Claim:-This suit filed by plaintiff for Partition, declaration and possession for perpetual injunction and also for damages in respect of respective schedule properties restraining respective Defendants from alienating the schedule properties.
This suit is coming before me in the presence of Sri.R.A.Achutanand and
Sri.K.Srinivas Rao, Advocates for the Plaintiff and of Sir.Md.Anwaruddin, Advocate for the Defendant Nos.4, 5, 7, 79, 87 & 88 and of Sri.K.Sai Reddy, Advocate for the Defendant Nos.D8 to 10 and of Sri. A.Sameer Kumar, Advocate for the Defendant No.11 and the Defendant No.3 is died, and the Defendant Nos.1, 2, 12 to 78 and 80 to 86 not pressed against the suit, and this court doth order as follows:

Heard, perused the records. On 28-08-2023 a memo was filed by plaintiff identified by her counsel as to not pressing the suit against LRs of defendant No.3 who are already on record and also against the defendant Nos.1, 2, 6, 12 to 78 and 80 to 86, it was prayed to dismiss the suit against the said defendants as not pressed. The plaintiff and other defendants were called present., Even compromise petition was filed by counsel between plaintiff and defendant Nos. 4, 5, 7 to 11, 79, 87 and 88.

It is seen from the record that the suit was filed by the plaintiff herein against the defendant Nos.1 to 88. During the pendency of suit defendant No.3 died and as already defendant Nos.5 to 11 who are the legal heirs of Defendant No.3 were on record, to that extent memo was filed before the court, amendment was carried out and neat copy of plaint was filed.
The relief claimed by the plaintiff is to grant the decree of declaration declaring the sale deeds bearing document Nos.2877/1995, 2878/1995, 2879/1995, 2881/1995, 2880/1995, 2882/1995, 2883/1995, 2884/1995, 2885/1995, 1570/2002 as null and void and to restrain the defendants mentioned in the prayer portion from interfering in the suit schedule properties. The suit schedule properties are shown as Schedule 1-A to J, Schedule II-A, Schedule III-A to Q, Schedule IV-A to D, Schedule V-A to Schedule V-D, Schedule VI-A to Schedule VI-D, Schedule VII-A to Schedule VII-C, Schedule VIII, Schedule IX, Schedule X, Schedule XI, Schedule XII, even the plaintiff also sought for grant of preliminary decree allotting a share to her along with her siblings in respect of their suit ancestral properties.
The record shows that the defendant No.6 filed his written statement along with defendant Nos. 75 and 76 denying that suit schedule properties are ancestral properties, it is also mentioned that the concept of joint family was broken in the year 1974. They denied the version of plaintiff and even prayed the court to dismiss the suit.
As discussed above on 28-08-2023 a memo was filed by the plaintiff not pressing the suit as discussed above, the defendant No.6, appeared personally and opposed the same, one Sri.G.Bhaskar advocate filed vakalath with no objection for defendant No.6, he opposed the memo.
On considering the nature of reliefs sought in the main suit and on considering the written statement filed by defendant No.6, this court feels that as plaintiff herself is not pressing the suit and if at all the defendant No.6 got any objection in regard to the joint family properties,, if he is claiming any right, he has to file separate suit for his claim, he cannot restrain the plaintiff to withdraw the suit.
Hence, the suit against defendants Nos.1, 2, 6, 12 to 78 and 80 to 86 is here by dismissed as not pressed.
Further the suit is referred to Lok Adalath, office is hereby directed to transmit the filed accordingly.
