Succession Certificate Court Fee in Haryana
A succession certificate under the Indian Succession Act, 1925 enables the holder to collect debts and securities belonging to a deceased person. Court fee is calculated under Schedule I, Article 7 of the Court Fees Act, 1870 (as amended by Haryana Acts 11/1974, 22/1974 and Act 16 of 2009) using a bracket system — the rate applies to the total aggregate value of all debts and securities specified in the certificate.
How is the court fee calculated?
- List all assets to be covered: bank accounts, fixed deposits, PPF, NSC, shares, bonds, debentures, provident fund, insurance proceeds, etc.
- Sum the total value of all such assets — this is the figure for court fee calculation.
- Apply the bracket rate to the TOTAL (not progressive): up to ₹5,000 = 2%; ₹5,001–₹25,000 = 3%; ₹25,001–₹50,000 = 4%; ₹50,001–₹1,00,000 = 5%; above ₹1,00,000 = 6%.
- Example: ₹3,00,000 in bank accounts and ₹50,000 in shares = ₹3,50,000 total → 6% × ₹3,50,000 = ₹21,000 court fee.
