This case is coming before me on 25.10.2019 for final hearing in the presence of Assistant Public Prosecutor for complainant and of Sri
M.Vinod, Counsel for A.17 and upon hearing arguments of both sides, and upon perusing the material on record and this matter having been stood over for consideration till this day, this court delivered the following:
J U D G M E N T
1. The Sub-Inspector of Police, Alipiri Police Station, Tirupati filed charge sheet against A1 to A.46 in Cr.No.90 of 2007 for the offences 4 punishable under sections 147, 148, 447, 188, 506 r/w 149 of IPC and section 7(1) of Criminal Law Amendment Act 1932.
2. The brief averments of the charge sheet are that: A1 to A.46 are residents of in and around Tirupati Town and belong to C.P.I (M) and C.P.I party and all are interested on each other. As the CPI(M) and CPI party given “Bhuakramana” call from 06.05.2007 to occupy the valuable Government lands forcibly in and around Mangalam village and other villages of Tirupati
Urban Mandal by raising huts and party flags illegally, in order to protect the valuable Government lands and to maintain peace and public tranquility, the
Tahsildar cum executive magistrate, Tirupati Urban, issued orders under section 144 of Criminal Procedure Code, promulgated on 06.05.2007 vide proceedings M.C.No.85/2007 dated 05.05.2007 prohibiting unlawful assembly of five or more persons and carrying sticks, kerosene, fire-arms, bricks, chains and other deadly weapons and persons moving with a view to crate violence upto 15.05.2007. Though the orders under section 144 of Criminal Procedure
Code are in force, on 11.05.2007 at about 6.00 A.M A.1 to A.47 noted above and some others formed themselves into an unlawful assembly, armed with deadly weapons like crow bars, spades, sticks etc, criminally trespassed into the Government land in S.No.119, knowing fully well that orders are in force and tried to occupy the land by erecting huts and their party flags. When the police and revenue officials intervened to prevent them, the accused pelted stones on police and revenue officials who were discharging their legitimate duties as public servants, resulting which, P.V.Sathyanarayana, STF P.C 1664 of A.R, Chittoor and I.Gurappa, PC 3207 of Traffic Police station, Tirupati sustained injuries on their persons. The accused also created public nuisance in the locality of behaving highhandedly. In this connection on the report of
Tahsildar, Tirupati Urban, a case in Cr.No.90 of 2017 under sections 147, 148, 447, 188, 332, 506 r/w 149 of IPC on 11.05.2017 was registered and investigated into. During the course of investigation, A.1 to A.29 were arrested on 11/12.05.2007 at 1.00 a.m at the scene of offence at S.No.119,
Chenganagunta Tank, Mangalam, Tirupati, A.30 to A.45 were arrested on 11.05.2007 at 10.30 p.m and sent them to court for judicial custody on 27.06.2007 at 12.45 p.m A.46 was surrendered in Alipiri police stated and was 5 arrested and sent to court for judicial custody. In this case the Tahsildar,
Tirupati urban also lodged complaint in Cr.No.89 of 2007 under sections 147, 148, 332, 427, 353 r/w 149 of IPC and sections 3, 4 and 5 of Prevention of
Damage to Public Property Act 1984 of Alipiri Police Station, Tirupati, as the section 332 of IPC is attracts only to A.30 to A.46, who are concerned in
Cr.No. 89 of 2007 marked as A.1 to A.17. Therefore, the section of Law 332 of
IPC was deleted from this case and after completion of investigation, charge sheet was filed against A.1 to A.46 for the offences punishable under sections 147, 148, 188, 506 r/w 149 of IPC and section 7(1) of Criminal Law
Amendment Act, 1932.
3. This court has taken cognizances of offences under sections 147, 148, 188, 506 r/w 149 of IPC and section 7(1) of Criminal Law Amendment
Act, 1932 taken against all the accused.
4. On production of A17 copies of documents, on which, the prosecution intends to rely upon, were furnished to the accused as contemplated Under Section 207 of Cr.P.C.
5. On further production of A17 he was examined under Sec: 239
Cr.P.C. He denied the accusation. Charges under sections147, 148, 447, 188, 506 r/w 149 IPC and 7(1) of Criminal Amendment Act are framed, read over and explained to him in Telugu, for which he pleaded not guilty and claimed to be tried.
6.To prove its case, the prosecution has examined P.Ws.1 to 7 and got marked Ex.P.1 to Ex.P.4 On behalf of defence, no oral or documentary evidence was adduced.
7. After completion of prosecution side evidence, A17 was examined under section 313 of Cr.P.C by explaining in Telugu, the incriminating evidence deposed against him by the prosecution witnesses, for which, he denied the same and reported no defence evidence on his behalf.
8. Now the point for determination is: Whether the prosecution is
able to prove the guilt of A.17 for the offences under sections 147, 148,

447, 188, 506 r/w 149 of the Indian Penal Code and 7(1) of Criminal
Amendment Act beyond reasonable doubt?
9.Originally this case was filed against A1 to A.46 vide CCNo. 569 of 2007 on the file of III Addl. Junior Civil Judge’s Court, Tirupati and as per proceedings of the Principal District Judge, Chittoor in Dis.No.17 of 2009
dated 02.01.2009 this case was withdrawn and transferred to IV Additional
Junior Civil Judge’s Court, Tirupati, and numbered as CCNo. 141 of 2009. As
NBWs are pending, case against A.12, A.17 and A.45 was split up from main
C.C.No.141 of 2009 and numbered as present C.C.No. 698 of 2012. While so,
A.17 i.e present accused became under trial prisoner and NBWs against A12 and A45 could not be apprehended since long time case against A.12 and
A.45 was split up from C.C.No. 698 of 2012 and numbered as C.C.No. 10 of 2019. Case against A.1 to A.11, A.13 to A.16, A.18 to A.44 and A.46 was disposed of on 30.04.2013. Case against A.7 was abated on 01.10.2009 as he died during pendency of trial. Therefore the present case is only against A17.
10. POINT: In this case, the prosecution has cited as many as 10 witnesses but examined only P.Ws.1 to 7 since the other witnesses were given up by learned Assistant Public Prosecutor.
11. When the evidence of P.W.1, who earlier worked as Surveyor,
Tirupati Urban is perused, he testified that on 11.05.2007, he went to field work near S.No.119, Mangalampalle and observed 60 persons as mob, trying to erect houses. As the land is kaluva poramboke, he intimated the same to the
Tahsildar and at that time section 144 Cr.P.C proceedings are in force. Then, himself, his Tahsildar and other officials went to the scene at 5.00 p.m and the mob made an attempt to scatter them from the scene as they are making efforts to remove the huts in the said place. In the scuffle the Sub-Inspector of
Police sustained blood injury and he was shifted to Sri Venkateswara
Ramanarayana Ruia Government General Hospital, Tirupati. Though P.W.1 stated that there was mob at the scene, he has not specifically stated that A.17 was present there in the mob or not. Hence, the evidence of PW1 has got no direct bearing against A17.

12. The next evidence let in by the prosecution is that of P.W.2, who earlier worked as police constable in Traffic Police Station, Tirupati. He testified that on 11.50.2017 he along with other police officials went to
Gangachennaiahkunta, Settipalle Panchayat, for the purpose of bundo-busth , since the CPI and CPM party people are illegally occupying the Government land. At that time, section 144 Cr.P.C proceedings are in force. The mob tried to attack them with stones and crowbars when they tried to dispossess them.
P.W.2 further deposed that one M.Nagaraja beat him with a stick on his head and Chinna Damu beat Sathyanarayana, who is STF Constable with a stick and he gave report to police. Admittedly, those two persons i.e Nagaraja and
Sathyanarayana are not the present accused. In the cross examination, P.W.2 has categorically admitted that he cannot identify whether A.17 was present in that mob or not. Therefore, the evidence of P.W.2 also will not render much help to prove the complicity of A17.
13. The next evidence let in by prosecution is that of P.W.3 who is working as Thalari, Mangalam village, since 1996. He testified that on 11.05.2007 CPI and CPM party people erected houses in Government Land at
Chennaiahgunta, Tirupati. He along with Village Revenue Officer went to the scene and made a call to the Thasildar who also came to the scene. At that time they removed the houses on the instructions of Tahsildar and CPI workers 50 in number tried to obstruct them. P.W.3 also categorically admitted in the cross examination that he cannot say whether A.17 in this case was present in the mob at the scene on the date of offence or not. Therefore, much credence need not be attached to the evidence of this witness also.
14. When the evidence of P.W.4 who earlier worked as police constable, armed Reserve, Chittoor from August 1990 to August 2007 is perused, he testified that on 11.05.2007 he along with his staff went to
Settipalli Cheruvu for bandobust duty and at that time mob consisting 200 people who belong to CPI and CPM party tried to erect houses in the
Government land and at that time section 144 Cr.P.C proceedings are in force.
P.W.4 further deposed that they pelted stones on them and in the incident 8
P.W.2 sustained injuries and he sustained injury on his right hand. This witness has also categorically stated in the cross examination that he cannot say whether A.17 in this case was present in the mob at the scene on the date of offence or not. Hence, much credence need not be attached to the testimony of this witness also.
15. In as much as the evidence of P.W.5 who earlier worked as
Tahsildar, Tirupati Urban is perused, he testified that on 11.05.2007 CPI and
CPM party workers made an attempt to occupy Government Lands under the name and style as Bhoo Akramana at Mangalam, Tirupati Urban and at that time section 144 Cr.P.C proceedings are pending. He further deposed that on 11.05.2007 at 7.00 a.m he received phone call that the mob consisting of 500 people tried to enter the land in Sy.No.119 in an extent of Ac:46.04 cents of
Mangalam village and then he along with his Revenue Inspector –
V.Viswanathan and Assistant Revenue Inspector Hemanth Reddy and P.Ws.1 and 3 along with police personnel proceeded to the scene and announced to public to leave the place. Despite it, some of the leaders in the mob provoked others to raise huts in the said land and some persons in the mob pelted stones on them and in the scuffle two constables sustained injuries. Ex.P.1 is orders under section 144 Cr.P.C dated 05.05.2007 issued by him. Ex.P.2 is his complaint given to Station House Officer of Alipiri Police Station, dated 11.05.2007. Of-course, P.W.5 has categorically identified A.17 particularly as the person in the mob. In the cross examination, this witness has stated that he cannot identify all the 500 members in the mob. He further admitted that he has not mentioned the physical features of A.17 in Ex.P.2. In such case, as to how P.W.5 has specifically identified A.17 in the Court at the time he gave evidence in the Court, is a million dollar question, since the incident was happened about 12 years back. P.W.5 has not stated specifically that he has got close acquaintance with A.17 for one reason or the other. Therefore, the identity of P.W.5 in respect of A.17 before the Court more particularly, after lapse of 12 yeas of time is rather a myth and far fetching from truth and as an official of Revenue, he has deposed against A.17. Had it been a fact that he had acquaintance with A.17, he would have mentioned the physical features of
A.17 in the report or he would have stated his other close acquaintance with 9
A17. Therefore, the argument of learned counsel that PW5 purposefully deposed against A17 more particularly with regard to the identity in the mob on the date of incident is an acceptable version. Hence, the sole evidence of
P.W.5 is not trustworthy so as to base conviction against A.17.
16. The next evidence let in by prosecution is that of P.W.6 who earlier worked as Assistant Sub-Inspector of Police, Alipiri Police Station from 2005 to 2007. He deposed that on 11.05.2007 at 9.00 p.m on the report of P.W.5 he registered a case in Cr.No. 90 of 2007. Ex.P.3 is original FIR in Cr.No. 90 of 2007. He further deposed that he went to the scene of offence and recorded the statements of P.Ws.1 to 3 and prepared Ex.P.4, rough sketch. At the scene he arrested A1 to A.27 and sent them to court for judicial custody. This witness has also not specifically stated that A.17 is one among the persons in the mob, except stating that he arrested A.17 also. Even otherwise, P.W.6 is not an eyewitness and P.W.6 has categorically admitted in the cross examination that along with complaint, P.W.5 has not submitted any document to him and he has not stated about the physical features of A.17. Therefore, much credence need not be attached to the testimony of P.W.6 also, since he stated about the arrest of accused and registration of crime.
17. The last evidence let in by prosecution is that of P.W.7 who earlier worked as Sub-Inspector of Police, Alipiri Police Station, from 06.09.2006 to 06.06.2010. He further deposed that on 09.06.2007 he arrested A.30 to A.45 at Chennaiagunta fields under police proceedings and sent them to Court for judicial custody. The evidence of P.W.7 is also not much helpful to prove the complicity of A.17, since, he deposed that he arrested A.30 to A.45.
18. To sum up as the evidence on record is not sufficient and there was no specific identity spoken out by any of the witnesses and the evidence of
P.W.5 did not stand to legal scrutiny, A.17 is entitled for acquittal for all the offences with which he is charged.
19. In the result, I found A17 not guilty for the offences punishable under sections 147, 148, 447, 188, 506 r/w 149 of the Indian Penal Code and section 7(1) of Criminal Law Amendment Act, 1932 and he is acquitted under 10 section 248(1) of Cr.P.C. A17 shall be set at liberty forthwith, if he is not required in any other case. Case against A.12 and A.45 was split up from
C.C.No. 698 of 2012 and numbered as C.C.10 of 2019.
