03. The defendant agrced that he will not send the drain water and sluice water into suit ABCID passage from his house. The drain water and sluice water to be sent by the defendant through the pipe installed on the castern side of the suit ABCD passage to the southern side Drainage channel. The plaintifla are agrced that they are not to put

Rangolies in Joint passage.

04. The defendant agreed that he will not to raise any objection, to nake construction of compound wall or any kind of constructions by the plaintiffs in their site on the western siele of the ABCD passage.

05. Both parties further agreed that if any one of the parties in the suit violates or contravenes for the above terms the other side agitate for the implementation of the above terms in this Award by way of filing Execution petition at the appropriate court of law. Accordingly Award is passed. The plan filed by the both parties is herewith attached.

Police returned the summons of LW3 along with certification of 24th ward counselor, Tenali stating that the said witness is not residing in the address given and his whereabouts are not known. Hence, evidence of LW3 is closed. The summons of LW7 also returned with endorsement of surpanch and relative of LW7 stating that the said witness had died about 3 years back. Hence, evidence of LW7 is closed. \ The learned APP given up the evidence of L.Ws.5, 6, 8 to 11. Prosecution evidence closed. Examination of the accused U/S.313 Cr.P.C. dispensed with as there is no incriminating material against the accused. Heard arguments. \ Judgment pronounced in the Open Court. (VSO) \ In the result, Accused is found not guilty for the offence punishable U/Sec.338 of IPC Sec.181 of MV Act and he is acquitted as per the provisions of Sec.255(1) Cr.P.C. and he is set at liberty and he shall be released forthwith if he is not required in any other case.
