 This petition is coming on 19­04­2022 for hearing before me, in the presence of Sri. V. Murugan, Advocate for petitioner/Accused No.2 and of Sri V. Lokanadha Reddy, Additional Public Prosecutor for the respondent/complainant, and after hearing both sides, this Court made the following:­

ORDER

This is an anticipatory bail application filed on behalf of petitioner/accused No.2 u/sec 438 of Criminal Procedure Code ( Cr.P.C) to enlarge him on bail, in the event of his arrest by respondent/police.

2. (a) Offence involved in the present case is under A.P. Prohibition act and AP Excise amendment Act

(b) Date of offence is 10­03­2022.

(c) Particulars of contraband involved in the present case are 50 litres of ID arrack and 400 litres of FJ wash.

 3. Notice is given to learned Addl. Public Prosecutor and memo is received to that effect.

4. Heard and perused the material available on record.

5. The Point for determination is :­

 Whether the petitioner/accused No.2 is entitled to the relief of

anticipatory bail u/sec 438 of Cr.P.C, as prayed for ?

 6. POINT:­ It is submitted on behalf of petitioner that he did not commit the alleged offence levelled against him; alleged offence is a foisted one without there being a Primafacie case whatsoever; petitioner is sole bread winner for his family and that if he is permitted to be arrested by respondent he will be put to great hardship and therefore he may be enlarged on anticipatory bail.

7. Present bail application is strongly resisted on behalf of prosecution mainly on the ground that if the petitioner is enlarged on anticipatory bail, he may cause threat on prosecution side witnesses and that it will become an impossible task to secure the presence of accused

before trial court, during the course of trial and therefore bail application

deserves for dismissal.

8. I have carefully gone through with the material available on record.

9. As per record, investigation of the case is half way through and it is not yet completed. Further, as observed supra, huge quantity of contraband which is injurious to the health of the public is involved in the present case. Therefore, any anticipatory bail in favour of petitioner will cause great hindrance to the investigation to be done by prosecution.

10. Thus, present bail application is devoid of any merit and deserves for dismissal.

11. Hence, the point is answered accordingly.

12. In the result, the anticipatory bail application filed on behalf of petitioner/accused No.2 is dismissed.

Point for determination is :­ Whether petitioners/accused 1 to 4 are entitled to the relief of anticipatory bail u/sec 438 of Cr.P.C as prayed for ?

POINT :­ It is submited on behal fof petitiones thtat they did not commit any offence much ess the alleged offence levelled against them; they never hrassed or ill treated the victi at any point of time; only to wreck vengence against them, present case is foisted; if they are ermitted tobe arrested by respondnet/police, they will be put to great hardship and therefore they may beenalrged on anticipatory bail.

Per contra, it is urged on behalf of the proecution that if thepetitioers are enlarged on bauk, they will disappear the evidence ofprosecution sought and therefore bail application isliable tobe dismsised.

I have carefylly gone trough with the entilre materila avilableon recored. As per record, alleged offence said to have been committed by petitioners is takebnplace on 19­5­2018 and the report on hand is given by defacto complaiant on 16­3­2022. Be that as it may, record would intdicate that major part of the investigation of the case is completed.

In the light of the afores said discussion and by takingintoconsideration of the facts and circumstnces involved in the present case, I am of the considered view thatit is a just and propr case to consider 8 the relief of anticipatory bail in favour ofpetitioners subject to certain conditions to meet the ends ofjusitce.

Hence the point sianswered accordingly.

POINT :­ (a) Quantity of Ganja involved in the present case is :­

(c) It is submitted on behalf of accuse dhtat he/they is are an innocent person/ innocnet persons; present case is foisted against them withotu their 9 beinga asis what so ever; petitioneriw/are only earningmember of the family; if thepetitioner/petitioners is/are continued tobe in Judicial custody, he/they will beput to great hardship and hence thebail application.

Present baik applicationis strongly reisted on behalf of prosecution on ther ground that if the accused is/are enalrged on bail, definitely, he/ they will commit the same offence once again; further, it will become a credible task to secure their presence durig the course of trial; they may also tamper the eviene of proseuction side and therefore bail application deserves for dismisssal.

I have givben y conspicious thought and reading over the materiala availaleon record. The gang involved in the prsent case, referred supra, comes under commercial quantity. Therfore, section 37 of the

NDPSAct, comes into pitcutre and according to it, if the court intents to grant bail.yhe court has tyo satisfy tnat there are reasomable grpunds for believing that the accused is not guilty of such offence and that he is not likely to commit any ofrnece3 whil on bail, But in the oresent case, since primafacie case is madeout against accused u/sec 20(b)(ii)(C ) of the NDPS act, this court cannot come to such a conclusion.

In the light of the saforesesiad discussion and by takinginto consideration of the facts and circumstances involvedin the prsent case, I am of the considered view that it is not at all a just and proper case to consider the relief of relular bail in favour of accused.

Hence thepint is answered accordingly.

In the result, the bai application filed on brehalf of petitioner/petitioners/accused is dismissed.

2. Contention of petitioners/accused 4 and 5, in concise, is this:

Petitioners submit that they did not commit the alleged offence levelled against them; there is no prima facie case against the petitioners; petitioners are sole breadwinners for their respective families; petitioners are law abiding citizen; if the petitioners are confined in judicial custody, their families will be put to great hardship and therefore they may be enlarged on regular bail.

3. Notice is given to the learned Additional Public Prosecutor and memo is received to that effect.

4. Contention of respondent/prosecution, in precise, is this :

Respondent submits that offence levelled against petitioner is very serious in nature; investigation of the case is not yet completed; if the petitioners are enlarged on bail, they may cause threat on prosecution side witnesses and that it will become an impossible task to secure their presence during the course of trial and therefore bail application deserves for dismissal.

6. The point for determination is:

Whether petitioners/accused 4 and 5 are entitled to the relief of

regular bail under Section 439 of Criminal Procedure Code (in

short "Cr.P.C"), as prayed for?

7. POINT:

Offence involved in the present case is under Sections 363 and 370(4) r/w 34 of IPC.

Date of offence was 20.03.2022 and the petitioners are in judicial custody since 22.03.2022.

8.It is submitted on behalf of petitioners that they are law abiding citizen and that they did not commit the alleged offence levelled against them; if they are confined in judicial custody, they will be put to great hardship and therefore they may be enlarged on bail.

9.Present bail application is strongly resisted on behalf of prosecution mainly on the ground that the investigation of the case is not completed and if the petitioners are enlarged on bail, they may cause threat on prosecution side witnesses.

10.Main accusation against accused is that "A newly born male baby from

Government Hospital, Chittoor was kidnapped in between 4.00 a.m., to 5.45 a.m. on 19.03.2022."

11.I have carefully gone through with the material available on record.

12.Previous bail application filed on behalf of petitioners/accused No.4 and 5 was dismissed by this court on the ground that investigation of the case is not yet completed. But, now record would disclose that major part of the investigation of the case is completed. Further, petitioners/A4 and A5 are in judicial custody since 22.03.2022.

13.In the light of aforesaid discussion, I am of the considered view that it is a just and proper case to consider the relief of regular bail in favour of 13 petitioners/accused 4 and 5 subject to certain conditions to meet the ends of justice.

14.Hence, the point is answered accordingly.

15.In the result, petitioners/accused 4 and 5 shall be enlarged on bail on executing personal bonds for Rs.20,000/­ (Rupees Twenty thousand only) each with two sureties for a like sum each to the satisfaction of learned

IV Additional Judicial Magistrate of I Class, Chittoor. Further, petitioners/accused 4 and 5 are directed to appear before Station House

Officer, Chittoor II­Town Police Station on every Sunday in between 10.00 a.m., and 5.00 p.m., for a period of two months or till the date of filing of charge sheet, whichever is earlier.

This Criminal Revision Petition coming on 09.03.2022 before me for hearing, upon perusing the grounds of revision petition and other connected papers on record and upon hearing the arguments of Sri M.Papaiah and Sri K.Satyamoorthy, Advocates for the Revision Petitioner and Smt P.Himabindu, Additional Public Prosecutor for 1st Respondent and Sri V.Jaya Kumar, Advocate for Respondent No.2, and having stood over for consideration till this day, this court made the following:­

O R D E R

This is a criminal revision petition filed by petitioner under Sections 397 and 402 of criminal Procedure Code to set aside the order, dt.30.11.2020 passed in Crl.M.P.No.308/2020 on the file of learned IV

Additional Judicial Magistrate of I Class, Chittoor.

2.Contention of revision petitioner before learned court below, in concise, is this :

Petitioner is an absolute owner of Maruthi Baleno car bearing No.AP­ 03 CD­4734, having purchased the same by petitioner through HDFC Bank,

Chittoor Branch under Rural Auto loan scheme in the month of February, 2017 for a total loan of Rs.7,04,482/­; petitioner paid the down payment and also discharged the loan amount; but the vehicle was registered in the name of 2nd respondent who is his wife; believing the deceitful words of 2nd respondent, petitioner got registered the said car in her name; later, misunderstandings cropped up between husband and wife and that they are living separately; in proof of possession of schedule mentioned car, 2nd respondent in O.S.No.3/2019 on the file of learned VIII Additional District

Court, Chittoor which was filed by 2rd respondent for partition, categorically stated that the car is in the custody of petitioner; petitioner is a heart patient and he badly require his car for his personal use and for appearing before the medical practitioners for medical aid and hence the petition seeking interim custody of said car.

3.Learned court below after hearing petitioner and 2nd respondent dismissed the petition with a finding that "At this juncture the court may not come to the conclusion who is real owner of the disputed seized property."

4.Aggrieved with the said order, present criminal revision petition is filed by revision petitioner urging the following :

GROUNDS OF REVISION

The order of court below is bad in law and material placed on  record.

Court below committed a grave mistake in accepting the  documents produced by 2nd respondent.

Petitioner is the absolute owner of Maruthi Baleno car and he  purchased the same by availing loan from HDFC Bank, Chittoor

Branch under Rural Auto Loan scheme and the petitioner only paid entire installments amount. 

Court below ought to have seen that the petitioner purchased the  said vehicle in the name of 2nd respondent on love and affection and also believing the deceitful words of the 2nd respondent.

Court below ought to have seen that petitioner and 2nd  respondent are living separately because of misunderstandings cropped up between them.

Court below ought to have seen that petitioner requires the said  vehicle as he is suffering from heart ailments and for his personal use.

Court below ought to have seen that if the vehicle is kept at police  station, there is every possibility that the vehicle will be damaged. 

Revision Petitioner therefore prays that interim custody of said vehicle may be granted in his favour by setting aside the order of court below.

5.On behalf of revision petitioner, Exs.P.1 to P.4 are marked and on behalf of 2nd respondent, Exs.R.1 and R.2 are marked.

6.Heard learned counsel for both parties and perused the entire material available on record.

7.The points for determination are :

1) Whether revision petitioner is entitled to seek interim

custody of vehicle in question, as prayed for ?

2) Whether the order of learned court below is sustainable under law and facts ?

3) To what relief ?

8.POINT Nos.1 AND 2 :

Since these two points are inter­related in nature, they are taken up together for just and proper adjudication of the matter.

The vehicle in dispute is in police custody. Generally, if any vehicle is kept in idle without use and exposing to sunlight and air, definitely, its value will be deteriorated and it will become useless in a short span of time. 

9.Undisputed fact of the case is that "WIFE" is registered owner of the vehicle. The registration certificate of vehicle stands in her name in government records. The relationship between disputed parties is husband and wife. But, because of matrimonial disputes several cases are pending between them and as such they are under logger heads. Further, they are living separately.

10.The vehicle was seized by police and kept in police custody on the report given by wife against husband.

Contention of husband is that he purchased the said vehicle by availing loan from HDFC Bank, Chittoor and that he himself from his 5 earnings had discharged the loan amount and the said vehicle is required for his personal use as he is suffering from heart ailment.

Per contra, it is submitted on behalf of wife that it was purchased by herself and as such registration certificate of the vehicle stands in her name.

11.Under Motor Vehicles Act, in whose name, the vehicle stands registered, that person will be treated as owner of the vehicle.

12.In the present case, it is not the contention of respondent that either as a general power of attorney holder or as guardian, he purchased the vehicle in the name of his wife. Even according to husband, due to his love and affection towards his wife, he purchased the vehicle in the name of his wife. So, we can safely presume that at the time of said purchase his main intention is that the vehicle should be used by his wife.

13.A registered owner is usually the person or entity that is on the government records as being the legal owner of certain property such as movable or an immovable property. We cannot forget that if anything is caused by that vehicle or anything was happened to it, definitely, the registered owner has to face the risk and consequences.

14.After giving conspicious thought over the dispute on hand with regard to interim custody of vehicle, I am of the view that it is a just and proper case to grant interim custody of vehicle in favour of registered owner 6 (wife) pending disposal of main case i.e., subject to final order by learned trial Court.

15.Learned counsel for petitioner has invited my attention to the following decisions reported in 

1) (2016) 10 AD (Delhi) 320 Between : Yogita Dasgupta ­ Appellant

vs. 

Kaustav Dasgupta ­ Respondent

2) AIR 2022 (NOC) 124 (TRI) Between : Arun Das

vs. 

Aparna Das

In the said decisions, it was held that "If the plaintiff discharged the onus which lay upon him to prove that the property was purchased by him not for the benefit of his wife, but for that of the family as a whole, in such a case, it does not come under the purview of a benami transaction."

The proposition of law laid down in the said two decisions is not applicable to the facts and circumstances involved in the present case since the present case is at threshold stage and trial of the matter is not yet commenced with regard to disputed property, to decide who is actual owner of the vehicle in question.

16.Hence, these two points are answered against the petitioner.

17.POINT No.3 :

In the result, criminal revision petition filed by petitioner is dismissed. But, the order of learned IV Additional Judicial Magistrate of

I Class, Chittoor is modified as per orders passed by this court in Criminal

Revision Petition No.15/2021, dt.07.04.2022 and in that connection the said order may be read as part of this order. Dismissal of this petition is no way prejudice to the rights and contentions of Revision Petitioner with regard to the disputed vehicle at the time of final adjudication of main case on the file of learned IV Additional Judicial Magistrate of I Class, Chittoor.

2.Contention of revision petitioner before learned court below, in concise, is this :

Petitioner submits that she is registered owner of Maruthi Baleno car bearing Regn. No.AP­03­CD­4734; the said vehicle is in the custody of

Station House Officer, I­town police station, Chittoor; at the instance of petitioner the said vehicle is seized from the possession of 2nd respondent; if the said vehicle is kept idle at police station, its value will be decreased and ultimately the said vehicle will be spoiled and hence interim custody of said vehicle may be granted in favour of petitioner.

3.Learned court below after hearing both parties has dismissed the petition with a finding that "At this juncture, the court may not grant interim custody to the petitioner until full­fledged trial and before that the property shall be in the custody of police."

4.Aggrieved with the order passed by learned court below, present criminal revision petition is filed by petitioner and urged the following :

GROUNDS OF REVISION

The court below has not appreciated the case of revision  petitioner.

Order of court below is not maintainable under law. 

Court below has miserably failed to consider the fact that revision  petitioner is the registered owner of Maruthi Baleno car.

Curt below ought o have seen that immediately after taking illegal  custody of the vehicle by 2nd respondent from the custody of revision petitioner, he fixed black colour paper to the window glasses and rear glass and used the vehicle for his illegal activities.

The court below ought to have seen that the said vehicle which is  now in the custody of police, if it is continued in the custody of police, its value will be decreased and ultimately the said vehicle will be spoiled.

the Revision Petitioner therefore prays that interim custody of said vehicle may be granted in favour of petitioner.

5.On behalf of revision petitioner, Exs.P.1 to P.9 are marked. On behalf of 2nd respondent, no document is marked.

6.Heard learned counsel for both parties and perused the entire material available on record.

7.The points emerge for determination in the criminal revision petition are :

1) Whether revision petitioner is entitled to seek interim

custody of vehicle in question, as prayed for ?

2) Whether the order of learned court below is sustainable under law and facts ?

3) To what relief ?

8.POINT Nos.1 AND 2 :

Since these two points are inter­related in nature, they are taken up together for just and proper adjudication of the matter.

The vehicle in dispute is in police custody. Generally, if any vehicle is kept in idle without use and exposing to sunlight and air, definitely, its value will be deteriorated and it will become useless in a short span of time.

9.Undisputed fact of the case is that "WIFE" is registered owner of the vehicle. The registration certificate of vehicle stands in her name in government records. The relationship between disputed parties is husband and wife. But, because of matrimonial disputes several cases are pending between them and as such they are under logger heads. Further, they are living separately.

10.The vehicle was seized by police and kept in police custody on the report given by wife against husband.

Contention of husband is that he purchased the said vehicle by availing loan from HDFC Bank, Chittoor and that he himself from his earnings had discharged the loan amount and the said vehicle is required for his personal use as he is suffering from heart ailment.

Per contra, it is submitted on behalf of wife that it was purchased by herself and as such registration certificate of the vehicle stands in her name.

11.Under Motor Vehicles Act, in whose name, the vehicle stands registered, that person will be treated as owner of the vehicle.

12.In the present case, it is not the contention of respondent that either as a general power of attorney holder or as guardian, he purchased the vehicle in the name of his wife. Even according to husband, due to his love and affection towards his wife, he purchased the vehicle in the name of 5 his wife. So, we can safely presume that at the time of said purchase his main intention is that the vehicle should be used by his wife.

13.A registered owner is usually the person or entity that is on the government records as being the legal owner of certain property such as movable or an immovable property. We cannot forget that if anything is caused by that vehicle or anything was happened to it, definitely, the registered owner has to face the risk and consequences.

14.After giving conspicious thought over the dispute on hand with regard to interim custody of vehicle, I am of the view that it is a just and proper case to grant interim custody of vehicle in favour of registered owner (wife) pending disposal of main case i.e., subject to final order by learned trial Court.

15.Learned counsel for petitioner has invited my attention to the following decisions reported in 

1) Hon'ble Supreme Court of India Between : Naveen Kumar 

vs. 

Vijay Kumar and Ors.

06­02­2018 Civil Appeal No.1427/2018

In the said decision, it was held that "Under Motor Vehicles Act, the person whose name is reflected in the records of the registered authority is the owner and the owner withing the meaning of Section 2(30) of Motor

Vehicles Act is liable to compensate." 6

2) Before the Hon'ble High Court of Madras Between : Vignesh Kumar

vs. 

State 22­01­2016 Criminal Revision Case (MD) No.13/2016.

In the said decision, it was held that "Where a vehicle in connection with an offence is lying and exposed to sun and rain at police station or court, the condition of the vehicle would be deteriorated and therefore interim custody of the vehicle would be handed over to the registered owner of the vehicle on furnishing surety."

The dictum laid down int he said two decisions is very much useful to the contention of wife to say that she is entitled to take interim custody of vehicle in question subject to production of surety as required under law. 

16.Hence, these two points are answered accordingly.

17.POINT No.3 :

In the result, criminal revision petition filed by petitioner is allowed by setting aside the order, dt.30.11.2020 in Crl.M.P.No.309/2020 in

Crime No.13/2020 on the file of learned IV Additional Judicial Magistrate of

I Class, Chittoor. In consequence, the vehicle i.e., Maruthi Baleno car

bearing Registration No.AP­03 CD­4734 shall be given interim custody to petitioner, pending disposal of main case i.e., subject to final order by trial court and subject to execution of a personal bond for Rs.5,00,000/­ (Rupees

Five lakhs only) by petitioner with a single surety for a like sum to the satisfaction of learned IV Additional Judicial Magistrate of I Class, Chittoor.

Further, petitioner is directed not to alter or change the vehicle and produce the said vehicle before learned trial court as and when required.

This Criminal Revision Petition coming on 04.04.2022 before me for hearing, upon perusing the grounds of revision petition and other connected papers on record and upon hearing the arguments of Sri V.Ramanarayana Reddy, Advocate for Petitioner and Sri T.K.Sundara Kumar, Advocate for Respondent, and having stood over for consideration till this day, this court made the following :­

O R D E R

This is a criminal revision petition filed on behalf of revision petitioner/accused to set aside the order passed in Crl.M.P.No.4880/2019 in

C.C.No.201/2016, dt.10.12.2019 on the file of learned Special Judicial

Magistrate of I Class for Prohibition and Excise, Chittoor.

2.Contention of revision petitioner/accused, in concise, is this :

Revision Petitioner never borrowed any amount from respondent/complainant; the case was filed by complainant with the instigation of one Subhash Chand Jain; the said Subhash Chand Jain has already filed a case against the petitioner in C.C.No.408/2014 on the file of 2

Special Judicial Magistrate of I Class for Prohibition and Excise, Chittoor and the same is ended in favour of petitioner on 26.08.2016, the certified copy of calender and judgment in C.C.No.408/2014 is very much necessary to prove the defence of revision petitioner; but, learned court below dismissed the petition filed by revision petitioner under Section 294 of Cr.P.C and hence the present revision petition.

3.Contention of respondent/complainant, in precise, is this :

This respondent submits that the judgment in C.C.No.408/2014 is irrelevant and immaterial and it cannot be received or marked in the case filed by complainant against revision petitioner; this respondent enquired with said Subhash Chand Jain about the said case, after receiving copy of petition in the petition and it is reliably learnt that there is a criminal appeal pending on the file of Hon'ble High Court of A.P and thus the said judgment is not final; a document which is not between the parties cannot be received in evidence in a criminal case and it is not binding on this complainant.

4.Learned court below has dismissed the Crl.M.P.No.4880/2019 in

C.C.No.201/2016. Aggrieved with the said order, accused in the said criminal case as revision petitioner has preferred present criminal revision petition urging the following :

GROUNDS OF REVISION

The order of court below is against law and weight of evidence. 

Court below without giving any valid finding dismissed the  petition.

Court below ought to have seen that the certified copy of judgment  in C.C.No.408/2014 is very much essential to prove the cae of revision petitioner.

Court below ought to have seen that the complainant in  C.C.No.408/2014 is the root cause for filing the present case through the complainant who are inter­related to each other.

Court below ought to have seen that the certified copy of judgment  in C.C.No.408/2014 is admissible in evidence, but the court below given a finding in its order that it is inadmissible in evidence.

Court below came to a wrong conclusion and dismissed the  petition filed by revision petitioner.

Therefore, the revision petitioner prays that the order of the court below may be set aside and direct the court below to receive the document to file.

5.Heard learned counsel for both parties and perused the record.

6.The core point for determination before this court is :

Whether the order passed by learned court below in

Crl.M.P.No.4880/2019, dt.10.12.2019 is valid and

sustainable under law and facts ?

7.POINT :

The revision petitioner who is accused in C.C.No.201/2016 has filed a petition under Section 294 of Cr.P.C to receive the document i.e., certified copy of judgment in C.C.No.408/2014 on the file of learned Special

Judicial Magistrate of I Class for Prohibition and Excise, Chittoor to file on

his behalf to substantiate his defence.

8.In this context, contention of revision petitioner is that one

Subhash Chand Jain is behind the back of the present litigation; the said

Subhash Chand Jain has filed a case against the revision petitioner in

C.C.No.408/2014 and it was ended in acquittal in favour of revision petitioner and therefore the certified copy of calender and judgment in

C.C.No.408/2014 may be received to file on his behalf.

9.The said petition was dismissed by learned court below and the main reason for dismissing the petition in question by learned court below is that "The transaction between the accused and complainant and the transaction between accused and Subhash Chand Jain are different and therefore the judgment in C.C.No.408/2014 is irrelevant and the same cannot be considered as the same is inadmissible in evidence."

10.I am unable to agree with the said finding of learned court below for the reason that at the time of permitting the document to file, we are not presupposed to decide the validity and binding nature of the document. It may be pointed out that unless the document is confronted to witness, it is not possible to decide the affect and impact of said document. Admittedly the proposed document is certified copy of judgment in C.C.No.408/2014 filed by one Subhash Chand Jain against revision petitioner/accused, in which, accused was acquitted. In the present case, it is the specific defence of accused that the said Subhash Chand Jain is behind the back of present litigation. Therefore, definitely, there is some relevancy in filing the petition by accused to receive the document to file. In such a situation, we cannot brush aside the prayer of petitioner as intended only to drag on the matter.

11.In the light of aforesaid discussion, I am of the considered view that the impugned order passed by learned court below is liable to be set aside.

12.Hence, the point is answered accordingly.

13.In the result, the order passed in Crl.M.P.No.4880/2019 in

C.C.No.201/2016, dt.10.12.2019 on the file of learned Special Judicial

Magistrate of I Class for Prohibition and Excise, Chittoor is set aside. In

consequence, learned court below is directed to receive the certified copy of the calender and judgment in C.C.No.408/2014 on the file of learned

Special Judicial Magistrate of I Class for Prohibition and Excise, Chittoor, on behalf of revision petitioner/accused to file subject to proof and relevancy and without prejudice to the rights and contentions of complainant.

 This petition is coming on 21.04.2022 for hearing before me, in the presence of Sri Syed Akbar Basha, Advocate for petitioner/Accused No.3 and of Sri P.V.Chakravarthi Reddy, Additional Public Prosecutor for the respondent/complainant, and after hearing both sides, this Court made the following:­

ORDER

This is a regular bail application filed on behalf of petitioner/3rd accused under Section 439 of Cr.P.C to enlarge her on bail.

2. Contention of petitioner/3rd accused, in concise, is this:

Petitioner submits that she did not commit the alleged offence levelled against her; there is no prima facie case against the petitioner; petitioner is sole breadwinner for her family; petitioner is a law abiding citizen; if the petitioner is confined in judicial custody, her family will be put to great hardship and therefore she may be enlarged on regular bail.

3. Notice is given to the learned Additional Public Prosecutor and memo is received to that effect.

4. Contention of respondent/prosecution, in precise, is this :

Respondent submits that offence levelled against petitioner is very serious in nature; investigation of the case is not yet completed; if the petitioner is enlarged on bail, she may cause threat on prosecution side witnesses and that it will become an impossible task to secure her presence during the course of trial and therefore bail application deserves for dismissal.

5.Heard and perused the record.

6. The point for determination is:

Whether petitioner/3rd accused is entitled to the relief of regular

bail under Section 439 of Criminal Procedure Code (in short

"Cr.P.C"), as prayed for?

7. POINT:

Offence involved in the present case is under Sections 363 and 370(4) r/w 34 of IPC.

Date of offence was 20.03.2022 and the petitioner is in judicial custody since 21.03.2022.

8.It is submitted on behalf of petitioner that she is a law abiding citizen and that she did not commit the alleged offence levelled against her; if she is confined in judicial custody, she will be put to great hardship and therefore she may be enlarged on bail.

9.Present bail application is strongly resisted on behalf of prosecution mainly on the ground that the investigation of the case is not completed and if the petitioner is enlarged on bail, she may cause threat on prosecution side witnesses.

10.Main accusation against accused is that "A newly born male baby from

Government Hospital, Chittoor was kidnapped in between 4.00 a.m., to 5.45 a.m. on 19.03.2022." 3

11.I have carefully gone through with the material available on record.

Previous bail application filed on behalf of petitioner vide

Crl.M.P.No.275/2022 was dismissed by this court on 01.04.2022.

12.As per record, major part of the investigation of the case is completed.

Further, as observed supra, petitioner is in judicial custody for the last one month.

13.In the light of aforesaid discussion and by taking into consideration of the fact that petitioner who is a lady was in judicial custody for the last one month, I am of the considered view that it is a just and proper case to consider the relief of regular bail in favour of petitioner subject to certain conditions to meet the ends of justice.

14.Hence, the point is answered accordingly.

15.In the result, petitioner/3rd accused shall be enlarged on bail on executing a personal bond for Rs.20,000/­ (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of learned IV

Additional Judicial Magistrate of I Class, Chittoor. Further, petitioner/3rd

accused is directed to appear before the Station House Officer, Chittoor II­ town Police station on every Sunday in between 10.00 a.m., and 5.00 p.m for a period of two months or till the date of filing of charge sheet, whichever is earlier.
