This petition is coming before me for final hearing on 18.05.2026 in the presence of Sri M.Vijaya Bhaskar & S.Kanaka Raju, Advocates for petitioner/accused no.1nd the learned Special Public Prosecutor for the state; and upon perusing the material papers on record and upon hearing and having stood over for consideration till this day, this court delivered the following:

: O R D E R :

1]This is the 4th bail petition filed by the petitioner/accused no.1 under section 483 of BNSS seeking bail in Cr.NO.56/2026 of P.S.Edullabayyaram for the offences punishable under sections 74, 87, 351(2) of BNS and Sec.3(1)(w)(i) & 3(2)(v)(va) of

SCs/STs (POA) Act, 1989 as amendment Act 2015.

2]Notice given to the learned Spl. Public Prosecutor, who opposed the bail and filed counter. Heard the defacto complainant who vehemently opposed the bail, and the same is endorsed on notice.

3]This Court heard the arguments on either side and perused the entire record.

“ Whether the Petitioner/Accused No.1 is entitled to be released on bail”?

POINT:

5]The brief facts of the case of the prosecution that on 20.03.2026 at 2:00 p.m., while the complainant was going to the MeeSeva center located at Edulla Bayyaram

Cross Road to apply for a PAN card, the Petitioner/A1 followed her in a white-coloured car bearing No.TS 28 TB 2053. He approached her near the HP Petrol Pump and mockingly commented that she had been talking on the phone, but she did not pay any attention to his words. After completing her work at the MeeSeva Center, she started walking back to her house in Uppaka village. At about 3:40 p.m., when she was on

Uppaka Road, the Petitioner/A1, along with his friend Uke Siddu, followed her in an auto-rickshaw bearing No. TS 04 UA 6258, which was being driven by Siddu. Suddenly, the Petitioner dragged her into the auto, forced her to get inside, caught hold of her hands, and covered her mouth. When she tried to free herself, he pressed her throat tightly and threatened her that if she shouted, he would kill her. Further, they attempted to take her to some unknown place with the intention of sexually assaulting her. When she pushed him away and hit the auto driver with her hands, they did not stop the auto. Instead, they drove from Uppaka Road towards Manuguru. When the auto reached near a restaurant (dhaba), she jumped out of the moving auto and fled from them. Due to fear and shock, she narrated the incident to her mother. Hence, the report.

6]The learned counsel for the petitioner/accused submitted that he has been implicated in this case by making false and baseless allegations. The petitioner/accused

No.1 have not committed any offence, much less the alleged offences. The police examined 12 witnesses, and the question of tampering with the evidence does not arise.

There was an abnormal delay in lodging the complaint, as the alleged offence occurred on 20.03.2026 at 2:00 p.m., but the complainant lodged the complaint on 22.03.2026 at 10:00 p.m. The petitioner is the sole earning members of his families, and his further detention will cause starvation to his family. Further contended that the earlier bails petitions vide Crl.MP.No.362 of 2026, Crl.Mp.426 of 2026 and Crl.Mp.498 of 2026 were dismissed by this court. Hence, it is prayed to allow the petition.

7] On the other hand, the learned Spl. Public Prosecutor filed a counter opposing the petition on the ground that the investigation has not yet been completed and some

Pg.No.2 more witnesses have to be examined. If the petitioner is released on bail, he may pose a threat to material witnesses and there is every chance of a law and order problem.

Accordingly, he prayed for dismissal of the petition.

8] As evident from the record, most of the investigation has been completed, and the petitioner/Accused No.1 have been in judicial custody since 01.04.2026. The first, second and third bail applications were dismissed by this Court. Having regard to the facts and circumstances of the case, this Court is of the considered opinion that the petitioner/Accused No.1 may be enlarged on bail, subject to conditions.

9] In the result, the petition is allowed , the petitioner/accused no.1 shall be released on bail on his executing a bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for the like sum to the satisfaction of this Court.

Further the petitioner / Accused No.1 is hereby directed to appear before the

Station House Officer, P.S. Edullabayyaram on every Monday, Wednesday and Friday in between 10.00 a.m to 5.00 p.m for a period of two months or till filing of the charge sheet, whichever is earlier.

The petitioner/Accused No.1, shall never cause any threat or inducement to the victim/defacto-complainant and other witnesses in this case.

1.This is the bail application filed for grant of bail under Section 483 of the Bharatiya Nagarika Suraksha Sanhitha by the petitioner/ A1, who is involved in Cr.No.45/2026 of PS Madhira Town, which was registered for the 1/4Spl.SJ

2.Heard the learned counsel for the petitioner/ A1 and the learned in- charge Public Prosecutor.

3. The counsel for petitioner/A1er submitted that all the accusations levelled against the petitioner/accused are false, baseless and invented for the purpose of case. In fact, the petitioners/accused are innocent and did not commit any offence much less the alleged offences. The petitioner accused is working as a driver, as such further detention of the petitioner in judicial custody will result much hardship and starvation of to his family. The entire investigation has been completed by examining material witnesses and except filing of charge sheet. There is a delay of 21 days in lodging report before the police as it is invented only to harass the petitioner. The petitioner/accused are ready to face the trial to prove his innocence and furnish the sureties and finally prayed to enlarge the petitioner/ Accused, on bail.

4.The learned in-charge Public Prosecutor filed counter stating that the petitioner/ Accused No.1 if released on bail, he will continue his attitude and may commit further offence and there is a scope of absconding and it will be difficult to apprehend him and further submitted that the accused No.1 may also cause the evidence to disappear and he would threaten the witnesses, accordingly prayed to dismiss the bail petition.

5. Now the point for consideration is :

“Whether the petitioner/ A1 is entitled to be enlarged on bail, as prayed for?”

P O I N T :

6. The case of the prosecution as can be seen from the remand case diary is that on 24.03.2026 at 1300 hours, the complainant came to police station and lodged Telugu written report stating that since four years she was working in Gouse Pasha’s Iron scrap shop in Yerrupalem road and that on 03.03.2026 at about 2.30 p.m, while she is working in the said shop, in the mean time one Yogi, driver of said shop along with his brother-in-law by courtesy came to the shop and tried to smash eggs on her, in view of Holi festival, but she admonished them and went on the road. At that time, said

Yogi’s brother in law obstructed her and they both dragged her into shop and they grabbed her wherever they could and smashed eggs on her body. On that her co-worker Thadikamalla Pramod and her owner admonished them.

Later she went to her house and after having bath, she came to shop at about 4.30 p.m, meantime the petitioner/A1 along with his mother and sister came there abused her in filthy language touching her case name as “Madiga

Lanja Dana”, beat her with hands and A1/Yogi caught hold her hair and pushed her down and kicked her. They also threatened her with dire consequences that “they will saw her end if she interferes in their matter”. Hence the case.

7.As seen from the contents of the petition and counter and also the submissions advanced by the learned counsels, the offence alleged to have committed by the petitioner/A1 is serious in nature. The learned in-charge

Public Prosecutor further submitted that the investigation in this case is still pending. Considering the rival contentions, having regard to the facts and circumstances of the case, in view of gravity and severity of the offence and apprehensions expressed by the prosecution and the defacto complainant and also the stage of the investigation, this Court is inclined not to grant the bail at this stage. The Point is answered accordingly.

8.In the result, the petition is dismissed.

“ Whether the Petitioner/Accused is entitled to be released on bail”?

POINT:

5]The brief facts of the case of the prosecution are that the victim is a married, deserted woman having children. She got acquainted with the accused while she was working at LOT Mobiles. Out of such acquaintance, they lived together at Safai Basthi,

Kothagudem, until April 2025 and also decided to get married. Due to differences between them, the matter was discussed in the presence of elders and they mutually decided to separate, and since then they have been living separately. Thereafter, the accused again approached the victim and convinced her by stating that he would marry her. Believing his words, on 30.11.2025 at about 9:00 p.m., the accused forcibly had physical relations with the victim. Thereafter, he started avoiding the victim and tried to marry another woman as the victim belongs to a lower caste. Hence, the report.

6]The learned counsel for the petitioner/accused submitted that the alleged victim has not obtained any divorce from her husband. As such, the question of promise of marriage by the petitioner/accused does not arise. The petitioner/accused has a wife, aged parents and family burdens. He is a daily-wage earner and the breadwinner of his family, and his further detention will cause starvation to his family members. It is averred that the petitioner did not commit the offence as alleged by the police. He is a law-abiding citizen and undertakes to abide by any condition imposed by the Court. The entire investigation is completed, except filing formal charge sheet and he is ready to furnish sureties to the satisfaction of this Court; the earlier bail applications were dismissed by this court vide Crl.MP.No.396 of 2026 dt.17.04.2026, Crl.MP No.435 of 2026 dt.28.04.2026 and prays to enlarge the petitioner on bail.

Accused if released on bail, there is every possibility of influencing, the witnesses or threatening the victim, as such requested to dismiss the bail petition.

8] On perusal of the remand case diary and the submissions made in the counter and also submissions made by the learned counsel for petitioner/accused and the remand case diary, material part of investigation has been completed by examining all the material witnesses except filing of charge-sheet. Considering the fact that material part of investigation has been completed, this court is inclined to grant bail to the petitioner/Accused, but on certain conditions. Accordingly, the point is answered in favour of the petitioner/accused and against the respondent/complainant.

9] In the result, the petition is allowed and the petitioner/ Accused shall be released on bail on his executing personal bonds for Rs.20,000/- (Rupees twenty thousand only) with two sureties for the like sum each to the satisfaction of this court. Further the petitioner / Accused is hereby directed to co-operate with the investigating agency as and when required until the time of filing of the charge-sheet, in case of breach of any of the above conditions, it shall be a ground for cancellation of this bail.

2.This is the bail application filed for grant of bail under Section 483 of the Bharatiya Nagarika Suraksha Sanhitha by the petitioner/accused, who is involved in SC.No.78/2017 on the file this court in Cr.No.212/2017 of PS

Manuguru, which was registered for the offences punishable under Sections 417, 420 and 323 of IPC and Sec.3(1)(w)(i) of SC and ST(POA)Act, 1989.

3.This is the third bail application filed by the petitioner/Accused and in the application the petitioner/accused contended that he was produced

before this court on PT warrant on 16.02.2026 and he was remanded to

judicial custody since then; that the petitioner / accused is innocent and he has not committed any offence much less the alleged offence and the entire version of prosecution is false, fabricated, baseless and invented for the purpose of the case and finally submitted that he has old aged parents, wife and children and further detention of petitioner will cause much starvation and mental agony to his family members. Accordingly prayed to enlarge the petitioner/Accused on bail.

4.The learned in-charge Public Prosecutor filed counter stating that the court issued NBW against the petitioner/accused and the Police, Manuguru PS put extensive efforts to apprehend the accused, but he could not be traced; the court after complying the necessary procedures, examined witnesses and converted this case to LPC No.01/2023. The learned in-charge PP further 2/4Spl.SJ submitted that the petitioner/accused, if released on bail he will not attend the court and may again jump the bail and the Police have to face severe strain to locate him, accordingly prayed to dismiss the bail petition.

5.Heard both sides.

6. Now the point for consideration is :

“Whether the petitioner/ Accused is entitled to be enlarged on bail, as prayed for?”

P O I N T :

7. The case of the prosecution as can be seen from the counter and petition is that on 04.09.2017 at 17.00 hours the complainant came to PS

Manuguru and lodged a Telugu written report in which she stated that she was deserted by her husband in 2009 and the accused used to follow her saying that he is loving and wanted to marry her since 2012. On believing his words she fell in love with him. Then the accused met her physically under the guise of love and marriage and he has also taken an amount of Rs.1,00,000/- for his personal needs and did not return the same. Upon 28.08.2017 at 10.00 hours she went to the house of accused and requested him to marry her, then the accused abused her in filthy language and beat her with hands. Hence the report.

8.This case is one of the oldest cases on the file of this court. The court after following due procedure converted this case vide SC.No.78/2017 to LPC

No.01/2023. Later, on production of the accused/petitioner before this court, the LPC No.01/2023 is reconverted into SC.No.78/2017 and the same is pending for recording evidence of remaining prosecution witnesses. The prosecution submitted that they will examine the remaining witnesses before this court in an expeditious manner. In view of apprehensions expressed by the prosecution with regard to the absconding nature of the petitioner/accused, having regard to the facts and circumstances of the case and in view of gravity and severity of the offence, this Court is inclined not to grant the bail petitioner/Accused at this stage. The Point is answered accordingly.

9.In the result, the petition is dismissed.

3. The case of the petitioner is that the respondent filed charge sheet against the petitioner/accused for the offences punishable under Section 294(b), 118(1), 351(2) BNS and

Sec.3(1)(r), 3(2)(va) of SC/ST (POA) Act,1989 and the same was numbered vide SC.No.137/2024 and the said case is posted for apperance of petitoner/accused on seeing the non-apperance of the accused before the court on 27.01.2026, this court issued NBW against the petitioner/accused. Hence, the petition.

4. The learned counsel for the petitioner/accused submits that the petitioner/accused could not attend the case proceedings due to lack of legal knowledge. Further, the accused is the sole earning member of his family and his family members are entirely dependent upon him.

Therefore, his continued detention would cause grave hardship to his family. The petitioner is ready to furnish sufficient surety and to abide by any conditions that may be imposed by this

Hon’ble Court. Hence, it is prayed that this Hon’ble Court may be pleased to enlarge the

petitioner/accused on bail in the interest of justice.

5. On the other hand, the learned Spl.Public Prosecutor filed counter stating that the accused is not cooperating the investigation and trial and it is showng his ignorance towards judciary. If he release on bail he may not available to the trial of the case. Hence, prays to dismiss the petition.

6. Perused the material on record and in view of the submission madeby the counsel for petitioner/accused , this court is inclined to grant bail to the petitioner/accused on condition.

7. IN THE RESULT: the petition is allowed and the petitioner is ordered to be released on bail on executing of a bond for Rs.20,000/- with two sureties for the like sum to the satisfaction of this court. Further, it is hereby ordered that the Petitioner/Accused shall attend before the

Court on each and every date of adjournment without fail. Further, the Petitioner/Accused shall not cause any threat, inducement, or promise to the complainant or any of the witnesses in this case.
