This petition is coming on this day for final disposal before me in the presence of Sri N.P.Venkatesh and Kum. N.P.Neha Sree, Advocates for the petitioner Nos.1 and 2 andupon hearing and perusing the material papers on record and the matter having stood over for consideration till this day, this Court made the following:-

1.This is a petition filed under Section 13-B of the Hindu Marriage Act, 1955, by the Petitioners for dissolution of their marriage dated 21.05.2024 by granting a decree of divorce by mutual consent.
2.The case of the petitioners, in short, is that:-
The marriage of Petitioner No.1 with the Petitioner No.2 was solemnized on 21.05.2024 at Dondlapally village of Balanagar mandal i.e., at petitioner No.2’s house. After the marriage, differences arose between them and they have been living separately. Inspite of the efforts made by their elders, they could not reconcile their differences and there is no possibility for them to live together and their marital tie has irretrievably
Page No.2 of total 5 pagesFCOP No.68 of 2025 broken down. Hence, they have finally decided to get their marriage dissolved by mutual consent.
3.On presentation of the petition under Section 13-B of the Hindu
Marriage Act, 1955, both the petitioners appeared before the Court and they were counseled but the efforts of the Court for reconciliation failed.
Hence, the parties were given six months cooling time to reconsider their decision and for reconciliation, the cooling period is waived. The petitioners No.1 and 2 have examined themselves as PWs 1 and 2 respectively and got marked Ex.P1: original wedding card, dated 21.05.2024, Ex.P2: two marriage photographs of both the petitioners and
Ex.P3: xerox copy of Aadhar Card of petitioner No.1 by petitioner No.1 and
Ex.P4: xerox copy of Aadhar Card of petitioner No.2 by petitioner No.2,
Exs.P3 and P4 are marked after verifying with original Aadhar cards produced by the petitioners respectively.
4.Heard arguments of both the petitioners and their counsel.
5.Now the points that arise for determination are:
1. Whether the petitioner Nos.1 and 2 are entitled
for granting a decree of divorce by mutual
consent?
2. To what relief?

6.The case of petitioners is that the marriage of petitioner No.1 was solemnized with the Petitioner No.2 on 21.05.2024 at Dondlapally village of Balanagar mandal i.e., at petitioner No.2’s house, and after the marriage, irreconcilable differences arose between them and they started living separately and inspite of their best efforts, they could not live together and ultimately decided to get their marriage dissolved by obtaining a decree of divorce by mutual consent.
7.The solemnization of marriage of petitioners is proved through their oral testimony and Exs.P1 and P2. All the efforts made by the Court for reconciliation failed and it appeared that the marital tie between the petitioners has broken down irretrievably and there is no hope of living together again. The petitioner No.1 lastly resided within the territorial jurisdiction of this Court.
8. It is further proved from the evidence of PWs.1 and 2 that they have no claims against each other, other than those mentioned below:
On 08.10.2025 PW-1 received an amount of Rs.5,00,000/- (Rupees
Five Lakhs only) from PW-2. On 10.04.2026 PW-1 received Rs.5,00,000/- (Rupees Five Lakhs only) from PW-2, and PW-2 also issued a cheque bearing No.000013, dated 15.04.2026 of H.D.F.C. Bank, Jadcherla, for
Rs.1,00,000/- (Rupees One Lakh only) and PW-1 received the same towards her permanent alimony. Both parties agreed that they do not have any allegations against each other; that they shall not bring any allegations against each other in future. PW-1 agreed that she will not
Page No.4 of total 5 pagesFCOP No.68 of 2025 claim any maintenance or any property from PW-2 or from his family members, and that she will not file any criminal cases against PW-2 or his family members in future.
In view of the terms of settlement, the petitioners are found entitled for granting divorce by mutual consent. The Point is, accordingly, answered in favour of the Petitioners.
Point No.2:-
In view of the findings in Point No.1, the Petition is to be allowed.
9. IN THE RESULT, the Petition is allowed and the marriage of
Petitioners dated 21.05.2024 is hereby dissolved by granting a decree of divorce by mutual consent under Section 13-B of the Hindu Marriage Act, 1955, with effect from the date of decree.
