Case against A4 is discharged. 

This Appeal is coming on 21.03.2022 before me for final hearing in the presence of Sri. Ch. Jangaiah, Advocate for the Appellant/A1 and of Sri. M. Ganga Reddy, Additional Public Prosecutor for State and upon perusal of the material papers on record and the case having been heard and stood over for 2 of 12 Criminal Appeal No. 626 of 2016 consideration till this day, this court delivered the following judgment:

J U D G M E N T 

1.This is an appeal filed by the appellant/A1 under Section 374 (3) (a) of 

Cr.P.C assailing the impugned judgment of conviction dated 22.07.2016 in CC 

No. 323 of 2012 passed by the learned IV Metropolitan Magistrate, Cyberabad at LB Nagar, RR District whereby and where under the appellant/A1 is convicted for the offence under Section 498­A of IPC and he is sentenced to undergo Rigorous Imprisonment for a period of One Year and to pay fine of 

Rs.100/­ with default clause. 

2.The parties hereinafter referred to as arrayed in the charge sheet for convenience and brevity. 

3.The State represented by Sub Inspector of Police, PS Ibrahimpatnam has filed charge sheet in Crime No. 149 of 2012 of PS Ibrahimpatnam against A1 to 

A4 for the offences under Sections 498­A and 497 of IPC. 

4.The learned IV Metropolitan Magistrate, Cyberabad at LB Nagar taken cognizance of the case against the accused for the offences under Sections 498­

A and 497 of IPC. 

5.On appearance of the accused persons, copies of the documents were furnished to them as required under Section 207 of Cr.P.C. The record reveals that A1 to A3 were discharged for the offence under Section 497 of IPC against 

A4 was discharged under Section 239 of Cr.P.C. Thereafter, the accused 1 to 3 were examined under Section 239 of Cr.P.C by explaining the accusation levelled gainst them and a charge for the offence under Section 498­A of IPC 3 of 12 Criminal Appeal No. 626 of 2016 has been framed, read over and explained to them. A1 to A3 pleaded not guilty and claimed to be tried. 

6.During the course of trial, P.Ws­1 to 7 were examined and Ex.P­1 to P­4 were marked on behalf of the prosecution. After closure of the prosecution evidence, the accused 1 to 3 were examined under Section 313 Cr.P.C by explaining the incriminating evidence available against them, for which, they denied the same and reported no defence evidence on their behalf. 

7.After hearing arguments and assessing the material placed before the trial court, A2 and A3 were acquitted for the offence under Section 498­A of 

IPC. However, A1 was found guilty for the offence under Section 498­A of IPC and accordingly he was convicted and sentenced as indicated above. 

8.Feeling aggrieved by the impugned judgment of conviction, the unsuccessful accused No. 1 constrained to file the present appeal on the following grounds:

1) The judgment passed by the learned Magistrate is contrary to law, against weight of evidence and probabilities of the case.

2) The learned Magistrate mechanically accepted the case without legal appraisal and logical deductions.

3) The trial court convicted the appellant basing on the evidence of interested witnesses ie., P.Ws­1 to 4. 

4) The trial court failed to see that P.Ws­5 and 6 turned hostile who are independent witnesses. 

5) The trial court has not taken into consideration that entire evidence on record is contrary to statement under Section 161 of

Cr.P.C and entire evidence is improvements.

6) The learned Magistrate failed to see that the prosecution miserably failed to prove the guilt of the appellant for the offence under Section 498­A of IPC. 

Hence, the appellant/A1 therefore, prayed to allow the appeals and set aside the impugned judgment passed by the learned IV Metropolitan 

Magistrate, RR District, LB Nagar in CC No. 323 of 2012 dated 22.07.2016 

and acquit the appellant/A1 for the charges levelled against him in the interest of justice. 

9.Heard arguments from both sides. 

10.Now the points for consideration in this appeal are:

1) Whether the prosecution is able to bring home the guilt of the appellant/accused No. 1 for the offence under Sections 498 of IPC beyond all reasonable doubt?

2) Whether the impugned judgment passed by the trial court is liable to be set aside?

3) To what relief?

11.POINT Nos. 1 and 2:Both the points 1 and 2 are interrelated with each other, as such, both the points have been taken up together for convenience. 

To substantiate the case of the prosecution, as many as seven witnesses are examined on behalf of the prosecution. P.W­1 is the de facto complainant and victim. P.W­2 is son of P.W­1. P.W­3 is brother of the victim. P.Ws­4 to 6 are independent witnesses and P.W­7 is the investigating officer.

12.The story of the prosecution as unfolded by the testimony of prosecution witnesses in brief is as under:

P.W­1 is the de facto complainant and she set the criminal law into motion by lodging Ex.P­1 report before the Police on 18.04.2012. P.W­1 deposed that she is resident of Cherlapatelguda Village. Her marriage with 

A1 taken place about 29 years ago, who is her maternal aunt's son. They lead marital life happily for 22 years. Out of wedlock, they blessed with a son and two daughters. After five years of her marriage, her parents presented 2 acres of land to her on her name. After marriage of her elder daughter, A1 started harassing her to sell the land given by her parents and give the amount to him. When she refused for the same, he started coming home once in a while and thereafter, she came to know that A1 is residing with another woman, who is a widow and leading marital life as wife and husband near Andhra Bank, Yamjal. Immediately, she rushed there and found A1 and another woman in the house. Both A1 and the said woman beat her indiscriminately and left the place. On receiving information, her son came and took her to hospital. Though her husband harassed now and then on petty reasons after the birth of her son, ie., after two years of her marriage, she did not complain against him. Thereafter, one Bikshapathi who is a worker in rice mill came to their house and convinced her stating that A1 would never repeat such harassment and left A1 in their house, but again after half an hour, A1 left the house and did not come to home for about one year. Thereafter, on one day, her husband returned home keeping the above said woman in the house of A2 and went to their house on the 6 of 12 Criminal Appeal No. 626 of 2016 same night. Out of suspicion, she went there and found both of them together and A2 along with her son were sleeping in another room. When she questioned the same, all of them beat her and A1 left the place and again after three years A1 returned home on 17.04.2012 and tried to take all her “pattau sarees” in a bag for giving to that woman by name Vijaya. When she resisted him, he beat her mercilessly and left her. Three days prior to that incident, she went to the house of A2 and A3 and requested them to tell the whereabouts of A1, but they abused her and stated that A1 can live with any woman as he wanted. After the said incident on 17.04.2012, A2 and A3 beat her when she questioned them about their support to A1. Her son took her to hospital for treatment and she lodged complaint at 

Ibrahimpatnam Police Station under Ex.P­1. 

13. The cross­examination of P.W­1 goes to show that, she admits that she did not mention either in Ex.P­1 or in her statement before the police that A1 is residing with another woman who is a widow and leading marital life as wife and husband near Andhra Bank, Yamjal and immediately she rushed there, found both in the house and they beat her indiscriminately and left the place and that she did not mention in Ex.P­1 that A1 used to harass her on petty issues after the birth of their son and that she did not mention in Ex.P­1 that one Bikshapathi who is a worker in the rice mill came to their house and convinced her stating that A1 would never repeat such harassment and left A1 in their house, but again after half an hour, 

A1 left the house and did not come to home for about one year and that she did not mention either in Ex.P­1 or in her statement that one day, her 7 of 12 Criminal Appeal No. 626 of 2016 husband returned home keeping the above said woman in the house of A2 and went to their house on the same day night and on suspicion, she went there and found both of them together and A2 alogn with her son were sleeping in another room and that she questioned the same and all of them beat her and A1 left the place. These statements are improvised statements, since P.W­1 neither stated the said facts in Ex.P­1 nor in her statement recorded by the police under Section 161 of Cr.P.C during the course of investigation. It is elicited from P.W­1 that since seven years A1 is not residing with her.

14.The contents of Ex.P­1 report lodged by P.W­1 before the police would reveal that “on 17.04.2012 at 7­00 am her husband came to their house and tried to take all her silk sarees in order to give the same to a woman with whom her husband is having illegal intimacy. When she resisted her husband, he abused her and beat her with hands and kicked with legs.” 

She further stated that previously A2 and A3 beat her when she questioned them about illegal intimacy of her husband with another woman. She further stated that her husband is harassing her to sell the land given by her parents and give to him and that her husband is giving his salary to that woman. Hence, she requested to take action against her husband. 

15.The FIR was registered on 18.04.2012 and prior to that A1 was not residing with P.W­1 since seven years. Basing on Ex.P­1, L.W­8 (Ch. Vijaya 

Rao), ACP, Ibrahimpatnam has registered a case in Crime No. 149 of 2012 under Section 498­A of IPC and issued FIR under Ex.P­4 and entrusted the investigation to P.W­7. During the course of investigation, P.W­7 examined 8 of 12 Criminal Appeal No. 626 of 2016 and recorded the statement of P.Ws­1 to 6 and also L.W­3 (A. Mallesh). On 21.04.2012, he arrested A1 and produced him before the court for judicial remand. Subsequently, on 25.04.2012, A2 to A3 surrendered before the court and they were released on bail. On completion of investigation, he filed charge sheet.

16.P.W­2 is none other than the son of P.W­1. He stated that A1 is his father and A2 and A3 are sisters of A1. According to him on 17.04.2012 at about 6­30 or 7­30 am, A1 came and tried to take away “pattu sareess” of 

P.W­1 from almirah to give the same to the woman with whom he has illegal intimacy. P.W­1 tried to stop him, but A1 abused his mother and beat her with hands and also kicked her with legs recklessly and went way. Then, he took his mother to Government Hospital, Ibrahimpatnam for treatment. 

Here it is important to mention that P.W­2 did not depose the alleged illegal intimacy of A1 with another woman namely Vijayamma as deposed by P.W1. 

This evidence of P.W­1 is not corroborated. On the other hand, the evidence of P.W­1 is contrary to the material particulars. 

17.P.W­3 is none other than the elder brother of P.W­1. According to him, after marriage P.W­1 joined her matrimonial home at Cherlapatelguda and lead happy marital life for about 15 years. Thereafter, A1 started neglecting 

P.W­1 by not coming to the house regularly and he used to come to the house once in a week. He was informed by P.W­1 that A1 developed illegal intimacy with one Laxmi and started residing with her. But according to prosecution it is one Vijayamma. Any how, this portion of evidence is only hear say evidence and cannot be acted upon. Whenever P.W­1 questioned 9 of 12 Criminal Appeal No. 626 of 2016 about the same, A1 used to beat her and thereby harassed her physically and mentally. They also convened panchayat in the presence of elders and the elders also advised him to mend his behaviour, but he did not change. 

He also deposed with regard to the alleged incident that had taken place on 17.04.2012 in the house of P.W­1. P.W­3 in his cross­examination could not say the names of elders. P.W­3 denies that P.W­1 is an arrogant lady and always pick up quarrel and on one occasion, she picked up quarrel with the counsel for the accused in his office, due to which a case was registered against P.W­1 and her son vide CC No. 269 of 2014 and the same is pending. He admits that A1 is not residing in Cgherlapatelguda Village. He does not know whether P.W­1 fled another case against A1 vide CC No. 360 of 2015. 

18.P.W­4 is resident of Chowdarpally Village. According to him, P.W­1 and A1 lead happy marital life for about 10 Years and blessed with three children during their wedlock. In the year 1995, while he was Sarpanch of 

Chowdarpally Village, a panchayat was held in a school at Ibrahimpatnam with regard to illicit relationship of A1 with another woman, and they advised A1 to change his behaviour and lookafter P.W­1 well, but he did not heed their words. He further deposed that again in the year 2012, they held another panchayat at Patelguda Village, with regard to same issue and also for the maintenance of P.W­1, but A1 did not change his attitude and subsequently, P.W­1 lodged complaint. During the cross­examination he denies that he did not state before the police that a panchayat was conveved while he was Sarpanch of the Village. A perusal of the statement of P.W­4 recorded by the police under Section 161 Cr.P.C, did not reveal about 10 of 12 Criminal Appeal No. 626 of 2016 holding panchayat either in 1995 or in 2012. Therefore, it is crystal clear that the evidence of P.W­4 is an improvised version. 

19. P.Ws­5 and 6 who are independent witnesses did not support the prosecution case and they denies the suggestion of the learned Assistant 

Public Prosecutor that they have stated before the police as in Ex.P­2 and P­ 3 ie., portion of their statements recorded under Section 161 of Cr.P.C.

20.In this case, P.Ws­1 to 3 are blood relatives and interested witnesses. 

Though P.W­4 is an eye witness, but his evidence is an improvised version. 

Therefore, his version is not believable. Except the evidence of P.W­1, there is no other evidence to support her version. Further, it is elicited from her cross­examination and as discussed above, the major portion of chief examination of P.W­1 is an improvised version, since the said facts were neither stated in Ex.P­1 nor in her statement recorded under Section 161 of 

Cr.P.C. Though P.W­1 stated that she sustained injuries and her son P.W­2 had taken her to the hospital for treatment, but no medical record is produced. Further, the police also neither seized the alleged silk sarees of 

P.W­1 allegedly taken by A1 nor conducted any panchanama in this regard. 

21.For commission of offence under Section 498­A of IPC, the the following necessary ingredients required to be satisfied:

a) The woman must be married;

b) She must be subjected to cruelty or harassment;

c) Such cruelty or harassment must be shown either by husband of the woman or by the relative of her husband (U. Suvetha vs State, (2009) 6 

SCC 757).

22.Every harassment does not amount to "cruelty" within the meaning of 

Section 498­A I.P.C. For the purpose of Section 498­A I.P.C. harassment simpliciter is not "cruelty" and it is only when harassment is committed for the purpose of coercing a woman or any other person related to her to meet an unlawful demand for property etc., that it amounts to "cruelty" punishable under Section 498­AI.P.C, (State of AP vs M. Madhusudhan 

Rao, (2008) 15 SCC 582)

23.Cruelty can either be mental or physical. It is difficult to straight jacket the term cruelty by means of a definition, because cruelty is a relative term. What constitutes cruelty for one person may not constitute cruelty for another person. (GV Siddaramesh vs State of Karnataka, 2010 (3) SCC 152)

24.The concept of cruelty and its effect varies from individual to individual also depending upon the social and economic status to which such person belongs. "Cruelty" for the purposes of constituting the offence under the aforesaid section need not be physical. Even mental torture or abnormal behaviour may amount to cruelty and harassment in a given case. 

(Gannath Pattnaik vs State of Orissa, (2002) (2) SCC 619)

25.Proof of the willful conduct actuating the woman to commit suicide or to cause grave injury or danger to life, limb or health, whether mental of physical, is the sine qua non for entering a finding of cruelty against the person charged. (Gurucharan Singh vs State of Punjab, (2017) 1 SCC 433).

26.As discussed above the entire evidence of P.W­1 is an improvised version and not supported either by her son P.W­2 or other P.Ws­3 to. 6. On careful scrutiny of the evidence available on record, this court is of the 12 of 12 Criminal Appeal No. 626 of 2016 considered opinion that the ingredients of Section 498­A of IPC are not proved beyond reasonable doubt. Thus, this court has no hesitation to hold that the prosecution has failed to prove the guilt of the accused for the offence under Section 498­A of IPC. 

27.I have carefully scrutinized the impugned judgment of conviction passed by the trial court and found that the trial court erred in believing the version of P.W­1 and came to a wrong conclusion and gave finding erroneously that the prosecution has proved its case against A1 for the offene under Section 498­A of IPC. For the reasons stated above and in view of the case law referred above, this court is of the considered opinion that the impugned judgment passed by the trail court is liable to be set aside. 

Accordingly these points are answered. 

28.Point No. 3:

As a result, appeal is allowed. The impugned judgment of conviction 

dated 22.07.2016 in CC No. 323 of 2012 passed by the learned IV

Metropolitan Magistrate, Ibrahimpatnam, Cyberabad is set aside. 

Consequently, the appellant/A1 is acquitted for the offence under Section 498­A of IPC and he is set at liberty. The bail bonds of the appellant/A1 if any shall stand cancelled after expiry of revision time. The fine amount if any paid shall be returned to the appellant/A1 after expiry of revision period.

J U D G M E N T 

1.This is an appeal filed by the appellant/A2 under Section 374 (3) (a) of 

Cr.P.C challenging the impugned judgment of conviction in CC No. 165 of 2011 

dated 27.12.2016 passed by the learned III Metropolitan Magistrate, Cyberabad 

at LB Nagar, RR District whereby and where under the appellant/A2 herein was convicted for the offence under Section 423 of IPC and sentenced to undergo simple imprisonment for a period of one year and further sentenced to undergo simple imprisonment for one year for the offence under Section 464 of 

IPC. 

2.The parties hereinafter referred to as arrayed in the charge sheet for convenience and brevity. 

3.The State represented by Sub Inspector of Police, PS Medipally has filed charge sheet in Crime No. 755 of 2009 of PS Medipally against A1 and A2 for the offences punishable under Sections 418, 420, 423, 424, 464, 120­B read with 34 of IPC. 

4.The learned III Metropolitan Magistrate, Cyberabad at LB Nagar has taken cognizance of the case against A1 and A2 for the offences under 

Sections 418, 420, 423, 424, 464, 120­B read with 34 of IPC. 

5.The case against A1 was ended in acquittal in main CC No. 248 of 2010. 

The case against appellant/A2 herein was split up vide CC No. 165 of 2011. 

Now the present case is against the appellant/A2 only. 

6.After following due procedure, A2 was examined under Section 239 of 

Cr.P.C by the trial court and charges for the offences under Sections 418, 420, 3 of 12 Criminal Appeal No. 30 of 2017 423, 424, 464, 120­B read with 34 of IPC were framed against him, the contents of the charges were read over and explained to the accused No. 2, for which he pleaded not guilty and claimed to be tried. 

7.During the course of trial, P.Ws­1 to 5 were examined and Ex.P­1 to P­7 were marked on behalf of the prosecution. 

8.After closure of the prosecution evidence, the appellant/A2 was examined under Section 313 Cr.P.C by explaining the incriminating evidence appearing against him, for which he denied the same and reported no defence evidence on his behalf. 

9.After hearing arguments and assessing the material placed before the trial court, the impugned judgment was passed holding that the A2 is found not guilty for the offences under Sections 418, 420, 424 and 120­B of IPC and accordingly he was acquitted for the said offences under Section 248 (1) of 

Cr.P.C. However, A2 was found guilty for the offences punishable under Section 423 and 464 of IPC and accordingly he was sentenced as indicated above. 

10.Feeling aggrieved by the impugned judgment of conviction passed by the trial court, the appellant/A2 constrained to file the present appeal on the following grounds:

1) The judgment passed by the learned Magistrate is contrary to law, against the probabilities of the case and against weight of evidence. .

2) The learned Magistrate mechanically accepted the prosecution case without critical appraisal of the evidence and logical deductions.

3) The learned Magistrate ought to have seen that the prosecution has not established the charges under Sections 423 and 464 of IPC. 

4) The learned Magistrate ought to have seen that the appellant has not executed any document in favour of P.W­1, much less the false document, as such, the ingredients of either Section 423 of 464 of

IPC are not constituted. 

5) The learned Magistrate ought to have seen that to constitute an offence under section 464 and 423 of iPC, the appellant must have executed a false document infavour of P.W­1 and executed a false document of transfer dishonestly and fraudulently and further to constitute an offence under Section 464 of IPC that the appellant must have made a false document. 

6) The learned Magistrate ought to have seen that to constitute the offence under Section 464 of IPC, the appellant must have made a false document, but no false document was executed by the appellant in favour of P.Ws­1 and 2. 

7) The learned Magistrate ought to have seen that the appellant has not executed any document in favour of P.W­1, the document which is executed infavour of P.W­1 was by accused No. 1.

8) The learned Magistrate ought to have seen that theappellant is not a party to the sale deed executed in favour of P.W­1 by L.W­2. 

9) The learned Magistrate have placed reliance on Ex.P­6 telegram alleged to have been given to the appellant by L.W­2, but theprosecution have not filed any acknowledgment showing that the telegram was received by the appellant and the prosecution also not examined any one from Telegram Department.

10) The learned Magistrate ought to have seen that the telegram purported to have sent by L.W­2 to the appellant, but the prosecution has not examined L.W­2. Mere marking of documents does not  5 of 12 Criminal Appeal No. 30 of 2017 dispense with content of document, unless the author of the document is examined. 

11) The learned Magistrate ought to have seen that the prosecution witnesses are inconsistency on material particulars and lacks of credence. 

Hence, the appellant/A2 therefore, prayed to set aside the impugned judgment passed by the learned III Metropolitan Magistrate, RR District, LB 

Nagar in CC No. 165 of 2011 dated 27.12.2016 and acquit the appellant/A2 for the charges levelled against her in the interest of justice. 

11.Heard arguments from both sides. 

12.Now the points for consideration in this appeal are:

1) Whether the prosecution has proved its case against the appellant/A2 for the charges levelled against him beyond all reasonable doubt?

2) Whether the impugned judgment passed by the trial court is liable to be set aside?

3) To what relief?

13.POINT Nos. 1 and 2:Both the points 1 and 2 are interrelated with each other, as such, both the points have been taken up together for convenience. 

In order to substantiate the case of the prosecution, the prosecution has examined as many as five witnesses and relied on documentary evidence under Ex.P­1 to P­7. P.W1 is the de facto complainant, P.Ws­2 to 4 are alleged eye witnesses and P.W­5 is the investigating officer.

14.The story of the prosecution as unfolded by the testimony of prosecution witnesses in brief is as under:

P.W­1 (Satyanarayana Agarwal) is the de facto complainant. His evidence shows that he purchased the Plot No. 43 in Survey No. 119 to 126 admeasuring 146 square yards from P.W­2 in 2005 situated at Boduppal 

Village, Ghatkesar Mandal, Ranga Reddy District. His vendor ie., P.W2 in turn purchased the said plot from accused No. 1. The present accused No. 2 is mediator to the transactions between P.W­2 and A1. In the year 2006, 

P.W­1 went to his plot and found that some constructions were going on. So he approached the Sub Registrar, Uppal and IG Stams and Registration for cancellation of the second registration. He came to know that A1 sold the said plot to Krishna Kishore (GPA) ie., A2 herein. They colluded with each other and sold way to one Simhadri through A2 knowing that the said plot was already purchased by P.W­1. Though P.W­1 purchased in the year 2005, subsequently, all the accused colluded with each other and transferred the said property in 2006. Hence, he lodged a complaint against the accused under Ex.P­1. Ex.P­2 is copy of sale deed bearing document No. 11271 of 2003 dated 30.08.2003 which was executed by A1 in favour of P.W­2 in respect of plot bearing No. 43 in Survey Nos. 119, 121, 124, 125, 126/A, 126/AA, 128 and 129 of Sri Sai Enclave admeasuring 140 square yards situated at Boduppal Village and Grampanchayat, Ghatkesar Mandal, RR 

District. Ex.P­3 is copy of sale deed bearing document No. 13067 of 2005 

dated 20.12.2005 executed by P.W­2 in favour of P.W­1 in respect of the 

above property. Ex.P­4 is copy of agreement of sale­cum­GPA with 7 of 12 Criminal Appeal No. 30 of 2017 possession bearing document No. 15260 of 2006 dated 16.10.2006 executed by A1 in favour of A2 herein in respect of vast extent of land admeasuring 4031 square yards including the above said plot No. 43 purchased by P.W­1. 

Ex.P­5 is copy of sale deed bearing document No. 7477 of 2006 dated 17.11.2006 executed by A1 represented by his GPA holder ie., A2 in favour of one T. Simhadri ie., L.W­5 (whose evidence was given up by the Assistant

Public Prosecutor). The subject matter of Ex.P­5 is the same property purchased by P.Ws­1 and 2. Ex.P­6 is copy of telegram given to A2 by P.W­2.

15. P.W­2 (Susha Rozario) also deposed that she sold plot No. 43 admeasuring 140 square yards in Survey No. 119 to 129 situated at 

Boduppal Village, Ghatkesar Mandal to P.W­1 in the year 2005. that she purchased the said plot from One Kakatti Narsimha through A1 herein in the year 2003. She further deposed that from the date of purchase of the land, the accused herein started insisting her to sell the said land to him and the accused sent his henchmen to her house and threatened to sell the above plot from the year 2003 to 2005. Shen, she approached her advocate 

Durga Prasad and issued a telegraphic notice to the accused under Ex.P­6. 

As she is in need of money, she sold the said plot to P.W­1 under Ex.P­3 and she purchased the said property under Ex.P­2. 

16.P.W­3 is none other than the husband of P.W­2. He also deposed on similar lines as that of P.W­2. P.W­4 is Sub Registrar, Motkur, Nalgonda and according to him, on the request of P.W­5, he furnished copy of the sale deed dated 30.08.2003 bearing document No. 11271 of 2003 ie., Ex.P­2 between A2 and P.W­2 to P.W­5.

17.P.W­5 is the investigating officer. According to him on 05.08.2009 as per the directions of the court, L.W­6 (Bhaskar Goud), the then Inspector of 

Police, PS Uppal registered a case in Crime No. 755 of 2009 under Sections 418, 420, 423, 464, 120­B read with 34 of IPC and issued FIR vide Ex.P­7. 

Thereafter, the investigation was entrusted to him. During the course of investigation, he examined P.Ws­1 to 4 and L.W­5 and recorded their statements. Further, he collected Ex.P­1 to P­6. He further deposed that as per Ex.P­6, A2 have knowledge about disposal of the plot by A1 to P.W­2 and A2 purchased the said plot from A1 who has already sold the said plot to P.W­2 quite earlier to the registration of plot to A2. On 27.11.2009 he effected the arrest of A1 and A2 surrendered before the court on 13.04.2010 and after completion of investigation, he filed charge sheet. 

17. From the above said oral and documentary evidence available on record, it is the case of the prosecution that A1 executed a registered document bearing No. 11271 of 2003 dated 30.08.2003 in favour of P.W­2 in respect of Plot No. 43 admeasuring 140 square yards sitauted in Survey 

Nos. 119, 121, 124, 125, 126/A, 126/AA and 129 situated at Sri Sai 

Enclave, Boduppal Village, Ghatkesar Mandal. P.W­2 having purchased the said property has sold the same in favour of P.W­1 through a registered sale deed bearing document No. 13067 of 2005 dated 28.12.2005 under Ex.P­3. 

While so, A1 had executed an agreement of sale­cum­GPA under Ex.P­4 

dated 16.10.2006 in favourof A2 for the entire land in the above said survey 

numbers admeasuring 4031 square yards. Subsequently, A1 represented by 

A2 had sold the said Plot No. 43 belonging to P.W­1 to one Simhadri ie., 9 of 12 Criminal Appeal No. 30 of 2017

L.W­5 in respect of plot purchased by P.W­1 from P.W­2. Thus, it is the case of the prosecution that A1 having sold his plot No. 43 in favour of P.W­2, he once again sold the said plot in favour of L.W­5 through A2, thereby the accused persons have committed offences punishable under Sections 

Sections 418, 420, 424 and 120­B of IPC. 

18.The trial court found A2 guilty for the offence under Section 423 and 464 of IPC. 

Section 423 of IPC reads as under:

“Dishonest or fraudulent execution of deed of transfer containing false statement of consideration.—Whoever dishonestly or fraudulently signs, executes or becomes a party to any deed or instrument which purports to transfer or subject to any charge any property, or any interest therein, and which contains any false statement relating to the consideration for such transfer or charge, or relating to the person or persons for whose use or benefit it is really intended to operate, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.”

Section 464 of IPC reads as under:

Making a false document. — [A person is said to make a false document or false electronic record— First —Who dishonestly or fradulently—

(a) makes, signs, seals or executes a document or part of a document; 10 of 12 Criminal Appeal No. 30 of 2017

(b) makes or transmits any electronic record or part of any electronic record;

(c) affixes any [electronic signature] on any electronic record;

(d) makes any mark denoting the execution of a document or the authenticity of the [electronic signature], with the intention of causing it to be believed that such document or part of document, electronic record or [electronic signature] was made, signed, sealed, executed, transmitted or affixed by or by the authority of a person by whom or by whose authority he knows that it was not made, signed, sealed, executed or affixed; or Secondly —Who, without lawful authority, dishonestly or fraudulently, by cancellation or otherwise, alters a document or an electronic record in any material part thereof, after it has been made, executed or affixed with [electronic signature] either by himself or by any other person, whether such person be living or dead at the time of such alteration; or Thirdly —Who dishonestly or fraudulently causes any person to sign, seal, execute or alter a document or an electronic record or to affix his [electronic signature] on any electronic record knowing that such person by reason of unsoundness of mind or intoxication cannot, or that by reason of deception practised upon him, he does not know the contents of the document or electronic record or the nature of the alteration.]

19.In this case, it is not the case of the prosecution that A2 had executed any false document in favour of P.W­1. In fact, the documentary evidence would reveal that A1 has executed subsequent document in respect of same property inf avour of L.W­5. If any grievance is there, it should be for L.W­5 namely Simhadri. But L.W­5 did not made any complaint against any of the accused. It is also not the case of the prosecution that the sale deed 11 of 12 Criminal Appeal No. 30 of 2017 executed by A1 in favour of P.W­2 and the sale deed executed by P.W­2 in favour of P.W­1 are false or fabricated. In fact, the sale deed executed in favour of P.Ws­1 and 2 are genuine and there is no dispute or grievance whatsoever either to P.W­1 or P.W­2 against any of the accused. The learned counsel for the appellant submits that if a person sales the property knowing that it does not belong to him, and thereby defrauds the person who purchased the property, the person defrauded ie., purchaser may complain that the vendor committed the fraudulent act of chearing and relied on a decision between Md. Ibrahim and others vs State of Bihar and another, 2010 (1) ALT (Crl) 291 (SC).

20.The above said citation squarely applicable to the facts and circumstances of the present case, because the person allegedly who defrauded did not complain anything. Moreover, P.W­1 was not defrauded by the accused herein. Thus, viewed from any angle, this court is of the considered opinion that the prosecution has not established the ingredients of Sections 423 and 464 of IPC. As such, this court has no hesitation to hold that the prosecution miserably failed to prove its case against A2 for any of the offence levelled against him, beyond all reasonable doubt. 

21.I have carefully scrutinized the judgment passed by the trial court and found that the trial court came to a wrong conclusion and convicted the accused for the offences under Sections 423 and 464 of IPC. Therefore, the impugned judgment of conviction does not stand to the legal scrutiny, as such, the same is liable to be set aside. Accordingly, these points are answered.

22.POINT No. 3:

As a result, appeal is allowed. The impugned judgment of conviction 

dated 27.12.2016 in CC No. 165 of 2011 passed by the III Metropolitan 

Magistrate, RR District at LB Nagar is hereby set aside. Consequently, the

appellant/A2 is found acquitted for the offence under Sections 426 and 464 of IPC and he is set at liberty. The bail bonds of the appellant/A2 shall stand cancelled after expiry of revision time.

This Appeal is coming on 13.04.2022 before me for final hearing in the presence of Sri G. Ashok, Advocate for the Appellant/Accused and of Sri A. Tulsi Raj Gokul, Advocate for the Respondent/Complainant and upon perusal of the material papers on record and the case having been heard and stood over for consideration till this day, this court delivered the following judgment:

J U D G M E N T 

1.This is an appeal filed by the appellant/accused under Section 374 (3) 

(a) of Cr.P.C challenging the impugned judgment of conviction dated 30.12.2016 in CC No. 177 of 2015 passed by the learned IV Special 

Magistrate, LB Nagar, Hasthinapuram, RR District whereby and where 

under the appellant/accused herein was convicted for the offence under 

Section 138 of NI Act and Sentenced to undergo simple imprisonment for six months and to pay compensation of Rs.3,60,000/­ to the respondent/complainant herein. 

2.The parties hereinafter referred to as shown in the original complaint for convenience. 

3.The respondent/complainant has instituted a private complaint against the appellant/accused under Section 138 NI Act with the following averments. 

4.The complainant known to the accused through common friends since past four years and out of acquaintance with the complainant, the accused approached the complainant for hand loan to meet her business commitment in her saree/botique business, carrying under the name and style of M/s. Siva Sai saree Center. Dur to the acquaintance and friendship, the complainant has lent an amount of Rs.3,60,000/­ to the accused on 02.11.2013 has hand loan. The accused executed a pronote on the said date at her shop, which was witnessed by the two shop workers by name M. 

Mary and M. Rani who are known to the complainant. On repeated insistences for repayment, the accused issued a post dated cheque bearing 

No. 672060 dated 07.04.2015 for Rs.3,60,000/­ in the last week of March, 3 of 11 Criminal Appeal No. 80 of 2017 2015 drawn on Andhra Bank, Habsiguda Branch, Hyderabad towards discharge of loan amount. On presentation of the said cheque with the banker of the complainant, ie., Indian Bank, Mallapur Branch, Hyderabad, but the same was dishonoured for the reasons account blocked vide bankers cheque return memo dated 25.04.2015. The said fact was informed to the accused, but the accused not made any efforts to any repayment of the said cheque amount. Therefore, the complainant got issued a note dated 04.05.2015 to the accused through registered post with acknowledgement due and the same was served on the accused on 07.05.2015. The said cheque was issued by the accused towards discharge of legally enforceable debt or liability and in spite of the receipt of the statutory notice, the accused did not choose to repay the amount within 15 days from the date of receipt of the said notice. As such, the accused has committed an offence punishable under Section 138 of NI Act. 

5.The learned XIII Metropolitan Magistrate, Cyberabad has taken cognizance of the case for the offence under Section 138 of NI Act against the accused vide CC No. 338 of 2015 and the same was transferred to IV 

Special Magistrate Court as per orders of the District Court and renumbered as CC No. 177 of 2015.

6.On appearance of the accused before the trial court and after following due procedure, the accused was examined under Section 251 

Cr.P.C by explaining the accusation levelled against him for the offence under Section 138 of NI Act, for which the accused denied the same and claimed to be tried.

7.During the course of trial, the complainant got himself examined as 

P.W­1 and got marked Ex.P­1 to P­10 on his behalf. After closure of the complainant's side evidence, the accused was examined under Section 313 

Cr.P.C by explaining the incriminating evidence appearing against him, in the evidence of P.W­1, for which she denied the same and reported that she is having defence evidence. 

8.The accused got herself examined as D.W­1 and one M. Sravan 

Kumar Reddy as D.W­1 on her behalf and no documentary evidence is produced on behalf of the accused.

9. After hearing both sides and assessing the material placed before the trial court, the impugned judgment of conviction was passed holding that the accused has committed an offence under Section 138 of NI Act and accordingly she was convicted as indicated above. 

10.Feeling aggrieved by the impugned judgment of conviction passed by the trial court, the unsuccessful accused constrained to file the above appeal on the following grounds:

1) That the judgment of the trial court is contrary to law, weight of evidence and probabilities of the case. 

2) The trial court failed to appreciate that the appellant herein never issued Ex.P­1 and P­10 in favour of the respondent herein in pursuance of the alleged enforceable debt.

3) The trial court failed to appreciate that Ex.P­1 was issued as security to one Badhsa in pursuance of transaction between the appellant and himself, as such, Ex.P­1 never issued to the respondent herein and never executed Ex.P­10 in favour of the respondent.

4) The trial court failed to appreciate that in fact the appellant name is D. madhumathi Naik, but whereas, the complaint is filed in the name of J.D. Madhumathi Naik, as such, it clearly establishes that there is no acquaintance of appellant with the respondent herein. 

5) The trial court failed to appreciate that as per Ex.P­10 transaction between JD Madhumathi Naik and the respondent herein, as such, the appellant herein nowhere related to Ex.P­10. Apart from amount shown 

Ex.P­1 and Ex.P­10 are distinguishable. 

6) The trial court failed to appreciate that Ex.P­1 and Ex.P­10 stands in the name of Syed Badsha, whereas the respondent name herein is 

Syed Basha, as such, Ex.P­1 and P­10 nowhere related to the respondent herein.

7) The trial court failed to appreciate that there is no corroboration between Ex.P­1 and Ex.P­10. 

8) The trial court failed to appreciate that Ex.P­6 to P­9 stands in the name of some third person (Badsha), as such, the said document nowhere related to the respondent herein. 

Hence, the appellant/accused therefore prayed to set aside the impugned judgment dated 30.12.2016 passed in CC No. 177 of 2015 by the 

IV Special Magistrate, Hasthinapuram and acquit the appellant/accused in the interest of justice. 

11.Both the parties have filed their respective written arguments and this court has given thoughtful consideration to the written arguments and also heard oral submissions. 

12.Now the point for consideration in this appeal are:

1) Whether the impugned judgment of conviction passed by the trial court suffers from any infirmities, illegalities or irregularities?

2) Whether the impugned judgment of conviction is liable to be set aside?

3) To what relief?

13.Points 1 and 2: Points 1 and 2 are interrelated with each other, as such, both the points have been taken up together for convenience. 

To substantiate the case of the complainant, he got himself examined as P.W­1 and filed an affidavit in lieu of chief examination reiterating the averments of the complaint. Since the chief examination of P.W­1 is nothing but replica of the complaint averments, as such, the same is not extracted hereunder to avoid repetition of facts. Besides that the complainant also relied on documentary evidence under Ex.P­1 to P­10. The main contention of the appellant/accused is that there is no transaction between the parties herein, as such, the issuance of Ex.P­1 cheque in favour of the complainant does not arise. It is argued that in fact Ex.P­1 stands in the name of Syed 

Badsha, and the complainant got issued notice under Ex.P­3 on behalf of 

Syed Badsha, moreover Basha is not a competent person to prosecute the above case, as she is not holder of the cheque. 

14.On perusal of Ex.P­1 cheque, which reveals that the name of payee is shown as “Syed badsha”, but whereas, Ex.P­3 legal notice was got issued by one “Syed Basha”. In the cross­examination dated 04.05.2016, P.W­1 deposed that “My name is written as Syed Basha wherein 'D' is silent. He admits that, in complaint as well as in the legal notice and in his evidence affidavit, his name is written as Syed Basha”. Therefore, the contention the accused that the complainant is not holder or holder in due course of Ex.P1 cheque.

15.According to Section 8 of NI Act, “Holder”.—The “holder” of a promissory note, bill of exchange or cheque means any person entitled in his own name to the possession thereof and to receive or recover the amount due thereon from the parties thereto. Where the note, bill or cheque is lost or destroyed, its holder is the person so entitled at the time of such loss or destruction.

16.Section 9 of Negotiable Instruments Act defines holder in due course:

“Holder in due course”.—“Holder in due course” means any person who for consideration became the possessor of a promissory note, bill of exchange or cheque if payable to bearer, or the payee or indorsee thereof, if 1[payable to order], before the amount mentioned in it became payable, and without having sufficient cause to believe that any defect existed in the title of the person from whom he derived his title.

17.In view of the above definition of Holder and Holder in Due Course, it is crystal clear that the complainant is neither holder nor holder in due course of Ex.P­1 cheque. 

18.Assuming for a moment that the name of the complainant is Syed 

Badsha, he would have issued Ex.P­3 legal notice on the name of Syed 

Badsha, but on perusal of recitals of Ex.P­3, goes to show that the said notice was issued on behalf of one Syed Basha. Further, Ex.P­3 legal notice does not contain the details of advancing the loan amount of Rs.3,60,000/­ to the accused on 02.11.2013. Absolutely, there is no whisper of availing loan and quantum of the amount advanced etc in Ex.P­3. According to the complainant and oral evidence of P.W­1, he advanced hand loan amount of 8 of 11 Criminal Appeal No. 80 of 2017

Rs.3,60,000/­ to the accused on 02.11.2013 and that the accused also executed a pronote on the same day in her shop in the presence of two witnesses namely M. Mary and M. Rani. Admittedly, the said witnesses are not examined and the said pronote has not been produced on behalf of the complainant. Therefore, an adverse inference shall be drawn against the complainant under Section 114g of Indian Evidence Act. P.W­1 in his cross­ examination also admitted the said fact.

19.P.W­1 in his cross­examination deposed that on 02.11.2013, the accused asked the amount and on the same day, he has advanced the amount of Rs.3,60,000/­ to the accused. Ex.P­10 is the alleged undertaking executed by the accused herein on 02.11.2013, in which the amount is shown as only Rs.2,70,000/­, but not Rs.3,60,000/­ as alleged. 

The cross­examination of P.W­1 further goes to show that the said 

Rs.3,60,000/­ includes interest. But there is not pleading to that effect in his complaint. The plaint reading of the complaint gives understanding that the complainant has advanced hand loan of Rs.3,60,000/­ to the accused on 02.11.2013. Moreover, there is no whisper in the complaint about the execution of Ex.P10 undertaking by the complainant. Though the complainant has filed Ex.P10, but the reasons best known to him, he did not choose to file the original pronote and receipt allegedly executed in his favour by the accused on 02.11.2013 in the presence of so called witnesses.

20.In this case, except the self serving evidence of P.W­1 there is no other evidence on his behalf to substantiate his claim. No other cogent evidence is put forwarded by the complainant. So also, no documentary evidence is forthcoming to show that Ex.P­1 cheque in question was issued in connection with the legally enforceable debt. The complainant did not 9 of 11 Criminal Appeal No. 80 of 2017 choose to adduce any documentary evidence to show that the impugned cheque related to a legally enforceable debt. Therefore, no offence is made out as held by the Hon'ble High Court in P. Narsi Reddy vs D.L.Narsimha 

Rao, 2004 (2) ALD Criminal 302 AP.

21.The conduct of the complainant is contrary to the conduct of a prudent man and appears that he approached the court with unclean hands. 

22.The argument of the respondent/complainant is that actually the fact is that the oral pronunciation of the complainant is called Syed Basha and written as Syed Badsha, but due to oral pronunciation, the name is written in the cause title of the complainant and legal notice as Syed Basha due to oversight or misconception to add “D” in the cause title of the complainant and legal notice, affidavits, so entire case of the complainant cannot be thrown out and doubted. But the said argument is not acceptable. 

23.P.W­1 was also cross­examined with regard to his financial capacity, wherein he deposed that he is not an income tax assessee, as on the date of his cross­examination and also in the year 2013. The source of his income is only his pension. He was getting an amount of about Rs.19,000/­ in the year 2013. he was blessed with six children and all are married. He performed the marriage of his last daughter in 2007 by spending his retirement benefits. He performed the marriage of his last son in the year 2010. After marriage of his last son, he used to spend an amount of 

Rs.7,000/­ per month towards his family expenses. Except his pension, 10 of 11 Criminal Appeal No. 80 of 2017 there was no other source of income to him. However, he added that his son used to send amounts to him if he asked. When such is the source of income, how the complainant could able to advance huge sum of 

Rs.3,60,000/­ to the accused on the same day when the accused requested him to advance hand loan amount. Apart from that, the cross­examination of P.W­1 itself contradicts with his statement. Thus, the accused is able to rebut the presumption available under Section 139 of NI Act.

24.Now the burden shifts on to the shoulders of the complainant to prove his financial capacity etc., but the complainant miserably failed to discharge the said burden. Viewed from any angle, this court is of the considered opinion that the complainant has not made out any case under Section 138 of NI Act against the accused. 

25.I have carefully scrutinized the impugned judgment of conviction passed by the trial court and found that the trial court came to a wrong conclusion basing on presumptions and assumptions and convicted the accused. Therefore, the impugned judgment passed by the trial court does not stand to the legal scrutiny and the same is liable to be set aside. 

Accordingly, these points are answered. 

26.POINT No. 3:

As a result, appeal is allowed. The impugned judgment of conviction in 

CC No.177 of 2015 dated 30.12.2016 passed by the IV Special Magistrate,

Hasthinapuram is set aside. Consequently, the appellant/accused is  11 of 11 Criminal Appeal No. 80 of 2017 acquitted for the offence under Section 138 of NI Act. The appellant/accused is set at liberty. The bail bonds of the appellant/accused shall stand cancelled after expiry of revision time.

This case coming on 13.04.2022 before me for final hearing in the presence of Sri M. Ganga Reddy, Additional Public Prosecutor for the State and of Sri A. Narsimha Murthy, Counsel for Accused; and upon perusal of the material papers on record and having stood over for consideration till this day, this court delivered the following:

J U D G M E N T 

1.The Inspector of Police, PS Vanasthalipuram, has filed charge sheet in 

Crime No. 644 of 2016 of Vanasthalipuram Police Station against the accused for the offence under Section 302 of IPC. 

2.The learned VII Metropolitan Magistrate, Cyberabad at Hayathnagar has taken cognizance of the case for the offence under Section 302 of IPC against the sole accused. 

3.After following the due procedure, the learned Magistrate has committed the case to the Metropolitan Sessions Court, RR District at LB 

Nagar vide PRC No. 45 of 2016. The Metropolitan Sessions Court, RR 

District numbered the same SC No. 877 of 2016 and made over to this court for trial and disposal according to law. 

4.In pursuance of the summons issued by this court, the accused have appeared before this court. On appearance of the accused before this court and upon hearing both sides, the accused was examined under Section 228 of Cr.P.C and charges for the offences under Section 302 of IPC has been framed against the accused for allegedly committing murder of his own brother, who was subjecting his mother to harassment demanding amounts for consuming liquor, by hitting on his head with granite stone. The same was read over and explained to the accused in Telugu. The accused denied the charge levelled against him, pleaded not guilty and claimed to be tried. 

5.During the course of trial, P.Ws­1 to 11 are examined and Ex.P1 to 

P11 and Ex.D1 and MO­1 are marked.

6.After closure of the prosecution evidence, the accused is examined under Section 313 of Cr.P.C by explaining the incriminating circumstances available in the evidence of the prosecution, for which, he denied the same and reported no defence evidence on his behalf. 

7.Heard the arguments from both sides. 

8.Now the point for consideration in this cases is: Whether the 

prosecution is able to bring home the guilt of the accused for the

offence punishable under Section 302 of IPC beyond all reasonable

doubt?

9.POINT:

To substantiate the case of the prosecution, as many as 11 witnesses are examined. P.W­1 is the de facto complainant and brother­in­law of the deceased, P.W­2 and 3 are circumstantial witnesses, ie., wife and elder brother of the deceased respectively. P.Ws­4 and 5 are eye witnesses. P.Ws­6 and 7 are panch witnesses for inquest. P.W­8 is panch witness for confession­cum­seizure report. P.W­9 is the panch witness for scene of offence panchanama and P.Ws­10 and 11 are the investigating officers.

10.The story of the prosecution as unfolded by the testimony of the prosecution witnesses in brief is as under:

11.P.W­1 (Y. Balaji) the de facto complainant and brother­in­law of the deceased has deposed that the marriage of his sister Hemalatha with the deceased had taken place about 20 years ago, who are residing in NGOs 

Colony, Vanasthalipuram. On 07.08.2016 at about 1­00 pm, he came to know that there was a quarrel between the accused and deceased. The deceased asked money from his wife and she told that she had no money

4 of 9 and went outside. After two hours, she returned home and she observed that her husband was lying in the house with bleeding injuries. Therefore, she shifted the deceased to Osmania General Hospital in an ambulance and he succumbed to injuries on 10.08.2016 while undergoing treatment. The accused beat the deceased and caused head injury, as a result of which, he died. Therefore, he set the criminal law into motion by lodging Ex.P­1 report in PS Vanasthalipuram on 10.08.2016.

12.The contents of Ex.P­1 report would reveal that on 07.08.2016 during afternoon, his brother­in­law ie., deceased Venugopal and his younger brother Raju consumed liquor and quarreled. Therefore, P.W­2 separated them and she went outside on work and when she returned home, she observed ambulance in front of her house and the deceased who was with bleeding injuries was being shifted to Osmania General Hospital. While undergoing treatment, he succumbed to injuries on 1.08.2016 at 10­00 pm. 

Therefore, he requested to take action against Rajy, younger brother of the deceased. 

13.Basing on Ex.P­1, L.W­16 (Likki Krishnam Raju), the then SI of Police, 

PS Vanasthalipuram, has registered a case in Crime No. 644 of 2014 on 10.08.2016 under Section 174 of Cr.P.C and issued FIR vide Ex.P­9 and entrusted the investigation to P.W­11. During the course of investigation, 

P.W­11 examined and recorded the statement of P.W­1. On the same day, he visited the scene of offence and conducted scene of offence panchanama and also drawn rough sketch under Ex.P­6 in the presence of P.W­9 and L.W­12 (P. Ramu). On the next day, he examined and recorded the statements of 

P.Ws­2 and 3. He also conducted inquest on the dead body of the deceased in the presence of P.W­6 and P.W­7 under Ex.P­10. On 28.08.2016, he has

5 of 9 examined and recorded the statement of P.Ws­4, 5, L.Ws­5 and 6 and got conducted postmortem examination. Ex.P­11 is the postmortem examination report. Subsequent investigation was done by P.W­10 in view of gravity of offence. 

14.According to P.W­10, the subsequent investigating officer, he altered the section of law on 28.08.2016 from Section 174 Cr.P.C to section 302 of 

IPC vide Ex.P­7. He has re examined P.Ws­1 to 5 and L.Ws­4 to 6. On 29.08.2016, he apprehended the accused and recorded his confessional statement in the presence of P.W­8 and L.W­14 (S. Chandra Sekhar) and he seized a granite stone at the scene of offence under a cover of seizure report under Ex.P­8. MO­1 is the granite stone. He got remanded the accused to judicial custody and after completion of investigation, he laid charge sheet against the accused. 

13.P.W­2 (K. Hemalatha) is none other than, the wife of the deceased. 

According to her, the accused is the younger brother of the deceased. On 07.08.2016, the deceased asked her to give money for consuming alcohol. 

Therefore, she went outside. Thereafter, the deceased and the accused herein quarreled with each other. At about 4­00 pm, she returned home and found her husband with bleeding injuries and also found blood stains near neem tree and there was granite stone MO­1. Her husband sustained head injuries and he was shifted to Osmania General Hospital. After three days, her husband succumbed to injuries while undergoing treatment. He further submitted that the accused beat her husband with MO­1 and caused head injury. 

14.P.W­3 (K. Naveen Kumar) is elder brother of the deceased and the

6 of 9 accused is his youngest brother. According to his evidence, about four years back his younger sister's son by name Sai Kiran informed him that the accused was fell down on the road and that the said Sai Kiran called ambulance and shifted him to Osmanai General Hospital. He do not know the cause of death of the deceased and the deceased used to consume alcohol regularly. While undergoing treatment, the deceased died in the hospital after three days. 

14.P.W­4 to P.W­8 did not support the prosecution case and they were declared as hostile. P.W­9 is one of the mediator to the scene of offence panchanama and rough sketch of scene of offence. 

15.In view of the above said evidence, it is crystal clear that P.Ws­1 and 2 are not eye witnesses to the alleged incident. P.W­1 is resident of Kukatpally and whereas P.Ws­2 and deceased are residents of Vanasthalipuram. P.W­1 simply stated that on 07.08.2016. he came to know about the alleged quarrel between the accused and deceased. But through him, he came to know about the incident is not whispered anywhere. Further, the oral evidence of 

P.W­1 is inconsistent with Ex.P1 report lodged by him. As per Ex.P­1 he got suspicion against one Raju who is younger brother of the deceased, even his name is not figured in FIR. It is mentioned in Column No. 7 as known accused. Further, the evidence of P.Ws­1 and 2 also inconsistent on material particulars along with Ex.P­1 report. Now the cross­examination of P.W­2 goes to show that two or three persons consumed alcohol with the deceased when she left home. According to the arguments of the defence of the accused the accused was habituated to consuming alcohol and he fell down in drunken condition somewhere else and received injuries and taking advantage of the death of the deceased, P.W­1 foisted a false case against

7 of 9 the accused, who is unmarried and staying with his mother and P.Ws­1 and 2 insisted the accused to settle his property in their favour. The said contention is supported by the evidence of P.W­3 to that extent since, P.W­3 admits that the deceased used to fell on the road in drunken condition and that the place where the deceased fell down on the date of incident is situated at about 500 meters away to their residence. He also admits that after the deceased was shifted to hospital, P.Ws­1 and 2 demanded the accused to fore go his share in favour of P.W­2, as he is unmarried and for which the accused refused and further admits that the accused is no way concerned for the death of the deceased. 

16. Therefore, on careful consideration of the evidence available on record, this court finds that there is no direct evidence or circumstantial evidence connecting the accused to the alleged crime. According to P.W­11, he conducted scene of offence panchanama under Ex.P­6, he did not seize any material objects from the scene of offence like MO­1. But strangely P.W­ 10 deposed that he seized the granite stone at the scene of offence under a cover of seizure report under Ex.P­8. It is not the case of P.W­10 that he has conducted the scene of offence and seized the same. 

17.According to the cross­examination of P.W­11, he admits that as per 

Ex.P­6, the scene of offence panchanama was conducted on 10.08.2016 at 4­30 pm, but, whereas, Ex.P­1 was received from P.W­1 at 6­00 pm. It means that 1 ½ hours prior to the lodging of Ex.P­1, P.W­11 has prepared 

Ex.P­6 panchanama. Thus, the entire case of the prosecution is falsified. 

Further, the alleged incident which took place on 07.08.2016, but the FIR was lodged on 10.08.2016 only after the death of the deceased. No complaint was given on 07.08.2016 with regard to the alleged quarrel between the

8 of 9 accused and deceased. Therefore, there is a delay of three days in lodging 

FIR from the date of the alleged incident. There is no explanation for delay caused in lodging the FIR. Further, P.W­11 has not examined the doctor who treated the deceased at OGH. P.W­11 admits that P.Ws­1 and 2 did not state that quarrel took place regarding money and that P.W­2 did not state that the accused beat the deceased with granite stone. Thus, in view of the cross­examination of P.W­11, it is crystal clear that the evidence of P.W­1 is an improvised version. 

18.With the foregoing discussion and in view of the material placed before this court, it is found that the prosecution has miserably failed to prove the guilt of the accused for the offence under Section 302 of IPC and also failed to connect the accused to the alleged incident. Accordingly, this point is answered. 

19.As a result, accused is found not guilty for the offence under Section 302 of IPC and he is acquitted under Section 235 (1) of Cr.P.C and he is set at liberty. The bail bonds of accused shall stand cancelled after expiry of appeal time. MO­1 and other unmarked non valuable case property if any shall be destroyed after expiry of appeal time.

No. 953 of 2015 of PS LB Nagar Police Station against the accused Nos. 1 and 2 for the offence under Section 302 read with 34 of IPC. 

2.The learned II Metropolitan Magistrate, Cyberabad at LB Nagar has taken cognizance of the case for the offence under Sections 302 read with 34 of IPC against the accused.

3.After following the due procedure, the learned Magistrate has committed the case to the Metropolitan Sessions Court, RR District at LB 

Nagar vide PRC No. 6 of 2016. The Metropolitan Sessions Court, RR District numbered the same SC No. 293 of 2016 and the same was made over to this court for trial and disposal according to law. 

4.In pursuance of the summons issued by this court, the accused Nos.1 and 2 have appeared before this court. On appearance of the accused Nos. 1 and 2, they are examined under Section 228 of Cr.P.C and charges for the offences under Section 302 read with 34 of IPC has been framed against the accused Nos. 1 and 2 for the alleged murder of deceased Venkatesh who is the husband of A2 by developing intimacy with A1 by beating with firewood stick on backside of the head on 22/23.07.2015 and the same was read over and explained to them in Telugu. The accused Nos. 1 and 2 persons denied the charges levelled against them, pleaded not guilty and claimed to be tried. 

During the pendency of the proceedings, A1 died on 10.10.2021, as such the case against A1 is abated vide order dated 24.01.2022.

5.During the course of trial, P.Ws­1 to 7 are examined and Ex.P1 to P8 are marked on behalf of the prosecution. Since P.W­1 to 7 who are material

3 of 6 witnesses turned hostile and did not depose anything against the accused supporting the case of the prosecution, the learned Additional Public 

Prosecutor has given up the evidence of L.Ws­7 to 10, 13 to 15, while L.W­6 said to be died. 

6.Since P.Ws­1 to 7 turned hostile and did not support the prosecution case and as there is no incriminating material appearing against A2, as such, the examination of A2 under Section 313 Cr.P.C is dispensed with. 

7.Heard the arguments from both sides. 

8.Now the point for consideration in this cases is: Whether the 

prosecution is able to prove its case A2 for the offence under Section

302 read with 34 of IPC beyond all reasonable doubt?

9.POINT:

To substantiate the case of the prosecution, the prosecution has examined P.Ws­1 to 7. P.W­1 is the de facto complainant cum­ step mother of the deceased Venkatesh. P.W­3 is the sister of the deceased, P.Ws­2, 4 and 5 are the circumstantial witnesses and P.Ws­6 and 7 are the panch witnesses for the confession of the accused Nos. 1 and 2. 

10.The story of the prosecution as unfolded by the testimony of the prosecution witnesses in brief is as under:

11.P.W­1 (T. Laxmi), who is the de facto complainant and step mother of the deceased and who set the law into motion against the accused by lodging the complaint before Police LB Nagar deposed that the deceased 

Venkatesh is the son of first wife of her late husband and the accused No. 2 is the wife of the deceased. The deceased and A2 are residents of bandlaguda and she do not know whether there were any quarrels between the deceased and A2. About seven years ago, A2 telephoned her and stated

4 of 6 that her husband Venkatesh died. Immediately, she rushed to their house and found injuries on the back side of the deceased. She got suspicion on the death of the deceased and that the police have obtained her thumb impression on written paper. Ex.P­1 is her thumb impression on the report 

dated 23.07.2015 and she do not know the contents of the report. As P.W­1 

did not support the case of the prosecution, the learned Additional Public 

Prosecutor declared P.W­1 as hostile and cross­examined the witness with the permission of the court, but nothing worthwhile could be elicited from her mouth supporting the case of the prosecution and she denied the suggestion that due to compromise with the accused she is deposing false. 

12.P.W­2 (D. Jyothi) is circumstantial witness and she deposed that the deceased was her neighbour and she do not know anything about this case and she do not know the cause of death of Venkatesh and he died seven years back. She further deposed that she has not suspicion about the death of said Venkatesh. Thereby, P.W­2 also did not support the case of the prosecution. 

13.P.W­3 (G.Laxmi) is the sister of the deceased Venkatesh, who deposed that A2 is the wife of the deceased and she do not know anything about this case and that A2 is no way concerned for the death of her younger brother. 

P.W­4 (K. Anuradha) and P.W­5 (K. Krishna) are the circumstantial witnesses and both of them deposed that they do not know the cause of death of the deceased Venkatesh and they do not know anything about the case. 

14.P.W­6 (Ch. Jangaiah) and P.W­7 (N. Laxmaiah) are the panch witnesses for the confession of A2 and both of them in one voice deposed

5 of 6 that about six or seven years ago police LB Nagar have obtained their signatures on blank papers under Ex.P­7 and P­8.

15.The learned Additional Public Prosecution appearing for the state has cross­examined P.Ws­1 to 4 with the permission of the court after declaring them hostile, but nothing worthwhile could be elicited from their mouth in favour of the prosecution or against A2. P.Ws­1 to 4 have denied that they have stated to the police as in Ex.P­2 to P­6 ie., portion of 161 Cr.P.C statements recorded by the police. 

16.Since P.Ws­1 to 7 who are the material witnesses being mother, sister, circumstantial witnesses and confession of A2 turned hostile and did not support the case of the prosecution, the learned Additional Public 

Prosecutor has rightly given up the evidence of the remaining witnesses ie., 

L.Ws­7 to 10, 13 to 15, as no useful purpose will be served in examining them. As there is no incriminating material appearing against A2 in the evidence of P.Ws­1 to 7, the examination of the accused Section 313 Cr.P.C is dispensed with. There is no incriminating material appearing against the accused in the evidence of P.Ws­1 to 7, to establish that A2 has committed murder of her husband along with A1 by beating with a stick on her head. 

Therefore, this court has no hesitation to hold that the prosecution has miserably failed to prove the ingredients of Section 302 read with 34 of IPC against the accused. As such, the accused is found not guilty for the offence under Section 302 read with 34 of IPC. Accordingly, this point is answered. 

17.As a result, A2 is found not guilty and she is acquitted under Section 232 Cr.P.C for the offence under Section 302 read with 34 of IPC and he is set at liberty. The bails bonds of accused No. 2 shall stand cancelled after expiry
