This bail petition is coming on 24.07.2023 for hearing before me in the presence of Sri G.S.Moorthy, Advocate for the petitioner/accused and of Public Prosecutor for the respondent/ complainant, after perusing the case records, and having stood over for consideration, this Court delivered the following:­

O R D E R

01.This second bail application is filed by the petitioner under Section 439 of Cr.P.C., seeking for grant of bail to the petitioner in Cr.No.147 of 2023 of Porumamilla Police Station for the offences U/Sec.420 I.P.C and

Section 5 of A.P.Protection of Depositors of Financial Establishment

Act,1999.

02.The case of the prosecution is that the accused organized some chits in Porumamilla town by collecting money from several persons by reposing confidence in them that he will promptly repay money to them either on the dates of their bidding chits or at the end of the chits period, and he failed to repay the money to his customers who are chit members and thereby cheated the defacto complainant Lakidi Raghuramudu and others and cheated the money in crores of rupees and absconded from town.

05.Point for consideration: Whether the petitioner / accused is entitled for bail under section 439 of Cr.P.C.?

06. Point:

The learned counsel for petitioner contends that this is second bail application and the first bail application was dismissed on the ground that some more witnesses are to be examined and the facts and materials on records discloses that the dispute is civil in nature and when a civil remedy is available, a criminal prosecution is barred but without approaching the civil Court the defacto complainant influenced the police and converted it into a criminal case and argued that the police custody was taken and records were seized and he admitted that he has got three houses and his wife is suffering from cancer and she has to be taken to the hospital for Chemotherapy and prayed for grant of bail. 

07.The learned public prosecutor contended that 86 witnesses are examined so far and the investigation is pending for want of some more records relating to the properties and opposed the bail. 

08.The perusal of the record shows the Crl.M.P.No.267/2023 has been dismissed on 10th July, 2023 and admittedly in this case police custody of petitioner was taken and records were seized and even as per prosecution 86 witnesses have been examined. Hence, in view of the submission of learned counsel for petitioner/accused that wife of the petitioner is a chronic cancer patient and his presence is necessary and material part of investigation is completed, I feel that it is a fit case to release the petitioner/accused on bail by imposing some conditions. Accordingly, point is answered.

09. In the result, this petition is allowed, granting bail to the petitioner/accused with following conditions.

i) The petitioner/accused is ordered to be released on bail on execution of personal bond for Rs.50,000/­ with two sureties for a like sum to the satisfaction of Additional Judicial Magistrate of First

Class, Badvel.

ii) On his release, the petitioner/accused shall appear before the concerned Station House Officer, Porumamilla P.S. twice in a month i.e., on second and fourth Saturday of every month between 10.00 a.m to 5 p.m till filing of charge sheet or until further orders.

iii) The petitioner/accused shall not leave India without prior permission of the Court. 

iv) The petitioner/accused shall cooperate with the investigating agency during the course of investigation.
