This suit is coming on this day before me for final disposal in the presence of Sri Y. Uma Maheshwar Rao, the learned Advocate for the Plaintiffssince the defendants were set Ex-parte, and the matter having been heard and stood over for consideration till this date, this court delivered the following :-

J U D G M E N T

1.The present suit has been instituted by Plaintiffs No.1 to 3 seeking a declaration as the legal heirs of the deceased Samilati Shankar.

The brief averments in the plaint :-

2.The deceased Samilati Shankar was the husband of the Plaintiff No.1 and father of Plaintiffs No.2 and 3 who died intestate on 29-04-2025. The Plaintiffs contended that they are the only legal heirs of Late Samilati Shankar. After the death of the Sri Samilati Shankar who was an employee of Osmania University, Plaintiffs filed an application to obtain a Legal Heir Certificate before the Branch Manager,

State Bank of India, Osmania University Branch, Osmania Art College Premises,

Hyderabad who is Defendant No.2 to redeem the amount deposited by the deceased

Sri Samilati Shankar into his account, defendant No.2 insisted to bring Legal Heir

Certificate for the same. Hence, Plaintiffs No.1 to 3 instituted this suit seeking a declaration that they are the legal heirs of Late Samilati Shankar.

3. Summons was served on Defendant No.2, i.e., Branch Manager, State Bank of In- dia, Osmania University Branch, Osmania Art College Premises, Hyderabad. How- ever, as there was no representation, Defendant No.2 was set exparte. With regard to any other person who may be concerned with this suit, i.e., Defendant No.1, the

Court allowed paper publication of summons under Order V Rule 20(1A) of the 3 of 5O.S.No.3540 of 2025

Civil Procedure Code, pursuant to which the Plaintiffs caused the publication of summons in the Surya Telugu Daily newspaper on 28.09.2025. As no person ap- peared to raise any objection, the suit proceeded to trial.

4. To prove the suit claim, on behalf of Plaintiffs, Plaintiff No.1 got examined herself as PW1. In her chief in examination, she reiterated the contents of the plaint.

PW1 got marked Ex. A1 to Ex. A12.

5. Heard the learned counsel for the Plaintiffs and perused the record.

6. Now the point for determination is :

(Q1): Whether the Plaintiffs are entitled to be declared as Legal heirs of Late

Samilati Shankar, who died intestate on 29-04-2025 for the purpose of legal

status only?

P O I N T 1:- (Q1): “Whether the Plaintiffs are entitled to be declared as

Legal heirs of Late Samilati Shankar, who died intestate on 29.04.2025 for the

purpose of legal status only?”

7. The Plaintiffs have produced Ex.A1 to Ex.A12 in support of their case. Ex. A1 is the original Death Certificate of the deceased Samilati Shankar which shows that he died on 29-04-2025, Ex.A2 is the Original Family Member Certificate issued by

MRO Office, Ex.A3 is the Original Identify Card of Sri Samilati Shankar issued by

Department Osmania University, Ex.A4 is the Original Pension Order (1321/5/2024/Accts/Pension), Ex.A5 is the Pension Letter to SBI (3067/NTFP/2284/Accts/Pension), Ex.A6 is the Original SBI Bank Account (No.52198287933), Ex.A7 is the Original Aadhar Card of Smt. (Plaintiff No.1), Ex.A8 is the Original Aadhar Card of Smt. S. Archana (Plaintiff

8. It is contended by the Plaintiffs that they are the legal heirs of Late Samilati

Shankar by virtue of Plaintiff No.1 being the wife and Plaintiffs No.2 and 3 being the daughters of Late Samilati Shankar. Although paper publication was made invit- ing objections, no person appeared to raise any objection against the declaration sought. As the evidence and contentions of the Plaintiffs have remained unchal- lenged, the Plaintiffs have established their case.

POINT 2: (Q2): To what relief ?

9. In the result, the suit is decreed, without costs by declaring that the Plaintiffs

No.1 to 3 are the sole surviving legal heirs of deceased Samilati Shankar who died intestate on 29-04-2025,for the purpose of legal status only.

1. The present suit has been instituted by Plaintiff seeking a declaration as the legal heir of the deceased Late Budidhipati Mahender Reddy.

The brief averments in the plaint :-

2. The deceased Budidhipati Mahender Reddy was the father of Plaintiff who died intestate on 20-02-2025. The Plaintiff contended that she is the only legal heir of

Late Budidhipati Mahender Reddy. After the death of Late Budidhipati Mahender

Reddy, Plaintiff’s GPA Holder filed an application on 08-10-2025 to obtain a Legal

Heir Certificate before the Tahsildar, Himayathnagar Mandal who is Defendant

No.1, but the same was not accepted. Hence, Plaintiff instituted this suit seeking a declaration that they are the legal heir of Late Budidhipati Mahender Reddy.

3. Summons was served on Defendant No.1, i.e., Tahsildar, Himayathnagar. How- ever, as there was no representation, Defendant No.1 was set exparte. With regard to any other person who may be concerned with this suit, i.e., Defendant No.2, the

Court allowed paper publication of summons under Order V Rule 20(1A) of the

Civil Procedure Code, pursuant to which the Plaintiffs caused the publication of summons in the Yudda Bhoomi Telugu Daily newspaper on 17.11.2025. As no person appeared to raise any objection, the suit proceeded to trial.

4. To prove the suit claim, on behalf of Plaintiff’s GPA Holder Jithender Reddy, got examined himself as PW1. In his chief examination, he reiterated the contents of the plaint. PW1 got marked Exs.A1 to Ex.A7.

5. Heard the learned counsel for the Plaintiffs and perused the record.

6. Now the point for determination is :

7.The Plaintiff’s GPA Holder has produced Exs.A1 to Ex.A4 in support of their case. Ex.A1 is the Original Death Certificate of the deceased Budidhipati Mahender

Reddy which shows that he died on 20-02-2023, Ex.A2 is the Original PAN Card of the Plaintiff, Ex.A3 is the Original GPA Doc.No.9017/2025 dated: 24-07-2025, and

Ex.A4 is the Original Aadhar Card of the Plaintiff’s GPA Holder.

8.It is contended by the Plaintiff that she is the legal heir of Late Budidhipati

Mahender Reddyby virtue of Plaintiff being the daughter of Late Budidhipati Ma- hender Reddy. Although paper publication was made inviting objections, no person appeared to raise any objection against the declaration sought. As the evidence and contentions of the Plaintiff have remained unchallenged, the Plaintiff has established their case.

9. In the result, the suit is decreed without costs by declaring that the Plaintiff as the sole surviving legal heirs of deceased Late Budidhipati Mahender Reddy who died intestate on 20-02-2025,for the purpose of legal status only.
