J U D G M E N T

1. Inspector of Police, Jammalamadugu Urban Police Station has laid a charge sheet in Cr.No. 103/2014 against the Accused of the offences Under

Section. 366(A), 376 of Indian Penal Code and Section. 8 of Protection Of

Children From Sexual Offences Act, 2012 , alleging in brief is as follows :

(a).Accused is the resident of Devagudi village, Jammalamadugu mandal.

Panditi Sasikala is the victim girl. The victim girl P.W.1 studied upto 7th class and she discontinued her studies and used to stay in the house of P.W.2 and

P.W.3 at Devagudi village, Jammalamadugu mandal. The Accused who is the junior paternal uncle of P.W.1 used to meet her frequently in the absence of

P.W.2 and P.W.3 and induced, seduced P.W.1 for sexual intercourse with him by giving promise that he will look after well. Due to immaturity of mind P.W.1 gave consent to the Accused for participating in sexual intercourse. Accused with intention to continue her sexual intercouse with P.W.1, he procured P.W.1 from their house, prior to 16 days to 19.3.2014 and stayed in the rented house of L.W.11 T. Nagaraju by informing that they are the brother and sister. Basing on the report given by P.W.7, S.H.O., Jammalamadugu registered a case in

Cr.No. 103/2014 of the offences Under Section. 376 of Indian Penal Code and

Section. 6 of Protection Of Children From Sexual Offences Act, 2012. P.W.8 C.

Chandrasekhar, Inspector of Police, Jammalamadugu took up investigation, examined the witnesses and also the victim girl, visited the scene of offence, prepared rough sketch. On 24.3.2014 at 8.00 a.m near bus stop of Devagudi village, on Jammalamadugu- Proddatur main road P.W.8 arrested the Accused and sent him to remand for judicial custody. Thus the Accused, committed an offences punishable Under Section.366(A), 376 of Indian Penal Code and

Under Section. 6 of Protection of Children from Sexual Offences, Act, 2012.

Hence, the charge sheet.

2.This case has taken on file as Spl.S.C.No. 126 /2014. On appearance, copies of the documents were furnished to the Accused. Accused was examined U/Sec. 239 of Cr.P.C and he pleaded not guilty. The Learned Public

Prosecutor and the learned counsel for the Accused were heard regarding charges. On consideration of the material on record, charge Under Section.

366-A, 376 of Indian Penal Code and Under Section 6 of Protection Of

Children From Sexual Offences Act, 2012 was framed against the Accused , read over and explained to him in Telugu and the Accused pleaded not guilty to the said charge and claimed to be tried.

3. In support of its case, the prosecution examined P.W. 1 to 9. Ex.P-1 to

Ex.P-12 were marked. As against the evidence of prosecution, Accused did not adduce any evidence.

4. On the strength of the prosecution case, Accused was examined U/Sec.

313 of Cr.P.C, regarding the incriminating circumstances appearing against

Accused in the evidence, he denied the same and reported no defence evidence.

5.Arguments of both the sides were heard.

6. Now the point that would arise for determination is “ Whether the

prosecution proved the guilt of Accused of the offences with which he

was charged, beyond all reasonable doubt ?“

(a).It is the case of prosecution that the Accused sexually harassed the minor girl P.W.1 and he is liable for the punishment.

(b). To substantiate their version, prosecution examined P.W.1, who is the victim girl. P.W.1 stated in her evidence that she does not know the Accused,

Accused never promised her to marry and never committed sexual assault against her and she does not know anything about the case and she was not examined by the police. P.W.2 and P.W.3 who are parents of the victim girl of 4

P.W.1, stated that they do not know anything about the case and they were not examined by the police. P.W.4 to P.W.6 stated that they handed over P.W.1 to

S.H.O. Jammalamadugu Police Station and again they brought back P.W.1 to their Swadhar Home, except that they do not know anything about the case.

P.W.7 stated that she has addressed a letter to A.S.P., Jammalamadugu to take action in this case. P.W.8 stated that he rescued P.W.1 and hand over to the Chairperson, Swadhar Home, Kadapa.

(c.). Section. 161 Cr.P.C statements of P.W.1 to P.W.5 were exhibited as

Ex.P-1 to Ex.P-5 and letter of P.W.7 was marked as Ex.P-6 and nothing was elicited in their cross-examinations. Evidence of the witnesses clearly shows that they have no interest to give evidence against the Accused. The evidence of P.W.9 Investigating Officer , would not help to the prosecution, in view of lack of material evidence in the evidence of P.W.1 to 8.

(d).As can be safely gathered, the prosecution utterly fails to prove the guilt of the Accused of the offences with which he was charged.

(e)For the foregoing reasons, this Court, therefore, answer this point in the negative holding that the prosecution failed to prove the ingredients of Section.

366-A, 376 of Indian Penal Code and Under Section 6 of Protection Of

Children From Sexual Offences Act, 2012.

7. In the result, Accused is found not guilty of the offences Under Section.

Children From Sexual Offences Act, 2012 with which he was charged and thereby acquitted U/Sec. 235(1) of Cr.P.C. The bail bonds of Accused stands cancelled. The unmarked non-valuable property shall be destroyed after appeal time is completed. The Accused shall execute personal bond for

Rs.10,000/- in view of Sec. 437(A) of Cr.P.C.

1. Inspector of Police, Rayachoty U/G Police Station has laid a charge sheet in Cr.No. 9/2014 against the Accused of the offences Under Section 354 2 of Indian Penal Code and Under Section 11(ii) of Protection Of Children From

Sexual Offences Act, 2012 , alleging in brief is as follows :

(a).Accused is the resident of Rayudu colony, Rayachoty town. About 4 days prior to the occurrence, the accused took the victim girl T. Bhargavi P.W.4 into his house and bolted the door from inside. On noticing the same P.W.3 V.

Subbarayudu went to the house of accused and knocked the door, then the accused came out from the house by opening the door and ran away from the spot, then the victim girl P.W.4 came out from the house of accused by wearing clothes. On 4.1.2014 morning at about 10.00 a.m while the victim girl P.W.4 T.

Bhargavi present at her house, the accused went there and lured the victim girl with money and called into the house, due to fear P.W.4 went into the house and bolted the door. Basing on the report given by P.W.1 T. Suguna, police registered a case in Cr.No. 9/2014 of the offences Under Section. 354 of Indian

Penal Code and Under Section 11(ii) of Protection Of Children From Sexual

Offences Act, 2012. P.W.5 C. Nagamanemma, Women Head Constable,

Rayachoty U/G Police Station took up investigation, examined the witnesses and also the victim girl, visited the scene of offence, prepared rough sketch.

On 7.1.2014 P.W.5 arrested the Accused and sent him to remand for judicial custody. Hence, the charge sheet.

2.This case has taken on file as Spl.S.C.No. 87/2014. On appearance, copies of the documents were furnished to the Accused. Accused was examined U/Sec. 239 of Cr.P.C and he pleaded not guilty. The Learned Public

Prosecutor and the learned counsel for the Accused were heard regarding charges. On consideration of the material on record, charges Under Section 354(B) of Indian Penal Code and Under Section 11(ii) of Protection Of Children

From Sexual Offences Act, 2012 were framed against the Accused , read over 3 and explained to him in Telugu and the Accused pleaded not guilty to the said charges and claimed to be tried.

3. In support of its case, the prosecution examined P.W. 1 to 5. Ex.P-1 to

Ex.P-7 were marked. As against the evidence of prosecution, Accused did not adduce any evidence.

4. On the strength of the prosecution case, Accused was examined

P.W.3 stated in his evidence that he does not know P.W.1, P.W.2 and P.W.4 and he does not know the Accused and he does not know anything about the case and he was not examined by the police. The crucial witness P.W.4 who is the victim girl stated that she does not know the Accused and he never misbehaved with her.

4 (c.). Section. 161 Cr.P.C statements of P.W.1 to P.W.3 were exhibited as

Ex.P-2 to Ex.P-4 and report of P.W.1 was marked as Ex.P-5 and nothing was elicited in their cross-examinations. Evidence of the witnesses clearly shows that they have no interest to give evidence against the Accused. The evidence of P.W.5 Investigating Officer , would not help to the prosecution, in view of lack of material evidence in the evidence of P.W.1 to 4.

(d).As can be safely gathered, the prosecution utterly fails to prove the guilt of the Accused of the offences with which he was charged.

(e)For the foregoing reasons, this Court, therefore, answer this point in the negative holding that the prosecution failed to prove the ingredients of Section.

Jammalamadugu mandal. On 4.2.2014 at about 11.00 hours accused went near to the house of P.W.1 Tirupulugalla Obulesu and kissed P.W.3

Tirupalagalla Jyothi, aged about 6 years, who is the daughter of P.W.1 and misbehaved with her. P.W.4 R. Anthony witnessed the incident. Basing on the report given by P.W.1 T. Obulesu, police registered a case in Cr.No. 29/2014 of the offences Under Section. 354 of Indian Penal Code and Section. 8 of

Protection Of Children From Sexual Offences Act, 2012. P.W.7 C.

Chandrasekhar, Inspector of Police, Jammalamadugu took up investigation, examined the witnesses and also the victim girl, visited the scene of offence, prepared rough sketch. On 6.2.2014 at 5.00 p.m P.W.7 arrested the Accused at the cross road of Gudemcheruvu village on Jammalamadugu – Muddanur main road and sent him to remand for judicial custody. P.W.5 and P.W.6 also did not support the case of prosecution and they stated that they do not know the accused and they do not know anything about the accused and the Accused never misbehaved with the victim girl.

4 (c.). Section. 161 Cr.P.C statements of P.W.1, P.W.2, P.W.4 and P.W.5,

Section. 164 Cr.P.C statements of P.W.3 and P.W.6 were exhibited as Ex.P-1 to Ex.P-4, Ex.P-8 and Ex.P-9 and report of P.W.1 was marked as Ex.P-5 and nothing was elicited in their cross-examinations. Evidence of the witnesses clearly shows that they have no interest to give evidence against the Accused.

The evidence of P.W.7 Investigating Officer , would not help to the prosecution, in view of lack of material evidence in the evidence of P.W.1 to 6.

(d).As can be safely gathered, the prosecution utterly fails to prove the guilt of the Accused of the offences with which he was charged.

(e)For the foregoing reasons, this Court, therefore, answer this point in the negative holding that the prosecution failed to prove the ingredients of Section.

7. In the result, Accused is found not guilty of the offences Under Section.
