This case is coming on 21.02.2017 for final hearing before me in the presence of learned A.P.P., for Prosecution and of Sri E.
Eswara Rao, Advocate for Accused and the matter having stood over for consideration till this day, this Court delivered the following:
J U D G M E N T
The Sub-Inspector of Police, Padmanabham Police Station has filed a charge sheet against the accused for the offence under Sec.
304-A of IPC and Secs. 181 and 196 (a) of M. V. Act 1988 in Cr. No.
32/2016 of Padamanabham Police Station alleging that;
The accused is the resident of Nerallavalasa Village of
Padmanabham Mandal. The deceased Turupati Ravi @ Ravi Kumar is residing at Vizianagaram and doing Onion business. On 29.03.2016 at about 5.00 p.m., he started from his house for collection of dues from his regular customers on his motorcycle bearing No. AP 35 Q 4734 to
Padmanabham via Chinnapuram and when reached near Sarikandam
Village i.e., near Sunkarigiribabu layout, the accused being the driver 2 of auto bearing No. AP 35 V 9148 drove the same in a rash and negligent manner without observing traffic rules and regulations and hit his motorcycle. On that, the deceased Turupati Ravi @ Ravi Kumar fell on the ground and sustained grievous injuries to his head and other parts in unconscious state. Then, the persons gathered at the scene of offence informed the incident to him and shifted the injured to M. R. Hospital, Vizianagaram for treatment. Later, the deceased
Turupati Ravi @ Ravi Kumar died at about 8.10 p.m., while undergoing treatment in the hospital. On 30.03.2016 at about 8.00 a.m., he presented a written report to PW.10 who in turn registered the same as a case in Cr. No. 32/2016 U/Sec. 304-A of IPC and investigated into the case. During the course of investigation, he visited the scene of offence, inspected the same and prepared a rough sketch of it. Later, he observed the scene of offence in the presence of PW.9 and LW.18
Korada Raju and conducted inquest over the dead body of the deceased Turupati Ravi @ Ravi Kumar in the presence of PW.8, LWs 13, 14, 15 and 17 Ramasingi Sanyasi Rao, Kalla Gopalam, Rowthu
Sreenu and Ura Kameswara Rao. He has also taken photographs of the dead body of deceased Turupati Ravi @ Ravi Kumar with the cell phone of LW.3 Koyyana Swarup Kiran at Mortuary, M. R. Hospital,
Vizianagaram and sent the dead body of the deceased Turupati Ravi @
Ravi Kumar for post mortem examination to LW.19 Dr. V.
Satyanarayana, Civil Assistant Surgeon, District Hospital,
Vizianagaram who in turn conducted autopsy over the dead body of the deceased Turupati Ravi @ Ravi Kumar and issued post mortem certificate opining that the cause of death of the deceased is due to head injury. On 01.04.2016 at about 10.00 a.m., he arrested the accused in the police station when he surrendered before him along 3 with vehicle records. Later, he served Notice U/Sec. 41-A of Cr.P.C., to the accused and then released him on bail after obtaining sufficient sureties since the punishment for 304-A of IPC is within seven years of imprisonment. Inspector who inspected both the vehicles has issued accident report opining that the accident was occurred not due to any mechanical defects of the crime vehicle. Thereafter further investigation was took up by LW.23 B. Simhachalam, the then Sub-Inspector of Police,
Padmanabham PS Therefore, the accused is liable for punishment under the aforesaid section of law.
2.On 16.07.2016 this case was taken on file for the offence under Sec. 304-A of IPC and Secs. 181 and 196 (a) of M. V. Act against the accused.
3.On appearance of the accused, copies of documents were furnished to him as contemplated U/Sec. 207 of Cr.P.C. He was examined under Sec. 251 of Cr.P.C., explaining the accusation made against him for the offence under Sec. 304-A of IPC and Secs. 181 and 196 (a) of M.V. Act in Telugu. For which, he denied the offence and claimed to be tried.
4.To substantiate the case of the prosecution, the prosecution has examined PW.1 – Turpati Ramesh Kumar, PW.2 – Akiri
Adhibabu, PW.3 – Puppala Padmanabam, PW.4 – Reddipalli
Chandrarao, PW.5 – Basavana Sattibabu, PW.6 – Allu Appalaraju,
PW.7 – Bora Appalanaidu, PW.8 – Vakada Venkata Ramesh Babu,
PW.9 – Chandaka Ramu and PW.10 – V. A. V. Satyanarayana, Head 4
Constable of Police, Padmanabham PS and got marked Exs P.1 to P.13 – Report given by PW.1 to the police, 161 Cr.P.C., statements of PWs 2 to 7, Signature of PW.8 on Inquest Report, Signature of PW.9 on
Scene Observation Report, FIR, Rough Sketch, Post Mortem Certificate of the deceased and MVI Report. On 14.10.2016, 11.11.2016 and 25.01.2017 the evidence of LWs 2 to 6, 13 to 15, 17 and 18 is closed as the police failed to serve summons to them since 29.08.2016, 14.10.2016 and 16.12.2016. On 09.02.2017 the evidence of LWs 20, 21 and 23 was given up by the learned A.P.P.
5.After the evidence of prosecution was closed, the accused was examined U/Sec. 313 of Cr.P.C., explaining the incriminating material available in the evidence of prosecution witnesses. For which, he denied the same and reported no defence evidence.
6.Heard, the arguments on both sides and perused the material on record.
7.The point for consideration is;
Whether the prosecution has proved the guilt of the accused for the offence U/Sec.304-A of I.P.C., and Secs 181 and 196 (a) of M. V. Act beyond all reasonable doubt?
8.P O I N T :
To bring home the guilt of the accused for the offence punishable under Sec. 304-A of I.P.C., and Secs. 181 and 196 (a) of
M. V. Act, the prosecution has to establish that the accused being the driver of Auto bearing No. AP 35 V 9148 without having licence and insurance to the crime vehicle drove the same in a rash and negligent 5 manner without observing THE traffic rules and regulations dashed against the motor cycle of the deceased Turupati Ravi @ Ravi Kumar.
As a result of which, the deceased Turupati Ravi @ Ravi Kumar fell on the ground and sustained grievous injuries on his head and other parts of his body and later died in the hospital while undergoing treatment and thereby, he committed the aforesaid offence.
9.To prove its case, the prosecution has examined PW.1 - to speak about the facts of the offence and his giving report to the police,
PWs.2 to 6 – to speak about their presence at the time of accident and facts of the case, PW.7 – To speak about his ownership of the crime vehicle i.e., Auto bearing No. AP 35 V 9148, PW.8 – to speak about his presence at the time of conducting inquest over the dead body of the deceased Turupati Ravi @ Ravi Kumar, PW.9 - to speak about his presence at the time of drafting the scene observation report, PW.10 – to speak his registration of FIR, his investigation and arrest of the accused etc.
10.PW.1 who gave report to the police has stated that the deceased Turupati Ravi @ Ravi Kumar is his own brother. He does not know the accused. On 29.03.2016 at about 5.30 p.m., he received phone call from District Hospital, Vizianagaram that his brother met with an accident. On that, he went to the hospital and found fracture to the right hand of his brother. On the same day at about 8.00 a.m., the Doctors declared that her brother was died. Then, he went to
Padmanabham Police Station and gave a report under Ex-P.1 to the police. Whereas in his cross-examination, he stated that Ex-P.1 report 6 was drafted by police officials. He does not know the contents of Ex-
P.1 report completely.
11.PWs 2 to 6 who alleged to be the direct eye witness to the offence had stated that they do no know the deceased Turupati Ravi @
Ravi Kumar, PW.1 and the accused. They do not know anything about the offence in this case. In their cross-examination by the learned APP, they denied the suggestion that they stated before police as in Exs P.2 to P.6 and now they are deposing falsely to help the accused.
12.PW.7 who alleged to speak about the offence and brother- in-law of the accused has stated that he is the owner of the crime vehicle i.e., auto. In the month of March, 2016 the accused informed him that his auto was involved in an accident. Except that, he does not know anything about the offence in this case. In his cross-examination by the learned APP, he denied the suggestion that he stated before police as in Ex-P.7 and now he is deposing falsely to help the accused.
13.PW.8 who alleged to have been present at the time of inquest over the dead body of the deceased Turupati Ravi @ Ravi
Kumar has stated that on 30.03.2016 at about 9.30 a.m., police conducted inquest over the dead body of the deceased Turupati Ravi @ Ravi Kumar at M. R. Hospital, Vizianagaram. But, he does not remember the contents of the inquest report. In his cross-examination by the learned APP, he denied the suggestion that he signed on the inquest report dt.30.03.2016 at about 9.30 a.m., at the time when the police conducted inquest over the dead body of the deceased Turupati 7
Ravi @ Ravi Kumar at M. R. Hospital, Vizianagaram and now he is deposing falsely to help the accused.
14.PW.9 who alleged to have been present at the time of drafting Scene Observation Report has stated that about two years back in morning hours at the request of PW.1, he signed on white paper at Vizianagaram. But, he does not know the contents of the said
Scene Observation Report. In his cross-examination by the learned
APP, he denied the suggestion that he signed on the scene observation report dt.30.03.2016 at about 9.00 a.m., at the time when the police got drafted scene observation report and now he is deposing falsely to help the accused.
15.PW.10 who is working as Head Constable of Police,
Padmanabham PS has stated that on 30.03.2016 at about 8.00 p.m.,
PW.1 came to police station and presented a written report to him. On that, he registered the same as a case in Cr. No. 32/2016 U/Sec. 304-
A of IPC. On the same day, he visited the scene of offence along with
PC 3069 T. Mahesh which is situated at Cherakandam, inspected the same and prepared a rough sketch of it under Ex-P.11. Then, he got drafted the scene observation report through PC 3069 T. Mahesh in the presence of PW.9 and LW.18 Korada Raju. Then, he went to
Government Hospital, Vizianagaram and conducted inquest over the dead body of the deceased Turupati Ravi @ Ravi Kumar at mortuary and got drafted inquest report through PC 3069 T. Mahesh in the presence of PW.8 and LWs 13 to 15 and LW.17 Ramasingi Sanyasirao,
Kalla Gopalam, Rowthu Sreenu and Ura Kamswararao. Later, he examined the witnesses and recorded their statements. Then, he sent 8 the dead body of the deceased Turupati Ravi @ Ravi Kumar to LW.21
Dr. V. Satyanarayana, Civil Assistant Surgeon, District Hospital,
Vizianagaram for conducting autopsy. Then, he obtained post mortem certificate from him. On 01.04.2016 at about 11.00 a.m., he arrested the accused in the police station when he surrendered before him and then served notice U/Sec. 41-A of Cr.P.C., to the accused and later on released him on bail after obtaining sufficient sureties. On 12.04.2016 at about 10.00 a.m., he sent a requisition to LW.20 R. Suman Kumar,
Assistant Motor Vehicle Inspector, Visakhapatnam for inspection of crime vehicle and the vehicle of the victim and obtained accident report from him. On 08.07.2016 he handed over the CD file to LW.23
B. Simhachalam, the then Sub-Inspector of Police, Padmanabham PS who in turn verified the investigation done by him and filed charge sheet after completion of investigation. Whereas in his cross- examination, he stated that he saw the dead body of the deceased
Turupati Ravi @ Ravi Kumar in the mortuary of Government Hospital,
Vizianagaram. He has shown the dead body of the deceased Turupati
Ravi @ Ravi Kumar on the road leading from Padmanabham to
Vizianagaram in Ex-P.11 rough sketch. The said Padmanabham to
Vizianagaram road leads from south to north. Whereas he has shown the said road in Ex-P.11 rough sketch from east to west. Ex-P.13 MVI
Report reveals no damages to the crime vehicle and damages to the vehicle of the victim. He denied the suggestion that he prepared the rough sketch in the police station but not at the scene and that the victim voluntarily dashed the vehicle of the accused and that he falsely involved the accused and his vehicle in this crime. He further denied the suggestion that he conducted table investigation and prepared the entire case record in the police station itself. He further denied the 9 suggestion that he falsely registered this case against the accused in order to get insurance to the family of the deceased and that the accused is no way concerned with the offence in this case. .
16.A perusal of Ex-P.1 Report given by PW.1 to the police and
Ex-P.10 FIR disclose that he is doing business in onions at P. W.
Market, Vizianagaram. He used to go to neighbouring places for collecting dues on every Tuesday. On 29.03.2016 at about 6.30 p.m., when his brother is returning from Vizianagaram to Padmanabham via
Chinnapuram on his motorcycle bearing No. AP 354 Q 4734 and reached to the main road of Chinnapuram Village near Sunkari
Giribabu layout, the driver of the Auto bearing No. AP 35 V 9148 drove the same in a rash and negligent manner with high speed and dashed against the pulsar motorcycle of his brother. On that, his brother fell on the ground along with his vehicle and sustained severe injuries to his head and both hands. The persons who witnessed the accident had called 108 ambulance and shifted his brother to M. R. Hospital,
Vizianagaram for treatment. On the same day at about 8.10 p.m., his brother died. The said facts were informed by the villagers through the cell phone of his brother. Then, he immediately came to M. R.
Hospital, Vizianagaram and came to know about the said accident and later gave report to the police and requests to take action against the driver of the crime vehicle. Whereas the complainant who is examined as PW.1 and gave report to the police has stated that he does not know the accused. On 29.03.2016 at about 5.30 p.m., he received phone call from District Hospital, Vizianagaram that his brother met with an accident. On that, he went to the hospital and found fracture to the right hand of his brother. On the same day at about 8.00 a.m., 10 the Doctors declared that his brother was died. Ex-P.1 report was drafted by police officials. He does not know the contents of Ex-P.1 report completely. His evidence does not disclose anything about the accused and how the accident was occurred. PWs 2 to 6 who alleged to be the direct eye witnesses to the offence had stated that they do no know the deceased Turupati Ravi @ Ravi Kumar, PW.1 and the accused. They do not know anything about the offence in this case.
They turned hostile and did not support the case of the prosecution.
PW.7 who is the owner of the crime vehicle i.e., auto has stated that in the month of March, 2016 the accused informed him that his auto was involved in the accident. Except that, he does not know anything about the offence in this case. He also turned hostile and did not support the case of the prosecution. PW.8 who alleged to have been present at the time of inquest over the dead body of the deceased Turupati Ravi @

Padmanabham PS, registered the FIR and investigation into the case has stated that on 30.03.2016 at about 8.00 p.m., PW.1 came to police station and presented a written report to him. On that, he 11 registered the same as a case in Cr. No. 32/2016 U/Sec. 304-A of IPC.
On the same day, he visited the scene of offence along with PC 3069
T. Mahesh which is situated at Cherakandam, inspected the same and prepared a rough sketch of it under Ex-P.11. A perusal of Ex-P.11 rough sketch discloses the scene of offence on the margin of the road leading from Padmanabham to Vizianagaram. It further discloses the dead body of the deceased Turupati Ravi @ Ravi Kumar near the bike.
Whereas PW.10 stated that he saw the dead body of the deceased
Turupati Ravi @ Ravi Kumar in the mortuary of Government Hospital,
Vizianagaram. He has shown the dead body of the deceased Turupati
Ravi @ Ravi Kumar on the road leading from Padmanabham to
Vizianagaram in Ex-P.11 Rough Sketch. The said road leads from
South to North. He has not shown the said road in Ex-P.11 rough sketch from east to west but not from north to south. His evidence discloses that he has not conducted investigation properly and prepared the rough sketch as if he likes but not as per the physical features existing on the said road. He further stated that he got drafted the scene observation report through PC 3069 T. Mahesh in the presence of PW.9 and LW.18 Korada Raju. But, a perusal of Scene
Observation Report does not disclose that it was drafted by the said T.
Mahesh. The prosecution has not got marked the said scene observation report for the reasons best known to it. He further stated that Ex-P.13 MVI Report reveals no damages to the crime vehicle and damages to the vehicle of the victim. Except denying the suggestions that he prepared the rough sketch in the police station but not at the scene and that the deceased voluntarily dashed the vehicle of the accused and that he falsely involved the accused and his vehicle in this crime in order to get insurance to the family of the deceased and that 12 he conducted table investigation and prepared the entire case record in the police station itself and that the accused is no way concerned with the offence in this case, the prosecution has not filed any document to show that the accused is the driver of the crime vehicle at the time of accident and that due to his rash and negligent acts only, the accident was occurred and that there is no driving licence and insurance to the crime vehicle. Thus, the evidence of PW.10 and Exs
P.1, P.10 to P.13 disclose that an accident was took place near
Sunkara Giribabu layout at Cherakandam and in the said accident, the deceased Turupati Ravi @ Ravi Kumar sustained grievous injuries and later he died at M. R. Hospital, Vizianagaram while undergoing treatment. Therefore, in the light of the evidence of PWs 1 to 9 coupled with Exs P.1 to P.9, the evidence of PW.10 and Exs P.10 to
P.13 are no way helpful to the prosecution to establish its case against the accused for the alleged offence under section 304-A of IPC and
Secs. 181 and 196 (a) of M.V. Act. There is absolutely no evidence on record to connect the accused for the alleged offence under Sec. 304-A of IPC and Secs. 181 and 196 (a) of M.V. Act. Hence, this Court has no hesitation to come to a conclusion that the prosecution is miserably failed to establish its case against the accused for the alleged offence under Sec. 304-A of IPC and Secs. 181 and 196 (a) of M.V. Act beyond all reasonable doubt and as such, the benefit of doubt should goes to the accused and the point is answered in the negative.
17.In the result, the accused is found not guilty of the offence under Sec. 304-A of IPC and Secs. 181 and 196 (a) of M. V. Act and accordingly, he is acquitted under section 255 (1) Cr.P.C. His bail bonds shall stand cancelled after appeal or appeal time is over.
