This suit came before me for final hearing on 13-05-2026 in the presence of Sri T. Narsimulu, Advocate for the Plaintiffs. The Defendants remained exparte. The matter having been heard and stood over for consideration till today, this court delivered the following: -

:: J U D G M E N T ::

1. The brief facts of the plaint are as follows:

The plaintiffs filed the present suit for declaration by declaring the plaintiffs as legal heirs of deceased late. Gajjala Kista Goud S/o Gajjala

Laxminaryana Goud, who died intestate on 21-08-2022, leaving behind the plaintiffs as his legal heirs. The plaintiffs further submitted that plaintiff No.1 is the wife and plaintiff s No.2, 3 & 4 are the sons and daughter and plaintiff No.5 is the mother of late. Gajjala Kista Goud. The plaintiffs further submitted that the plaintiffs are the only legal heirs of deceased late. Gajjala Kista Goud.

2. The plaintiffs further submitted that after the death of Gajjala Kista Goud, recently, the plaintiffs approached the defendants No.1 & 2, and 2 of 5

requested for issuance of Legal heir certificate, but the concerned authorities refused to consider the application and directed the plaintiffs to approach a competent court of law. Therefore, the plaintiffs filed the present suit for declaration to declare the plaintiffs as legal heirs of

Gajjala Kista Goud. Hence, this suit.

3. Defendants No.1 and 2 remained absent and failed to file written statement within the stipulated time. Hence, the right of D1 and D2 to file written statement is forfeited. The defendant No.3 was set exparte.

4. To prove the case of the plaintiffs, the plaintiff No.2 examined himself as

Pw-1 and Ex.A1 to A3 got marked.

5. Heard the counsel for plaintiffs and perused the material on record.

6. Now the points for determination is:

1. “ Whether the plaintiffs are entitled for declaration to declare them as legal heirs of deceased late. Gajjala Kista Goud, as prayed for ?

2. To what relief ? ”

7. POINT NO.1:- The contention of the plaintiffs is that they are the wife, children and mother and are surviving legal heirs of late. Gajjala Kista

Goud, who died on 21-08-2022. They further submitted that they approached the defendants No.1 and 2 for issuance of Legal heir certificate, but the concerned authorities refused to consider the 3 of 5

application and directed the plaintiffs to approach a competent court of law, therefore, the plaintiffs filed the present suit for declaration by declaring them as legal heirs of deceased late. Gajjala Kista Goud, who died on 21-08-2022.

8. To prove the case, the plaintiffs examined plaintiff no.2 as Pw-1 and reiterated the contents of the plaint in his chief examination affidavit and

Ex.A1 to Ex.A3 got marked. Ex.Al is CC of death certificate isued dated 25-08-2022. Ex.A2 is Original copy of addidavit cum self declaration dt.20-01-2026. Ex.A3 is Aadhar card of plaintiffs No.1 to 4.

9. The oral evidence of Pw-1 and the documentary evidence under Ex.A1 to

Ex.A3 are remained unchallenged. Moreover, according to the plaintiffs, they are the legal heirs of deceased late. Gajjala Kista Goud, who died on 21-08-2022 and they filed Ex.A1 to Ex.A3 in support of their case.

10. From the above said unrebutted testimony on record and documentary evidence under Ex.A1 to A3, it is clear that plaintiffs are the legal heirs of deceased late. Gajjala Kista Goud, as such the plaintiffs are entitled for declaration that they are the legal heirs of the deceased late. Gajjala Kista

Goud. Accordingly, this point is answered in favour of the plaintiffs.

11. POINT NO.2:In view of the findings in point No.1, the plaintiffs are declared as legal heirs of deceased late. Gajjala Kista Goud.

12. IN THE RESULT, the suit is decreed without costs and the plaintiffs are declared as the legal heirs of deceased late. Gajjala Kista Goud

S/o Gajjala Laxminaryana Goud, who died on 21-08-2022.
