This petition coming before me on 06.05.2026 for final hearing in the presence of M/s.Sai Kiran, Counsel for the Petitioner/Accused No.1 and the learned Addl.Public Prosecutor for the Respondent/Complainant and upon hearing both sides, and on perusal of the material on record and the matter having stood over for consideration till this day, this Court made the following—
O R D E R
This is a first bail application filed by the petitioner/accused No.1 under Section 483 of BNSS in Crime No.722 of 2026 for the offence under Section 8(c) read with 20(b)(ii)(B) of the NDPS Act, 1985. The
Petitioner is in judicial custody since 24-04-2026.

2. The learned counsel for the petitioner/Accused No.1 contended that a false case has been foisted against the petitioner; that he is innocent and has no connection with the alleged offence; and the entire case of the prosecution is based on suspicion and conjectures and stringent conditions for grant of bail as stipulated under Section 37 of
NDPS Act is not applicable as the quantity of Ganja allegedly seized from his possession is intermediate and not commercial quantity and he is sole bread winner of his family. It is also contended that the substantial part of the investigation has already been completed and, therefore, there is no likelihood of tampering with evidence. Hence, he prayed that the petitioner be enlarged on bail.
3. The learned Additional Public Prosecutor filed Counter denying the averments made in the petition and contended that the offence alleged against the accused is grave in nature. It is submitted that the accused illegally transported Ganja from Uttar Dinajpur District, West Bengal, to
Hyderabad and kept the same in his possession for the purpose of sale, thereby involving himself in the illegal transportation, possession, and sale of contraband. It is further contended that, if the accused is released on bail, there is every likelihood of his committing similar offences, not cooperating with the investigating agency and tampering with the evidence. It is also submitted that accused No.2 is still absconding, and if the present accused is enlarged on bail, it would become difficult for the police to apprehend accused No.2. Hence, he prayed for dismissal of the petition.
4.Heard both sides. Perused the record.
5.Now, the point for consideration is whether the petitioner/accused
No.1 is entitled for bail?

6.POINT: – A perusal of the record goes to show that the allegation against the petitioner/accused No.1 is that he illegally transported 1.523
Kgs of Ganja from Uttar Dinajpur District, West Bengal, to Hyderabad for the purpose of sale. Though the quantity allegedly seized is intermediate quantity and the rigours under Section 37 of the NDPS Act are not attracted, the investigation is still in progress and accused No.2 is yet to be apprehended. At this stage, if the petitioner is enlarged on bail, there is every possibility of hampering the investigation and it may become difficult for the police to apprehend the absconding accused No.2.
Further, considering the nature and gravity of the allegations, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, the point is answered against the petitioner.
7.In the result, the petition is dismissed.
