This suit is coming on 20.1.12 for final hearing before me in the presence of Sri K. Srinivasulu Naidu, Advocate for plaintiff and D1 to D3 remained exparte and having stood over for consideration till this day, this court made the following: - :: J U D G M E N T ::

1.This is a suit for recovery of money. The gist of the contention of plaintiff is that Thati Yellamanda rao borrowed a sum of Rs. 1,00,000/- on 21.8.06 and executed a promissory note in favour of the plaintiff agreeing to repay the amount with interest at the rate of 24% p.a. During the life time of Thati

Yellamanda rao, the plaintiff requested him on several occasions to repay the amount, but in vain. Subsequently Yellamanda rao died without repaying any part of the amount.

2.The defendants herein are the legal heirs of late Yellamanda rao. After the death of original borrower, the plaintiff got issued a notice to the defendants calling upon them to repay the debt. The defendants managed to get the notice returned unserved. Hence the suit.

3.The defendants refused to receive summons and evaded service of summons through R.P. After giving ample opportunity the defendants were set exparte. The plaintiff choosen to examine himself as Pw.1 In his evidence the suit promissory note is marekd as Ex.A1. The office copy of legal notice is marked as

Ex.A2. In all Exs. A1 to A7 are marked. Through the evidence of Pws. 2 and 3 who are the attestors, the execution of pronote and passing of consideration has been proved.

4.The evidence adduced by the plaintiff left un-rebutted. Hence the suit deserves to be decreed. In the result, the suit is decreed for a sum of

Rs.1,71,866/- (Rupees one lakh seventy one thousand and eight hundred and sixty six only) with future interest at 12% p.a from the date of suit till the date of decree and thereafter at 6% p.a till complete realization.

Suit for recovery of Rs.1,71,866/- being the balance amount of principal and interest due on a promissory note dt; 21.8.06 executed by the defendant in favour of plaintiff for Rs.1,00,000/- agreeing to repay the same together with interest at 24% p.a and for subsequent interest and for costs.

Cause of action for the suit arose when on 21.8.06 when the Yellamanda rao son of Anjaiah borrowed an amount of Rs.1,00,000/- from the plaintiff at Ongole for his necessities and when he executed a pronote in favour of the plaintiff on the same day, agreeing to repay the same with interest at 24% p.a either to the plaintiff or his order on demand and when the T. Yellamanda rao failed to pay the same, and when he died, and when the plaintiff knowing about the death and informed the said pronote debt, and requested to pay the same, and when the defendants 1 to 3 agreed to pay the same, and when the defendants failed to pay the same, and when the plaintiff got issued legal notice, dt; 6.9.08 when the defendants 1 to 3 failed to receive the same and when they returned the same and the transaction took place at Ongole within the jurisdiction of this court.

Value of the suit for the purpose of court fee and jurisdiction is at Rs.1,71,866/- on which CF of Rs.4226/- is paid U.sec. 20 of APCF and Sv Act.

This suit is coming on 20.1.12 for final hearing before me in the presence of Sri K. Srinivasulu Naidu, Advocate for plaintiff and D1 to D3 remained exparte and having stood over for consideration till this day, this court doth order and decree:

(1) that the defendants jointly and severally do pay to the plaintiff a

sum of Rs.1,71,866/- (Rupees one lakh seventy one thousand eight hundred and sixty six only) with subsequent interest at 12% p.a from the date of the suit till date of decree and at 6% p.a. From date

of decree till realization due under suit pronote; and

(2) that the defendants do also pay a sum of Rs.7328/- (Rupees seven

thousand three hundred and twenty eighty only) to the plaintiff towards suit costs.
