Petitioners / claimants filed the claim petition under section 166 of Motor Vehicles Act read with Rules 455 and 475 of A.P. Motor Vehicle

Rules claiming compensation of Rs.37,00,000/­.

2.Brief averments of the claim petition:­ First petitioner was the wife of the deceased Shaik Mahamad Wassay. Second petitioner was the minor daughter of the deceased Shaik Mahamad Wassay. Third petitioner 2 was the mother of the deceased Shaik Mahamad Wassay. The deceased was having Indian Passport and his date of birth is 1.7.1973 and aged about 41 years prior to the date of accident. The deceased Shaik Mahamad Wassay came down to India from Kuwait. The deceased went to Kuwait for his livelihood and was worked as driver since 2007 and earning Rs.25,000/­ per month in Indian Currency and same was sending to India for the welfare and maintenance of his family members. On 28.8.2014 the deceased Shaik

Mahamad Wassay and S.G.H. Khadeer came to Kadapa on a motorcycle in order to visit a house site located in front of CWC godown in RIMS road and after finishing their work, both of them were returning on the motorcycle.

When they reached near Government Junior College, Kadapa near Judge’s

Bungalow on RIMS road at about 3.20 p.m., the first respondent tractor and trailer bearing No.Ap 04W 8818 and AP 04W 8819 came in opposite direction being driven in a rash and negligent manner and the trailer of the tractor hit the motorcycle. As a result of which the deceased fell on the northern side underneath the trailer and the tyres of the trailer ran over the deceased and sustained fatal injuries and succumbed to the same while undergoing treatment. Whereas the pillion rider fell on southern side and escaped from life risk. Immediately after the accident the deceased and S.G.H., Khadeer were shifted to RIMS Hospital, Kadapa for treatment, where the deceased died at 4.45 p.m., on the same day. Basing on the complaint given by S.G.H.,

Khadeer a case in Cr.No.105 of 2014 was registered by the Traffic Police

Station, Kadapa against the driver of the tractor and trailer of the first respondent. Due to the sudden demise of the deceased Shaik Mahamad

Wassay the petitioners lost their support and the second petitioner lost her 3 bright future and guidance. Hence, the petitioners are entitled to claim compensation from the respondents.

3.Brief averments of the written statement filed by the first respondent:­ There was no negligence on the part of the driver of the first respondent and the accident occurred due to rash and negligence of the deceased who was in drunken position came from RIMS side on a wrong direction to the right side of the road and hit the tractor and trailer of the first respondent. Hence, the accident was took place due to the negligence of the deceased only. The first respondent insured his tractor and trailer under valid policy valid from 6.6.2014 to 5.6.2015. Hence, the second respondent alone is liable to pay the compensation to the petitioners. The amount of compensation claimed by the petitioners is highly excessive. Hence, the petition is liable to be dismissed.

4.Brief averments of the written statement filed by the second respondent:­ The petitioners are put to strict proof of the allegation that the accident occurred due to rash and negligent driving of the driver of the first respondent tractor and trailer and hit the motorcycle of the deceased and caused the death of the deceased. The policy was in force as on the date of accident. The driver of the first respondent tractor and trailer had no valid and effective driving licence as on the date of accident. So, the first respondent violated the terms and conditions of the policy. The petitioners are put to strict that the deceased was hale and healthy prior to the accident and was aged about 41 years at the time of accident and working as driver and getting Rs.25,000/­ per month and contributing the same to the petitioners. The amount of compensation claimed by the petitioners under 4 various heads is highly excessive. Hence, the petition is liable to be dismissed.

5.Basing on the above pleadings the following issues were framed for trial:­ (1) Whether the deceased Shaik Mahammad Wassay @ Wasa died due to the injuries sustained in a motor vehicle accident occurred on 28.8.2014 due to rash and negligent driving of the driver of the tractor and trailer bearing No.AP 04W 8818 and

AP 04W 8819?

(2) Whether the petitioners are entitled for compensation, if so, to what amount and from whom?

(3) To what relief?

6.On behalf of the petitioners P.W.1 and P.W.2 were examined and Ex.A.1 to Ex.A.11 were marked. On behalf of the contesting respondents

D.W.1 was examined and Ex.B.1 was marked.

7.Heard both sides.

8.Issue 1:­ P.W.1 is the first petitioner and wife of the deceased

Shaik Mahamad Wasay. P.W.2 is eye witnesses to the accident. The evidence of P.W.1 and P.W.2 and the contents of claim petition, Ex.A.1 F.I.R.,

Ex.A.2 inquest report, Ex.A.3 postmortem certificate, Ex.A.4 charge sheet,

Ex.A.5 passport and Ex.A.7 original return ticket, show that the deceased

Shaik Mahamad Wassay came down to Kadapa from Kuwait on 8.8.2014. On 28.8.2014 the deceased and S.G.H. Khadeer were returning from CWC godown on RIMS road on a motorcycle driven by the deceased in normal speed on the left side of the road. At about 3.20 p.m., when they reached 5 opposite to Government Junior College near Judge’s bungalow the first respondent tractor and trailer bearing No.AP 04W 8818 and AP 04W 8819 came in opposite direction driven by its driver in a rash and negligent manner and the trailer hit the motorcycle of the deceased. As a result of which the deceased fell on the northern side underneath the trailer and the tyres of the trailer ran over the body of the deceased, whereas pillion rider fell on the southern side and escaped from the life risk. At that time P.W.2 saw the accident and he and others shifted the deceased and another in 108

Ambulance to RIMS Hospital, Kadapa, where the deceased succumbed to the injuries at 4.45 p.m., on the same day. On the complaint given by S.G.H.

Khadeer traffic police, Kadapa registered a case in Cr.No.105 of 2014 against the driver of the tractor and trailer. After completion of investigation, police filed charge sheet against the driver of the tractor and trailer. So, the petitioners proved that the accident occurred due to rash and negligent driving of the tractor and trailer and caused the death of the deceased Shaik

Mahamad Wassay. This issue is decided in favour of the petitioners.

9.Issue 2:­ According to section 166 of Motor Vehicles Act, (1) An application for compensation arising out of an accident of the nature specified in sub­section (1) of Section 165 may be made,­­ (a) by the person who has sustained the injury; or (b) by the owner of the property; or (c) where death has resulted from the accident, by all or any of the legal representatives of the deceased; or (d) by any agent duly authorised by the person injured or all or any of the legal representatives of the deceased, as the case may be.

10.First petitioner was the wife, second petitioner was the minor daughter and third petitioner was the mother of the deceased Shaik 6

Mahamad Wassay. So, the petitioners are the legal heirs and dependents on the income of the deceased Shaik Mahamad Wassay and they are entitled to claim compensation from the respondents.

11.As per the docket order, summons were not issued to third respondent. Respondents 1 and 2 filed counters. First respondent did not choose to adduce either oral or documentary evidence. Second respondent examined D.W.1 who is legal executive and marked Ex.B.1 copy of the policy.

According to the evidence of D.W.1 tractor and trailer was insured with the second respondent under Ex.B.1 policy valid from 6.6.2014 to 5.6.2015. The accident was occurred on 28.8.2014. So, the policy was in force as on the date of accident. Hence, the second respondent is liable to indemnify the liability of the first respondent. Hence, all the respondents are jointly and severally liable to pay compensation to the petitioners.

12.As per the judgement in Sarla Verma v. Delhi Transport

Corporation and another (2009 ACJ 1298). The claimants has to establish three factors for compensation in case of death, (a) age of the deceased; (b) income of the deceased; (c) number of dependents. The income of the deceased should be determined and out of the said income personal and living expenses of the deceased is to be deducted, the balance is to be considered, his contribution to the dependent family member which constitute multiplicand. The multiplier should be chosen from the table with reference to the age of the deceased. The annual contribution to the family is multiplied by such multiplier gives loss of dependency to the family. No amount should be awarded for pain and suffering of the legal heirs of the 7 deceased except funeral expenses, cost of transportation, cost of medical treatment of the deceased before the death.

13.The learned counsel for the petitioners relied on the judgements reported in (1) National Insurance Company Limited v. Pranay Sethi and others, 2017 ACJ 2700, (2) United India Insurance Company Limited v.

Patrica Jean Mahajan and others, 2002(3) SAR 1176. (3) United India

Insurance Company Limited v. Gattawadi Venugopal Kalpana and others, 2014 ACJ 2863, and (4) Vanita Ben and others v. L.Rs., of Devshi Bhai and others, 2015 ACJ 315. The learned counsel for the second respondent also relied on a judgement reported in Chanderi Devi and another v. Jaspal Singh and others, 2015 SAR (Civil) 709 (SC). The facts and circumstances in the above said judgements and the facts and circumstances in the present case on hand are not similar, so, the above said judgements are not applicable to the facts of the present case on hand.

14.Age of the deceased:­ According to the evidence of P.W.1 and the contents of claim petition, Ex.A.5 passport, the date of birth of the deceased

Shaik Mahamad Wassay is 1.7.1973. So, the age of the deceased was 41 years as on the date of accident. According to the contents of Ex.A.2 inquest report, Ex.A.3 postmortem certificate and Ex.A.4 charge sheet the age of the deceased was shown as 35 years as on the date of accident. In view of the date of birth mentioned in Ex.A.5 passport, the age of the deceased is taken

as 41 years as on the date of accident, in the age group of persons having age

between 41 and 45 years and the appropriate multiplier applicable is 14 as per the guidelines given in Sarla Verma v. Delhi Transport Corporation and another (2009 ACJ 1298).

15.Income of the deceased:­ The evidence of D.w.1 shows that the deceased was not working as driver in Kuwait and did not send Rs.2,30,000/­ in the year 2014 and Rs.69,000/­ in the year 2013 to his account and other accounts. So, Ex.A.8 to Ex.A.11 are false documents. So, the respondents are not liable to pay compensation to the petitioners.

16.According to the evidence of P.W.1 and P.W.2 the deceased was worked as driver in Kuwait and transferred an amount of Rs.2,30,000/­ in the year 2014 and Rs.69,000/­ in the year 2013 through money transfer agencies as per Ex.A.8 to Ex.A.11 work order, money transfer vouchers and bank accounts of the deceased. Therefore, the income of the deceased is to be taken as Rs.25,000/­ per month in Indian currency. As per Ex.A.8 work order, the name of the deceased is shown as second party, but nature of work of the deceased is not mentioned and monthly salary is not mentioned in the work order. The signatures of the deceased and the first party / sponsor are not found in the work contract. Therefore, Ex.A.8 cannot be taken into consideration to show that the deceased was a driver in Kuwait and earning

Rs.25,000/­ per month. Ex.A.5 original passport of the deceased and Ex.A.8 is the original driving licence of the deceased issued by the State of Kuwait.

Therefore, it can be said that the deceased went to Kuwait and possessed driving licence issued by the State of Kuwait. Ex.A.7 shows the airline booking from Kuwait to Mumbai on 22.8.2014 and from Mumbai to Chennai on 23.8.2014 and to return from Chennai to Bangalore on 13.9.2014 and from

Bangalore to Abudabi on 13.9.2014 and from Abudabi to Kuwait on 14.9.2014, travelling through 9W jet airlines, India. So, it is made clear that the deceased arrived to India form Kuwait and he met with an accident. If 9 the accident was not occurred he would have gone to Kuwait through Ex.A.7 airlines ticket. Ex.A.9 and Ex.A.10 and Ex.A.11 money transfer vouchers bank pass books show that the deceased transferred money from Kuwait to his account in State Bank of India, Chennur Branch, Kadapa district an amount of Rs.2,30,000/­ during the year 2014. So, the income of the deceased is taken as Rs.2,30,000/­ per annum. The deceased was having fixed income as on the date of accident and the age of the deceased was 41 years, the petitioners are entitled to claim future prospects at the rate of 30% for the persons having age between 40 and 50 years as per the guidelines given in

Sarla Verma v. Delhi Transport Corporation and another (2009 ACJ 1298).

So, the 30% of Rs.2,30,000/­ comes to Rs.69,000/­. So, the total income of the deceased as on the date of accident is Rs.2,30,000/­ + Rs.69,000/­ =

Rs.2,99,000/­. 

17.Number of dependents:­ First petitioner was the wife, second petitioner was the minor daughter and third petitioner was the mother of the deceased Shaik Mahamad Wassay and they are the legal heirs and dependents on the income of the deceased and they are three in number. So, 1/3rd of the income of the deceased has to be deducted towards the personal expenses of the deceased and the remaining 2/3rd of the income of the deceased is to be taken as the contribution of the deceased towards maintenance and welfare of the petitioners. So, the loss of dependency comes to Rs.2,99,000/­ x 14 x 2/3 = Rs.27,90,666/­.

18.The first petitioner was the wife of the deceased and she lost her husband at her young age, so first petitioner is entitled to claim compensation of Rs.1,00,000/­ towards loss of consortium. The petitioner are 10 further entitled to claim compensation of Rs.25,000/­ towards funeral expenses. The petitioners lost support and guidance of the deceased, so they are entitled to claim compensation of Rs.50,000/­ towards loss of love affection and estate. The petitioners are entitled to claim compensation of Rs.5,000/­ towards transport charges.

19.In total the petitioners are entitled to claim compensation of

Rs.27,90,666/­ towards loss of dependency; Rs.1,00,000/­ towards loss of consortium; Rs.50,000/­ towards loss of love affection and estate; Rs.25,000/­ towards funeral expenses; Rs.5,000/­ towards transport charges; totalling

Rs.29,70,666/­ and the same is rounded off to Rs.29,71,000/­ and the respondents 1 to 3 are jointly and severally liable to pay the same to the petitioners with future interest and costs.

20.In the result petition is allowed with costs granting compensation of Rs.29,71,000/­ (Rupees twenty nine lakhs seventy one thousand only) to the petitioners with future interest at the rate of 9% p.a., from the date of petition till the date of realization. The respondents 1 to 3 are jointly and severally liable to pay the said compensation amount to the petitioners and they are directed to deposit the same into the court within one month from the date of this order. On deposit of the same, petitioners 1 and 2 each are entitled to claim Rs.9,00,000/­ each with proportionate interest and costs and petitioners 1 and 2 are permitted to withdraw a sum of

Rs.8,00,000/­ each and the remaining balance of their respective shares of compensation amount shall be deposited in fixed deposits in any nationalized bank for a period of one year and after completion of one year period the petitioners 1 and 2 are permitted to withdraw the same with accrued interest 11 thereon. The second petitioner is entitled to claim Rs.11,71,000/­ with proportionate interest and costs and the same shall be deposited in fixed deposits in any nationalized bank till second petitioner attains majority and after second petitioner attaining majority second petitioner is permitted to withdraw the same with accrued interest thereon. Advocate fee is fixed at

Rs.5,000/­.

Petitioner / claimant filed the petition under section 166 of

Motor Vehicles Act read with Rules 455 and 475 of A.P. Motor Vehicle Rules claiming compensation of Rs.2,00,000/­.

2.Brief averments of the claim petition:­ Petitioner is the injured person. The petitioner / claimant is an agriculturist having Ac.2.00 of land and also doing cultivation in an extent of Ac.5.00 by raising crops and earning Rs.6,000/­ per month. On 10.8.2016 afternoon the petitioner and his friend Mahaboob Basha started from Guvalacheruvu village on scooty bearing No.AP 04BA 6450 to Kadapa for their personal work. At about 12.30 2 p.m., when they reached near the masque of Guvalacheruvu village, the second respondent hired R.T.C., bus bearing No.AP 04W 5391 driven by first respondent driver in a rash and negligent manner without blowing horn with high speed came from Kadapa side and dashed against the scooty of the petitioner. As a result of which the petitioner and his friend Mahaboob

Basha fell down on the road and sustained injuries. Immediately after the accident the petitioner was taken to RIMS Hospital, Kadapa and from there to MM Hospital, Kadapa, where he had undergone surgery for fracture of both bones of right leg below knee and took treatment for ten days and spent

Rs.20,000/­ towards medicines and Rs.10,000/­ towards extra nourishment and for attending charges. Due to the injuries sustained in the accident the petitioner became permanently disabled persons. The accident occurred due to the rash and negligent driving of the first respondent driver of the second respondent hired R.T.C., bus and the same was insured with the third respondent insurance company. Hence, the petitioner is entitled to claim compensation from the respondents.

3.Brief averments of the written statement filed by the first respondent:­ The petitioner is put to strict proof of the allegation that the accident occurred due to rash and negligent driving of the first respondent driver of second respondent RTC hired bus. The first respondent driver was working under the control and command of fourth respondent RTC., for operation of the bus in a particular route. The fourth respondent was collecting charges from the passengers of the bus by wy of tickets, so the fourth respondent alone liable to pay the compensation to the victims. The second respondent insured his vehicle with the third respondent insurance 3 company. The vehicle should possess valid and effective RC, FC and permit to run the vehicle on road. The first respondent is having valid and effective driving licence to drive the vehicle. The petitioner is put to strict proof of his age, income and avocation. The amount of compensation claimed is highly excessive. Hence, the petition is liable to be dismissed.

4.Brief averments of the written statement filed by the third respondent:­ The petitioner is put to strict proof of the allegation that the accident occurred due to rash and negligent driving of the first respondent driver of second respondent RTC hired bus. The first respondent driver was working under the control and command of fourth respondent RTC., for operation of the bus in a particular route. The second respondent has no right to ply the bus on a particular route. The services of the first respondent driver of second respondent was transferred along with complete control of the bus to A.P.S.R.T.C., i.e., fourth respondent. The fourth respondent was collecting charges from the passengers of the bus by way of tickets, so the fourth respondent alone liable to pay the compensation to the victims. The second respondent insured his vehicle with the third respondent insurance company. The vehicle should possess valid and effective RC, FC and permit to run the vehicle on road. The first respondent should possess valid and effective driving licence to drive the vehicle. The petitioner is put to strict proof of his age, income and avocation. The amount of compensation claimed is highly excessive. Hence, the petition is liable to be dismissed.

5.Brief averments of the written statement filed by the fourth respondent:­ A.P.S.R.T.C., is not the owner of the bus bearing No.AP 04W 5391 involved in the accident on 10.8.2016 at 12.30 p.m., near Guvvala 4

Cheruvu on Rayachoty – Kadapa road. The driver who was responsible for the accident is not the servant of the A.P.S.R.T.C. Second respondent is the master of the driver. RTC has taken the bus from the second respondent for hire only on the basis of contract. The second respondent entered into an agreement with A.P.S.R.T.C., incorporating several conditions. As per the agreement clause No.5(iv) the owner shall be held responsible for all claims that may arise due to statutory violations out of the operations, like claim due to the accidents payable under the provisions of Motor Vehicles Act and

Rules and A.P.S.R.T.C., shall under no circumstances be made liable or responsible to pay compensation that may be awarded by Motor Accident

Claims Tribunal or Tribunals in respect of accidents. As per clause 6(iii) the corporation used to reimburse the owner the motor vehicle tax and insurance premium paid by him in respect of the operation carried out once in 15 days.

As per clause 5(ii) the vehicle insurance policy certificate shall carry IMT – 44 indemnify to hirer package policy negligence of the owner of the hirer.

Hence, the insurance company is exclusively liable to pay the compensation.

Hence, the petition is liable to be dismissed against this respondent.

6.Basing on the above pleadings the following issues were framed for trial:­ (1) Whether the petitioner sustained injuries in a motor vehicle accident which occurred on 10.8.2016 due to rash and negligent driving of the driver of the hire RTC bus bearing No.AP 04W 5391?

(2) Whether the petitioner is entitled for compensation, if so, to what amount and from whom?

7.On behalf of the petitioner / claimant P.W.1 and P.W.2 were examined and Ex.A.1 to Ex.A.7 were marked. On behalf of the contesting respondents D.W.1 and D.W.2 were examined and Ex.B.1 and Ex.X.1 to

Ex.X.5 were marked.

8.Heard both sides.

9.Issue 1:­ P.W.1 is petitioner and injured person in this case.

The evidence of P.W.1 and the contents of the claim petition, Ex.A.1 F.I.R.,

Ex.A.2 wound certificate, and Ex.A.3 charge sheet show that on 10.8.2016

P.W.1 and his friend S. Mahaboob Basha were proceeding on scooty AP 04B 6450 to Kadapa for their personal work. At about 12.30 p.m., they reached near the masque of Guvvalacheruvu at that time first respondent driver of

RTC hired bus bearing NO.AP04W 5391 belonging to second respondent came from Kadapa side with high speed without blowing horn in a rash and negligent manner and dashed against the scooty of the petitioner. As a result of which, the petitioner sustained fracture of his right leg. The petitioner was taken to RIMS Hospital, Kadapa and from there to MM Hospital, Kadapa.

Both bones of right leg were operated and inserted steel plates and screws.

On the report given by the petitioner a case in Cr.No.83 of 2016 was registered. After completion of investigation, police filed charge sheet against the first respondent driver of RTC hire bus. Hence, the petitioner proved that the accident occurred due to rash and negligent driving of the firs respondent driver of RTC hired bus and the petitioner sustained fracture injuries in the accident. Hence, this issue is decided in favour of the petitioner.

10.Issue 2 :­ According to section 166 of Motor Vehicles Act, (1) An application for compensation arising out of an accident of the nature specified in sub­section (1) of Section 165 may be made,­­ (a) by the person who has sustained the injury; or (b) by the owner of the property; or (c) where death has resulted from the accident, by all or any of the legal representatives of the deceased; or (d) by any agent duly authorised by the person injured or all or any of the legal representatives of the deceased, as the case may be.

11.The petitioner being the injured person is entitled to claim compensation from the respondents.

12.Second respondent set him exparte. D.W.1 and D.W.2 were examined and Ex.X.1 to Ex.X.5 were marked on behalf of the third respondent insurance company. First respondent and fourth respondent did not adduce either oral or documentary evidence. D.W.1 is the branch manager of third respondent insurance company. The evidence of D.W.1 and the contents of Ex.B.1 policy show that the RTC hired bus was insured with the third respondent insurance company under Ex.B.1 policy valid from 28.7.2016 to 27.7.2017. The accident was occurred on 10.8.2016. So, the policy was in force as on the date of accident. Therefore, the third respondent is liable to indemnify the liability of the second respondent.

13.D.W.2 is stenographer in Road Transport Authority Office,

Kadapa. The evidence of D.W.2 and the contents of Ex.X.2 extract of driving licence of first respondent show that the first respondent had valid non transport and transport driving licence as on the date of accident i.e., 10.8.2016. So, the Ex.X.2 driving licence was in force as on the date of accident. Hence, first respondent had valid driving licence to driver the RTC 7 hired bus as on the date of accident. According to the evidence of D.W.2, RTC hire bus has Ex.X.3 registration certificate, Ex.X.4 permit and Ex.X.5 fitness certificate as on the date of accident. Therefore, the respondents 1 and 2 did not violate any terms and conditions of the policy. Hence, third respondent is liable to indemnify the liability of the second respondent. Hence, all the respondents are jointly and severally liable to pay the compensation to the petitioner.

14.Age of the petitioner:­ According to the evidence of P.W.1 and the contents of claim petition and Ex.A.2 wound certificate, the petitioner was aged about 42 years as on the date of accident. So, the age of the petitioner is taken as 42 years as on the date of accident in the age group of persons having age between 41 and 45 years and the appropriate multiplier applicable is 14 as per the guidelines given in Sarla Verma v. Delhi

Transport Corporation and another (2009 ACJ 1298).

15.Income of the petitioner:­ The evidence of P.W.1 and the contents of the claim petition show that the petitioner was hale and healthy and cultivating his own land of an extent of Ac.2.00 and an extent Ac.3.00 of land on lease. The petitioner raised paddy sunflower and groundnut crops in the above said lands and getting income of Rs.6,000/­ per month. But the petitioner did not file any revenue record to show that he owns Ac.2.00 of land and cultivating Ac.3.00 of land on lease and getting income of Rs.6,000/­ per month. However, the petitioner is an agricultural coolly, so in the absence of documentary evidence the income of the petitioner cannot be taken as Rs.6,000/­ per month. In view of the petitioner was an agricultural coolly, the income of the petitioner is taken as Rs.4,500/­ per month as per the 8 guidelines given in Rama Chandrappa v. Rayal Sundaram Allinaz Company

Limited (2011(6) ALT 48 (SC)), the income of the daily wage earner was considered at Rs.4500/­ per month. So, the income of the petitioner is taken as Rs.4,500/­ per month.

16.Disability of the petitioner:­ P.W.2 is the professor, Orthopedic

Department, RIMS Hospital, Kadapa and one of the member of the District

Medical Board, Kadapa. P.W.2 examined P.W.1 on 3.11.2017 and found the following injuries i.e., old fracture right leg malunited operated, painful restricted movements of right knee and ankle joints and also petitioner is having implant in tibia bone, difficulty in squatting. Basing on clinical examination, x­ray, wound certificate and discharge summary, P.W.2 assessed the disability as 20% permanent disability. Accordingly P.W.2 issued Ex.A.4 disability certificate. So, the loss of future income of the petitioner is Rs.4500/­ x 12 x 14 x 20% = Rs.1,51,200/­.

17.Medical expenses:­ The evidence of P.W.1 and the contents of claim petitioner, Ex.A.6 discharge summary, Ex.A.7 medical bills for

Rs.5,710/­ and Ex.A.5 receipt for Rs.1,000/­ show that the petitioner took treatment and undergone surgery in MM Hospital, Kadapa and in RIMS

Hospital, Kadapa. So, the petitioner incurred medical expenses of Rs.6,710/­.

So the petitioner is entitled to claim Rs.6,710/­ towards medical expenses.

Further the petitioner undergone surgery to his right leg below knee and inserted implants, so the petitioner is entitled to claim Rs.30,000/­ towards pain and suffering. The petitioner is further entitled to claim Rs.15,000/­ towards transport charges, attendant charges and extra nourishment.

18.In total the petitioner is entitled to claim compensation of

Rs.1,51,200/­ towards loss of future earnings; Rs.6,710/­ towards medical expenses; Rs.30,000/­ towards pain and suffering; Rs.15,000/­ towards transport charges, attendant charges and extra nourishment; totalling

Rs.2,02,910/­. But the petitioner claimed only Rs.2,00,000/­ compensation.

Hence, the petitioner is entitled to claim compensation of Rs.2,00,000/­ with future interest and the respondent 1 to 4 are jointly and severally liable to pay the same to the petitioner.

19.In the result, petition is allowed with costs granting compensation of Rs.2,00,000/­ (Rupees two lakhs only) to the petitioner with future interest at the rate of 9% p.a., from the date of petition till the date of realisation. The respondents 1 to 4 are jointly and severally liable to pay the same to the petitioner and they are directed to deposit the same into the court within one month from the date of this order. On such deposit the petitioner is permitted to withdraw a sum of Rs.1,50,000/­ and the remaining balance of compensation amount shall be deposited in fixed deposits in any nationalized bank for a period of one year and after completion of one year period the petitioner is permitted to withdraw the same with accrued interest thereon. Advocate fee is fixed at Rs.5,000/­.

This petition had been coming on 18.12.2018 for hearing before me in the presence of Sri M. Ramanjaneya Reddy, Advocate for petitioner / claimant and Sri K. Guru Murthy, Advocate for second respondent and the respondents 1 and 3 being called absent and set exparte and after perusing the records on file and hearing arguments on both the sides and having stood over till this day for consideration, this court delivered the following:­

Petitioner / claimant filed claim petition under section 166 of

Motor Vehicles Act read with Rules 455 and 475 of A.P. Motor Vehicle Rules claiming compensation of Rs.12,30,000/­.

2.Brief averments of the claim petition:­ The petitioner is the injured person. The petitioner was hale and healthy and aged about 43 years as on the date of accident. The petitioner is an agriculturist having Ac.2.48 cents of land with water facility and raising crops and also maintaining two bullocks and a cart and earning Rs.15,000/­ to Rs.20,000/­ per month. On 25.11.2016 the petitioner and other farmers purchased flowers from other famers engaged a tempo vehicle bearing No.AP 04TU 7601 went to Vellore 2 and while so, on 26.11.2016 when the petitioner and other farmers were reutnring back to Kadapa on the way at about 2.00 p.m., when tempo vehicle was in down gradient in Guvvalacheruvu ghat road at the last turning in

Kadapa side on Rayachoty – Kadapa main road the first respondent lorry bearing No.TN 31J 7269 which was coming in the same direction from behind the tempo vehicle the driver of the said lorry drove it in a rash and negligent manner and hit the tempo on its rear side. As a result of which tempo went and hit the front going lorry and again the first respondent lorry driver having failed to control the lorry further hit the tempo. As a result of which the tempo fell on the road side and in turn first respondent lorry also fell over the tempo. The petitioner and others sustained injuries. On a complaint

C.K., Dinne Police registered a case in Cr.No.251 of 2016 against the first respondent lorry driver. The petitioner sustained fracture injuries and took treatment in RIMS Hospital, Kadapa and later at Rama Devi Hospital,

Tirupati and under gone surgeries and the petitioner was treated as inpatient from 28.11.2016 to 15.12.2016. Due to the injuries sustained in the accident the petitioner became permanently disabled person and lost his source of income and the petitioner is unable to attend his daily routine works also. The accident occurred due to the rash and negligent driving of the driver of the first respondent lorry and the said vehicle was insured with the second respondent insurance company. Hence, the petitioner is entitled to claim compensation from the respondents.

3.Respondents 1 and 3 set them exparte.

4.Brief averments of the written statement filed by the second respondent:­ The petitioner is put to strict proof of the allegation that the 3 accident occurred due to rash and negligent driving of the driver of the first respondent lorry bearing No.TN 31J 7269 which was coming on the same direction of the tempo bearing No.AP 04TU 7601 in which the petitioner was travelling and dashed the said vehicle on its rear side and caused the accident and the petitioner sustained grievous injuries. The driver of the first respondent lorry had no valid driving licence at the time of accident.

The petition is bad for non joinder of necessary parties i.e., owner and insurer of the tempo vehicle in which the petitioner was travelled at the time of accident. The petitioner is put to strict proof of his age, avocation and income. The petitioner has to prove that he became permanently disabled person and lost his source of income. The amount of compensation claimed under different heads is highly excessive. Hence, the petition is liable to be dismissed.

5.Basing on the above pleadings the following issues were framed for trial:­ (1) Whether the petitioner sustained injuries in a motor vehicle accident which occurred on 26.11.2016 due to rash and negligent driving of the driver of the lorry bearing No.TN 31J 7269?

(2) Whether the petitioner is entitled for compensation, if so, to what amount and from whom?

(3) To what relief?

6.On behalf of the petitioner / claimant P.W.1 to P.W.3 were examined and Ex.A.1 to Ex.A.21 were marked. On behalf of the contesting second respondent no witnesses were examined and no documents were marked.

7.Heard both sides.

8.Issue 1 :­ P.W.1 is claimant and injured person. P.W.3 is the investigating officer in Cr.No.251 of 2016 of C.K., Dinne Police Station registered under sections 337 and 338 of I.P.C. The evidence of P.W.1 and

P.W.3 and the contents of claim petition, Ex.A.1 F.I.R., Ex.A.2 wound certificate and Ex.A.21 final report, show that on 26.11.2016, P.W.1 and other farmers were returning to Kadapa in tempo AP 04TU 7606 from Vellore. At about 2.00 p.m., they reached near Guvalacheruvu ghat road on Rayachoty –

Kadapa main road, the first respondent lorry TN 31J 7269 driven by its driver in a rash and negligent manner and hit the tempo on its behind, as a result of which the tempo went and hit the front coming lorry, again the driver of the first respondent lorry failed to control the lorry and further hit the tempo, as a result of which the tempo fell on the road side and the first respondent lorry also fell on the tempo and petitioner and others sustained injuries. The driver of the first respondent lorry also sustained fatal injuries.

Later the driver of the first respondent lorry died leaving behind his mother third respondent. On the complaint given by P. Dasthagiri a case in

Cr.No.251 of 2016 was registered. After completion of investigation police filed Ex.A.21 final report stating that the driver of the first respondent lorry committed suicide. Therefore, the petitioner proved that the accident occurred due to the rash and negligent driving of the driver of the first respondent lorry and the petitioner sustained injuries in the accident.

9.Issue 2 :­ According to section 166 of Motor Vehicles Act, (1) An application for compensation arising out of an accident of the nature specified in sub­section (1) of Section 165 may be made,­­ (a) by the person who has 5 sustained the injury; or (b) by the owner of the property; or (c) where death has resulted from the accident, by all or any of the legal representatives of the deceased; or (d) by any agent duly authorised by the person injured or all or any of the legal representatives of the deceased, as the case may be.

10.The petitioner being the injured person is entitled to claim compensation from the respondents.

11.Respondents 1 and 3 set them exaprte. Second respondent filed written statement and petition under section 170 of Motor Vehicles Act and failed to adduce either oral or documentary evidence. The learned counsel for the second respondent argued that there was no rash and negligence driving of the driver of first respondent lorry TN 31J 7269 and the accident was occurred only due to the rash and negligent driving of the driver of tempo in which P.W.1 was travelled. The driver of the lorry had no valid driving licence. The petitioner has not filed copy of policy and driving licence of the driver of the lorry. Hence, the first respondent violated the terms and conditions of the policy. So, the second respondent is not liable to indemnify the liability of the first respondent. The evidence of P.W.3 and the contents of Ex.A.21 final report show that the driver of the first respondent lorry committed suicide and the case in Cr.No.326 of 2016 of Tiruchunapalli Police

Station registered under section 174 of Cr.P.C. The investigation done by the

Head Constable 133 disclose that the driver of the first respondent lorry came from behind in a rash and negligent manner with high speed and unable to control the speed and dashed against the tempo in which P.W.1 and others were travelling, as a result of which tempo turned turtle. Therefore, the accident was occurred due to rash and negligent driving of the driver of the 6 first respondent lorry. The contents of Ex.A.21 further did not disclose that the driver of the first respondent lorry had no driving licence to drive the lorry. So, the F.I.R., was not registered under section 3 of Motor Vehicles

Act. Hence, the driver of the lorry had driving licence as on the date of accident. The petitioner is third party to the policy. The policy of the first respondent lorry was valid from 20.4.2016 to 19.4.2017. The accident was occurred on 26.12.2016. So, the policy was in force as on the date of accident.

So, the second respondent is liable to indemnify the liability of the first respondent. Hence, all the respondents are jointly and severally liable to pay the compensation to the petitioner.

12.Age of the petitioner:­ The evidence of P.W.1 and the contents of claim petition show that the petitioner was aged about 43 years as on the date of accident. Ex.A.2 wound certificate shows the age of the petitioner was 45 years as on the date of accident. So, the aged of the petitioner is taken as 45 years as on the date of accident in the age group of persons having age between 41 and 45 years and the appropriate multiplier applicable is 14 as per the guidelines given in Sarla Verma v. Delhi Transport Corporation and another, 2009 ACJ 1298.

13.Income of the petitioner:­ According to the evidence of P.W.1 and the contents of claim petition, the petitioner is an agriculturist and doing flower business and getting Rs.15,000/­ to Rs.20,000/­ per month. The petitioner filed Ex.A.19 pattadar pass book and Ex.A.20 1(B) adangal. The contents of Ex.A.19 and Ex.A.20 show that the petitioner is having agricultural lands of an extent of Ac.2.48 cents of dry land. So, it is made clear that the petitioner is an agriculturist. On the other hand the evidence 7 of P.W.1 and the contents of Ex.A.1 F.I.R., show that the petitioner and others went to Vellore with a load of flowers and while they were returning, they met with accident. So, it shows that the petitioner was doing flowers business as on the date of accident. Considering the evidence of P.W.1 and the contents of Ex.A.1 F.I.R., Ex.A.19 pattadar pass book and Ex.A.20 1(B) adangal, it is proved that the petitioner was doing business in flowers and cultivation. Therefore, the income of the petitioner is taken as Rs.15,000/­ per month.

14.Disability of the petitioner:­ P.W.2 is the Professor and Head of the Department of Orthopedics in RIMS Hospital, Kadapa and one of the member of the District Medical Board, Kadapa. The evidence of P.W.2 and the contents of the Ex.A.8 disability certificate, show that P.W.2 examined the petitioner on 30.4.2018 and found the following injuries (1) old fracture right side radius malunited operated implant in the bone, painful, restricted movements of the wrist and forearm. (2) old fracture right side femur operated malunited painful, restricted movements of right knee and hip joints, implant in the femur bones, difficulty in sitting and squatting on the floor. Basing on physical examination, x­ray, wound certificate, discharge summaries, he assessed the permanent disability of the petitioner as 45% to the right upper limb and lower limb. So, the loss of future earnings of the petitioner is Rs.15,000/­ x 12 x 14 x 45% = Rs.11,34,000/­.

15.Medical expenses:­ The evidence of P.W.1 and the contents of

Ex.A.3, Ex.A.4, Ex.A.5, Ex.A.10 and Ex.A.11 discharge summaries, Ex.A.6 and Ex.A.7 medical bills and Ex.A.12, Ex.A.13 and Ex.A.15 out patient slips, shows that the petitioner took treatment at various hospital of Kadapa, and 8

Tirupati and incurred medical expenses of Rs.18,201/­ in total. So, the petitioner is entitled to claim Rs.18,201/­ towards medical expenses.

16.Petitioner filed Ex.A.8 ambulance bills for Rs.15,500/­, since the petitioner has undergone treatment at different hospital of Kadapa and

Tirupati, so the petitioner is entitled to claim compensation of Rs.15,500/­ towards transport charges.

18.The petitioner sustained grievous and fracture injuries to his right forearm and hip joint and undergone surgeries, so, the petitioner is entitled to claim compensation of Rs.30,000/­ towards pain and suffering.

The petitioner is further entitled to claim Rs.10,000/­ towards attendant charges and extra nourishment.

19.In total, the petitioner is entitled to claim compensation of

Rs.11,34,000/­ towards loss of future earnings; Rs.18,201/­ towards medical expenses; Rs.15,500/­ towards transport charges; Rs.30,000/­ towards pain and suffering; Rs.10,000/­ towards attendant charges and extra nourishment; totalling Rs.12,07,701/­ and the same is rounded off to Rs.12,07,000/­ and the respondents are jointly and severally liable to pay the same to the petitioner with future interest and costs.

20.In the result, petition is allowed with costs granting compensation of Rs.12,07,000/­ (Rupees twelve lakhs seven thousand only) to the petitioner with future interest at the rate of 9% p.a., from the date of petition till the date of realisation. The respondents 1 to 3 are jointly and severally liable to pay the same to the petitioner and they are directed to deposit the same into court within one month from the date of this order. On deposit of the same, the petitioner is permitted to withdraw a sum of 9

Rs.10,00,000/­ and the remaining balance of compensation amount shall be deposited in fixed deposit in any nationalized bank for a period of one year and after completion of one year period the petitioner is permitted to withdraw the same with accrued interest thereon. Advocate fee is fixed at

Rs.5,000/­.

Petitioners filed the claim petition under section 166 of Motor

2.Brief averments of the claim petition:­ The first petitioner is the wife of the deceased D. Thirupal Reddy. The second petitioner is the son of the deceased D. Thirupal Reddy. The deceased Thirupal Reddy was hale and 2 healthy prior to the date of accident and aged 54 years and running a mess in the name and style of Reddy Mess and earning Rs.25,000/­ per month and contributing the same for the maintenance and welfare of the petitioners. On 10.8.2014 night the deceased and his friend Veerachari left pulivendula on a motorcycle bearing No.AP 04UETR 7721 and went to Pedda Duddayala village and after completion of their work, they left the village and when they reached Pedda Duddayala village situated on Muddanur – Pulivendula main road, the first respondent auto bearing No.AP 04TU 2190 came from their behind in a rash and negligent manner with high speed without blowing horn and without dim and dip lights driven by its driver and dashed against the motorcycle on its back side. As a result of which the deceased fell down from the motorcycle and sustained fatal injuries and died on the spot. The rider of the motorcycle Veerachari also sustained injuries and he was shifted to

Government Hospital, Pulivendula. Basing on the complaint of Veerachari a case was registered in Cr.No.111 of 2014 of Muddanur Police Station and after completion of investigation charge sheet was filed against the driver of the first respondent auto. Due to the sudden demise of the deceased Thirupal

Reddy, the petitioner lost their livelihood and support and guidance to the second petitioner. The accident was occurred due to the rash and negligent driving of the driver of the first respondent auto and the same was insured with third respondent insurance company. Hence, the petitioners are entitled to claim compensation from all the respondents.

3.Second respondent set him exparte.

4.Brief averments of the written statement filed by the first respondent:­ The first respondent is the owner of the auto bearing No.AP 3 04TU 2190, but the accident was not occurred due to the fault of the driver of the first respondent. The driver of the first respondent had valid and effective driving licence to drive the auto at the time of accident. The auto of the respondent is insured with the third respondent insurance company. The first respondent has not violated any terms and conditions of the policy. The petitioner is put to strict proof of the age, avocation and income of the deceased. The amount of compensation claimed under various heads is highly excessive. Hence, the petition is liable to be dismissed.

5.Brief averments of the written statement filed by the third respondent:­ The petitioners are put to strict proof of the allegation that the accident was occurred due to rash and negligent driving of the driver of the first respondent auto bearing No.AP 04TU 2190 and caused the death of the deceased Thirupal Reddy. The petitioners have to prove that the first respondent auto had valid fitness certificate, permit and the driver of the first respondent had valid and effective driving licence as on the date of accident. The petition is bad for non joinder of necessary parties i.e., owner and insurer of the motorcycle on which the deceased was travelled at the time of accident. The petitioners are put to strict proof of the age, avocation and income of the deceased by running Reddy Mess at Pulivendula. The amount of compensation claimed under different heads is highly excessive. Hence, the petition is liable to be dismissed.

6.Basing on the above pleadings the following issues were framed for trial:­ (1) Whether the accident occurred due to rash and negligent driving of the driver of auto bearing No.AP 04TU 2190 resulting 4 the death of the deceased by name Devireddy Tirupal Reddy on 10.8.2014?

(2) Whether the petitioner is entitled for compensation, if so, to what amount and from whom?

(3) To what relief?

7.On behalf of the petitioners P.W.1 to P.W.3 were examined and

Ex.A.1 to Ex.A.9 were marked. On behalf of the contesting respondents

D.W.1 and D.W.2 were examined and Ex.B.1 and Ex.X.1 and Ex.X.2 were marked.

8.Heard both sides.

9.Issue 1:­ P.W.1 is the first claimant and wife of the deceased

Tirupal Reddy. P.W.2 is the rider of the motorcycle in which the deceased was travelled as pillion rider. P.W.3 is eye witness to the accident. So, P.W.2 and P.W.3 are the eye witnesses to the accident. According to the evidence of

P.W.1 to P.W.3 and the contents of claim petition, Ex.A.1 F.I.R., Ex.A.2 inquest report, Ex.A.3 postmortem certificate, Ex.A.4 charge sheet and

Ex.A.5 motor vehicle inspector report and the Ex.A.9 statement under section 161 Cr.P.C., of P.W.3 that on 10.8.2014 at 10.30 p.m., P.W.2 and deceased were proceeding on motorcycle bearing No.AP 04UE TR 7721, when they reached near Peddadudyala village on Muddanur – Pulivendula main road, the first respondent auto bearing No.AP 04TU 2190 driven by its driver in a rash and negligent manner came from their behind with high speed without blowing horn and without applying dim and dip lights, dashed against the motorcycle, as a result of which the deceased fell down from the motorcycle and sustained fatal injuries and died on the spot. P.W.2 also sustained 5 injuries. P.W.2 lodged a complaint before the Muddanur police station and the same was registered as a case in Cr.No.111 of 2014 of Muddanur Police

Station. After completion of investigation police filed charge sheet against the driver of the first respondent auto. Hence, the petitioners proved that the deceased died due to the injuries sustained in a motor vehicle accident caused due to rash and negligent driving of the driver of the first respondent. This issue is answered in favour of the petitioners.

10.Issue 2:­ According to section 166 of Motor Vehicles Act, (1) An application for compensation arising out of an accident of the nature specified in sub­section (1) of Section 165 may be made,­­ (a) by the person who has sustained the injury; or (b) by the owner of the property; or (c) where death has resulted from the accident, by all or any of the legal representatives of the deceased; or (d) by any agent duly authorised by the person injured or all or any of the legal representatives of the deceased, as the case may be.

11.First petitioner being the wife of the deceased and the second petitioner being the son of the deceased, who are the legal heirs of the deceased are entitled to claim compensation from the respondents.

12.Second respondent set exparte. Respondents 1 and 2 filed written statement. Third respondent examined D.W.1 and D.W.2 and marked Ex.B.1 copy of policy and Ex.X.2 extract of permit. The evidence of

D.W.1 and D.W.2 and the contents of Ex.X.2 permit show that the second respondent auto had valid permit as on the date of accident. According to the evidence of D.W.2, the second respondent auto was insured with the third respondent insurance company under Ex.B.1 policy valid as on the date of accident. Ex.A.5 motor vehicle inspector report shows that the driver of the 6 second respondent auto was D. Nagendra Babu and he had valid driving licence to drive the auto as on the date of accident. Therefore, the third respondent is liable to indemnify the liability of the respondents 1 and 2. So, all the respondents are jointly and severally liable to pay compensation to the petitioners.

13.As per the judgement in Sarla Verma v. Delhi Transport

Corporation and another (2009 ACJ 1298). The claimants has to establish three factors for compensation in case of death, (a) age of the deceased; (b) income of the deceased; (c) number of dependents. The income of the deceased should be determined and out of the said income personal and living expenses of the deceased is to be deducted, the balance is to be considered, his contribution to the dependent family member which constitute multiplicand. The multiplier should be chosen from the table with reference to the age of the deceased. The annual contribution to the family is multiplied by such multiplier gives loss of dependency to the family. No amount should be awarded for pain and suffering of the legal heirs of the deceased except funeral expenses, cost of transportation, cost of medical treatment of the deceased before the death.

14.Age of the deceased:­ According to the evidence of P.W.1 and the contents of claim petition, the deceased was aged about 54 years as on the date of accident. According to the contents of Ex.A.2 inquest report, Ex.A.3 postmortem certificate and Ex.A.4 charge sheet that the deceased was aged about 54 years as on the date of accident. So, the age of the deceased is taken

as 54 years as on the date of accident, in the age group of persons having age

in between 51 and 55 years and the appropriate multiplier applicable is 11 as 7 per the guidelines given in Sarla Verma v. Delhi Transport Corporation and another, 2009 ACJ 1298.

15.Income of the deceased:­ The evidence of P.W.1 and the contents of claim petition show that the deceased was hale and healthy as on the date of accident. The deceased was running a mess in the name and style of

Reddy Mess and earning Rs.25,000/­ per month. The deceased was contributing his entire income for the maintenance of his family members, but P.W.1 filed Ex.A.6 copy of statement of account in State Bank of India,

Pulivendula and Ex.A.7 and Ex.A.8 municipal receipts. But the contents of

E.A.6 to Ex.A.8 show that they are in the name of P.W.1 and not in the name of the deceased. Therefore the petitioners failed to prove that the deceased was running Reddy Mess and getting income of Rs.25,000/­ per month.

However, the deceased was working in the mess run by P.W.1 as a daily wage earner. So, the income of the deceased is taken as Rs.4500/­ per month as per the guidelines given in Rama Chandrappa v. Rayal Sundaram Allinaz

Company Limited (2011(6) ALT 48 (SC)), the income of the daily wage earner was considered at Rs.4500/­ per month. So, the income of the deceased is taken as Rs.4500/­ per month as on the date of accident.

16.Number of dependents:­ The petitioners are wife and son of the deceased and they are two in number and they are the legal heirs of the deceased Thirupal Reddy, so, 1/3rd of the income of the deceased is to be deducted towards the personal expenses of the deceased and the remaining 2/3rd of the income of the deceased is taken as the contribution of the deceased towards the maintenance of the petitioners. Hence, the loss of dependency comes to Rs.4500/­ x 12 x 11 x 2/3 = Rs.3,96,000/­.

17.The first petitioner being the wife of the deceased lost her husband, so the first petitioner is entitled to claim compensation of

Rs.1,00,000/­ towards loss of consortium and the petitioners are entitled to claim compensation of Rs.25,000/­ towards funeral expenses and Rs.5,000/­ towards transport charges. The petitioners are further entitled to claim compensation of Rs.50,000/­ towards loss of love affection and estate.

18.In total the petitioners are entitled to claim compensation of

Rs.3,96,000/­ towards loss of dependency; Rs.1,00,000/­ towards loss of consortium; Rs.50,000/­ towards loss of love affection and estate; Rs.25,000/­ towards funeral expenses; Rs.5,000/­ towards transport charges; totalling

Rs.5,76,000/­ and the respondents are jointly and severally liable to pay the same to the petitioners with future interest and costs.

19.In the result, petition is allowed with costs granting compensation of Rs.5,76,000/­ (Rupees five lakhs seventy six thousand only) to the petitioners with future interest at the rate of 9% p.a., from the date of petition till the date of realization. The respondents 1 to 3 are jointly and severally liable to pay the same to the petitioners and they are directed to deposit the same into the court within one month from the date of this order.

On deposit of the same, the petitioners 1 and 2 each are entitled to claim

Rs.2,88,000/­ each with proportionate interest and costs and the petitioners 1 and 2 each are permitted to withdraw a sum of Rs.2,00,000/­ each and the remaining balance of their respective shares of compensation amount shall be deposited in fixed deposits in any nationalized bank for a period of one year and after completion of one year period the petitioners are permitted to 9 withdraw the same with accrued interest thereon. Advocate fee is fixed at

Rs.5,000/­.

This petition had been coming on 20.12.2018 for hearing before me in the presence of Sri T. Chalamaiah, Advocate for petitioner / claimant and the first respondent being called absent and set him exparte and Sri G.

Rama Chandra Reddy, Advocate for second respondent and after perusing the records on file and hearing arguments on both the sides and having stood over till this day for consideration, this court delivered the following:­

Petitioner filed the claim petition under section 166 of Motor

Vehicles Act read with Rules 455 and 475 of A.P. Motor Vehicle Rules claiming compensation of Rs.6,00,000/­.

2.Brief averments of the claim petition:­ The petitioner was the injured person in the accident. The petitioner was hale and healthy prior to the date of accident and doing agricultural coolly works and earning Rs.200/­ per day and contributing the same for the maintenance of his family. On 21.1.2014 in the early hours at about 4.30 a.m., the petitioner and one

Ramulu left their village on a D.B., cart with a load of tomatos to go to

Devapatla market and when they reached near Roadvari kothapalli village at 2 about 5.15 a.m., the first respondent lorry bearing No.AP 04TT 7199 being driven by its driver in a rash and negligent manner with high speed without blowing horn and dashed against the D.B., cart and further dashed to a pedestrian. As a result of which the petitioner and the said Ramulu fell down from the D.B., cart and sustained injuries. The bills died and the D.B., cart was completely damaged. Immediately after the both the injured were shifted to Government Hospital, Rayachoty. Basing on the complaint given

before the police, a case was registered as Cr.No.10 of 2014 of Sambepalli

Police Station and after investigation police filed charge sheet against the driver of first respondent lorry. The petitioner was shifted to SVRR Hospital, for better treatment and the petitioner under gone surgery to his fracture injuries and spent Rs.50,000/­ towards medical expenses. Due to the injuries sustained in the accident the petitioner became permanently disabled person and lost his earning capacity. The accident was occurred due to the rash and negligent driving of the driver of the first respondent lorry and the said vehicle was insured with the second respondent insurance company. Hence, the petitioner is entitled to claim compensation from the respondents.

3.First respondent set him exparte.

4.Brief averments of the written statement filed by the second respondent:­ The petitioner is put to strict proof of the allegation that the accident occurred due to rash and negligent driving of the driver of the first respondent lorry bearing No.AP 04TT 7199 and dashed against the D.B., cart and caused injuries to the petitioner. The first respondent has not insured his vehicle with the second respondent insurance company. So, the second respondent is not liable to pay compensation to the petitioner. However, the 3 amount of compensation claimed by the petitioner under various heads is highly excessive. Hence, the petition is liable to be dismissed.

5.Basing on the above pleadings the following issues were framed for trial:­ (1) Whether the petitioner received injuries in a motor vehicle accident occurred due to rash and negligent driving by the driver of the lorry bearing No.AP 04TT 7199 on 21.1.2014?

(2) Whether the petitioner is entitled for compensation, if so, to what amount and from whom?

(3) To what relief?

6.On behalf of the petitioner P.W.1 and P.W.2 were examined and

Ex.A.1 to Ex.A.6 were marked. On behalf of the contesting second respondent no witnesses were examined and no documents were marked.

7.Heard both sides.

8.Issue 1:­ P.W.1 is claimant and injured person. The evidence of

P.W.1 and the contents of claim petition, Ex.A.1 F.I.R., Ex.A.2 wound certificate and Ex.A.3 charge sheet show that on 21.1.2014 at about 5.15 a.m.,

P.W.1 and Ramudu were proceeding on D.B., cart with a load of tamotos to

Devapatla market, when they reached near Reddivaripalli kothapalli village, the driver of the first respondent lorry AP 04TT 7199 driven by its driver in a rash and negligent manner with high speed and without blowing horn and dashed against the D.B., cart and further dashed to a pedestrian, as a result of which the petitioner and the said Ramudu fell down from the D.B., cart and sustained injuries, two bulls died and the D.B., cart was completely damaged. Both the injured persons were shifted to Government Hospital, 4

Rayachoty and P.W.1 lodged complaint before the police and the same was registered as Cr.No.10 of 2014 of Sambepalli Police Station. After completion of investigation police filed charge sheet against the driver of the lorry.

Therefore, the petitioner proved that the accident occurred due to rash and negligent driving of the driver of the first respondent lorry and caused injuries to the petitioner. This issue is decided in favour of the petitioner.

9.Issue 2:­ According to section 166 of Motor Vehicles Act, (1) An application for compensation arising out of an accident of the nature specified in sub­section (1) of Section 165 may be made,­­ (a) by the person who has sustained the injury; or (b) by the owner of the property; or (c) where death has resulted from the accident, by all or any of the legal representatives of the deceased; or (d) by any agent duly authorised by the person injured or all or any of the legal representatives of the deceased, as the case may be.

10.The petitioner being the injured person is entitled to claim compensation from the respondents.

11.First respondent set exparte. Second respondent filed written statement and petition under section 170 of Motor Vehicles Act. The counsel for the second respondent argued that the first respondent violated the terms and conditions of the policy and colluded with the petitioner and further the first respondent is not insured his vehicle with the second respondent company. So, the second respondent is not liable to pay compensation to the petitioner. The evidence of P.W.1 and Ex.A.5 copy of insurance policy, show that the first respondent insured his lorry with the second respondent insurance company valid from 11.12.2013 to 10.12.2014 and the accident occurred on 21.1.2014, so the policy was in force as on the date of accident.

The second respondent did not adduce either oral or documentary evidence to prove the violations of terms and conditions of the policy by the first respondent and there was no rash and negligent driving of the driver of the first respondent. Hence, second respondent is liable to indemnify the liability of the first respondent. So, all the respondents are jointly and severally liable to pay compensation to the petitioner.

12.Age of the petitioner:­ The evidence of the P.W.1 and the contents of claim petition, Ex.A.2 wound certificate and Ex.A.3 charge sheet show that the petitioner was aged about 28 years as on the date of accident.

So, the age of the petitioner is taken as 28 years as on the date of accident, in the age group of persons having age between 25 and 30 years and the appropriate multiplier applicable is 17 as per the guidelines given in Sarla

Verma v. Delhi Transport Corporation and another, 2009 ACJ 1298.

13.Income of the petitioner:­ The evidence of P.W.1 and the contents of claim petition show that the petitioner was hale and healthy as on the date of accident and he was an agriculture coolly and earning Rs.200/­ per day and contributing his earnings for the maintenance of his family members. Admittedly the petitioner is an agricultural coolly and he is treated as daily wage earner and the income of the petitioner is taken as

Rs.4500/­ per month as per the guidelines given in Rama Chandrappa v.

Rayal Sundaram Allinaz Company Limited (2011(6) ALT 48 (SC)), the income of the daily wage earner was considered at Rs.4500/­ per month. So, the income of the petitioner is taken as Rs.4500/­ per month.

14.Disability of the petitioner:­ P.w.1 is orthopedic surgeon. He examined the petitioner on 1.5.2017 and found the following injuries (1) 6 malunited fracture shaft of fibula left with deformity painful and restricted movements of left knee difficulty to stand on the affected limb difficulty to squat and cross legged difficulty in climbing the stairs and antalogic gait present. Basing on physical examination, wound certificate, Ex.A.6 x­ray, he assessed the permanent disability of the petitioner is 30%. So, the loss of future earnings of the petitioner comes to Rs.4500/­ x 12 x 17 x 30% =

Rs.2,75,400/­.

15.Medical expenses:­ According to the evidence of P.W.1 and the contents of claim petition, the petitioner sustained fracture of fibula and others injuries over his body and took treatment at Government Hospital,

Rayachoty and thereafter at SVRR Hospital, Triuapti and spent Rs.50,000/­ towards medicines and treatment. But the petitioner has not filed any medical bills showing the expenditure incurred by him towards treatment, but the petitioner took treatment at Government Hospitals, so the petitioner is entitled to claim Rs.15,000/­ towards medical expenses As per the guide lines given in the case, Branch Manager, Oriental Insurance Company,

Proddatur v. Durgam Hussainaiah and others 2013(1) An.W.R. 530, the claimant can claim Rs.15,000/­ towards medical expenses. Hence, the petitioner is entitled to claim compensation of Rs.15,000/­ towards medical expenses.

16.The petitioner sustained fracture of fibula and other injuries and undergone surgery, so the petitioner is entitled to claim compensation of

Rs.30,000/­ towards pain and suffering. The petitioner is further entitled to claim compensation of Rs.15,000/­ towards transport charges, attendant charges and extra nourishment.

17.In total the petitioner is entitled to claim compensation of

Rs.2,75,400/­ towards loss of future earnings; Rs.30,000/­ towards pain and suffering; Rs.15,000/­ towards medical expenses; Rs.15,000/­ towards transport charges, attendant charges and extra nourishment; totalling

Rs.3,35,400/­ and the respondents are jointly and severally liable to pay the same to the petitioner with future interest and costs.

18.In the result, petition is allowed with costs granting compensation of Rs.3,35,400/­ (Rupees three lakhs thirty five thousand four hundred only) to the petitioner with future interest at the rate of 9% p.a., from the date of petition till the date of realization. The respondents 1 and 2 are jointly and severally liable to pay the same to the petitioner and they are directed to deposit the same within one month into the court from the date of the order. On deposit of the same, the petitioner is permitted to withdraw a sum of Rs.3,00,000/­ and the remaining balance of compensation amount shall be deposited in fixed deposit in any nationalized bank for a period of one year and after completion of one year period, the petitioner is permitted to withdraw the same with accrued interest thereon. Advocate fee is fixed at

Rs.5,000/­.
