CLAIM FOR: This is a petition filed by the Decree Holder under Order XXI rule 11 of CPC praying the court to order for attachment of salary shown in the schedule belongs to the Judgment debtors No.3, 7 under Order 21 rule 48 C.P.C in satisfaction of the decreetal amount with feature interest @ 6% per annum till realization and directing the disbursing officer of the judgment debtors No.3, 7 to deduct their amount shown in the schedule respectively and deposit in this case account for payment to the decree holder in satisfaction of the decree.

CLAIM FOR: This is a suit filed by the plaintiff under Order 7 rule 1 of CPC r/w Section 26 of CPC praying the court to decree that the plaintiff is entitled half share in the suit schedule property shown in the schedule by preliminary decree and to appoint a commissioner to divide the suit schedule property into 2 equal shares by metes and bounds and to allot one such share to the plaintiff and deliver the possession by a final decree and to award costs of the suit.

This suit is coming before me and Sri V.Madan Mohan, Advocate representing on behalf of the plaintiff, and Sri.Shaik Rafi, representing on behalf of the defendant and after perused the record and having stood over for consideration till this day, this Court has made the following:

Sri.V.Madan Mohan, Advocate and plaintiff in person are present and reported that the plaintiff was declared as major from guardianship as per orders in I.A.No.289 of 2025 and filed Vakalath for plaintiff and also filed a not press memo by issuing notice to other side counsel. On perusal the plaintiff was discharged from guardianship as per orders in I.A.No.289 of 2025 dated 10.09.2025. There is no Vakalath of plaintiff after discharging guardianship as such Vakalath is filed for plaintiff by the said Sri.V.Madan

Mohan advocate and at request vakalath is taken on record. On perusal of not press memo the other side counsel endorsed as no objection. The plaintiff also endorsed as not pressed on the last page of plaint. In these circumstances at request the suit is dismissed as not pressed.
