This case is coming on this day before me final hearing on 16.06.2025 in the presence of learned Assistant Public Prosecutor for the State and of Sri. N. Surendra Babu, learned counsel for the Accused and upon perusal of the material on record and the matter having stood over for consideration till this day, this Court delivered the following:

The State represented through the Sub-Inspector of Police, PS

Balanagar has filed a charge sheet against the Accused in Cr.No. 158/2015

Indian Penal Code.

2.The averments of the charge sheet in brief are that on 12.06.2015 at 14:00 hours Sri Yerra Umamaheshwar Rao, S/o. Sri Y. Mallikarjun Rao aged 39 yrs (complainant/LW-1) came to PS Balanagar and lodged a Telugu written complaint in stating that on 05.06.2015 at 17:00 hours he along with his family members went to his native place on the eve of inauguration of Saibaba temple. After attending the program and returned back on 12.06.2015 at about 09:00 hours, found that the main door lock was broken, entered inside the house, found the Almara lock was also broken and cloths were scattered. Immediately he checked in the Almarah and found the gold ornaments i.e., Bracelet and Gold chain w/g, about 35 grams and Net cash

Rs.50,000/- (Fifty thousand only) were missing from the Almara. Some unknown persons might have committed theft. Thus he requested for taking necessary action as per law.

3.Based on the report LW12 registered a case in Crime No. 158/15 U/S 457, 380 IPC and took up the investigation. During the course of investigation the LW-12 examined the LWs. 1 to 3 recorded their statements.

Then the LW-12 along with staff visited the scene of offence situated at H.

No.6-8-18/2/A, Raju Colony, Beside Kattamaisamma Temple, Balanagar and caused enquiries, secured the presence of two mediator's i.e. LWs. 6 and 7

Page No.3 Dated : 18.06.2025 and in their presence conducted the scene of offence panchanama, drawn rough sketch and all the observations were brought on record in the shape of

CDF. Deputed crime party men to locate the offenders to detect the case.

While the investigation was in progress, on 13.06.2015 at 08:30 hours on credible information the ID party men i.e. LWs.10 and 11 apprehended the accused Nethinti Chinnababu S/o N.Laxmanrao under suspicious circumstances, brought him to PS and produced before the LW-12. On interrogation he voluntarily admitted his guilt to have committed the offence in this case. As the accused person was in mood of confession, the LW.12 secured the presence of two Panch witnesses i.e. LWs.8 and 9, in their presence recorded his detailed confessional statement cum recovery panchanama and recovered net cash of Rs. 50,000/- pertaining to this case from his possession under the cover of same panchanama. Further, he confessed that the stolen gold ornaments i.e. One Gold Chain and One Gold

Bracelet w/g. 35 grams pledged at Muthoot Finance, Balanagar main Branch through his friend, LW-4. In pursuance of confession of the accused, he led the panchas and police to Muthoot Finance Limited at Balanagar Main

Branch situated at House No.7-4-195, Balanagar where the LW-12 seized the stolen gold ornaments i.e. one Gold chain and one gold bracelet all w/g. 35 grams pertaining to this case from the LW-5 under a cover of separate seizure report in presence of the said mediators at the instance of the accused. The LW-12 also recorded statements of the LWs.4 and 5. Affected

Page No.4 Dated : 18.06.2025 arrest of the accused and he was produced before the Hon'ble court for judicial remand. The seized property i.e. gold ornaments i.e. One Gold Chain and One Gold Bracelet w/g. 35 grams and net cash of Rs.50000/- in this case was deposited in the Hon'ble Court as per the Form.60.

4.Basing on the charge sheet filed by the police, the case was taken on file for the offence U/sec.457 and 380 of IPC against the Accused.

5.On appearance of the Accused, copies of the case documents as required under section 207 Cr.P.C was furnished to him. Accused was examined under section 239 Cr.P.C. A charge for the offence punishable

U/sec.457 and 380 of IPC was framed. The charge was read over and explained to him to which he denied and claimed to be tried.

6.During the course of trial, the prosecution has examined PW1 and

PW2 and got marked Exs.P1 to P6. The defense did not examine any witnesses and no exhibits were got marked on his behalf.

7. After closure of prosecution evidence, the accused examined under section 313 Cr.P.C on the incriminating material appeared against him, to which he denied and reported no evidence to be adduced on his behalf.

8.Now the point for determination is :

Whether the prosecution has established the guilt of the accused

beyond reasonable doubt for the offence under Section 457 and 380 of

IPC?

9.The case of the prosecution as contended by the learned APP is that on 06.06.2015 at night hours the accused Nethinti Chinnababu gained entry into the house of the complainant by broke opening the main door lock, committed theft of gold ornaments ie. one gold chain, one gold bracelet w/g.

35 grams and net Cash Rs. 50,000/- by broke opening the almara and fled away from the spot. Later, he pledged the gold ornaments in Muthoot

Finance Limited, Balanagar Main Branch through his friend. From the evidence collected and materials on record it is well established that the accused committed an offence punishable U/s 457, 380 IPC.

10. The PW1 turned hostile and deposed that he does not know

LW3/Rajashekar Reddy. He does not know anything about the case. One day he went to the police station and police obtained his signatures on some papers. Ex. P1 is the signature on the report.

11. The evidence of PW2 categorically reveals that on 12.06.2015 at 2.00 PM he has received the report from PW1. Ex.P3 is the report and registered a case in Crime No. 158/2015 for the offence under section 457, 380 IPC and issued FIR. Ex.P4 is the FIR and recorded the statement of PW1, LW2 and

LW3 and he visited the scene of offence and conducted CDF in the presence of LW6 and LW7. Ex.P5 is the CDF. On 13.06.2015 LW10 and LW11 apprehended the accused and brought to the police station and produced

before me and he secured the presence of two mediators LW8 and LW9 and

conducted confession seizure panchanama of the accused and seized stolen amount. Ex.P6 is the confession cum seizure panchanama. He has recorded the statement of LW4 and LW5. After that he has produced the accused

before the Hon'ble Court for judicial custody and he has deposited the seized

property before the Hon'ble Court. The property was returned to PW1 vide

Crl.MP.560/2015. After completing the investigation he has filed the charge

sheet for the offence under section 457, 380 IPC.

12.On appreciation of the evidence of PW1 and PW2, PW1 is the complainant and he did not depose anything about the case of the prosecution and he turned hostile. PW2 is the official witness and is the investigation officer and he deposed about the investigation process done by him. Further prosecution has given up the evidence of LW2/Yerra

Manjula, LW3/B. Rajashekar reddy, LW4/Uppalapati Srinivasa Raju,

LW5/Chennamsetti Chalamaiah who are the witnesses and LW6/Y.

Chandra Shekar, LW7/ B. Srinivas who are Panch for scene of offence,

LW8/K. Jagadish Chandra Prasad and LW9/B.Raju who are panch for

Page No.7 Dated : 18.06.2025 confession and seizure of the accused, LW10/S. Shiva Kumar,

LW11/Y.V.S Guravaiah who apprehended the accused. Except PW1 and

PW2 none were examined in this case and PW1 who is the complainant turned hostile and did not support the case of the prosecution and LW2 who was the wife of PW1 and who is the material witness to the case, was not examined, which is fatal to the case of the prosecution. In the absence of evidence of material witnesses and panch witnesses, the evidence of PW2 who is the investigation officer cannot be solely relied upon to convict the Accused for the alleged offences.

13. So, considering the testimonies of PW1 and PW2 and the above discussion and in view of the absence of any incriminating evidence against the Accused in order to establish that the Accused has committed the offence, the prosecution failed to establish the offence against the Accused this court is of considered opinion that there is no substantial and cogent evidence on record to hold that the Accused have committed the alleged offence, hence, this court held that the prosecution has failed to establish the guilt of the Accused beyond all reasonable doubts.

14.In the result, the Accused found not guilty for the offence U/Sec.457 and 380 IPC, accordingly, the Accused are acquitted U/s. 248 (1) of Cr.P.C.

The bail bonds of the Accused shall stand cancelled U/s. 437-A Cr.P.C.

1.The Prohibition and Excise Sub-Inspector, Excise Station, Balanagar has filed a charge sheet against the Accused for the offence punishable under section 7A R/w 8(e) of A.P Prohibition Amendment Act, 1997.

2.The brief facts of the case are that on 11.8.2015 on reliable information about illegal sales of Illicitly Distilled Liquor in front of H.No:2-82, Pardhiwada,

Fathenagar, the LW3 and staff went to the above place and secured two panch

Page No.2 Dated : 24.06.2025 witnesses LW1, 2. At about 7:00 AM found the accused is sitting at the place keeping one plastic bag beside her and she was rounded. On demand the accused opened the bag and found Illicitly Distilled liquor sachets. On counting the sachets, they are 46 Illicitly Distilled Liquor sachets, each about 100 ml.

On enquiry the accused revealed her particulars as K.Jyothi, W/o Raja, aged 32 yrs., r/o.H. No. 2-82, Pardhiwada, Fathenagar. On further enquiry the accused confessed that she purchased sachets at dhoolpet @ Rs 5/- each and selling @ Rs. 10/- each.

3.Upon which the LW3 drawn two samples, each 3 sachets, seized the samples, and remaining contraband under the cover of panchanama in the presence of LW1 and 2. The accused, samples and seized property were brought to the Station and handed over to LW4 for further action. Basing on the panchanama, LW4 registered a case in Cr. No. 235/2015-16, u/s. 7A r/w 8(e) of A.P. Prohibition Act, 1995 produced the accused before the court for judicial remand. One sample is sent for chemical examination through Excise

Station, Balanagar. Second sample is deposited before the court. The remaining seized property was deposited before the Deputy Commissioner of Excise,

Ranga Reddy District for confiscation. The Govt. Chemical Examiner after analyzing the samples issued CE Report No.5120/2015/8, dt.25.8.2015 opined that the sample is Illicitly Distilled Liquor unfit for human consumption and injurious to health.

4.Basing on that charge sheet filed by the police, the case was taken on file for the offence U/Sec. 7A R/w 8(e) of A.P Prohibition Amendment Act, 1997, against the Accused.

5.On appearance of the Accused, copies of the case documents as required under section 207 Cr.P.C was furnished to her. Accused was examined under section 239 Cr.P.C. A charge for the offence punishable U/Sec. 7A R/w 8(e) of

A.P Prohibition Amendment Act, 1997 was framed. The charge was read over and explained to her to which she denied and claimed to be tried.

6. During the course of trial, the prosecution has examined PW1 and PW2 and got marked Exs.P1 to P4. The defense did not examine any witnesses and no exhibits were got marked on her behalf.

7. After closure of prosecution evidence, the Accused examined under section 313 Cr.P.C on the incriminating material appeared against her, to which she denied and reported no evidence to be adduced on her behalf.

8.Now the point for consideration is:

Whether the prosecution has proved the guilt of the Accused beyond

all reasonable doubt for the offence punishable under section 7A R/w 8(e)

of A.P Prohibition Amendment Act, 1997?.

POINT

9.It is the case of the prosecution that the accused was found in possession of 46 Illicitly Distilled Liquor sachets in front of H.No.2-82,

Pardhiwada, Fathenagar, Balanagar, purchased the same @ Rs.5/- each at dhoolpet and selling @ Rs.10/-each after imposition of prohibition on liquor possession or sale. As such the accused contravened the provisions of Sec. 7A of A.P. Prohibition Amendment Act, 1997 and liable for punishment u/s. 8(e) of

A.P. Prohibition Amendment Act, 1997. The prosecution to establish the present case against the Accused has relied on the testimonies of PW1 and

PW2. LW2/Panch witness was examined as PW1, LW4/Investigation Officer and who filed the charge sheet was examined as PW2.

10. Now it would be seen how far the prosecution will prove the offences under section 7A R/w 8(e) of A.P Prohibition Amendment Act, 1997 against the

Accused.

11. PW1 turned hostile and deposed that at about long back police obtained his signatures on written papers. He does not know the accused. Ex.P1 is the signature on the panchanama.

12. The evidence of PW2 categorically reveals that on 11.08.2015 on reliable information about illegal sale of illicit liquor in Pardiwada, Fathenagar

LW3/Shaik Manzoor Ahmed and along with staff went to the H.No.2-82,

Pardiwada and found one person sitting with plastic bags beside with then LW3 conducted panchanama in the presence of PW1 and LW1. LW3 handed over the case papers to him. He received the case papers and seized property along with samples from LW3/Shaik Manzoor Ahmed. He registered the case in

COR.No.235/2015-16. Ex.P2 is the COR. LW3 conducted panchanama in the presence of PW1 and LW1. Ex.P3 is the panchanama. He has send the samples to the chemical examination and received the report. Ex.P4 is the chemical examination report. Accused was produced before the court for judicial custody. After completing the investigation he has filed the charge sheet.

13.On appreciation of evidence of PW1, PW1 is the panch witness for the confession and seizure panchanama deposed that at about long back police obtained his signatures on written papers. He does not know the accused and he turned hostile. Though he was cross examined by the learned APP, nothing material could be elicited in their cross-examination except, putting some suggestions. In this case, the Law is set into motion basing on the panchanama. Hence, the panchanama plays a vital role in proving the guilt of the accused. It is the case of the prosecution that 46 Illicitly Distilled

Liquor sachets was seized from the scene of offence in the presence of PW1 and LW1 but PW1 the panch witness has turned hostile by stating that no

Page No.6 Dated : 24.06.2025 panchanama is conducted in his presence. Hence, the panchanama of seizure is not proved. The entire case is depending on the panchanama but the panchanama itself is not proved through the evidence of panch witness i.e., PW1 and LW1. Though the investigating officer/PW2 has stated about the facts of the case but, in the absence of proving the panchanama, the evidence of PW2 is no use. In the absence of proving the panchanama, which is the basis for registering the case it cannot be said that the accused is involved in selling the Illicitly Distilled Liquor. Thereby, this Court is left with no other option except to acquit the accused.

14.For the foregoing reasons, the prosecution has miserably failed to bring home the guilt of the Accused beyond all reasonable doubt for the offences punishable under section 7A R/w 8(e) of A.P Prohibition Amendment

Act, 1997 and thereby, the Accused is entitled for an acquittal. Accordingly, the point is answered.

15.In the result, the Accused is found not guilty for the offence punishable under section 7A R/w 8(e) of A.P Prohibition Amendment Act, 1997 and Accused is acquitted u/sec.248(1) Cr.P.C. for the said charge. The bail bonds of the Accused shall stand cancelled. The unmarked property if any shall be destroyed after expiry of appeal time.

At about 10.15 AM went to the suspected place and found 4 to 5 persons including the accused are sitting in front of the house and on seeing the officer all the persons are ran away. On search of the place found one plastic bag. On search of the bag found Illicitly Distilled Liquor sachets and on counting the sachets, they are 210 Illicitly Distilled Liquor sachets, each about 100 ml. On local enquiry it is revealed that the ran away accused is R. Padma, W/o.Shankar, aged about 32 yrs., r/o H.No. 10-8-191,

LBS Nagar, Fathenagar.

3.Upon which the LW3 drawn two samples, each 3 sachets, seized the samples, and remaining contraband under the cover of panchanama in the presence of LW1 and 2. The samples and seized property were brought to the

Station and handed over to LW4 for further action. Basing on the panchanama,

LW4 registered a case in Cr.No.237/2015-16, u/s.7A R/w.8(e) of A.P.

Prohibition Act, 1995 submitted case papers before the court. One sample is sent for chemical examination through Excise Station, Balanagar. Second sample is deposited before the court. The remaining seized property was deposited before the Deputy Commissioner of Excise, Ranga Reddy District for confiscation. The Govt. Chemical Examiner after analyzing the samples issued

CE Report No.5120/2015/10, dt.25.8.2015 opined that the sample is Illicitly

Distilled Liquor unfit for human consumption and injurious to health.

4.Basing on that charge sheet filed by the police, the case was taken on file for the offence U/Sec. 7A R/w 8(e) of A.P Prohibition Amendment Act, 1997, against the Accused.

A.P Prohibition Amendment Act, 1997 was framed. The charge was read over and explained to her to which she denied and claimed to be tried.

6. During the course of trial, the prosecution has examined PW1 and PW2 and got marked Exs.P1 to P4. The defense did not examine any witnesses and no exhibits were got marked on her behalf.

8.Now the point for consideration is:

Whether the prosecution has proved the guilt of the Accused beyond

all reasonable doubt for the offence punishable under section 7A R/w 8(e)

of A.P Prohibition Amendment Act, 1997?.

POINT

9.It is the case of the prosecution that the accused is ran away leaving 210

Illicitly Distilled Liquor sachets at open place, in front of H.No. 10-8-191, LBS

Nagar, Fathenagar after imposition of prohibition on liquor possession or sale.

As such the accused contravened the provisions of Sec 7A of A.P. Prohibition

Amendment Act, 1997 and liable for punishment u/s. 8(e) of A.P. Prohibition

Amendment Act, 1997. The prosecution to establish the present case against the Accused has relied on the testimonies of PW1 and PW2. LW1/Panch witness was examined as PW1, LW4/Investigation Officer and who filed the charge sheet was examined as PW2.

10. Now it would be seen how far the prosecution will prove the offences under section 7A R/w 8(e) of A.P Prohibition Amendment Act, 1997 against the

Accused.

11. PW1 turned hostile and deposed that at about long back police obtained his signatures on written papers. He does not know the accused. Ex.P1 is the signature on the panchanama.

12. The evidence of PW2 categorically reveals that on 11.08.2015 he received the case papers and seized property along with samples from LW3/N.

Srinivasulu. He registered the case in COR.No.237/2015-16. Ex.P2 is the COR.

LW3 conducted panchanama in the presence of PW1 and LW2. Ex.P3 is the panchanama. He has send the samples to the chemical examination and received the report. Ex.P4 is the chemical examination report. On 09.09.2015 the accused surrendered before the court and released on bail. After completing the investigation he has filed the charge sheet.

Liquor sachets was seized from the scene of offence in the presence of PW1 and LW2 but PW1 the panch witness has turned hostile by stating that no panchanama is conducted in his presence. Hence, the panchanama of seizure is not proved. The entire case is depending on the panchanama but the panchanama itself is not proved through the evidence of panch witness i.e., PW1 and LW2. Though the investigating officer/PW2 has stated about the facts of the case but, in the absence of proving the panchanama, the

In the absence of proving the panchanama, which is the basis for registering the case it cannot be said that the accused is involved in selling the Illicitly Distilled Liquor. Thereby, this Court is left with no other option except to acquit the accused.

Act, 1997 and thereby, the Accused is entitled for an acquittal. Accordingly, the point is answered.

The bail bonds of the Accused shall stand cancelled. The unmarked property if any shall be destroyed after expiry of appeal time.

In view Adalath this of National case is suo Lok- moto advanced from 31.01.2025 to today i.e. 05.12.2024. The prosecution filed the petition under Sec.321 of Cr.P.C. to withdraw the section 14(1) of C.L Act and also filed Alteration petition U/s. 216 Cr.P.C. to alter the section U/s. 79 of JJ Act to 374 of IPC and the same is allowed. Accused called present. He is examined under Section 251 Cr.P.C. for the offence under Sec. 374 of IPC. The substance of accusation is read over and explained to him. Accused pleaded and admitted his guilty voluntarily and also filed an affidavit to that extent. income and he is repenting for his acts. The accused prayed to take lenient view. Having regard to the nature of offence, the circumstances under which the incident took place and submissions made by the accused, this court is inclined to take lenient view while imposing sentence. Accordingly, sentencing the accused by imposing fine would meet the ends of justice. In the result, accused found guilty for the offence U/Sec. 374 of IPC. Accordingly the accused is sentenced to pay a fine of Rs.5000/- for the offence punishable under Section 374 of IPC in default of payment of fine to suffer simple imprisonment for period of 15 days. Since the accused has voluntarity admitted the guilt, the same is accepted and found the guilty under Section 252 Cr.P.C. The accused submitted that he is sole bread winner of his family and family members depended on his earnings. Accused further submitted that he has no other sources of income and he is repenting for his acts. The accused prayed to take lenient view. Having regard to the nature of offence, the circumstances under which the incident took place and submissions made by the accused, this court is inclined to take lenient view while imposing sentence. NBW against A2 recalled. A1 and A2 called present. Police filed the report stated that A4 whereabout not known and NBW pending against A4. Police filed the report stated that the death certificate of the A3 is not traced out and his wife is also not residing in the address. Hence to curtail the delay the case against A3 and A4 is split up and office is directed to give new CC No. 1657 of 2025.

A1 and A2 are present. They are furnished with copies of documents. They are examined under Section 251 of Cr.P.C. Accused Nos.1 and 2 pleaded guilty for the offence under Section 4 of A.P. Gaming Act.

The plea of guilt of accused are accepted as voluntarily made. Accused Nos.1 and 2 are convicted of the offence under Section 4 of T.S.Gaming Act, under Section 252 Cr.P.C When accused Nos.1 and 2 are questioned on the quantum of sentence to be imposed against them, they prayed the Court to take a lenient view while passing sentence. They stated that they are the sole bread earners of their family.

Considering the plea of A1 and A2, they are sentenced to pay a fine of Rs. 2000/- each for the offence U/s. 4 of A.P.Gaming Act, in total fine of Rs.4000 in default of payment of fine A1 and A2 shall under go S.I for 7 days for the offence under Section 4 of A.P Gaming Act.
