ORDER

The Plaintiffs and first defendant are sisters and brother and they are present. The defendants Nos. 2 to 28 are tenants of the suit schedule property and they are set exaparte. The plaintiffs filed a suit for partition of suit schedule properties. The plaintiffs and the first defendant filed a petition on that under order 23 rule 3 of Civil Procedure Code and prays that to pass a preliminary decree according to terms of compromise with out costs and the same was allowed. The terms and conditions are as fallows (a) Both the parties are agreed to pass a preliminary decree for partition of the suit schedule properties which is total extent of Ac.69.15 gts equal to 2766 gts in to 5 equal shares according to terms of the plaint, allotting Ac.13.11 gts to the each of the plaintiff total come to for plaintiffs an extent of 2212.8 gts equal to Ac.55.32 gts, and to allot an extent of 553.2 gts equal to Ac.13.11 gts of land to the first defendant. Both parties are agreed to obtain final decree as per the law. On filing separate application.

(b) Both parties are agreed to bare their own costs. (c) Hence the both parties are prayed that the Honble court may be pleased to pass a preliminary decree according to terms of compromise without costs. In the result suit is decreed a preliminary decree is passed for partition and separate possession of suit schedule property. The plaintiffs Nos. 1 to 4 and first defendant are entitled to 1/5th share each in the suit schedule property i.e. as per the terms and condition of compromise between the parties. In the circumstances no costs. The final decree should be passed on a separate application.

ORDER

Orders pronounced in the open court, (VSO) In the result, the petition is allowed by granting compensation of Rs.10,33,900/- with interest at 7.5 percentage per annum from the date of the petition to till the date of deposit with costs. The respondents 1 and 2 are jointly and severally liable to pay compensation to the claim petitioners. Time for deposit is one month. The first claim petitioner is entitled an amount of Rs.5,33,900/-, the minor claim petitioners 2 and 3 are entitled Rs.2,00,000/- each and the claim petitioner 4 is entitled Rs.1,00,000/- each. On such deposit, the first claim petitioner is permitted to withdraw an amount of Rs.3,00,000/- and the balance amount shall be invested in fixed deposit in any Nationalized Bank for a period of two years and after maturity she is permitted to withdraw the entire amount at a time. The claim petitioners 2 to 4 are permitted to withdraw their respective shares at a time with accurred interest and costs. The claim petitioners are directed to pay the deficit Court fee within 10 days from the date of this order. The office is directed to prepare the decree after payment of deficit Court fee only.
