This original petition is coming on before me for final hearing in the presence of Sri Vikram Reddy, Advocate for claimants and Assistant Government Pleader for referring officer and having been heard and stood over for consideration, this Court delivered the following:-
O R D E R
01-This reference is made u/sec.18 of Land Acquisition Act to enhance the compensation granted for acquisition of lands of the claimants in the village of Thallapally of Mancherial Mandal, district
Adilabad vide Award No.A/1636/2005, dt.07.03.2008 passed by the respondent/Land Acquisition Officer.
The claimant No.577 filed claim statement. The gist of it is as follows:- 02-The respondent acquired the structures i.e, residential houses along with house site lands and other properties all together six

hundred and twenty three (623) including this claimant situated at
Thallapally village of Mancherial revenue Mandal for the purpose of conversion of SRP-2&2A Mines into open cast at Thallapally village of
Mancherial Mandal. The draft notification u/sec.4(1) of Land
Acquisition Act was lastly published on 25.09.2007. The respondent no.1 fixed the market value of the house and house site lands by passing award No.A/1636/2005, dt.07.03.2008 and paid compensation amounts to all the claimants. His main contention is that the amounts received by him as well as other claimants under protest as the Land
Acquisition Officer fixed lesser market value to the acquired houses and house sites. Therefore, all the claimants requested the respondent no.1 to send the matter to the Court u/sec.18 of the Land Acquisition
Act for adjudication of the proper market value on the date of 4(1)
Notification.
03-The main contention of the claimant no.577 is that the amounts fixed by the respondent no.1 for residential house and house site lands is quite arbitrary and based on incorrect data. The compensation awarded to them with regard to their acquired houses and house site lands and other properties is very less. It passed the award without assessing the value of the said houses properly. The houses in question have been undervalued and the payment of amount by respondent no.1 do not reflect the actual prevailing market value as on the date of Sec.4(1) notification. The actual market value of the acquired house is more than three times than the market value fixed and awarded by the respondent no.1 as on the date of issuance of
Sec.4(1) Notification. The market value of the open house site lands was more than Rs.2,00,000/- (rupees two lakhs only) per gunta. The houses are having all modern facilities like electricity, sanitary, shabad stone flooring and tap connections and they had potentiality of using for commercial and industrial sites as they are located near to
Mancherial city.
04-The claimant no.577 further averred that the respondent no.1 failed to take into consideration the cost of the construction of the houses and the potentiality of the house site lands. The ever increasing value of the abadi land and high wages for labour required for construction of houses prevalent at the time of acquisition of the said houses. He did not take any cognizance of the objections and the claim made by the claimants at the time of Award enquiry and wrongly fixed the market value without considering the cost of the construction

of the hoses and the potentiality of the house site lands. He simply adopted the under valued estimations of the Public Works Department, who had prepared the estimates by relying on old SSR rates without inspecting the houses. The further contention of the claimant is that they were not called for or given any notice before taking measurements. Thereby, the P.W.D. authorities prepared the estimates behind their back.
05-One more plea taken by this claimant is that as a matter of fact, the Estimating authority comes under the Pubic Works Department and it is only interested party, so that they had estimated the houses in a biased manner without inspecting the houses. The estimating authority did ot take the correct measurements, cement construction work, cost of construction, cost of labour and material of the houses used all most in all items. The value of the house site lands at the time of notification was Rs.2,00,000/- (rupees two lakhs only) per gunta as there is a major demand of future potentiality of the open land if they sold as house sites. Even then the respondent no.1 has not fixed the market value for the open land.
06-The village Thallapalli is situated at a distance of 6 kms. from
Mancherial town on the P.W.D. main road. It is an integral part of industrial belt. If this village is not acquired, then there would be large importance for that village and much demand for house site lands.
That village got several rice mills, saw mills, form houses and poultry forms etc., are located in between Mancherial and Thallapally village
before acquisition. As there is vast development in Mancherial town
and it spread upto six kms, as such, there will be very much importance to Thallapally village for its development as it is only within six kms in the municipal limits. Had the village not been submerged under the fllod water, there would be much importance for this village and much demand for house site lands and ready built houses.
07-The claimant further comes up with a contention that they have deprived of their houses and their entire property was converted SRP-2 and 2A mines into open cast mine by way of compulsory acquisition.
They are unable to get proper house in the adjoining villages. Even the cost of the material has increased enormously. It is highly impossible to get similar houses even compensation is enhanced five times. They got great attachment to the premises as they have grown up in the said houses. At present, their families are leading miserable life, so

that they sought to enhance the amount atleast two times to the amounts fixed by the respondent no.1. he even sought the Court to invoke the mandatory provision u/sec.23(1-A) of Land Acquisition (Amendment) Act for the acquired houses and trees of the claimants.
As such, they are entitled for the amount of the amounts on the amounts already paid by it.
08-Finally, the claimant sought the Court to enhance the compensation amount in respect of the acquired houses and trees more than two (2) times to the market value fixed by the Land
Acquisition Officer by setting aside the award passed by the respondent no.1, in the interest of justice.
09-Claimant Nos.1 to 576 and claimant no.578 to 623 adopted the claim statement of claimant no.577.
10-Respondent no.1 adopted the counter of respondent no.2.
11-Respondent no.2 filed counter by contending that the material allegations in the claim statement are not true and correct, except those are specifically admitted by them and put the claimants to strict proof of the same. It is the main contention of the respondents that it is a Government company with share capital ration of 49:61 of Central and State Government. Its main object is excavation of coal to meet national requirement of power sector and other small and major industries. It has submitted a requisition on 14.04.2005 to the Disrict
Collector, Adilabad for acquisition of the houses situated in Thallapally village of Mancherial mandal for the conversion of underground mines
SRP-2 and 2A into open cast mines. Firstly, the respondent n.1 got draft notification published on 03.01.2007 u/sec.4(1) of the Land
Acquisition Act, but not 25.09.2007 as alleged by the petitioners. The draft notification published on 05.10.2007 u/sec.6 of Land Acquisition
Act duly notifying the structures to be acquired. Respondent no.1 officials requested the Executive Engineer, Roads and Buildings to prepare estimates of the houses and accordingly, they followed the measures and estimated and submitted report. In pursuance of those estimations, award was passed on 07.03.2008 in respect of six hundred and twenty four (624) structures not covered in the above said award and it is the subject matter in the present reference u/sec.18 of the L.A.Act. it specifically contended that the contention of the petitioners that the value of the land is inadequate and untenable.

12-Respondent no.2 further comes up with a contention that the details of all the measurements of each acquisition were taken by a qualified engineer of R & B department. Their report is correct as per the standard schedule rates of 2007-2008. Furthermore, those estimates reflecting the market value prevailing as on the date of 4(1)
Notification. Respondent no.2 further averred that in between
Thallapally village and Mancherial, there are other villages namely
Garmilla, Naspur and Seetharampally. Thallapally village is totally an agricultural based village and aloof from Mancherial and house site potentiality for the lands of Thallapally village is very much low and insignificant. So the Executive Engineer, R & B department given proper valuation for the structures by taking the shabad stones, sanitary fittings, electrical fittings, water taps etc, into account. The
S.S.R. rates are prepared b y the Government after taking all the factors into account such as traveling cost of materials used in the construction, wages of labour and other connected overhead expenditure. So the contention of the petitioners that they were neither called nor surveyed without notice at the time of taking measurements is absolutely false and put them to strict proof of the same.
13-Respondent no.2 company has no connection whatsoever over the estimating authority and vice versa and it is a statutory authority to estaiamte the structures. It further wants to impress that estimates were prepared in scientific manner by applying S.S.R. rates as on the date of notification. It specifically took a plea that the petitioners contention that the value of the house lands was Rs.2,00,000/- (rupees two lakhs only) per gunta and put the petitioners to strict proof of the same. Respondent no.2 further took a plea that the alleged amenties such as several rice mills, saw mills, poultry forms have located in between claimants village and Mancherial is not correct and put them to strict proof of the same. That the respondent no.1 paid the market value for the open lands separately in another way. Respondent no.2 paying various monetary benefits and giving developed house sites duly provided with all amenities in compliance of rehabilitation and resettlement package of the Governent of Andhra Pradesh vide
G.O.Ms.No.68, dt.08.04.2005. As the petitioners have to vacate the acquired structures after implementation of Rehabilitation and
Resettlement packages, so there is delegation that their lives became miserable is false and put the to strict proof of the same. Finally, the

respondent no.2 comes up with a contention that the relief sought by the petitioners is not tenable under the law or on facts and sought the
Court to confirm the market value fixed by the respondent no.1 to meet the ends of justice.
14-On behalf of the claimants, PW1 to PW5 are examined and got marked Exs.A1 to A13 and A13(1) to A13(585). On behalf of the respondents 1 and 2, RW1 and RW2 are examined and Exs.R1 to R18 are marked.
15-Heard arguments on both sides.
16-Now the points for considerations are:-
1) Whether the award passed by the Land Acquisition Officer is not reasonable and adequate. If so, whether the claimants are entitled for enhancement of compensation for the acquired structures 200% of the market value as prayed for?
2) To what relief?
POINT No.1:- 19-On behalf of the claimants, claimant no.577, claimant no.264, claimant no.560, claimant no.417 are examined as PW1 to PW4 and
Exs.A1 to A13 are marked. One Civil engineer examined as PW5 on behalf of claimants and through him, Exs.A13(1) to Ex.A13 (585) are marked with regard to the respective estimates of structures.
Exs.A13(1) to Exs.A13(585) are inadvertently got marked by my learned predecessor instead of marking as Exs.A14(1) to Exs.A14(585) so that to avoid ambiguity for the sake of conveninence this coure considered those documents as Ex.A-14(1) to Ex.A-14(585).
20-The learned counsel for the petitioner mainly argued by referring the available oral and documentary evidence that all the claimants were compelled to be settlers without having permanent abode though they were having permanent abode prior to the acquisition. He further tried to enlighten the Court that no notice served upon them while fixing the market value though their houses are having many more amenities and their constructions are with all civil amenities.
Furthermore, the village of the claimants is just six (6) kms. from
Mancherial industrially grown up town, but due to the forcible acquisition of their structures, they are deprived of their permanent abode, as such, the claimants are entitled for enhancement of market value to 200%. The learned counsel further argued that in similar set

of circumstances under Ex.A1, A3, A7 and A11 Judgments in Original
Petition 69/2009, dt.29.04.2013 and also in O.P.No.99/2009, dt.11.03.2005 and certified copy of Judgment in O.P.No.434/1992, dt.2.9.2014 and O.P.No.55/2009, dt.8.4.2013, the learned Judge enhanced the market value by doubling it. Aggrieved those decrees and Judgments, the Land Acquisition Officer preferred Ex.A5 appeal
before the Hon’ble High Court and the Hon’ble High Court confirmed
the orders passed in the above said Judgments and Decrees. He further wants to impress upon the Court that one independent Engineer visited the acquired land and estimated the cost of the structure and submitted Ex.P14 estimates and got marked Exs.P14(1) to P14(585).
The contention of the respondents and their official witnesses is not true and correct and finally sought the Court to enhance the market value to meet the ends of justice.
21-The learned Assistant Government Pleader sailed with the submissions put forth by the learned respondent No.2’s counsel. He wants to impress upon the Court that the estimated value between 2007-08, Standard Schedule Rates (S.S.R) existing as on the date of notification are considered and prepared a book of estimates in the presence of claimants, even then, the claimants sought for 200% enhancement, which cannot be considered. Furthermore, the evidence of PW1 to PW5 is a stereo type statements. As such their evidences cannot be considered as it is not in accordance with S.S.R. rules. So, the orders and decreetal orders relied by the claimants are pertaining to the Karimnagar district and compromise matters between the claimants as such those documents cannot be considered at all for enhancement of market value u/sec.23 (A) of Land Acquisition Act.
Ex.B3 and B4 documents reveal these aspects clearly. PW5 is a private Engineer. No summons given to him as third party and finally tried to impress upon the court that the compensation paid by respondent no.1 is sufficient and it need not be enhanced and sought the Court to confirm the award by dismissing the exorbitant claim of the claimants in the interest of justice.
22-Claimant No.577, Claimant No.264, Claimant No.560 and
Claimant No.417 are examined as PW1 to PW4. Through PW1, certified copy of Judgment in O.P.No.69/2009, dt.29.04.2013 is marked as
Ex.A1. Certified copy of Decree in the above said O.P. is marked as
Ex.A2. Similarly, certified copy of Judgment and decree in
O.P.No.99/2009, dt.11.03.2005 are marked as Exs.A3 and A4. The

matter was carried upto the Hon’ble High Court vide
L.A.A.s.No.1541/2005, dt.1.3.2007 and its order and decree marked as
Exs.A5 and A6. Similarly, Ex.A7 is the certified copy of order in
O.P.No.494/1992 and Ex.A8 is certified copy of decree in the above said O.P. Aggrieved by the said order and decree, the claimants preferred civil appeal No.167/1995, dt.9.3.2004 on the file of Hon’ble
High Court of A.P., Hyderabad in respect of O.P.No.494/1992, dt.9.3.2004 (with reference to Exs.A7&A8). Similarly, one more certified copy of order in L.A.A.P. 167/1995, dt.9.3.2004 in respect of
Judgment and decree in O.S.No.A7 and A8 are marked. So also,
Exs.A11 and A12 are the certified copies of Order and decree in
O.P.No.55/2009, dt.8.04.2013. Certified copy of L.A. Award, dt.9.11.2012 held by District Legal Services Authority, Karimnagar.
23-One independent witness said to be the Engineer (expert) examined as PW5. He visited acquired land in respect of the structures and prepared estimates of each claimant independently. Those estimates are marked as Exs.A14(1) to A14(585).
24-This Court has gone through the evidence of PW1 to PW4. In their chief examination, it is nothing but reiteration of claim statement in the major portion and in the remaining portion is in respect of
Exs.A1 to A13 documents. All these witnesses want to impress upon the Court that the market value fixed by the respondent no.1 is not in accordance with the procedure and they were deprived of the houses, which are attached with much more sentiments and a kind of dignity which they are having as permanent abode. After the land acquisition proceedings under compulsory, all together six hundred (600) and odd claimants were compelled to evacuate the village by vacating their permanent abode and also sentimental attachments affixed to those structures. It is pertinent to note that respondent no.1 represented through Assistant Government Pleader not cross examined all the witnesses, whereas respondent no.2 counsel only cross examined them by reintroducing the counter averments to enlighten the Court that the market value fixed by the respondent no.1 is more than sufficient and respondent no.2 officials are taking steps to provide house sites to all the claimants under Rehabilitation and Resettlement guidelines. Thereby, it is clear that respondents No.1 & 2 did not choose to provide house sites to the claimants from September, 2007 till date. A Specific suggestion put to all these four witnesses that the documents relied by them i.e., Exs.A1 to 13 need not be considered to

enhance the market value as sought by them, however, all these four witnesses emphatically in similarly deposed that the documents relied by them in the similar situation and the enhancement of the market value by the concerned competent court and it is confirmed by the
Hon’ble High Court on merits or even on Lok Adalath by passing award.
Evidently, Judgments and decrees which are marked as Exs.A1 to A4,
Exs.A7, A8, A11 and A12 and the corresponding their decretal orders on the file of Hon’ble High Court of A.P. under Exs.A5, A9, A10 and also the Lok Adalath award in Ex.A13. No doubt, the arguments put forth by the learned counsel for respondent no.2 that the acquisition took place in Karimnagar district need not be considered while deciding this petition, but at the same time, this Court cannot forget the factum that all those orders are referred to the appellate Court i.e., Hon’ble High
Court of A.P., where the said orders were confirmed including the Lok
Adalath award. So, the submissions of the learned counsel for respondent no.2 that the award passed in the above O.Ps. relied by the claimants not going to help the claimants in the present case, cannot be considered in toto and this Court compelled to see the second limb of the litigation before the appellate Court i.e., Hon’ble High court of
Judicature at Hyderabad for the state of A.P and Telangana
Furthermore, on close perusal of those decrees, orders and judgments, they are pertaining to the acquisition of the lands and structures under similar situation on compulsory acquisition for public utility at large and the order and decrees passed by the courts are confirmed by the
Hon’ble High Court of A.P at Hyderabad. Therefore, this Court
compelled to arrive to the conclusion that the documents, which are marked as Exs.A5, A6, A9, A10 and A13 are very much supporting the contentions of the claimants. As this Court considered the surrounding totality of facts and circumstances and the parameters taken by the
Land Acquisition officer are not at all considered even by the appellate
Court and enhanced the market value as doubled by confirming the lower Court orders.
25-One more aspect is with regard to the evidence of the expert, who is examined as PW5. He mainly deposed that he completed
B.Tech in the year 1994 and working as private Engineer since 15 years. He used to give reports to the claimants and he categorically narrated what procedure he followed while preparing the estimates.
He visited Thallapally village and estimated 585 houses in total, but he did not give notice to the respondents 1 and 2 before going to
Thallapally villge for estimation of the structures. He prepared

estimations in the presence of claimants and handed over the same to them. He further admitted that he has prepare calculating even for others lands, trees, etc., He even examined Mason with regard to the nature of structures. The learned Assistant Government Pleader tried to shatter the evidence of this witness that too to help the claimants, he created Exs.P14(1) to P14(585) and those estimates are not correct, for which, he clearly reaffirmed his stand, by denying such suggestion.
26-The Revenue Divisional Office examined as RW1. In her chief examination, she simply reiterated the counter averments of respondent no.2. Exs.B1 to B8 are the signatures of PW1 to PW4 in the log book in different pages. By relying those documents, the endeavour of the respondent No.1 is that in the presence of claimants i.e., PW1 to PW4, the estimates were prepared by the Government officials. Whereas these four (4) witnesses deposed that they are not present and no notice given to them when such estimations are prepared. Evidently, PW1 to PW4 are not so well versed like respondents 1 and 2 moreover they are rustic persons. Perhaps they may not have any knowledge for what reason their signatures were obtained. One more aspect, merely confronting their signatures without eliciting about the purpose of obtaining their signatures is not going to help the respondents in any manner. Either the learned
Asst.Goverment Pleader or respondent No.2 counsel not even confronted Ex.B-1 to Ex.B-8 documents to those witness PW-1 to PW-4 at the time of cross examination. No probable reasons offered on this aspect to accept their version as true, correct as convincing to impress upon this court. For that reason that plea cannot be considered at all.
Ex.B9 reference letterA/1636/2005, dt.7.3.2008. Ex.B1 is the Form 16
Schedule 19(2) of Land Acquisition Act. Ex.B11 is the award copy in
Form No.8. Ex.B12 is the apportion statement, dt.7.3.2008 Ex.B13 is the schedule u/sec.19(2) of reference. Ex.B14 is the form of reference.
Ex.B15 is valuation of acquired structures and Ex.B16 is the attested copy of structures certificate.
27-The learned counsel for the claimants meticulously cross examined RW1 and got it elicited that when Ex.B11 award was passed, at that time, the Land Acquisition Officer/Revenue Divisional Officer was A.Prasad Rao worked in the year 2008. The statement of the award enquiry of the claimants was recoded by the then Land acquisition Officer, but those statements are not filed before the Court.
For which the witness wants to clarify that those original statements

are put forth into the court, but those statements are not in the Court.
She further admitted that the estimations of the structures of the claimants were not served upon the claimants personally. This itself emphatically goes to show that the then land acquisition officer did not choose to follow the procedural foramlity as contemplated in the act.
No proper explanation given on this aspect. RW1 clearly and specifically admitted that Thallapally village is situated at a distance of six (6) kms. from Mancherial town, but she wants to support the version of respondent no.2 that the rental and value of the structures in that village are low. Finally, RW1 admitted that land covered by structures are not covered in the notification, as such, they have not paid any amount to the claimants. So, by considering the above said admissions made by RW1, she clearly supported the version of her predecessor in office i.e., respondent no.1/Land acquisition officer, but she has no knowledge about the actual and factual aspects that were transcribed at the relevant point of time. The respondent did not choose to examine the said A.Prasada Rao, Land Acquisition Officer and no tenable reasons offered as this aspect. Furthermore undoubtedly he is the concerned competent person to speak on all those aspects about acquisition proceedings and other allied aspects, at that relevant point of time.
28-The Senior Estate officer of respondent no.2 examined as RW2 by reintroducing the counter averments to impress upon the Court that market value fixed by the respondent no.1 for acquisition of the structures of the claimants are true and correct and they are not entitled to claim any kind of enhancement in the market value. The learned petitioners counsel cross examined RW2 and got it elicited that his qualification is B.Com., LL.B., and he is not a qualified person in engineering side. When the requisition was given by respondent no.2 officials to the District collector, he was not working in that area.
Even before the acquisition land survey was conducted on the proposed acquired property. He clearly stated that he cannot say, who conducted the said survey. He clearly admitted that till the notification was issued, no official communication sent to the land losers i.e., claimants. First time this witness visited Thallapally village in the year 2013. Evidently, by the time of RW-2’s visit entire proceedings of acquisition completed way back in the year, 2007 itself. Then there is no significance for his visit as the entire proceedings already completed by October,2007, even as admitted by RW1. He admitted that social economic survey was conducted in the year 2007-08. He

clearly admitted that no documentary proof is submitted to substantiate his statement. He further clearly admitted that only award was passed in respect of the structures, but for the land covered by structures, no compensation paid for land till his date of giving his evidence before this court i.,e 22.12.2015 and those award proceedings are still under process. He clearly admitted that he does not know as per the basic value register maintained by Sub-Registrar concerned, considered for payment of compensation to the land covered by structures/houses. This witness admitted that the Roads and Building officials not intimated the basis of the preparation and estimations to respondent No.2 officials. He admitted that all the claimants in this O.P. submitted representations to the respondent no.2 for land acquisition settlement and the same was forwarded to the corporation office for examination and approval. He expressed his ignorance whether the respondent No.1 officals are having separate
S.S.R. rates and he is not having any knowledge whether S.S.R rates reflects the prevailing market value or not.
29- RW-2 further admitted that the market rates of construction material used to raise from day to day. In the fag end, through RW2,
Ex.R7 valuation of acquired estimates prepared by Roads and Buildings engineers handed over to his department and Ex.R8 is the attested copy of structures certificate of Thallapally village issued by Secretary,
Grampanchayath,Thallapally. By referring these two documents, he wants to impress upon the court that Ex.R8 discloses the details of the persons that their name, age and other details and also the age of the structures. Ex.R7 relied to show that it was handed over by the team of engineers to respondent no.1. After marking these two documents, the learned Assistant Government Pleader cross examined this witness and got it elicited that the copy of Ex.R7 given to RW1 and another copy handed over to respondent no.2. The learned counsel for the petitioners meticulously cross examined him on these two documents and got it elicited that he was not at all present when the team of engineers acquired the land and prepared the estimations, as such, he cannot say whether beneficiaries were present and informed about the estimations made by team of engineers. So from the above admission it is clear that though he relied upon two documents but he could not establish these documents as he is no way concerned about those documents so also he has no knowledge about them so also he is not competent to speak about them. Thereby these document are not proved and established to substantiate the contentions of respondents.

30-Now let us see the documents relied by the claimants how far they could substantiate their contentions for enhancement of compensation as sought by them. Ex.A1 is certified copy of Judgment in O.P.No.69/2009, dt.29.04.2013 on the file of Senior Civil Judge’s
Court, Karimnagr. Ex.A2 is certified copy of decree in the above said
O.P. These two documents are relied to impress upon the Court that when the Land Acquisition Officer/Special Deputy Collector, Land
Acquisition Unit, S.R.S.P., Lower Maner Dam, Karimnagar acquired the entire hosuses/structures including the residential houses and cattle sheds for submergence of Lower Maner Dam, reservoir. The aggrieved claimants approached the Court. After thorough enquiry, the Court enhanced the compensation award as double on the structures and residential houses. Claimants further relied on one more similar instance by relying on Ex.A3 certified copy of Judgment in
O.P.No.99/2004, dt.11.03.2005 on the file of Senior Civil Judge,
Karimnagar and Ex.A4 is the certified copy of decree in the above said
O.P. Even in Ex.A3, the Land Acquisition Officer acquired the land with regard to the structures and residential houses. After thorough and full-fledged enquiry, the learned Judge enhanced the compensation award as doubled for the loss of structures and wells. Ex.A5 is certified copy of order of L.A.A.S.1541/2005 of the Hon’ble High Court of A.P.,
Hyderabad against the order and Decree in O.P.No.99/2004, dt.1.3.2007 (Exs.A3&A4). Ex.A6 is the certified copy of decree in the above said appeal, wherein their Lordships dismissed the appeal by confirming the order under Exs.A3 and A4. The claimants further relied on Ex.A7 certified copy of Judgment in O.P.No.494/1992, dt.2.9.2004 on the file of Hon’ble II Additional District and Sessions
Judge, Karimnagar. Ex.A8 is the certified copy of decree in the above
said O.P. On its perusal, it was also u/sec.18 reference, where the
Land Acquisition Officer acquired agricultural lands, houses, wells and trees. After full fledged enquiry, the Hon’ble Judge enhanced the market value for the acquired houses, wells and trees by doubling the compensation fixed by the Land Acquisition Officer. Aggrieved by the above said order and decree in Exs.A7 and A8, the Land Acquisition
Officer preferred appeal to the Hon’ble High Court, Hyderabad vide
Appeal No.167/1995, dt.9.3.2004, under Exs.A9 and A10, wherein their
Lordships after hearing both sides, dismissed the appeal by confirming the order and decree under Exs.A7 and A8. The claimants further relied on Ex.A11 certified copy of Judgment in O.P.No.55/2009, dt.8.4.2013 on the file of Senior Civil Judge, Karimnagar and Ex.A12 is

the certified copy of decree in the said O.P. In the above said O.P., the acquisition was made by the Land Acquisition Officer with regard to the entire houses and structures for the submergence under the Lower
Maner Dam reservoir, wherein the learned Senior Civil Judge,
Karimnagar after thorough enquiry, awarded the enhanced compensation in double. Ex.A-11 is the copy of award passed by in
O.P.No.38 of 2012 passed by the lok adalath by District Legal services
Authority, Karimnagar held at Godavarikani. Even on its perusal the
Land Acquisition Officer agreed and accepted to enhance the market value by doubling the compensation on mutual agreement. As such there was no need or occasion to take the matter to the higher authorities.
31-By considering Exs.A1 to A13 documents, the learned counsel for the claimants tried to impress upon the Court that as and when the
Land Acquisition Officer acquire the structures in connection with the submergence of land either for Lower Maner Dam or in the present case on hand, the minimum enhancement is double the market value as the claimants totally deprived of their identity and they were compelled to migrate to some other places on compulsive circumstances. By considering all those aspects, the Court is required to enhance the amounts even more than the double and the claimants sought the Court to enhance the market value of the compensation two times for their rehabilitation. To further strengthen the contentions of the petitioners, PW5 independent witness examined.
He filed a detailed estimation with regard to each and every structure in very detailed manner and those estimations of each petitioner are marked through PW5 as Exs.14(1) to 14(585). A mere formal suggestion put to PW5 that no intimation was given to Land Acquisition
Officer when he executed the work with regard to estimation of the available acquired houses. No doubt, there is a specific averment in the claim statement and also in the evidence of PW1 to PW4 that they have supplied the copies of estimations to the Land Acquisition Officer during his visit to their village, even then, there is no such mention in
Ex.B8 award and they have not even considered the same. When the claimants come up with such specific allegation about the intimation of estimation copies for the acquired structures to the Land Acquisition
Officer, then it is the bounden duty of the Land Acquisition Officer to even refer the same in the award and he is at liberty to discard such estimations by giving valid and tenable reasons. But when there is no such reference in Ex.B8, then undoubtedly, it goes to show that the

Land Acquisition Officer not even considered the representation made by the claimants when he visited the village for award enquiry.
32-It is not out of place to mention that evidently, one A.Prasad Rao was the Land Acquisition Officer when those acquisition proceedings took place, and he only passed award. There is no specific mention about the names of engineers or other technical staff, who have assisted the above said Land Acquisition Officer during the award enquiry period and also during the period when they have estimated the cost of each acquired structures or the houses of the claimants at that relevant point of time. But surprisingly, the Land Acquisition
Officer brought a new officer, who has no knowledge about the entire acquisition proceedings and also with regard to the Statements of claimants taken at the time of acquisition in the present case on hand, as it could be seen from her own evidence. When he was meticulously cross examined about her knowledge with regard to the acquisition proceedings and also the other steps taken by her predecessor in office, for which, she could not give any tenable and convincing reasons. Thereby, this Court is of considered view that the respondent ought to have taken much more precautions to shatter the contentions of claimants on one hand and on the other hand to substantiate their contentions that adequate compensation paid to the structures by the land acquisition Officer at the time of acquisition. But they did not choose to do so and no convincing reasons offered on these aspects, though a duty cast upon them. It also goes to show that the contentions of the petitioners has to consider on this aspect.
33-At one point of time, the learned Assistant Government Pleader vehemently argued that the structures value used to depreciate due to the passage of time, for that reason also, the compensation amount fixed by the Land Acquisition Officer is quite sufficient and reasonable and it need not be enhanced as sought by the claimants. The learned counsel for the claimants tried to impress upon the Court that as the claimants had taken all necessary precautions in maintaining their houses from time to time and other structures by attending annual repairs. They have constructed those houses with teak wood, shabed stones and all permanent amenities also provided there for those structures. The annual maintenance to the houses will not depreciate the value as argued by the learned Assistant Government pleader and sough the Court not to consider that plea.

34-After hearing both counsel and also after considering the totality of facts and circumstances, evidently, the construction cost and labour cost and the material for the construction used to enhance abnormally from day by day to zenith level. One more point is that if the claimants are not selling their houses then to consider the plea of depreciation does not arise at all and the Land Acquisition Officer acquired those houses under compulsory acquisition of course for public purpose without consent of the claimants. It means to say the question of depreciation does not arise at all and the raise in the construction cost, material cost and other ancillary aspects can be taken into consideration and one more crucial point is that the claimants are compelled to migrate as the Land Acquisition Officer acquired those structures under compulsion for public purpose. For that reason, the plea of the learned Assistant Government Pleader cannot be considered.
35-After considering the oral and documentary evidence put forth by both the parties, it is an undisputed fact that the acquired structures are within the a distance of six (6) kilometers from
Mancherial town even as admitted by RW1 in her cross examination.
This Court can take judicial notice of the topography of Mancherial and even RW1 not denied about the facilities that were available to the claimants in their village and also the factum that Mancherial is grade one municipality having Singareni Collieries company Ltd., and other developed industries, such as Mancherial cement company. On these aspects, the version of PW1 to PW4 in their evidence is passively admitted by RW1 in his cross examination. Thereby the facilities enjoyed by the claimants in their village as Mancherial is within its vicinity. Even with regard to the evidence of PW5 engineer and
Exs.A14(1) to A14(585) relied by them are formally denied, but not with any authenticity. Therefore, the contentions of the claimants on these aspects also holds good and this court inclined to consider the case.
36-It is pertinent to note that the new Land Acquisition Act emerged in the year 2013. The present petition is in the interrugnum period of old enactment and the new enactment, so for the sake of better understanding, this Court compelled to have a look towards the new enactment. Evidently, it is for the betterment of the public at large, for that reason only, they have incorporated Rehabilitation and
Resettlement aspect brought into existence. The enactment provides

to compensate the rural households both lands owners and livelihood of land looser and the act goes beyond compensation even by considering the aspect of rehabilitation and resettlement aspect. It mandates guaranteed series of entitlement to real householders effected. At one point of time in the benefits and effects of the new enactment, there was beneficial provisions incorporated. If the effect of facilitates on the real demand 100% up compensation from the land aquirer mandate. The land acquirer to offset the loss of a village per capita 2010 income per year is to be assessed. There was even an observation that the effect of Land Acquisition Rehabilitation and
Reconstruction bill 2011 in certain cases will apply retrospectively to pending and incomplete projects. The land acquisition for all linear projects such as high ways and reservoir etc., In the present case on hand, the respondent acquired the entire village for submergence purpose for Yellampally project.
37-The learned counsel for claimants relied on a citation reported in
AIR 2011 (SC) 2458 in Trishala Jain and Another Vs. State of
Uttaranchal and another. By relying this citation, the learned counsel for claimants wants to impress upon the Court that when there is no specific guidelines for enhancement of market value, then the guess work can be done by the Court. On close perusal of the above said citation, their lordships exhaustively dealt the concept of land acquisition proceedings and also determination of market value and further observed that “when there are no clinching material for enhancement of market value, then the guess work estimations can be done”. Evidently, in the present petition on hand, the claimants not filed any sale deeds. However, they filed the certified copies of the orders and decretal orders of lower Courts as well as the Hon’ble High
Court at Hyderabad by confirming the orders passed by the lower
Courts. So the question of guess work cannot be considered as the facts and circumstances emerged in the citation are entirely different and separate with that of the facts and circumstances of the present petition on hand. Therefore, the claimants cannot be permitted to derive any benefit on the plea of guess work. The above said citation is not going to help the claimants in any manner.
38-The learned counsel for claimants also relied on a citation reported in AIR 1988 (SC) 943 (1) in Administrator Genl.of West
Bengal Vs.Collector, Varanasi to impress upon the Court with regard to the determination of market value and the procedure to be

followed and other relevant material aspects. On close perusal of the said citation, the value of the building was estimated by the Land
Acquisition Officer as Rs.57,000/-, (rupees fifty seven thousand only) whereas the enhanced market value fixed by the Court is at
Rs.2,00,000/- (rupees two lakhs only) as per the facts averred in the above said citation. On perusal of the above said citation, at one point of time, their Lordships of Apex court observed that “when the Court proceeded to value the property on the land and building method, the building value is estimated on the basis of the prime cost or replacement cost less depreciation. The rate of depreciation is generally arrived at by dividing the cost of construction by number of years of utility of the building. The factors that prolong the life and utility of the building, such as good maintenance, necessarily influence and bring down the rate of deprecation.” Their Lordships further observed that “report of the executive engineer on the record in preparation, value of the construction considered, it appears from the said report that the value was determined on the basis of the rates prevailing in the year 1960, whereas the preliminary notification in the instant case issued in the year 1959 and finally observed that the market value of the building as on the date of preliminary notification accordingly fixed at
Rs.2,00,000/- (rupees two lakhs only). By relying this citation, the leaned counsel argued that the market value fixed by the Land
Acquisition Officer is very megre and the claimants are entitled for two times enhancement to the market value and urged that in the above said citation of the Hon’ble Apex Court awarded more than three times market value is to be considered in favour of claimants.
39-The learned counsel for claimants further relied on a citation reported in 2011(1) ALD 124 (SC) in Prabhakar Raghunath Patil and others Vs. State of Maharashtra to impress upon the Court to consider the expert opinion with regard to the nature and structure of the acquired land. In the present case on hand, PW5 is the expert and he relied on Exs.A14(1) to P14(585). No doubt, though he tried to support the version of claimants, but it is borne out from the record that when the expert estimated the calculation of the acquired structures, he has not issued notice to the Land Acquisition Officer. So all the estimations done by him, are behind the back of referring officer. Of course, it is brought to the notice of the Court that a copy of the expert estimations were supplied to the Land Acquisition Officer during his visit in the village, even then, no reference made about it in
Ex.B8 award and no steps taken to cross check with regard to the said estimations made by expert. In the above said citation, their Lordships observed that “In sofar as the opinion of the expert is concerned, he has not given

any specific evidence as to what was the age of the structure when it was notified for acquisition. Without making an enquiry with regard to the age of the structure which was acquired, it would be difficult to assess the valuation and, therefore, the expert was not justified in not making an assessment with regard to the age of the structure. He has faulted on the basic principle of assessment of valuation of a construction. Besides, the cost of construction of the ground floor is always on the higher side while the cost of construction of first floor and second floor is on the lower side. The expert examined has also ignored the said fact which goes to the root of the valuation and for that also the evidence of the expert, in our considered opinion, is not reliable”. So by considering the dicta in consonance with the present facts and circumstances, at this juncture, this Court unable to give much prominence to the expert opinion to consider for enhancement of the structures three times as per his report. As the expert in all his calculations specifically shown that the cost estimated by the Land Acquisition Officer and the calculation made by him is three times more than the market value. So this Court unable to consider the opinion of the expert as claimed by him. The claimants even sought for compensation for the land apportionment to the structure acquired by the Land Acquisition Officer. The admission made by the claimants in the cross examination that alternative site allotted to them under Rehabilitation and Resettlement, for that reason, their plea cannot be considered at all.
40-The learned counsel for the claimants also relied on the following citations to impress upon the Court with regard to the claim of 12% market value. As the Land Acquisition Officer not paid to the claimants though they are entitled for it as per the provisions under the Land
Acquisition Act.
41-2013(2)ALD AP 591 in Dommati Kishan and others Vs.
State of Andhra Pradesh, His Lordship held that “It is imperative for him to follow the statutory provision in stricto-sensu. He cannot ignore the specific statutory provisions and make the award in derogation thereof and drive the aggrieved parties to seek reference under section 18 of the Act”. In another citation reported in 2004(1) ALD 1 (D.B) in K.Peda Venkataiah Vs.
Government of Andhra Pradesh, His Lordship set aside the award on the ground that the market value was not assessed as on the date of notification issued under section 4(1) of the Act, as mandated under section 23(1) thereof. His Lordship further observed “when an award is made contrary to the mandatory provisions of the Act, the same needs to be

declared as a nullity. The aggrieved party cannot be non suited on the ground of availability of alternative remedy. Far from rectifying his defect, respondent no.3 has even gone to the extent of threatening the claimants with deposit of the compensation amounts in the civil Courts if the latter to not receive the same. This conduct on the part of respondent No.3 is abhorrent”. His Lordship further observed that “In the light of the above discussion, respondent no.3 is directed to pass a supplementary award by awarding
additional market value @ 12% as envisaged under the act within a period of one
month from the date of receipt of this order. For passing the award in utter disregard of the mandatory statutory provision, respondent o.3 is saddled with costs of Rs.10,000/- payable to the Secretary, A.P. High Court Legal Services Committee, Hyderabad”.
42.The Learned counsel for the claimants relied upon the decision of
The Hon’ble Supreme court in the case of Palsingh Vs. Union
Territory of Chandigarh reported in AIR 1993 SC 225 in which the Hon’ble Supreme court held that “a judgment of a court in a Land acquisition case determining the market value of land in the vicinity of the acquired lands, even though not value of the acquired land could be deduced or inferred”. So by denying the strength from this citation this court compelled to consider the analogy of the learned counsel for the petitioners/claimants upon Ex.A-1 to A-13 documents as those factual matrix are similar to the present facts and circumstances. The learned counsel for the claimants further relied on a citation reported in the case of LAO and RDO, Chitoor Vs. P.Narsimhulu Naidu and this report in 1998(1) ALT 88(DB) in which the Hon’ble court held that “adding minimum excavation charges of 10% per year to the existing marked value is valid under law”. Evidently in the present case on hand 4(1) notification was issued on 07.03.2008. Award was passed on 07-03-2008. Possession was taken on 24-01-2010. Thereby it is crystal clear that about nine (9) years back, the Land Acquisition officer started taking steps of acquisition. So by considering the above judgment the Land Acquisition officer took nine years time to complete the proceedings. Then considering the said analogy for each year adding minimum explanation charges of 10% per year to the existing market value altogether comes to 90% for nine years. So by over all consideration of factual aspects coupled with the dicta this court left with no option except to consider that 90% enchancement is permissible. As the claimants sought 200% enhancement, so it can be considered. However, after re-appraisal and scanning of entire available evidence. This court feel that 100% enchancement will serve the purpose to meet the ends of justice.

43-After considering the totality of the facts and circumstances in consonance with the oral and documentary evidence put forth by both sides, it is abundantly clear that the acquisition proceedings under 4(1)
Notification took place on 03.10.12007. RW1 tried to impress upon the
Court by taking the census of the year 2001 to give a picture with regard to Thallapally village. . This Court cannot forget that the present petition is disposing in the year 2016. The claim petitioners in their oral and documentary evidence, sought the Court for enhancement of the market value two (2) times to the market value awarded by the Land Acquisition Officer, whereas the documentary evidence shows that the Hon’ble High Court enhanced the market value by doubling its value. So the expert opinion i.e, PW5 evidence tried to support the version of claim petitioners to enhance the market value three (3) times. It is further pertinent to note that during interregnum period and also very recently, much more debate held with regard Land Acquisition Act, 2013 and the bill also passed to that effect in the year 2011. Evidently, it is a beneficial legislation. When its aims and objectives as well as its purpose and scope gone through, then that factum is abundantly clear. By considering those aspects and also by considering that the claim petitioners main avocation is agriculture, agriculture coolies and Singareni Employees and they have lost their permanent abode and compelled to migrate from that place, to another village with all their framily members.
44-Then the next question to be considered is with regard to fixing of the market value for the acquired structures of the claim petitioners.
Evidently Sec.23 of the Land Acquisition Act and also various to
Judgemade Laws including the above referred citations emphatically
dealt and inclined favouring the claim petitioners as they were displaced under compulsive circumstances. The market value would be multiplied by factor of at least one to two times from the value for the land acquired under rural areas and at least one time the market value for the land acquired in urban areas. The Act stipulates that the minimum compensation to be the multiple to the total to the above ascertained market value, value to assets attached to the property.
Evidently, though the acquired structures are of entire Thallapally village and it is about six (6) kms. from Mancherial and its it is further pertinent to note that the Mancherial radius expended up to ten (10) kms. even as per the admission of RW1 as well as from the evidence of
PW1 to PW4 due to urbanization and industrialization. By considering all these aspects coupled with cumulative factors, this Court is of

considered view that enhancing the market value of the acquired structures at least at one time of the market value is just and reasonable as it serves the purpose. As such, the contentions of the claim petitioners to enhance the market value two (2) times cannot be considered.
45-The next aspect is with regard to additional market value. The learned counsel for the claim petitioners vehemently argued that at the time of acquisition, the Land Acquisition Officer not considered about additional market value of 12%, as such, the claim petitioners are entitled for the statutory benefits by amending 12% additional market value of the land. Even after considering the Sec.23(IA) of the
Act, it is abundantly clear that the Court shall in every case award, the amount calculated @ 12% per annum on such market value for the period of commencing on and from the date of publication of the notification under 4(1) in respect of such land to the date of award or the date of taking possession of the land whichever is earlier.
46-This Court gone through the citations reported in 1990 AIR SC
981 in between Union of India and others Vs. Filip Tiago De
Gama of Vedam. In the said citation, the Hon’ble Supreme Court exhaustively dealt the application of Sec.30(2) and 23(IA) of the
Amended Land Acquisition Act,1984 and their Lordships observed that “Entitlement of additional amount provided under Section 23(1A) depends upon pendency of acquisition proceedings as on 30 April 1982 or commencement of acquisition proceedings after that date. Section 30 sub-section (1)(a) provides that
additional amount provided under Section 23(IA) shall be applicable to acquisition
proceedings pending before the Collector as on 30 April 1982 in which he has not made the award before that date. If the Collector has made the award before that date then, that additional amount cannot be awarded. Section 30 sub-section (1)(b) provides that section 23(l-A) shall be applicable to every acquisition proceedings commenced after 30 April 1982 irrespective of the fact whether the Collector has made an award or not before 24 September 1984. The final point to note is that Section 30 sub-section (1) does not refer to Court award and the Court award is used only in section 30 sub-section (2). In the case before us, on 26 October 1967, the notification under section 4 was issued. On 5 March 1969 the Collector made the award. The result is that on 30 April 1982 there was no proceedings pending before the Collector. Therefore, section 30 sub-section (1)(a) is not attracted to the case. Since the proceedings for acquisition commenced before 30 April 1982, section 30 sub-section (1)(b) is also not applicable to the case. Here, the case is really gone by both ways. It cannot be saved from Scylla or Charybdis. The claimant is, therefore, not entitled to additional amount provided under Section 23( I-A)”.

47-In the light of the observations of the Hon’ble Supreme Court in the above said citation, this Court is of considered view with the facts of the petition on hand. Notification for the acquisition was issued and possession was taken prior to commencement of the land acquisition
Act, the award was passed by the Land Acquisition Officer in the case on hand subsequent to the commencement of the said Act. Even the
Hon’ble Apex Court clearly observed that the notification was issued
and possession was taken prior to commencement of the Land acquisition act when the proceedings are pending before the Land
Acquisition Officer and the award was passed subsequent to the commencement of the Act. As such, the claimants are entitled for fixing of additional market value, enhanced rate of interest and interest and solatium. Even on perusal of Ex.B8 award, it is very much evident on this aspect. Therefore, the claimants are entitled for
additional market value u/sec.23(IA) of the Amended Land Acquisition
Act.
48-The learned counsel for claimants even tried to impress upon the
Court with regard to the subsequent changes in the Law, more particularly, with regard to the Land Acquisition Act and Rehabilitation and Resettlement Bill 2011, that the claimants were forced to displace from their permanent abode to some other places even by terming themselves as settlers without having any specific identity, which they were having earlier when they were residing in their village with their specific identity. When this Court considered the submissions, undoubtedly, it is abundantly clear that in view of the acquisition, the claimants herein and other villagers at large are compelled to vacate the village to accommodate the Land Acquisition Officer for submergence of their village by causing much hardship to them on one hand without giving adequate compensation and on the other hand, even by leaving the sentimental attachments with their structures as well as to their village, thereby it caused mental trauma for their shift to some other place under the compulsive situation for rehabilitation and for resettlement. This kind of sufferance, agony and mental trauma, cannot be measured with any scale more particularly with financial aspects as much more attachments attached to those aspects.
49-After careful consideration of the oral and documentary evidence produced by both sides and also considering the above discussion, this
Court has no hesitation to hold that the claimants are entitled for

doubling the enhancement of market value with all benefits under the
Amended Act that is for the additional market value, solatium and interest as per the provisions of Amended Land Acquisition Act. The claimants are entitled to the enhancement amounts after deducting the amount of compensation already paid to them and they further entitled for the costs of the petition. Accordingly, this point is answered in part.
POINT No.2:- 50-As the point no.1 is answered in part in favour of the claimants, the reference is answered in part in favour of the claimants.
IN THE RESULT, the reference is answered in part as follows:-
1)The compensation amount awarded by Land Acquisition Officer on the structures/residential houses is hereby enhanced as doubled.
2)The claimants shall be entitled to additional amount of compensation @ 12% on the enhanced market value from the date of Sec.4(1) notification till the date of taking over possession or till the date of award whichever is earlier.
3)The claimants are further entitled to claim interest @ 9% for the first year from the date of taking over the possession and thereafter, @ 15% till the date of deposit or payment as the case may be on the enhanced market value.
4)The claimants shall be entitled to 30% solatium on the enhanced market value.
5)The amount of compensation already paid to the claimants shall be deducted from the balance to be paid to them.
The claimants are entitled for the costs of the petition.
