This case is coming on this day before me in the presence of Assistant Public Prosecutor for the complainant Police and Smt Bindu Madhavi, Legal Aid counsel for accused and having stood over for consideration to this day and on, hearing both sides, this court delivers the following:

ORDER

The S.I of Police, Arundelpet P.S filed charge sheet in Crime No. 120/15 U/Sec 307 of IPC.

2.The contents of the charge sheet in brief is as follows:

Accused is a Rowdy sheeter having got “A” Category History No.273 in Arundelpet P.S. As the accused was involved in Cr.No. 33/14 U/s 302, 201 IPC, Rowdy History sheet has opened on 27.10.2014 in Arundelpet P.S and the same is maintaining. The accused is a dangerous and desperate character, and habituated in committing bodily offences. The cases against the accused are Cr.No.33/14 U/s 302, 201 IPC of Arundelpet P.S, Cr.No.484/14 U/s 324 r/w 34 IPC of Arundelpet P.S, Cr.No.404/14 U/s 384 IPC of Kothapet P.S, Cr.No.410/14 U/s 384, 324 r/w 34 IPC of Kothapet P.S, Cr.No.411/14 U/s 380 r/w 34 IPC of Kothapet P.S, Cr.No.490/14 U/s 309 IPC of Kothapet P.S, Cr.No.498/14 U/s 506 r/w 34 of Kothapet P.S and Cr.No.584/13 U/s 307 r/w 34 of Nallapadu P.S. The husband of L.W.6 Thagore Lakshmi died about one year back and she has no children. Accused is one of the nephews of L.W.6. T. lakshmi and he is habituated in drinking alcohol and used to extract money from L.W.6 T. Lakshmi by threatening her with dire consequences. L.W.6 T. Lakshmi has got a terraced building and taking advantage of having no children to L.W.6 T. Lakshmi the accused used to compel her to register the terraced building on his name. As the matter stood like thus on 5.3.15 afternoon the accused went to the house of L.W.6 T. Lakshmi demanding for cash of Rs.5,000/- and threatened her, if she will not give cash he would kill her and went away. On the same day night at about 9 Pm when L.W.6 T. Lakshmi stood on the road at her house, the accused went to her with an iron road attacked her on her head forcibly, as a result, she fell down on the stones of drainage canal in-front of the house of L.W.3 V. Koteswara Rao, in an UN-conscious state, and with bleeding. When the complainant L.W.1 Boppana Naga Raju and others went to the rescue of the injured L.W.6 T. Lakshmi, the accused ran away with the iron rod. Later she was shifted to GGH, Guntur for treatment, where her statement was recorded by the Head constable of Arundelpet P.S who in turn handed over the statement to the SI of Police, Arundelpet P.S and he registered the same as a case in Cr.No.120/15 U/s 307 IPC at 1.45 A.M on 6.3.2015 and investigated the same. During the course of investigation, he examined the available witnesses, recorded their statements and he inspected the scene under the cover of observation report. On 8.3.2015 he arrested the accused at about 6 PM at the road leading to Reddypalem, Rajiv Gandhi Nagar, 6th lane Corner, Guntur in the presence of mediators under the cover of mediatornama and seized an iron rod, length about 3 feet and accused confessed about the crime. L.w.11 who is the medical officer treated the injured and issued wound certificate opining that the injury No.1 of L.W.6 T. Lakshmi is simple in nature and the injury No.2 is Grievous in nature. The S.I of Police, Arundelpet P.S after completion of investigation filed charge sheet in this case.

3. On a careful perusal of charge sheet and other relevant material placed on record, cognizance of offences punishable U/Secs.307 of IPC was taken against the accused and posted the matter for his appearance.

4. On appearance of accused, he was furnished with copies of documents as stipulated under Sec.207 Cr.P.C.

5. On going through the entire material placed on record, a prima facie case is made out against the accused for the offence alleged U/Secs.307 of IPC, which is exclusively triable by Court of Sessions, and hence the case is committed to the Court of Sessions Division, Guntur Under Section 209(a) Cr.P.C.

6. Accused is in judicial custody in District Jail, Guntur. The Superintendent, District Jail, Guntur, is directed to produce the accused before the Court of Sessions, Guntur, after receipt of summons.

7. The entire case record, documents and material objects shall be forwarded to the Court of Sessions Division Guntur, under Section 209 (c) Cr.P.C.

8. The commitment of this case shall be notified to the Public Prosecutor of the Court of

Sessions Division, Guntur, under Section 209(d) Cr.P.C.

9. Accused submits that, they got sufficient means to defend their case at the time of trial and they are directed to appear before the Court of Sessions Division, Guntur, as and when they receives summons.

In the result, the case is committed to the court of sessions u/sec 209(a) Cr.P.C. P.C. since accused is in judicial custody in District Jail, Guntur. The Superintendent, District Jail, Guntur, is directed to produce the accused

before the Court of Sessions, Guntur,

after receipt of summons. The office is directed to submit the entire case record and property if any to the court of Court of Sessions Division Guntur, as required u/sec 209 (c ) Cr.P.C. and notify u/sec 209(d) Cr.P.C. to the public prosecutor about the commitment of the case to the court of sessions.
