Sentence: In the result, A1 and A2 are found guilty and they are convicted under Sec.241 of Cr.P.C for the offence under Sec.379 IPC. Al and A2 are sentenced to undergo simple imprisonment for 3 (three) months each and to pay a fine of RS.100/- each, /D SI for 15 days each.

The remand period already undergone by them as UT Prisoners is given

Tnis Case was Coming before me en 2203.2013 for examination of Al and AZ under sec.239 CrP C in the presence of Assistant Public Prosecutor for the complajinant and Sri LGopinadh, Advocate for Al and A2 and after consideration this court delivered the following:

JUDGMENT

The Inspector of Police, Pattabhipuram P.S., Guntur laid charge sheet against the Al and A2 in Cr.No.329/2012 for the offence under Sec.379 of I.P.C.

2. The brief averments of the charge sheet are that: Since L.W.1 requires money, he consulted L.W.2 over telephone and requested him to arrange Rs.2,00,000/- towards loan and L.W.2 agreed to arrange the amount, as such on 22.6.2012 about 2.0o0 p.m. L.w.1 visited the house or LWZ on his Bajaj CT 100 bike and from there both LWs.l and 2 viSIted HDP Bank, Lakshmipuram Branch, Guntur and LW2 drawn cash or Ks.Z,00,000/- from his account vide Alc

No.1891720000577 and handed over e same to LW1 and Lws 1 and 2

came out from the bank and Lwa kep uie cash in the dickey of his Baiai CT 100 bike and Al and A2, who are waiting in front of the bank to commit offence witnessed the same and they followed L.Ws.1 and 2 by hiring some unknown auto and LW2 took LW1 to his house in order to obtain promissory notes from L.W.1 and during such time. LW.1 did not 2 choose to collect the cash from the dlckey and went into the house of LW2 and noticing this, Al and AZ opened the dlckey of bike of LW1 with the help of screw driver committed theft of cash of Rs.2,00,000/- and decamped with the cash and the accused shared the amount and spend the amount for thelr vices and deposlted some of the stolen amount in the account of Al vide Alc No.2192101013299 which is tarred in Canara Bank and after executing the promissory note, LW1 came out from the nouse and he recognized the offence and Lws 1 and 2 searched for the Offenders in the vicinity, but failed to trace and as such on the same day at 6 pm, LW1 gave report to the police. LW13 registered the report as a case in Cr.No.329/12 u/s. 379 IPC (MO unclassified) of Pattabhipuram police station and investigated the case and during investigation, LW13 visited the scene of offence, inspected it under the cover of an observation report duly attested by Lws.9 and 10 and prepared rough sketch of the same and ß and recorded their statements and on LW13 examined LWs.1 to 10.9.2012 LW12 arrested A1 in Cr.No.267/12 u/s.25 of Arms Act of Shahdara police station, North East Delhi, and Al confessed that with the active of support of A2 and Hamith Tyagi they committed theft of cash from the customers of HDFC Bank in Andhra Pradesh and on 24.9.2012 LW12 arrested A2 in Cr.No.284/12 u/s.25 Arms Act of Shahdara police station, North East Delhi and A2 too confessed that with the active Support of A1 and Hamith Tyagi they committed theft of cash by from the customers of HDFC Bank in Andhra Pradesh and as such on 15.11.2012 the accused were remanded in this case by filing PT warrant and later the aCcUsed were taker tor 24 hours police custody vide Dis No.1884 dt.21.11.2012. S Turner alleged that in between 3 pm to 6 pm. on 22.11.2012 the dccused Were inerrogated in the presence of Lws.7 to 9 and 11 and LwS 9 and ll acted as mediators while | we 7 and e acted ac translators since the accused are speaking in hindi language and the accused confessed to nave committed this offence and the offences in Cr.No.264/12 u/s.3/9 IPC Or Pattabhipuram PS, Cr.No,434/12 u/s.379 IPC of Pattabhipuram P5 and Cr.No.381/12 u/s.379 IPC of Arundelpet PS and a detailed mahazar was drafted to that effect duly attested by Lws 7 to 9 and 11 and the acCused were sent for judicial Custody as the purpose for taking the accused to police custody was served and during enquiry it came to know that the account of Al which is maintained in Canara Bank vide Alc No.2192101013299 was already freezed and after completion of the investigation, LW13 filed charge sheet. This case was coming before me on this day for final hearing in the presence of Assistant Public Prosecutor for the complainant, and having stood over till this day for consideration this court delivered the following:

JUDGMENT

The Inspector of police, Pattabhipuram Police Station, Guntur, laid charge sheet against accused for the offence U/Sec.379 riw 511 IPC.

2. The brief averments of the charge sheet against the accused

are that on 2.7.2013 at about 7.30 p.m, the complainant came to PS and

presented a written report stating that "To the SHO, Pattabhipuram Sir I Singam Setty Veeraiah, S/o Butchaiah, age 49 yrs, caste by Kapu, R/o.D.No.1-3-90, Gujjanagundla, Guntur. I am doing rental iron pillar boxes, today i.e., 2.7.2013 at about 5.00 p.m, one male person aged about 25 years came to my house and getting the pillar boxes to the out side from his house by saving that his mastery entrusted to him to get iron pillar boxes and my workers Shaik Chand bash and Gopu Venkata Swamy informed the Same to me, i came to their on seeing me the accused escaped from there and he enquired about the accused and he came to know that his name is Konda Tirupataiah and he is resident of Sree Nagar, Guntur and so he requested in his repot to take legal action against the accused who tried to try and attempted theft of iron pillars boxes from his compound and he requested in his report to take legal action against the accused", LW4 registered the report as a case in Cr.No.355/13 under sec. 379 r/w 511 IPC of Pattabhipuram Ps and investigated the case. During investigation, LW4 visited the Scene of offence and inspected it, he 2 prepared rough sketch of the scene of offence and he secured the presence of LWs 1 to 3 and he examined the witnesses and recorded their statements. On 4.7.2013 he arrested the accused and sent him for remand RdWE verified the invesuiygduonor LW4 and investigated the case further

od afer completion of invesugaton, LW5 filed charge sheet. Hence, the

charge.

2 This case was taken on me under Sec.379 r/w 511 |PC against the accused.

When the accused produced before the court, copies of case 4 documents were furnished to him as required U/sec.207 of Cr.P.C.

Accused is examined under Sec.239 of Cr.P.C, charge under sec. 5 379 r/w 511 |PC is framed, read over and explained to him in Telugu, for which, he pleaded guilty for the said offence. The admission of the accused

is voluntarily.

Hence, the accused is convicted under Sec.241 of Cr.P.C. and he is sentenced to undergo SI for a period of 6 (six) months and also sentenced to pay a fine of Rs.100/- (Rupees one hundred only) for the said offence, ID S/| for 15 days.

The remand period undergone by the accused shall be given set off under sec.428 Cr.P.C.
