This case is coming on 11-08-2025 before me for final hearing in the presence of Smt.Naheda Farheen Assistant Public Prosecutor for the State and of Miss. Shameem Sulthana, Advocate for the Accused No.1 and Sri. M. Bhanu Krishna, Advocate for A2, and having been heard both sides and having stood over for consideration to this day, the Court made the following:-

1.The Sub-Inspector of Police, Police Station, Basanthnagar has filed charge sheet against the accused in Crime No.163 of 2024 for the offence punishable under sections 331(3), 305 of BHARTIYA NYAYA SANHITA 2023 (for short BNS).

2. The case of the prosecution in brief is as follows:- 2.1That, on 24-08-2024 at 0730 hrs the complainant/Pw1 came to PS
Basanthnagar and lodged a complaint in telugu stating that he is resident of Bamlanayak thanda village by doing agriculture coolie for his livelihood, yesterday on 23.08.2024 morning at 10:00 hrs he locked the door and went to coolie work. Afternoon at 1500 hrs his son-in-law Pw2 came to his house, he saw that the lock on the house was removed, and the lock on the door was half removed. Immediately his son-in-law got suspicious and went into the house and saw that all the household articles in the house were scattered. When his son-in-law/Pw2 called him and told him about this, when he came to his home and checked, and found that ½ tula Gold ear studs, silver leg chains weighing about 20 thulas one pair, and one
Bracelet approximately weighing about 5 thulas and the bill of purchase of gold was not found and total worth of rupees is approximately
Rs.50,000/-. Some unknown thieves entered his house yesterday afternoon and stole it. He complaining to today because he could not find the items yesterday. Thus the reason was delay. Thus he requested to take necessary action.
2.2Basing on the complaint, the Pw6 registered a case vide in Cr. No.
163/2024 U/Sec. 331(3), 305 of BNS 2023 and issued FIR and took up the investigation. During the course of the investigation, the Pw6 examined and recorded the statement of Pw1. Subsequently he visited the scene of offence situated at Bamlanayak thanda village and secured the presence of

Pw3 & Lw5/Gugulothu Gattaiah and observed the scene minutely, found one broken lock, later seized it and completed the details of the CDF before the mediators, subsequently the Pw6 secured the presence of Pw3 &
Lw3/Daravath Shyamala Rani examined them and recorded their statements. The efforts are continued to detect the case. Subsequently, the
Pw7 took up the investigation of this case and verified the investigation done by the Pw6 found it on correct lines.
2.3During the course of further investigation, on 28.08.2024 at 11:00 hrs on credible information about the presence of the suspect person, the
Pw7 along with party apprehended the accused at Dharmaram X Road,
GD Nagar village and secured the presence of the Pw5 & Lw7/Ollepu
Kumar as mediators and interrogated him. During the interrogation the accused revealed his name as Goskula Raju and he voluntarily confessed that he is resident of Kammampalli village. He is doing as Labour work. He is not satisfied with his earnings as he is addicted to enjoyments, he has been in the habit of drinking alcohol, as such he hatched a plan to commit any theft to gain money easily for his enjoyments and waited for chance.
When his Jalsa’s stole Motorcycles for money, cases were filed against him and he went jail in cases of Sulthanabad PS, Karimnagar-I town PS and
Peddapalli Police Stations and other cases also. When he was in Jail, he met with A2/Dasari Raju and their acquaintance became friendship, after coming from Jail they both decided to theft again for their lavish. About a ten days ago, in Kataram night time, on the road to Mahadevpur, one HF

Deluxe Motor cycle was parked at night, he stole it and drove it to his house and brought it, then on 23.08.2024 A2/Dasari Raju called him and said that they both should theft something together, to which he also said yes. He came to Peddapalli on the stolen HF Deluxe Motor cycle and took the toddy, they both met at the Peddapalli Masjid and together on the motor cycle, went to the outskirts of Peddapalli and drank the white toddy, went to Palakurthi mandal on the motor cycle, and there while drinking beer together in the wine shop, and noticed that a house in Bamlanayak thanda village was locked at 13:00 hrs in the afternoon and after seeing that no one was around, they both broke the lock of the house and entered the house and stole a gold pair ear studs, one pair silver leg chain, and one silver Bracelet with them. A2/Dasari Raju handed him one pair silver leg chain and Bracelet. Later on the same day they both went to Rachapalli village to theft there too, broke the lock of a house when no one was there and A2/Dasari Raju entered the house, A1/Goskula Raju guarding outside and at the same time the owner of the house came, he got scared and ran away on his motorcycle, A2/Dasari Raju, then in the same sequence. On 27.08.2024 on his motorcycle at night, thinking to theft something again, he noticed a locked a quarter in workers' colony, Basanthnagar village, and noticed that no one was around, broke the lock of that house and entered the house from the door. He stole a gold chain, then he drank a lot and in the same drunkenness, he misplaced the bracelet and the gold chain somewhere, he don't even remember where he misplaced it and even today

also when he came here, the Basanthnagar Police were caught him and saying that he would theft something and showed him a pair of silver leg chains that he had. When the panchas examined them, they were a pair of silver leg chain weighing up to 20 tulas and later the Pw7 seized it. After that the A-1/Gosukula Raju showed the motorcycle with him. The bike is also said to be the same when panchas examined it and found it to be HF
Deluxe Motor Cycle of Hero Company bearing No.TS-25-B-9967 and its engine no. HA11ENK5H22356, Chassis No. MBLHAWO34K5H41578 and the Pw7 also seized it.
2.4 During the course of further investigation the police was seized the same from the possession of A-1 by affixing the panch signature chits. The
Pw7 recorded the confession and seizure panchanama of the A-1 and brought the accused to PS Basanthnagar on the same day at 13:00 hrs and to serve the notice U/s. 35(3) BNSS but the accused didn't co- operated to the investigation as such the Pw7 issuing arrest cards and informed the affected the grounds for his arrest were communicated to the accused and their relatives through notices served under Sections 47 and 48 of the BNSS. Later Pw7 referred the accused for medical examination and medical certificate. Later Pw7 produced the A1 before the Hon'ble II
Addl. JFCM along with remand report.
2.5During the course of further investigation, on 23-08-2024 at 21:45 hours the A2 has come to PS and surrendered before the LW-11/S.
Laxman, S.I of Police, PS Dharamaram and voluntarily confessed that

committed this offence along with the A1. Immediately the LW-11/S.
Laxman, S.I, PS Dharamaram has secured the presence of the two mediators i.e., Pw4 and Lw9/Kamsani Yellaiah, in presence of them interrogated the A2-Dasari Raju. The A2-Dasari Raju has disclosed his identity and confessed that he has addicted to consume alcohol and lavish life, with that he is decided to commit theft to gain easy money for his lavish life. Upon that in the month of February-2021 he has committed theft in the Vengalapur village of Gollapalli mandal, later he has apprehended by the police and lodged in jail. After that he has committed theft in the month of January-2023 at Bathikepalli village of Pegadapalli mandal, later he has apprehended by the police and lodged in jail. After that he has again committed theft in the month of December -2023 at
Nandagiri village of Pegadapalli mandal, later he has apprehended by the police and lodged in jail, while he has in Jail he has met the A1-Goskula
Raju and made friendship with him. After that he has stopped thefts and living at his grandmother house at Kondapur village and mother in laws house at Endapalli village. On 23-08-2024 he has called to the A1-Goskula
Raju, then he said that come to Peddapalli. On his words the A2-Dasari
Raju has went to Peddapalli and met the A1-Goskula Raju at Masjid area.
Later both are consumed toddy and decided to commit theft. With that both are moved on the A1-Goskula Raju bike HF deluxe blue color to
Palakurthi mandal, while they are rooming in the villages, they are found one house locked in the Bheemlanayak thanda. The A2-Dasari Raju & A1-

Goskula Raju are broken the house lock and committed theft of one pair gold ear rings and one pair silver pattilu. Later the A2-Dasaru Raju has kept the gold ear rings, the A1-Goskula Raju kept the silver pattilu and both are moved to Rachapalli village on bike. While they are roaming in the
Rachapalli village at about 14.00 they found one locked house, with that the A1-Goskula Raju has standing outside of the house by drinking beer and the A2-Dasari Raju has gained entry into the house by breaking the main door lock to commit theft. In the meantime the house owner came there with that the A1-Goskula Raju has fled from the scene along with his bike and the A2-Dasari Raju has hide behind the cot. The house owner has entered into the house, after sometime he has caught hold the A2-
Dasari Raju. Further the A2-Dasari Raju has showed the one pair of gold ear rings to the LW-11/S. Laxman, S.I, PS Dharamaram which was committed theft at Bamlanayak thanda of Palakurthi mandal. The LW- 11/S. Laxman, S.I, PS Dharamaram has seized the case property, from the
A1-Goskula Raju. After completion of confession and seizure pachanama of the A2-Dasari Raju, affected his arrest and complied the formalities of arrest as required U/s 47, 48 of BNSS and sent him to Medical officer for examination. The arrested A-2 was produced on 28.08.2024 in Cr.No.
168/2024, U/sec 331(3), 305 r/w 62 of BNS of PS Dharmaram before the
Hon’ble Judicial Magistrate of First Class at Nandimyadram and sent to
Judicial remand on the same day. Now the accused was lodged at District
Jail, Karimnagar.

2.6During the course of further investigation, Pw7 filed a requisition
before the II AddI. JMFC at Godavarikhani with a request to issue PT
warrant against the A2/Dasari Raju who is involved in this crime as A2 to produce him in this case as A2. The Pw7 received PT warrant against the accused from II Addl. JMFC at Godavarikhani with instructions to produce the A2 on or before the 17.09.2024 vide dis No. 738/2024, Dt. 05.09.2024.
The case property i.e Ear rings weighing about ½ thulas handed over to
SHO PS Basanthnagar from SHO Dharmaram. After completion of entire investigation Pw7 filed the charge sheet against the accused No.1 and 2.
3.Cognizance was taken under sections 331(3), 305 of BNS against accused No.1and 2 and issued summons to Accused No.1 and 2.
4.Copies furnished to the Accused No.1 and 2 as contemplated under
Sec. 230 of BNSS.
5.Accused No.1 and 2 were examined under section 262 of BNSS with reference to the accusation leveled against them and the same is read over and explained to them in their vernacular language, for which they pleaded not guilty and claimed to be tried. Heard. Charges framed.
6. In order to prove the case, the prosecution had examined PW1 and
PW7 and marked Ex.P1 to Ex.P5, MO:1 and MO:2. The evidence of
LW3/Daravath Shyamala Rani, LW5/Gugulothu Gattaiah, LW7/Ollepu
Kumar and LW9/Kamsani Yellaiah are given up by the learned APPO.
Further despite of conditional order passed by this court, the police

Basanthnagar not produced the Lw11/Sri. S. Laxman, S.I of Police, PS
Dharmaram, as such this court closed the evidence of Lw11.
7. After completion of the prosecution side evidence, on 13-12-2024 the accused No.1 and 2 were examined U/sec.351 of BNSS with reference to incriminating material found against them in the evidences of prosecution and the same is read over and explained to them in their vernacular language, for which they denied the same and reported no defense evidence.
8. Heard both sides.
9.Now the point that arises for determination is:-
“Whether evidence available on record sufficient to record a
conviction against the accused No.1 and 2 for the offence alleged
under sections 331(3), 305 of BNS beyond all reasonable doubts?
10. POINT:- 10.1 The PW1, who is complainant deposed that, at about two months back on one Friday at about 10.00 A.M she locked her house and she went to coolie work. At about 03.00 P.M, the Pw2 went to his home and found that the lock was broken and all the articles and all the clothes in the beeruva are in pelmell condition. Then Pw2 made a phone call to her and informed about the incident immediately she rushed to her home and she found that one (1) pair of gold ear rings weighing about 5 Grams and silver anklets weighing about 18 tulas, worth of Rs. 50,000/- are missing. In this regard, she lodged a report before the police. Police examined and recorded her statement.

10.2 The PW2, who is son in law of Pw1 deposed that, on 23-08-2024 at about 03.00 P.M he along with LW3/Daravath Shyamala Rani went to the house of Pw1 situated at Bamlanayak thanda and he found that house lock was broken and all the articles and clothes are in pelmell condition.
Immediately he made a call to PW1 when she reached the spot she found missing of 6 grams of 1 pair of gold ear rings and 18 tulas of silver anklets.
Later he made call to dial 100. Police came and later PW1 and he went to police station and lodged a report. Police examined and recorded his statement.
10.3. The PW3, who is panch witness for CDF deposed that, on 24-08- 2024 in between 08.30 to 09.30 AM Police Basanthnagar called him at
Bhamlanayak Thanda and conducted C.D.F panchanama in regard to thefting house of PW1.
Upon cross-examination of PW3 by the learned counsel for A1, it is elicited that the house of PW1 is slab house. He denied the suggestion that he do not know anything about the case but he is deposing false.
Upon cross-examination of PW3 by the learned counsel for A2, it is elicited that he is doing Agriculture work. He was at bridge and as police called him to the spot as such he went to the scene of offence and by that time when he reached to the scene of offence only police constable is present. There are surrounding houses near to the scene of offence. He

along with LW5/Gugulothu Gattaiah are present. He do not know contents of Ex.P2/C.D.F.
10.4. The PW4, who is panch witness for confession and recovery
panchanama of A2 in Cr.No. 168/2024 U/sec. 331 (3), 305 r/w 62 of
BNS of PS Dharmaram deposed that, on 23-08-2023 in between 09.30 to 10.00 P.M Police Basanthnagar called him at Dharmaram Police station and at that time Lw9/Kamsani Yellaiah is present along with police accused by name D. Raju was present. On request of police when in enquired with A2/D. Raju then he confessed the guiltiness by stating that he has committed theft of gold ear rings and silver anklets with another accused and that another accused was absconding. Then police seized the above said gold ear rings weighing about 500 grms in his presence and obtained his signature.
Upon cross-examination of PW4, it was elicited that he is doing
Agriculture. He is resident of Dharmaram village. He is working in congress party. Police called him in between 09.30 P.M to 10.00 P.M and at that time he was on the way to his home from his Agriculture field. His phone number was already with the police. Prior to this previously police called him to P.S. He do not have previous acquaintance with Accused
No.2/D. Raju.
Pw4 denied the suggestion that he is working in the congress party and he used to visit police station frequently and he has signed over

panchanama but he do not know the contents of the pachanama and he is deposing false. He further denied the suggestion that nothing was seized in his presence by the police.
10.5. The PW5, who is panch witness for confession and recovery panchanama deposed that, on 28-08-2024 while he along with
LW7/Ollepu Kumar reached to Dharmaram X-road at about 11.00 A.M.
then police called them and asked them to enquire with the accused by name Gasarla Raju. Then accused stated that he is doing coolie work and he addicted to alcohol and he committed theft at various places
Dharmaram, Manthani and Karimnagar. He also stated that he committed thefts at various places by using H.F Delux Motor Cycle. Later police took away the accused.
Upon cross-examination of PW5 by the learned counsel for A1, it was elicited that, he admitted that as police called him to the spot as such he went to the spot and he signed at request of the police. He do not know personally about the case of A1 at Dharmaram Manthani and Karimnagar. He denied the suggestion that the police not conducted any panchanama in his presence but he is deposing false.
Upon cross-examination of PW5 by the learned counsel for A2, it was elicited that, police not seized H.F Delux Bike in his presence and police also not shown the H.F Delux Bike to him. He do not know about this case and he do not know contents of the confession and recovery panchanama of A1 and

he have signed over panchanama of A1 at the instance of police. He denied the suggestion that he is deposing false at the instance of police.
10.6. The PW6, who is first investigating officer and issued FIR deposed that, on 24-08-2024 at about 0730 Hours he received complaint/Ex.P1 from
PW1. Basing on the record, he registered a case in crime No. 163 of 2024 u/sec. 331(3), 305 BNS 2023 and he issued F.I.R. During the course of investigation he examined and recorded statement of PW1 and later visited the scene of offence and secure the presence of PW3 and LW5/Gugulothu
Gattaiah and conducted scene of offence panchanama and draw the rough sketch in their presence. Later examined recorded the statement of PW2 and
Lw3/Daravath Shyamala Rani. Later handed over the C.D file to Pw7.
Upon cross-examination of PW6, it was elicited that, the incident was occurred on 23-08-2024 at about 1600 hours. The distance between police station Basanthnagar and scene of offence is about 5 KM. no dial 100 call received with regard to commission of theft in this crime. He do not know that whether PW2 made call to dial 100. On 24-08-2024 he visited the scene of offence at 11.30 A.M. He has taken two punch witnesses for scene of offense panchanama in the village itself. At the time of conducting scene of offense panchanama he along with PW3 and LW5/Gugulothu Gattaiah (only 3 persons including him) are present. There are so many houses around the scene of offense house.
He denied the suggestion that on 23-08-2024 he received information

from dial 100 and he visited the scene of offence. He further denied the suggestion that he has not visited the scene of offence and he never conducted scene of offense panchanama but he is deposing false. He further denied the suggestion that he never went to the scene of offense but he sent his subordinate constables to the scene of offence. He further denied the suggestion that he went to the scene of offence he sent his constables to the scene of offense and the same is stated by PW3 in his chief examination. He denied the suggestion that he do not know about this case and he done table investigation in this case.
10.7. The PW7/ who is second investigating officer and filed charge sheet deposed that, on 28-10-2024 took up the investigation of this case from
PW6 and verified the facts of the case and found it to be correct lines. During the course of investigation, on credible information about the presence of suspected person he along with party apprehended accused at Dharmaram
X-road G.D nagar village secure the presence in the presence of PW5 and
LW7/Ollepu Kumar. On interrogation the accused revealed his name as
G.Raju and he voluntarily confessed to have committed the offence in this case along with another accused by name D. Raju. he has conducted confession and seizure panchanama of A1 and seized silver leg chain weighing up to 20 tulas and also the H.F Deluxe Motor cycle Bearing No. TS 25 B 9967 and brought the accused to P.S Basanthnagar and on the same day he served the notice u/sec. 35 (3) BNSS to the A1. On the same day he has arrested the A1 and send to the Government hospital and accordingly

collected medical certificate from medical officer Government hospital at
Godavarikhani and the produced the Accused No.1 before this court. Later he filed a requisition before this court with request to is P.T warrant against accused D. Raju and accordingly, as per the court order have produced the
Accused No.2 before this court along with his confessed case property. After completion of the investigation he filed charge sheet u/sec. 331 (3) 305 of BNS 2023 against A1 and A2.
Upon cross-examination of PW7 by the learned counsel for the A2, on 28-08-2024 he took up the investigation in this case. As per the investigation done by LW10 and on going to the C.D file he came to a conclusion that the investigation done by LW10 was in proper lines. As per the record On 24-08- 2024 at 07.30 hours LW10 received the petition and registered the F.I.R. He do not know and he do not remember that whether they received dial 100 call or not. As complainant not mentioned in the petition that he made a call to dial 100 as such he has not mentioned the same in his charge sheet. He has conducted panchanama of A1 at Dharmaram X-road. He has seized H.F
Deluxe by conducting confession and seizure panchanama in the presence of
PW5 and LW7/Ollepu Kumar at Dhrarmaram X-road he has shown H.F
Deluxe bike to the panch witnesses. He read over contents of confession and seizure panchanama of A1 to panch witnesses i.e.. PW5 and LW7/Ollepu
Kumar.
He denied the suggestion that the PW2 made a call to dial 100 and his subordinates went to the spot but he has not mentioned in his charge sheet.

He denied the suggestion that Pw5 deposed before this court that police not seized HF delux bike in his presence and police also not shown the H.F
Deluxe bike to him. He further deniedthe suggestion that he has done table investigation in this case and he do not know about this case. He further denied the suggestion that A1 and A2 are no way concerned with the case but he has falsely implicated them.
11.The case of the prosecution in nutshell that, on 23-08-2024
Pw1/complainant locked her house and went to coolie work but at about 03.00 PM the Pw2 who is son in law of Pw1 informed to Pw1 through phone call that all the household articles are in pelmel condition. Immediately Pw1 came to her house and found that (1). Gold ear studs ½ thula, (2) Silver leg chain -20 thulas (1 pair), (3) One silver bracelet weighing about 5 thulas are missing and some unknown offender committed the theft of the same.
12.The evidence of Pw1/complainant and Pw2/son in law of complainant
before this court discloses commission of offence by unknown offender and
their evidence does not discloses that “one silver bracelet-5 thulas is missing from the Beeruva of Pw1. Hence, there is a omission of one of the stolen item.
13.The Pw3, who is one of panch witness for the scene of offence panchanama admitted that he do not know contents of the panchanama and though there are surrounding houses to the house of Pw1/complainant but police particularly called him to the scene of offence.
14.The Pw4, who is panch witness for confession and recovery

panchanama of A2 deposed that on 23-08-2023 Police Basanthnagar called him at PS Dharmaram and conducted confession and recovery panchanama of A1 and seized gold ear ring in his presence.
The date of offence is 23-08-2024.
The date of conducting confession panchanama as per Pw4
before this court is 23-08-2023.
Hence, the above is serious contradiction and which is going against to the prosecution case. Further Pw4 not stated that about location of offence i.e., Bamlanayak thanda. The prosecution given up the evidence of another panch witness for confession and recovery panchanama of A2 i.e.,
Lw9/Kamsani Yellaiah. Further as per the contents of confession and recovery panchanama of A2 it reveals that police Dharmaram called Pw4 and Lw9 to PS Dharmaram for conducting confession and recovery panchanama of A2 but not police Basanthnagar. In view of the above serious contradition this court is of the view that confession and recovery panchanama of A2 is not proved to the satisfaction of this court in accordance with law.
15.The Pw5, who is panch witness for confession and recovery panchanama of A1 in his evidence not stated about place of occurrence of offence i.e., Bamlanayak Thanda and not stated about commission of theft in this crime and also not stated about any seizure or recovery from the possession of A1. During the course of cross examination of Pw5 admitted

that he do not know about this case and contents of confession and recovery panchanama of A1 and police not seized HF delux bike in his presence and police not shown the bike to him. The prosecution not examined another panch witness for confession and recovery panchanama of A1 i.e., Lw7/Ollepu Kumar. Hence, confession and recovery panchanama of A1 is not proved in accordance with law.
16.The Pw2 deposed that, on the date of alleged incident itself he made a dial 100 call to the police, but Pw6/ASI he stated that he had not received any dial 100 call with regard to the commission of theft in this crime. The prosecution not examined Lw11/S. Laxman, S.I of Police, PS
Dharmaram.
17.To sum up, there are several contradictions, omissions and infirmities over the evidences of prosecution witnesses. It is cardinal principle of criminal law jurisprudence that penal laws shall be construed strictly. The burden lies on the prosecution to prove the guilt of the accused beyond all reasonable doubts. In the instant case the prosecution failed to prove guilt of accused persons beyond all reasonable doubts.
Therefore, in view of the above said reasoning this court is of the view that the material placed by the prosecution is not sufficient to record a conviction beyond all reasonable doubts. Hence, A1 and A2 are entitled for benefit of doubt.
18. I N THE RESULT, Accused No.1 and 2 are found not guilty for the

offence punishable under sections 331 (3) and 305 of BNS. Accordingly, accused No.1 and 2 are acquitted under section 271 (1) of BNSS for the offence punishable under sections 331 (3) and 305 of BNS. The bail bonds of the accused No.1 and 2 if any, shall stands cancelled after expiry of the appeal time. The case property which was already handed over to the defacto complainant vide Crl.M.P No. 524/2024
dt. 08-10-2024 shall be made absolute after expiry of appeal time.
