Both the petitions have come on 12.05.2026 before me for hearing in the presence of Sri E. Srinivasa Babu, learned Counsel for Petitioners in both the petitions and learned Additional Public Prosecutor for respondent, and upon hearing the arguments, perusing the material on record and the matter having stood over for consideration, this Court made the following:
C O M M O N O R D E R
Petitioners/A1, A13 and A14 filed Crl.M.P.No.224/2026 and petitioner/A4 filed Crl.M.P.No.236/2026 under Section 483 of Bharatiya 2
Nagarik Surakha Sanhitha, 2023 (in short referred as BNSS, 2023) to release them on bail. The petitioners are accused in Cr.No.79/2026 of Denduluru P.S.
for the offence punishable under Sections 109(2), 191(2), 191(3), 115(2), 118(1), 329(4), 361(2) r/w.3(5) and 190 of BNSS, 2023.
2. Notices given to learned Additional Public Prosecutor and learned
Additional Public Prosecutor endorsed the same.
3. Briefly, the averments of the case of prosecution are as follows:
On 23.04.2026 evening hours and continued on 24.04.2026 at about 6.30 AM and 12.00 Noon at Jogannapalem Village of Denduluru Mandal and was reported on 25.04.2026 at 7.00 AM wherein the complainant Gunje
Ramudu was admitted with injuries and he gave statement before the police that due to previous family disputes with his paternal uncle Al Gunje
Peddiraju, they were having frequent quarrels and that, he further stated that
A1 and his family members used to place lemons (used for Pooja) on every eclipse day on the boundary wall which fall into their house, and when he and his brother questioned the same earlier, disputes arose and that on 23.04.2026 evening, when they again questioned, A1 Gunje Peddiraju, A2
Gunje Raju, A3 Gunje Prabhu and A4 Gunje Yesu came to their house, abused them in filthy language and picked up quarrel, during which A2 fell down and that on 24.04.2026 at about 6.30 A.M., A1 Gunje Peddiraju along with A5 Tatakula Ramaswamy and A6 Tatakula Kumari and others criminally trespassed into their house and beat them with sticks, threatening to kill them and that, again at about 12.00 Noon, A1 along with A2 to A16 namely A2

Tatakula Ramana, all armed with deadly weapons such as sticks and iron rods, came in a group, criminally trespassed into their house premises and attacked them with an intention to kill, as power their pre-planned act and that and that, during the said incident, A1 and A4 beat the complainant with sticks and stones causing injuries on his nose and left eye, resulting in swelling and blackening the left eye and that, A3 along with others beat his younger brother
Raj Kumar with iron rods and sticks causing injuries on his face and head and that, further, A5, A6 and A11 attacked their relative Devala Chinna and Devala
Rajesh with sticks on their heads causing bleeding injuries and that, A7, A8,
A9 and A10 attacked Gali Venkatesu and Gali Peddiraju with iron rods causing bleeding injuries on their heads and that A12, A13, A14, A15 and A16 attacked other victims namely Gali Yedukondalu and Komari Nagaraju with sticks causing injuries on their heads and legs and that, all the accused threatened them victims with dire consequences stating that they would kill them and bury them and that due to the severe injuries, the victims fell down bleeding and that, and later they were shifted by their relatives to Denduluru
Government Hospital and thereafter to Government General Hospital, Eluru for better treatment.
4. Heard arguments of learned Additional Public Prosecutor and
Counsel for petitioners.
5. Now the point for determination is
Whether the petitioners/Accused 1, 4, 13 and 14 are entitled for bail Under Sec.483 of BNSS?
POINT:
6. I have gone through the record. The police registered a crime against the accused for the offence under Sections 109(2), 191(2), 191(3), 115(2), 118(1), 329(4), 361(2) r/w.3(5) and 190 of BNSS, 2023.

7. In this case, both the parties are relatives. The A1 is paternal uncle of defacto complainant whose house is situated near the house of the defacto complainant. As per the record, there were family disputes and boundary disputes between the families since long time. In recent times, the disputes cropped between them on the issue that in the new moon day, the younger paternal uncle of the defacto complainant and his family members (accused) were keeping worshipping lemons on their bordering compound wall and on at borders on their house boundaries. Meanwhile, on 24.06.2026 evening also, they kept worship lemons on the house compound wall, on that again they conflicted with the accused. While thus, on 24.04.1016 at 06.30
A.M., the accused attacked them and on the same day at 12.00 hours also, they were attacked by the accused on 2nd time.

The petitioners denied all the allegations and categorically stated that they were falsely implicated in this case in view of the politics in the village and they are nothing to do with the alleged offence. In fact, the defacto complainant and his family members bet the brother of the petitioner/A1, who sustained fracture injury, thereby as counterblast, this case was foisted since father of A1 is YSRCP leader. The petitioners further submitted that they are ready and willing to furnish sufficient sureties for their due release and pray the court to grant bail by imposing any conditions.
9. Per contra, the investigating agency contended that there are serious allegations against all the accused and submitted that only A1, A4,
A13 and A14 were arrested in this case and remaining accused are absconding. Further submitted that the investigation in this case is still under progress and several crucial steps are yet to be completed, i.e., apprehension of remaining accused, recovery of weapons, awaited the reports from RFSL medical opinion and examination of witnesses etc.

10. As discussed supra, the record reveals that only A1, A4, A13 and
A14 were arrested by the police and the remaining accused are absconding and most of the investigation remained uncompleted. As contended by the respondent, if the petitioners are enlarged on bail at this stage, there is every likelihood that they may threaten induce or intimidate the witnesses and thereby hamper the fair course of investigation. Further, there are every chances to attack the defacto complainant and his family members again by the accused in view of the previous long disputes.
11. Therefore, in view of seriousness and gravity of the allegation and the stage of investigation that most of the accused are not yet arrested and particularly forensic evidence, this court is not inclined to grant bail to the petitioners at this stage. Accordingly this point is answered.
12. IN THE RESULT, the petition is hereby dismissed.
