ORDER

Accused present. Judgment pronounced in the open court. In the result, the accused is found guilty of the offence under section 138 r.w.142 of the Negotiable Instruments Act, 1881 and accused is hereby convicted Section 255 (2) of Cr.PC for the said offence. The convict is heard on the quantum of sentence. He requested the court to be lenient in sentencing. Taking the circumstances of the case, this court is not inclined to invoke the provisions of section 360 of Cr.PC or section 3 and 4 of Probation of Offenders Act. In the result, the accused is found guilty for the offence punishable under section 138 of N.I Act an as such the accused is convicted of the said offence under section 255(2) of Cr.PC. The accused is sentenced to undergo simple imprisonment for a period of 6 months and to pay fine amount of Rs.3,10,000 (Rupees three lakhs ten thousand only). In default of payment of fine he shall undergo simple imprisonment for a period of 1 month. Out of the fine amount of Rs.3,10,000/-, Rs.10,000/- (Ten thousand only) shall be paid to the state and remaining fine amount of Rs.3,00,000/- (Rupees three lakhs only) shall be paid to the complainant as compensation under section 357(1) (b) of Cr.PC. The accused is appraised to his right to prefer appeal against the judgment and sentence passed by this court. Accused reported means to engage the counsel to prefer the appeal against judgment and sentence passed by this court. Office is directed to furnish the true copy of judgment to the accused forthwith.

MO1 is the gold necklace which is given to Pw1 for interim custody as per the orders made in

crlmp no.596 of 2017 dt 15.09.2017, shall be made absolute after appeal time is over.
