 future monthly subscriptions at the rate of Rs.5,000/-per month. The 1st defendant paid 25 monthly subscriptions in full and part payment of 26th month subscription was due on 22-5-2011 and committed default continuously for a period of 3 months and if the same is continued the prized bidder will loose the future dividends and they shall become liable to make full payment with interest at the rate of 12% p.a. from the date of default.

The plaintif further submits that inspite of repeated oral demands made by the plaintif, the 1st defendant did not come forward to repay the amount, therefore lawyer's notice on dated 25-9-2011 was issued and served. The postal acknowledgments of defendants 3 and 3 4 and unserved covers of defendants 1 and 2 are produced. Hence the present suit is fled.

3. Defendants 1 and 2 remained absent and were set ex parte as they failed to appear on the publication fled against them. The defendants 3 and 4 were served with the summons but they failed to appear before this court and therefore, were set ex parte

4.On behalf of the plaintif company, one B. Sreekanth, present Manager/Foreman entered the witness box and fled his chief affidavit and got marked Exs.A-1 to A-13. Ex.A-1 is the certifed copy of authorization letter dated 10-10-2007, Ex.A-2 is the certifed copy of incorporation certifcate of plaintif company dated 21-12-2005, Ex.A-3 is the chit agreement dated 12-1-2009, Ex.A-4 is the original pronote

As the defendants failed to appear before this court and contest the suit an adverse inference is raised against the defendants that in order to evade the suit amount they failed to appear before this court. Therefore, it is considered that the defendants are liable to repay the suit amount along with its interest.

In the result, the suit is decreed with costs granting a decree for recovery of Rs. 62,277/- (Rupees Sixty two thousand two hundred and 4 seventy seven only) with interest at the rate of 12% p.a. from the date of the suit to till the date of decree and thereafter future interest at the rate of 6% p.a. on the principal amount of Rs 54,998/- till the date of realization from the defendants 1 to 4 jointly and severally.

Suit for recovery of Rs.62,277/- being the balance of Principal, interest and other charges due on chit agreement dated 12-1-2009 executed by Ist defendant as borrower in favour of plaintif for Rs.2,00,000/- repayable at Rs.5,000/- p.m. in 40 monthly equal instalments. D-2 to D-4 have executed an agreement of guarantee for D-1 in favour of the plaintif company on 28-5- 2009. All the defendants have executed a promissory note jointly for a sum of Rs. 1,80,000/- on 28-5-2009 agreeing to repay the same with interest at 12% p.a. as collateral security towards the future liability. The plaintif company is claiming interest at 12% p.a. D-1 committed default in payment of instalments from 22-5-11 leaving a balance of Rs.1,80,000/-. Cause of action for the suit arose at Adoni on 12-1-2009 the date of execution of chit agreement; on 28-5-09 the date of pronote and agreement of guarantee and on 22-5-11 the date of default in payment of instalment.

This suit is coming on this day before me for fnal disposal in the presence of Sri M. Sreedhar Reddy and Smt. M. Satya Sri, Advocates for the plaintif and the defendants having remained ex parte and this Court doth order and decree :

JUDGMENT

This is a suit fled by the plaintif against the defendants on the strength of chit agreement executed by 1st defendant and for costs of the suit.

2. The brief averments in the plaint are that: The plaintif is a private limited company incorporated under the Indian Companies Act, 1956 for doing chit business. The 1st defendant is a subscriber joined in the chit bearing No. ANT05F with Ticket No.15. He also got executed a chit agreement on the same day in favour of the plaintif company. It is pleaded that the value of the chit is Rs.1,00,000/- consisting of 50 members and each member has to pay a sum of Rs.2,000/- per month for 50 months towards subscription. The said chit commenced on 23-8-2007 after completing the formalities.

The plaintif further pleaded that the 1st defendant participated in the auction conducted by the plaintif company on 27-8-2007 where he became a successful bidder having agreed to forego a sum of

Rs.29,200/-. As per the rules and regulations of the company, 1st defendant furnished D-2 to D-4 as guarantors for withdrawing the prized amount. D-2 to D-4 executed an agreement of guarantee on 15-10-2007 and further all of them jointly executed a promissory note for a sum of Rs.70,000/- payable with interest at the rate of 12% p.a.

as collateral security towards future liability.

The plaintif further pleaded that the 1st defendant was paid a sum of Rs.70,800/- towards the prized amount after deducting due arrears and other incidental charges by way of cheques drawn in

Andhra Bank, Adoni.

The plaintif also pleaded that the 1st defendant paid 16 instalments in full inclusive of dividends and paid one incomplete instalment of Rs.1,408/- and thereafter committed default in payment of the instalments from November 2007. 1st defendant further became liable to make full payment with interest at the rate of 12% p.a. The plaintif company also pleaded that inspite of repeated demands and also issuing of notice dated 25-8-2008, the defendants failed to pay the amount. Hence the present suit is fled.

3. It is seen from the records that defendants 1 to 4 were set ex parte.

4. The plaintif in support of its case fled chief-examination affidavit of its legal assistant as P.W-1 and got marked Exs. A-1 to A-9.

In his chief-examination affidavit he re-iterated the contents of the plaint by exhibiting Ex.A-5 Agreement of guarantee dated 15-10-2007 and Ex.A-4 promissory note dated 15-10-2007 executed by the defendants 1 to 4. As the defendants failed to appear before this court and contest the suit an adverse inference is raised against the defendants that in order to evade the suit amount, they failed to appear before this court. Therefore, it is considered that the defendants are liable to repay the suit amount along with its interest to

P.W-1.

In the result, the suit is decreed with costs granting a decree for recovery of Rs.72,585.29 ps. (Rupees Seventy two thousand fve hundred and eighty fve and twenty nine paise only) with interest at the rate of 12% p.a. from the date of fling of the suit to till the date of decree and thereafter future interest at the rate of 6% p.a., on the principal amount of Rs.66,592/- till the date of its realization from the defendants 1 to 4 jointly and severally.

Defendant No.1 participated in the auction held on 27-8-2007 and succeeded as highest bidder by foregoing amount of Rs. 29,200/- and defendant No.1 paid Rs.70,800/- and deducting the foregoing amount.

D-2 to D-4 stood as guarantors for D-1 and also executed agreement of guarantee on 15-10-2007. All the defendants have also executed a pronote on 15-10-2007 for Rs.70,000/- towards collateral security agreeing to repay the same with interest at 12% p.a. in case of default made by defendant No.1. Defendant No.1 paid in all Rs.66592/- including dividends and committed default in paying the remaining instalments. Inspite of repeated demands made by the plaintif, the defendants failed to pay the suit amount. The plaintif company also issued a legal notice on 25-8-2008 but they failed to repay the amount.

The plaintif further pleaded that the 1st defendant participated in the auction conducted by the plaintif company on 27-11-2006 where he became a successful bidder having agreed to forego a sum of

Rs.22,500/-. As per the rules and regulations of the company, 1st defendant furnished D-2 to D-5 as guarantors for withdrawing the prized amount. D-2 to D-5 executed an agreement of guarantee on 27-4-2007 and further all of them jointly executed a promissory note for a sum of Rs.48,000/- payable with interest at the rate of 12% p.a.

as collateral security towards future liability.

The plaintif further pleaded that it paid a sum of Rs.27,500/- to the 1st defendant towards the prized amount after deducting due arrears and other incidental charges by way of cheques drawn in

Andhra Bank, Adoni.

The plaintif also pleaded that the 1st defendant paid 30 instalments in full inclusive of dividends and part one incomplete instalment and thereafter committed default in payment of the instalments from April 2009. 1st defendant further became liable to make full payment with interest at the rate of 12% p.a. The plaintif company also pleaded that inspite of repeated demands and also issuing of notice dated 27-5-2011, the defendants failed to pay the amount. Hence the present suit is fled.

3. It is seen from the records that defendants 1 to 5 were set ex parte.

4. The plaintif in support of its case fled chief-examination affidavit of its legal assistant as P.W-1 and got marked Exs. A-1 to A-11.

Suit for recovery of Rs.19,933/- being the balance of Principal, and interest due on chit agreement dated 1-11-2006 executed by Ist defendant as main borrower in favour of plaintif for Rs.50,000/- with ticket No. 26 repayable at Rs.1,000/- p.m. in 50 monthly instalments commencing from 28-10-2006 and termination on 28-11-2010

Defendant No.1 participated in the chit and become successful bidder for Rs.22,500/- out of the total amount of Rs.50,000/-. Defendant No.1 paid of Rs.27,500/- and executed a cash voucher. Defendants 2 to 5 executed an agreement of guarantee in favour of the plaintif company.

All the defendants have also executed a pronote to Rs.48,000/- agreeing to repay the same with interest at 12% p.a. as collateral security. Defendant No.1 committed default in payment of 30 instalments in full inclusive of dividends and part one incomplete installments and thereof committed default. The plaintif company also issued a legal notice on 27-5-2011 but they failed to repay the amount.

Plaint presented on 12-8-11 and fled on 13-10-11. Jurisdiction value of Rs.19,933/- and Court fee of Rs.1386/- is paid u/Sec.20 of the A.P.C.F. and Suit Valuation Act.

Cause of action for the suit arose at Adoni on 1-11-2006 the date of execution of chit agreement; on 27-4-2007 the date of pronote and on default of payment of amount and o 27-5-2011 the date of issuance of legal notice.

This suit is coming on this day before me for fnal disposal in the presence of Sri L.K. Sunder Singh, Advocate for the plaintif and the defendants 1 to 5 having remained ex parte and this Court doth order and decree :

1. That the suit be and the same is hereby decreed;

2. that the defendants 1 to 5 jointly and severally do pay to the plaintif a sum of Rs. 19,933/- (Rupees Nineteen thousand nine hundred and thirty three only) with interest at the rate of 12% per annum from the date of suit i.e., 12-8-2011 to till the date of decree and thereafter future interest at the rate of 6% per annum on Rs.19,579/- till the date of realization;

This suit is coming on this day before me for fnal hearing in the presence of Sri T.L.V.Subramanya Sharma, Advocate for the plaintif and the defendant having remained ex parte and after hearing the counsel for the plaintif, this Court delivered the following:

JUDGMENT

This is a suit fled for recovery of money for Rs.10,000/- which is borrowed by the defendant from the plaintif on 14-6-2010 agreeing to repay the same with interest at the rate of 24% p.a. and in evidence thereof has executed a pronote in favour of the plaintif. Inspite of repeated demands and also issuance of legal notice dated 26-2-2013, the defendant failed to repay the suit pronote amount and the accrued interest. Therefore, the suit is fled for recovery along with its interest for a total amount of Rs.1,,90,/-.

2. The defendant was served with the summons but he failed to appear before this court and therefore, was set ex parte.

3. The plaintif entered the witness box and fled his chief afdavit and got marked Exs.A-1 to A-4. Ex.A-1 is the suit pronote dated 14-6-2010,

Ex.A-2 is the ofce copy of legal notice dated 26-2-13, Ex.A-3 is the postal receipt and Ex.A-4 is the served postal acknowledgment. On perusal of the

Ex.A-1 it goes to suggest that the said pronote was executed and the thumb impression on the revenue stamp has been afxed and so also below the revenue stamp in the presence of witnesses and the scribe for Rs.10,000/-.

As the defendant failed to appear before this court and contest the suit an adverse inference is raised against the defendant that in order to evade the suit amount he failed to appear before this court. Therefore, it is considered that the defendant is liable to repay the suit amount along with its interest to

P.W-1.

In the result, the suit is decreed with costs granting a decree for recovery of Rs.1,,90,/- (Rupees Seventeen thousand nine hundred and seven only) with interest at the rate of 12% p.a., from the date of suit to till the date of decree and thereafter future interest at the rate of 6% p.a., on the principal amount of Rs.10,000/- till the date of realization from the defendant.

As the defendant failed to appear before this court and 2 contest the suit an adverse inference is raised against the defendant that in order to evade the suit amount he failed to appear before this court. Therefore, it is considered that the defendant is liable to repay the suit amount along with its interest to P.W-1.

In the result, the suit is decreed with costs granting a decree for recovery of Rs.21,740/- (Rupees Twenty one thousand seven hundred and Forty only) with interest at the rate of 12% p.a., from the date of suit till the date of decree and thereafter future interest at the rate of 6% p.a., on the principal amount of Rs.20,000/- till the date of realization from the defendant.
