Accused No.1 and 2 produced from Central Jail, Chenchalguda jail. Copies furnished.They are examined u/s.239 CrPC.Charge for the offence u/s.454,380 IPC is framed. Read over and explained to accused. Accused admitted the offence u/s.454,380 IPC and they pleaded guilty .I am satisfied that the plea of accused is voluntarily. As such, A1 and 2 are convicted. Accused is heard on quantum of sentence. He stated that his entire family is dependant upon on his earning and that he is the sole earning member of his family and prayed for mercy of the court. As the plea of the accused is voluntary in nature provisions of PO Act cannot be invoked. A1 and A2 are sentenced to undergo Rigorous imprisonment of 14 months 26 days and to pay fine of Rs.200 each for the offence punishable u/s.454 IPC and further shall undergo Rigorous imprisonment of 14 months 26 days and to pay fine of Rs.200/- each for the offence punishable u/s.380 IPC, total fine of Rs.800/-. IN case of default of payment of fine, they shall undergo Simple imprisonment for a period of one month each. Both the sentences shall run concurrently. The remand period of A1 and 2 for 14 months 26 days each is set off and the accused are set at liberty. Accused shall be released forthwith if not required in any other case. There is no property.
