Money & Property Recovery Suit Court Fee in Andhra Pradesh
Money suits and property recovery suits in Andhra Pradesh courts are governed by Schedule I, Article 1(c) of the A.P. Court Fees and Suits Valuation Act, 1956. The fee is ad valorem — calculated on the total amount claimed using a progressive slab system with ceiling-rounding. Since the 2014 bifurcation, Andhra Pradesh has maintained and amended this schedule independently through G.O.s published in the AP Gazette. Advocates filing in courts at Vijayawada, Visakhapatnam, Guntur, Tirupati, Nellore, Kakinada, Kurnool, or Rajahmundry should verify the current schedule from https://apgazette.apcfss.in before filing high-value suits.
How is the court fee calculated?
- Determine the total claim: principal amount + interest accrued up to the date of filing. Exclude future interest and estimated costs — only amounts actually due as on the filing date.
- The suit value spans multiple rate slabs. The ceiling-rounding rule applies: each slab portion is rounded up to the nearest increment (₹5, ₹10, ₹100, ₹500, ₹1,000, etc.) before applying the rate.
- Fee is cumulative across slabs — e.g. a ₹1.5L claim is broken into ₹100 + ₹900 + ₹9,000 + ₹10,000 + ₹10,000 + ₹20,000 + ₹50,000 + ₹50,000 portions, each rounded and rated separately.
- For suits on promissory notes or cheques where interest is a component, value the suit at principal + interest to date; future interest from filing date onward is excluded.
- Cross-check with the AP eCourts pay portal (https://pay.ecourts.gov.in) and, where available, the court registry fee table displayed at the filing counter.
Key points advocates must know
- AP courts follow the same 1956 Act as Telangana but with independent post-2014 amendments — do not rely on Telangana G.O.s for AP rates.
- Court fee stamps in AP are issued as e-Stamps through the IGRS AP portal (https://registration.ap.gov.in) and SHCIL-authorised banks — physical stamps are being phased out in urban districts.
- For property recovery suits, the suit value is the market value of the property or the amount of the claim, whichever is lower if there is a dispute — verify the applicable provision with the AP HC judgments.
- Deficit court fee is a common cause of plaint return in AP district courts. Always compute conservatively on the higher side near the boundary of each slab to avoid deficit.
- AP government departments and statutory authorities should verify their exemption status under Section 5 of the Act from the relevant G.O. before assuming exemption.
