This suit coming for final hearing before me on 14-08-2023 in the presence of Sri. K.V. Nagarjuna, Advocate for Plaintiff and Sri. B.L.Chinnaiah, Advocate for defendants No.1,5 & 6 are exparte and Defendants 2 to 4 & 7 are set exparte and having stood over the matter for consideration to this day, this Court delivered the following:

J U D G M E N T

This is a suit for Partition and the plaintiff prays for partition of the suit schedule properties into 49 equal shares and to allot 8/49 such sahre to the plaintiff by meets and bounds with good and bad qualities with separate possession to pass final decree in terms of prelimanary decree and for cots.

The learned counsel for plaintiff memo submitting thyat, both parties are compromised before village elders and suit may dismissed, to that effect memo is recorded.

Hence suit is dismissed as settleded out of court. No order as to costs.

This petition is coming up for hearing before me on this day 16-03-2024 in the presence of Sri D.A.Chandra Sekhara Rao, Advocate for Petitioner/D.Hr, the matter having stood over for consideration till this day, the court delivered the following:

O R D E R

01.Sole Decree Holder filed this execution petition under Or.21, Rule 48 of CPC against the Judgment Debtor to attach the salary of J.Dr No.2 for realization of the decretal debt.

02.The D.Hr prays that the Hon’ble Court may be pleased to issue notice to the

J.Dr U/Or.21, R.48 CPC to attach the salary of J.Dr and if there is no answer, his salary may be attached by issuing salary attachment warrant to Garnishee of J.Dr.

U/Or.21 R.48 of CPC to deduct the amounts from the salary of J.Dr as per Sec.60

CPC and send the same into this Hon’ble Court by way of demand draft in the interest of Justice.

As per terms of compromise, the J.Dr/Defendant agreed to pay entire suit amount of Rs.10,00,637/- to the D.Hr/plaintiff @ Rs.20,000/- per month in 50 equal installments till completion of EP amount. The J.Dr agreed to send the deducted amount from his salary through his garnishee i.e., Executive Engineer, O&M shift

Division, N.S.J.C, NSP colony, Narasaraopet road, Vinukonda post and Mandal to the S.B. Account of D.Hr by name Gogineni Rama Devi bearing

No.700310011006865 of Union Bank of India, Adigoppula Branch, situated at Durgi

IFSC Code: UBINOCG7003. The salary of J.Dr shall be deducted from the month of

April, 2024. In default, the D.Hr/Plaintiff is at liberty to file execution petition against the defendant to the extract of the balance amount. Accordingly EP is disposed of and award is passed in terms of compromise.
