The decree-holder filed this E.P.for realization of the amount due under the decree, dated 13.02.2017 passed by this Court in O.S.No.2230 of 2006 by way of attachment and sale of the E.P. Schedule immovable property. Against 29 the subject decree, Judgment debtor No.1 filed an appeal being CCCA No.107 of 2017. He also filed a petition being CCCA MP No.265 of 2017 seeking stay.
The Hon’ble High Court by Order, dated 14.06.2017 granted of execution of decree subject to the condition of judgment debtor No.1 depositing half of the decreetal amount along with interest granted by this Court within four weeks from the date of the order. The Hon’ble High Court also observed that in case of default of payment, the order stands vacated without further reference to the Court.
As seen from the record, judgment debtor No.1. filed a memo into the
Court on 14.07.2017 enclosing a copy of challan to the effect that he has deposited an amount of Rs.6,90,142/- on 01.07.2017 to the credit of the suit in pursuance of the compliance of the order of the Hon’ble High Court. But, when the decree-holder filed a cheque petition to withdraw the amounts so deposited by judgment debtor no.1 as per the orders passed by the Hon’ble
High Court in I.A.No.1 of 2018 in CCCA MP No.265 of 2017 in CCCA No.107 fo 2017, dated 27.12.2018, the accounts section of this Court made an endorsement on 29.01.2019 that no amount as such is lying in the CCD to the credit of OS.No.2230 of 2006.
The decree-holder filed a petition being EA No.7 of 2019 to direct judgment debtor No.1 to produce original challan evidencing the deposit of the amount in the Court. This Court by order, dated 13.03.2019 directing judgment debtor No.1. to produce the original challan. But, he did not produce the same so far.
The learned counsel for the decree-holder requests to take up the E.P.
for further proceedings for non-compliance of the conditional order passed by the Hon’ble High Court. But, it is to be noted that the Hon’ble High Court vide 30
Order, dated 27.12.2018 in IA.No.1 of 2017 in I.A.No.1 of 2018 in CCCA MP
No.265 of 2017 in CCCA No.107 of 2017 while permitting the decree-holder to withdraw the amount stated to have been deposited by judgment debtor no.1, made the interim stay absolute. So, it has to be taken that the stay is in subsistence, unless the same is specifically vacated by the Hon’ble High
Court. Hence, the decree holder is advised to take appropriate steps in the matter. Call on 14.06.2019.

Ali, Counsel for the Defendants, this court doth Judgment and Decree in terms of Compromise as follows:
1. That in pursuance to the above compromise, the plaintiffs offered to confine her claim only to an extent of 232 Sq.yards of land, equivalent to about 193.982 Sq.Meters of land, out of total extent of 600 sq.yards of land comprising part only of the appurtenant land on the Western side of the property belonging to the Defendant no.1 and the Defendant no.1 has agreed to convey the same by way of sale deed for an extent of 232 Sq.yards of land only, equivalent to about 193.982 Sq.Meters of land comprising part only the appurtenant land on the Western side of the property belonging to the Defendant no.1 forming part of H.No’s 6-3-597 and 6-3-597/A, forming part of Sy.No.263 and 264 fo Shaikpet Village, Banjara Hills, Hyderabad T.S., and without payment of any further consideration to the said 1st defendant who is the sole legal heir and successor of late Ms.Iftekharunnisa Begum as aforesaid.
2. That in terms of the above compromise, the defendant No.1 shall execute sale deed in respect of 232 sq.yards of land, equivalent to about 193.982 Sq.Meters of land, out of 600 sq.yards of suit land, under the aforesaid Agreement of Sale, dated 21.09.1988, in favour of plaintiff No.1 and the plaintiffs hereby withdraw all their rights, claims over the remaining extent of 368 Sq.yards or 307.695 Sq.Mts., of suit land in favour of Defendant no.1, in lieu of this Joint Compromise.
3. That the plaintiffs hereby agrees and declares that they have finally and conclusively settled the dispute upon execution and registration of sale deed in respect of 232 Sq.Yards of land, equivalent to 193.982 Sq.Meters of land and the plaintiffs hereby declares that the agreement of sale deed, dated 21.09.1988, shall stand cancelled to the remaining extent of land upon execution of sale deed in respect of the aforesaid land, and in recognition of its cancelled status the original document shall be used only as a link document for 232 Sq.Yards of land that shall be so conveyed to the plaintiff No.1 and the plaintiffs hereby withdrawn the suit claim against the said defendants for the above said remaining land admeasuring 368 Sq.Yds., or 307.695 Mts.,
4. That both the plaintiffs and the Defendants hereby declares that neither of them nor their legal heirs nor any person/s claiming through or under or in trust for them or any of them shall have any sort of claim, right, 33 title or interest in respect of the terms agreed under this Joint Compromise.
5. That as the 1st plaintiff’s son Mr.R.Ravi Kumar, the plaintiff No.2 is already owner of another plot admeasuring 600 Sq.Yards which is on the North- Western side of the Defendants property and the said plot already has an existing thirteen feet wide access from the Southern Corner of the said plot as mentioned in the registered Sale Deed Bearing Document No.5403/88, executed by Ms.Iftequarunnisa Begum, therefore now as part of this Joint Compromise, the Defendants agree to convey the adjoining appurtenant land admeasuring about 232 Sq.Yards, equivalent to about 193.982 Sq.Meters, as per the schedule at the foot of the present document, and delineated in the plan annexed here to and marked in Red Colour.
6. That the schedule property comprising the aforesaid 232 Sq.Yards, of land, equivalent to about 193.982 Sq.Meters of land, hereby agreed to be conveyed shall adjoin the plot measuring 600 Sq.Yards of Mr.R.Ravi Kumar, Plaintiff No.2, and the schedule property comprising the aforesaid 232 Sq.Yards shall have access abutting the road from the Southern side only, i.e., abutting the existing 13 feet wide access from the said southern side corner of the said plot of Plaintiff No.2 Mr.R.Ravi Kumar, under Regd.Sale Deed Doct. No.5403 of 1988.
7. That it is further agreed between the parties that the schedule property comprising the aforesaid 232 Sq.Yards of land, equivalent to about 193.982 Sq.Meters of land, shall have no entrance nor any opening from any corner of the property belonging to the Defendants, except from the Southern side i.e., the schedule property comprising the aforesaid 232 Sq.Yards shall have access abutting the road from the Southern side only, i.e., abutting the existing 13 feet wide access from the said southern side corner of the said plot of Mr.R.Ravi Kumar plaintiff No.2, under Regd.Sale Deed Doct.No.5403 of 1998 and further that this restriction shall be a covenant running with the land, such that alienees of the transferee/s concerned shall continue to be bound by the same restrictive covenant.

That the Defendants have agreed to convey the aforesaid 232 Sq.Yards, equivalent to about 193.982 Sq.Meters of land, within one week from the 34 date of recording this Joint compromise, free of any further consideration, and the Stamps and Registration charges shall be borne by the plaintiff No.1, failing which the plaintiff no.1 shall get registered the Sale Deed through this Hon’ble Court, by filing an Execution Petition
before this Hon’ble Court in terms of the above Joint Compromise.
9. That the parties hereto have agreed that the Defendants shall execute a sale deed in favour of the Plaintiff No.1 conveying an extent of 232 Sq.Yards as contemplated supra and that the Plaintiff in turn has Relinquished, withdrawn her right, claim whatsoever in nature in respect of remaining 368 sq.yards or 307.695 Sq.Mts., out of the total extent of 600 sq.yards comprising the suit schedule property which is already in possession of the Defendant no.1.
10. That it is agreed between both the parties, that the compound wall separating the land under this compromise shall be erected by demarcating the plot of land i.e., 232 Sq. Yards, (about 193.982 Sq.Meters) of land, which is subject matter of this Joint Compromise, to separate it from the rest of the property exclusively belonging to the Defendant no.1, at the location as delineated in the plan annexed to this Joint Compromise and shall be constructed by the Plaintiff along with one Servant Quarter Room, WC and Bathroom and the sewage line which are affected due to the erection of wall, entirely their costs.
11. That the respective parties hereto declare that in view of this Joint Compromise they shall not have any other or further claim by invoking the above Agreement of Sale, Dt:21.09.1988, or otherwise in respect of any part of the property of either parties and inspite of this settlement if the Plaintiffs or Defendants and their respective legal heirs or successors of one or more of them nor any person claiming through, under or in trust from them or any of them lays any such claim the same shall be null and void, and devoid of any legal sanctity.
