This case is coming before me for final hearing and disposal in the presence of Addl. Public Prosecutor representing the State and of Sri B.Ram Mohan, Counsel for the accused and having been heard and stood over for consideration till this day, this Court delivered the following:-

J U D G M E N T

1. The prosecution charged the accused in Crime No.193/2012 under sections 305 & 306 IPC and Section 3(2)(v) of Scheduled Castes and

Scheduled Tribes (Prevention of Atrocities) Act, 1989, basing on the complaint of LW-1 Balamma that her brother-in-law Mysani Basappa

S/o.Late Basappa and his son Ravinder Kumar were residing in front of her house and they slept in their house on the night of 4-12-2012. On 5-12-2012 at 7.30 hours, the doors of their house were not opened and no reply of them on her call, thereby she told her son Mysani Venkatappa and one Rayappa of her caste person to go to see them as they are not responding. Venkatappa and Rayappa went there and removed inner bolt of the door and they observed that Mysani Basappa and his son Ravinder were found dead by 2 consuming pesticide poison and they also observed that Mysani Basappa and his son Ravinder were found dead by consuming pesticide poison and they also observed that three papers were pasted to the wall stating that they died due to the harassment by Madhu Sudhan Reddy and beating for studying the sorcery books and he taking away Prathap, the son of Madhu Sudhan

Reddy’s brother to study the same books. Madhu Sudhan Reddy locked the new house of Ravinder on Saturday and beat Ravinder and called a

Panchayath on 3-12-2012 Monday. The deceased committed suicide by consuming pesticide poison and died due to the unbearable harassment meted by Madhu Sudhan Reddy (accused).

2. After appearance of accused, he is examined U/s.228 (2) Cr.P.C. in which he denied prosecution allegations. Charges U/s.305 & 306 IPC and

Section 3(2)(v) of Scheduled Castes and Scheduled Tribes (Prevention of

Atrocities) Act, 1989 were framed, read over and explained to the accused, for which he pleaded not guilty and claimed for trial.

3. On behalf of the prosecution, PWs 1 to 20 were examined and Ex.P-1 to P-30 were marked.

4. The accused is examined U/s.313 Cr.P.C.in which he denied incriminating evidence.

5. Heard the arguments.

6. The point for determination is whether the prosecution established the guilt of accused beyond all reasonable doubt under the charged section?

7. PW-1 is the complainant. Deceased is her brother-in-law by relation.

Another deceased Ravinder is son of Basappa. They died four years ago due to consuming poison. Next day after the death in the morning at 8.30 am

PW-1 saw the door of the deceased was not opened and informed the same to 3 her son and others. They opened the doors and found two dead bodies and poison bottle. On the previous day of the death a panchayat was held by the elders and reprimanded the deceased as to why Ravinder and his friends were not going to the school and in the evening he saw both the deceased going outside. Next day he found the dead bodies in the house. The village servants threatened the deceased what they were doing at the canal without going to the school. Because of the said panchayat they felt insulted and committed suicide. PW-1 stated that she did not submit any police complaint. PWs 2 and 3 who are eye witnesses and participated in the panchayath turned hostile stating that she did not know what happened in the panchayath as they were present. PW-4 to PW-8 also did not know anything about this case details. They did not know how the deceased died. So also

Pw-9 to P-12. Pw-13 and PW-14 who are co students of deceased also turned hostile.

8. PW-15 is photographer who took Ex.P-16 photos at the instance of the police. PW-17 is Tahasildar who issued the caste certificate of Pw-1 and

Pw-2 and Ravinder as well as accused regarding their respective caste vide

Ex.P-21 caste certificate. PW-18 is Head Constable who issued FIR. PW-19 is SI of Police who conducted inquest over the deceased No.2. PW-20 is the investigation officer. He spoke about the investigating part. Thus, the material on record, failed to bring home the guilt of accused. Therefore, the accused is not found guilty.

9. In the result, accused is acquitted U/s.235(1) Cr.P.C.for the charges

U/s.305 & 306 IPC and 3(2)(v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

J U D G M E N T

The prosecution charged the accused in Cr.No.190/2013 for the offence

U/s.354 IPC and 3(1) (xi) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, basing on the complaint of LW-1

Shankaramma to the effect that her marriage was performed with one

Bheemappa R/o.Chengeshpur, about three year ago and due to some differences she is staying with her parent’s house at Allapur Village and eking her livelihood by attending daily coolie work. On 16-12-2013 at about 10.35 hours when she was returning into village after handing over meals box to her brother Lalappa who is working at labouradda. When she reached near to Maisamma Temple, one Prashanth Goud, S/o.Narsimulu Goud,

R/o.Allapur Village approached her and caught hold her and forcibly took her 2 into the bushes with an intention to outrage her modesty. She escaped from the hands of said Prashanth Goud and return to house and informed to her parents and informed her brother over phone.

2.After appearance of the accused, he was examined U/s.228(2)

Cr.P.C in which he denied prosecution allegations. Charges U/s.354 IPC & 3(1)(xi) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities)

Act, 1989 against accused were framed, read over and explained to the accused, for which he pleaded not guilty and claimed for trial.

3.On behalf of the prosecution, PWs 1 to 7 were examined and

Ex.P1 to P12 were marked.

4. The accused was examined U/s.313 Cr.P.C.in which he denied incriminating evidence.

5.Heard the arguments.

6.The point for determination is whether the prosecution established the guilt of accused beyond all reasonable doubt under the charged sections?

7.PW-1 is the complainant turned total hostile stating that she does not know accused and she never saw him, nobody committed any perpetration against her. Ex.P-1 is her signature. According to her, she did not submit any police complaint, she cannot say for what purpose, she signed.

PW-2 is the mother of PW-1. PW-3 is father of Pw-1. Pw-4 is brother of

PW-1. PW-5 is the circumstantial witness. As per his evidence, he did not witness any incident in this case between accused and PW-1. Pw-6 is the

Tahasildar, basing on that he issued caste certificate stating that PW-1 belongs to SC Madiga and accused No.1 belongs to Ediga BC caste.

8.PW-8 is the investigating officer and he spoke about the investigation part. Basing on the official witnesses evidence and when there is no 3 supporting evidence from the material witnesses, the accused cannot be convicted. In the circumstances, the prosecution has failed to prove the guilt of the accused. Therefore, the accused is not found guilty.

10.In the result, the accused is acquitted U/s.232 Cr.P.C.for the charges 354 IPC & Section u/s.3 (1) (xi) of Scheduled Castes and Scheduled

Tribes (Prevention of Atrocities) Act, 1989.
