This suit is coming on this 30th day of August, 2016 before me for final hearing in the presence of Sri S.Malla Rao, Advocate for the plaintiffs and of Sri J. Prabhakar, Advocate for the defendant and the matter having stood over for consideration and this court passed the following :
JUDGMENT
1)This is a suit filed for grant of perpetual injunction restraining the defendants and anybody claimed through them from causing interference with the peaceful possession of the plaintiff over the suit schedule property bearing Part of Plot No.25/A/3, admeasuring 600
Sq Yds or 500 sq. Mts in the layout of Survey No. 120/403/1 of
Shaikpet Village and Survey No.102/1 of Hakeempet Village of Sri
Venkateswara Coop. House Building Society known as MLA Colony,
Hyderabad. The plaintiff pleaded as follows:
2)Plaintiff is are the absolute owner and possessor of the property bearing part of Plot No.25/A/3, admeasuring 600 sq. yds or 500 sq.
Mts in the layout of Survey No.120/403/1 of Shaikpet Village and
Survey No. 102/1 of Hakimpet Village in the layout of Sri 2OS 69-2015
Venkateswara Co.operative House Building Society known as MLA
Colony, Hyderabad Urban Taluk, Hyderabad District in the limits of
GHMC Ward No.8, & Block No.2 situated at MLA's Colony, Road
No.12, Banjara Hills, Hyderabad having purchased the said plot for valid sale consideration through registered sale deed bearing document
No.2637/2009 dated 02.09.2009. No Objection certificate was issued to the plaintiff by his vendor Society for construction of house subject to GHMC sanction and to obtain electricity and water connection.
3)The Government of Andhra Pradesh allotted land admeasuring 100 acres in Survey No.403 of Shaikpet Village, Hyderabad District to
Sri Venkateswara Coop. House Building Society for A.P Legislators
Ltd, (Regd. No.TAB 185) for developing the land by making into residential plots and to allot them to Members of Parliament, Members of Legislature and later extended the benefit to the Assembly employees also. The land was allotted on payment of Market Value subject to usual conditions by alienation vide G.O.Ms.No.176, Revenue (Q) Department dated 09.02.1982. Subsequently the Government of
Andhra Pradesh, Revenue (Q) Department issued another
G.O.Ms.No.894 dated 24.06.1982 by annulling the earlier G.O.to the effect that Ac.820 Guntas of land in Survey No.403 and Ac.9120
Guntas in Survey No.102/1 of Hakimpet Village out of the surplus land held by Jubliee Hills Cooperative Housing Society.
4)The said Society prepared a Layout which was approved by
Municipal Corporation of Hyderabad after obtaining permission from
Town Planning Department, HUDA vide Permit No.153/7 dated 3OS 69-2015 31.12.1982. In accordance with the said Layout, plots were allotted to various members of the Society as per the Bye Laws of the said Society.
Subsequently after laying the roads basing of the topography of the land there arose a necessity by submitting Revised Layouts from time to time by the said Society. Like that first Revised Layout was sanctioned by Municipal Corporation of Hyderabad on 18.01.1984 and second Revised layout was sanctioned vide Permit No.19/82 dated 28.08.1984, third Revised Plan was sanctioned vide Permit No. 71/22
dated 20.03.1985 and fourth Revised Plan was sanctioned vide Permit
No.140/92 dated 19.02.1988.
5)On a representation made by the Society to the Government stating that it need some more land for their members since there were encroachments in their land, the Government of Andhra Pradesh allotted 4 more acres of land through G.O.Ms.No.1013 Rev. (ASN.III)
Department dated 08.11.1991. In accordance with the said G.O, the
Deputy Collector, Survey Department authorities handed over possession of the allotted land to the personincharge of the Society on 15.11.1991. The then PersoninCharge of the Society submitted a layout for the 4 acres separately as Phase II to the Municipal
Corporation of Hyderabad in the year 1992 itself. Subsequently a continued map was prepared showing 100 acres of land as well as 4 acres of land to the municipal authorities.
6)The Andhra Pradesh Housing Board, a Body Corporate incorporated under the Provisions of Andhra Pradesh Housing Board
Act represented by its Vice Chairman executed a Sale Deed in favour of 4OS 69-2015 the defendant herein on 13.02.2008 which was registered as document
No.597/2008 for an extent of 14 acres of land in Survey No.102/1,
T.S.No.5, Block No.15, Ward No.12 of Shaikpet Village and Mandal,
Hyderabad District. In the Schedule of the said sale deed it was indicated that towards north of the land sold, the boundary is mentioned as MLAs. Colony and Venkateswara Housing Society.
Surprisingly in the plan annexed to the sale deed, it was mentioned that T.S.No.5, Block J, Ward No.12 and Old Survey No.102/1 of
Hakimpet Village and towards northern side of the map again it was written as MLAs. Colony and Venkateswara Society. In the sale deed, it was mentioned that Government alienated this 14 acres of land to the Andhra Pradesh Housing Board Vide G.O.Ms.No.1555 dt.
19.12.2007 and A.P. Housing Board in turn executed the sale deed in favour of the defendant herein.
7)Subsequently in the year 2010, the defendant addressed a letter to the Collector, Hyderabad District stating that even though sale deed was executed their favour, boundaries were not fixed and they are not in a position to take up any activity and requested to conduct the survey and demarcate the land as per the sketch annexed to their sale deed. The defendant herein do not know about the particulars of the land purchased by them, its boundaries and where the land is located, but they have got the knowledge that towards north of their land, the land of Venkateswara Society (MLAs Colony) is located. Venkateswara
Society land means, the land of 100 acres originally allotted by the
Government and additional land of 4 acres subsequently allotted in the 5OS 69-2015 year 1991 through Government Orders. For the four acres of land which was allotted in the year 1991, as land was not developed completely and properly, the defendant under the guise of their sale deed is interfering with the possession of purchasers of Plots in the 4 acres land by sending their officials and their henchmen from the nearby basthi. The plaintiffs herein is among the purchasers of the plots in these 4 acres additional land that was allotted to the Sri
Venkateswara Co.op. Society by the Government. Having aggrieved by the illegal interference by the employees and other staff of the defendant over the peaceful possession and enjoyment of plaintiff over his plot, the plaintiff along with K.L.Mrudula and Dr K. Akhila were constrained to file a Writ Petition No.6037/2012 in Honourable High
Court. Unfortunately, the said Writ Petition was dismissed at the stage of admission on 06.03.2012 on the ground that even though there is no title dispute between the parties, the dispute is with regard to boundary between the lands of petitioner and that of respondents and since it is purely a civil dispute it has to be tried and disposed by a
Civil Court in an appropriately framed suit.
8)After nearly 4 years, the defendant is trying to take possession of the property and disturbing the possession of the plaintiff and others came on 28.03.2013 and threatened the plaintiff and other plot purchasers with dire consequences if any constructions are made. The plaintiff wanted to construct compound wall to prevent encroachments in order to safe guard the property. The defendant has no manner of right to enter into the property of the plaintiff when they themselves do 6OS 69-2015 not know where their property is located and its boundaries. Being aggrieved by the illegal interference by the employees and other staff of the defendant over the peaceful possession and enjoyment of plaintiff over his property, the plaintiff is constrained to file the present suit.
9)The defendant filed the written statement denying the suit claim and also adverse averments further pleadings as follows :
10)The plaintiff do not have right title and interest in the plaint schedule property and is not the owner or title holder of the property.
The plaintiff's' alleged vendor had no right or title to the plaint schedule property. The society had been executing sale deeds/ conveyance deeds in respect of the property over and above its entitlement and as such, the alleged sale deeds/conveyance deeds executed by the society itself are void and does not confer title upon the vendees/aloottees. The very object of allotment of a plot to the
Society gets defeated as the sales are made in favour of persons who were neither members or were eligible for becoming members. The title, right, interest and possession of the plaintiff and his predecessor in title is seriously disputed by the defendant and the plaintiff cannot maintain a simple suit for injunction simplicitor. There has been an allotment by way of government order by the Government in favour of
Andhra Pradesh Housing Board which in turn had executed a registered sale deed in favour of this defendant and possession of the property was handed over to this defendant under a cover of panchanama by virtue of documents and transactions referred to in the succeeding paras of this written statement neither the G.O's or 7OS 69-2015 sale deed are challenged by the plaintiff. The identity, location of the properties being claimed by the plaintiffs under the alleged sale deed itself is not clear, not delineated and are not identifiable on the ground.
11)This defendant is the absolute owner, title holder and possessor or all that part and parcel of land admeasuring Acres 14.00 or 67760 sq. yards situated in Survey No.102/1, T.S.No.5, Block No.J, Ward
No.12 of Shaikpet Village & Mandal, Hyderabad District having acquired the same under a registered sale deed bearing document
No.597/2008 dt. 13.02.2008 executed by A.P Housing Board. Form the date of it's purchase, the defendant has been in peaceful possession and enjoyment of the said land, without any manner of interference from the third parties.
12)Originally, the Government of Andhra Pradesh vide
G.O.Ms.No.42, Housing (HB.1) Department, dated 27.10.2006 had permitted the Andhra Pradesh Housing Board (A.P.H.B.) to create a new subsidiary under Section 21(A) of the Andhra Pradesh Housing
Board Act, 1956, to be incorporated as a Company under the
Companies Act, 1956 to undertake any one or all the activities as incorporated under Section 21(b) of the A.P. Housing Board, Act, 1956.
The Government of A.P. further directed that the State Government will hold 49% of the equity in the new subsidiary with the A.P Housing
Board holding 51% of the equity. The equity will come by way of transfer of unencumbered land in favour of the said subsidiary by the both the State Government and the A.P Housing Board.

13)Pursuant to the same, the A.P Housing Board has registered M/s
Deccan Infrastructure & Land Holdings Limited I.e the defendant under the companies Act, 1956 on 14.12.2006 as a new Subsidiary of the A.P Housing Board. The Government of Andhra Pradesh has vide
G.O.Ms.No.1379, 1380, 1382 & 1383, revenue Department, all dated 26.10.2007 has transferred various ands in favour of defendant on payment of prevailing market value fixed by the Government which was adjusted towards the State Government Equity in Defendant's
Company.
14)The Andhra Pradesh Housing Board has passed a resolution by way of Note on 02.01.2007, resolving to transfer certain lands to the newly created company M/s Deccan Infrastructure & Land Holdings
Limited (defendant) and the said circulation resolution was confirmed in the Special Board Meeting of the A.P Housing Board held on 05.01.2007. In compliance with the said resolution, the Vice Chairman and Housing Commissioner, A.P Housing Board vide proceedings No.
151/DILL/AE/PC/062 dated 23.11.2007 passed orders for registering the lands mentioned therein including the land admeasuring Acres 14.00 or 67760 sq. yards situated in Survey No.102/1, T.S.No.5, Block
No.J, Ward No.12 of Shaikpet Village & Mandal, Hyderabad in favour of the defendant.
15)The above referred land with some other lands was alienated by the Government to the Andhra Pradesh Housing Board on cost basis @
Rs.40,000/ per Sq. yard vide G.O.Ms.No.1555 Revenue (Assignment
III) Department dated 19.12.2007 thereby A.P. Housing Board has 9OS 69-2015 become absolute owner and possessor of the said land. The
A.P.Housing Board by virtue of the above referred resolutions decided to transfer land admeasuring Acres 14.00 or 67760 sq. yards situated in Survey No.102/1, T.S.No.5, Block No.J, Ward No.12 of Shaikpet
Village & Mandal, Hyderabad to the defendant on payment of the market value as fixed by the Government in the above referred G.O by adjusting the said cost towards the A.P Housing Board's equity in the defendant's company.
16)The Government of Andhra Pradesh also exempted stamp duty and Transfer duty and accordingly the A.P Housing Board executed registered Sale Deed bearing document No.597/2008 dated 13.02.2008 in favour of the defendant conveying all its title rights and interest in respect to the above referred and the A.P Housing Board also delivered vacant peaceful possession of the above referred land to the defendant.
Since, then the defendant has been in peaceful possession and enjoyment of the said land.
17)Thereafter a joint survey of land given to this defendant and
Hyderabad Metropolitan Development Authority (H.M.D.A) was conducted in pursuance to the Orders issued by the Collector,
Hyderabad District vide proc. No.E6/11/644/2007 dated 14.11.2012, in which highest authority I.e Deputy Director, Survey and Land
Records and other officials conducted field survey for demarcation of land handed over to the defendant I.e land admeasuring Acres 14.00 or 67760 sq. yards situated in Survey No. 102/1, in Ts. No.5 of Sheikpet
Village and accordingly fixed the boundaries of the defendant and also 10OS 69-2015 the land belonging to the H.M.D.A. In the said Joint Survey, it was found that on the southern side of this defendant's land that around 181 slum dwellers have encroached an extent of Acres 521 Guntas of land and after ascertaining the encroachers, this defendant filed Land
Grabbing case before Spl. Court under Land Grabbing and Prohibition
Act, 1982 at Hyderabad in L.G.C.Sr.No.3005 of 2012 which is pending adjudication.
18)The land is an open land and there are no constructions in the land handed over to this defendant. The Society having colluded, executed the sale deeds in respect of the nonexisting land and under the guise of survey, at different times, the Society has been executing the conveyance deeds in respect of the property which is not available and particularly in respect of which the Society itself does not have any right, title and interest much less possession. The property purchased by this defendant is in survey number 102/1 corresponding to TS
No.5, Block No.J, Ward No.15 of Shaikpet Village and mandal,
Hyderabad District. At some places, on account of typographical error, it is incorporated as Block No.15 in fact, it is Block No.J. There is no
Block No.15 in TS No.5, Ward No.12. The society is also in collusion as a matter of fact, the suit schedule property is non existing any where in the layout or revised layout of the Society. The plaintiff is not the members of the society, which is formed for the welfare of the members of the Parliament, Members of the Assembly and the employees working in the Assembly.
19)It is denied for want of knowledge that on a representation made 11OS 69-2015 by the Society to the Government stating that it need some more land for their members since there were encroachments in their land, the
Government of Andhra Pradesh allotted 4 more acres of land through
G.O.Ms.1013 Rev. (ASN.III) Department dated 08.11.1991. As a matter of fact, the lands which were alienated to the defendant were covered by some encroachments by the slum dwellers on the southern side of land in Survey o.102/1, T.S.No.5, Block No.J, Ward No.12 of Shaikpet
Village and Mandal, Hyderabad District. The officials conducted filed survey for demarcation of land handed over to the defendant I.e land admeasuring Acres 14.00 or 67760 sq. yards situated in Survey
No.102/1, in Ts.No.5 of Shaikpet Village and around 181 slum dwellers have encroached an extent of Ac.521 guntas of land and after ascertaining the encroachers, this defendant filed Land Grabbing cases
before Special Court under Land Grabbing and Prohibition Act, 1982
at Hyderabad in L.G.C.SR.No.3005 of 2012.
20)Basing on the pleadings, the following issues were framed.
1) Whether the plaintiffs are in possession of the suit schedule property as on the date of filing the suit?
2) Whether the suit schedule property is not identifiable on the ground or alternatively not existing on the ground?
3) Whether the suit schedule property falls in Ward No.8 and Block
No.2 situated at MLA Colony, Banjara Hills, Hyderabad?
4) Whether the plaintiff is entitled for permanent injunction as prayed for?
5) To what relief?
21)At the time of trial both parties have adduced oral and 12OS 69-2015 documentary evidence through Pw.1, Pw.2, Dw.1, Exs A.1 to A.111 and
B.1 to B.5.
22) On closure of the evidence, heard the arguments on both sides.
23) ISSUE No.1 , 2 & 3: Precisely the case of the plaintiff is that he had purchased the original plots I.e schedule property under registered sale deed in the month of September, 2009. Originally the land in 100 acres of survey No. 403 of Shaikpet Village was allotted by the Government of Andhra Pradesh to the Sri Venkateswara Co.op.
House Building Society which was meant for developing the land and allotted the same to the Members of Parliament and Members of
Legislature and also to the Assembly employees making the lands into plots. Subsequently the land was limited to Ac.91.20 Guntas. Layouts and revised layouts were sanctioned from time to time by the municipal corporation and in due course on request the Government of
Andhra Pradesh allotted 4 more acres of land under Government Order dt.08.11.1991. Accordingly the Deputy Collector, Survey delivered the possession of the allotted land to the Society on 15.11.1991 which in turn submitted a lay out for such 4 acres separately in the year 1992 and continued layout map was prepared for both areas of land and submitted to the municipal authority.
24)The Andhra Pradesh Housing Board executed a sale in favour of the defendant on 13.02.2008 for an extent of land in 91 acres forming part of survey No.102/1 of Shaikpet Village which is a different one.
The defendant caused illegal interference over the possession and 13OS 69-2015 enjoyment of the plaintiffs in respect of the land purchased by them I.e the suit schedule property.
25)The Special Power of Attorney holder of the first plaintiffs by name Sri P. Ravinder Rao, deposed through his evidence affidavit in total consonance with the plaint pleadings. Ex A.9 G.O.Ms.No.176 dt.
09.02.1982 speaks of the order of the Government of Andhra Pradesh directing the allotment of 100 acres of land in survey No.403 of shaikpet to the Sri Venkateswara Co.op. House Building Society for allotment to its members. Ex A.10 concerned G.O.No.894 dt.
24.06.1982 issued by the Government of Andhra Pradesh resumes an extent of Ac.91.20 Gts of land in Survey No.102/1 of Hakimpet Village from Jubilee Hills Coop. Housing Society and alienated to the said same to the Sri Venkateswara Co.op. House Building Society.
Thereafter under Ex A.10 G.O. No.1013 dt. 08.11.1991 alienated 4 more acres of land out of Survey No.102/1 of Hakimpet Village in favour of
M/s Sri Venkateswara Co.op. House Building Society.
26)Therefore, it is crystal clear that the land was allotted to the Sri
Venkateswara Co.op. House Building Society by the Government of
Andhra Pradesh which in turn made the plots and sold the schedule A property to the plaintiff No.1 under Ex A.1 registered sale deed dt.02.09.2009. Ex A8 Encumbrance Certificate also confirm the same. Thus, it is crystal clear the plaintiff having purchased the land under the schedule properties under valid conveyance deed and since there is a clear flow of title from the Government to the plaintiff through the Housing Society, the plaintiffs could prove their incidental 14OS 69-2015 title over the suit schedule properties.
27)In one Writ Petition No.30532 of 2011 filed by Sri Venkateswara
Co.op House Building Society, the Greater Hyderabad Municipal
Corporation appears to have filed the counter affidavits admitting the submission of lay out for four acres of land by the said society also and that the Greater Hyderabad Municipal Corporation has already issued a letter.
28)The petitioners appears to have filed a Writ petition No.6037 of 2012 by the Hon'ble High Court of Andhra Pradesh against no other than the defendant herein seeking a direction declaring the connection of the respondent I.e the defendant herein in causing interference with the property purchased by the plaintiffs herein from the said Sri
Venkateswara Co.op House Building Society, the Hon'ble High Court was pleased to observe that there is no title dispute between the petitioner and respondent with regard to their respective properties and the dispute is with regard to boundary between the lands of the petitioners and lands of respondent. Ex A.111 Minutes of the said
Society reveal about Resolutions passed inclusive of the allotments etc.
By virtue of the little disputed documents Ex A.1 to A.111 plaintiff are found to be the title holders and consequently in possession of the property.
29)The contention of the defendant is that there is no such schedule property existing and the plaintiffs are not in possession of any such property and it is the defendant who purchased the land of 14 acres in 15OS 69-2015
Survey No.102/1 T.S.No.5, Block No.J, Ward No.12 of Shaikpet Village.
As seen from the Ex B.1 sale deed in favour of the defendant executed by the A.P Housing Board the schedule property is of Block No.15 whereas the defendant referred it as block No.J such schedule property is on the face it apparently different from the suit schedule property property and it is categorically mentioned in the schedule that there is
MLA Colony and Sri Venkateswara Co.op House Building Society on the northern side of the property. All the documents in Ex B.2 I.e
G.O.Ms.No.1555 dt. 19.12.2007, Ex B.3 Memo dt. 05.08.2008 issued by the Government of Andhra Pradesh, Ex B.4 panchanama said to have been conducted by the Deputy Tasildar relates to different Survey number from the suit schedule property.
30)It is pertinent to note that even under Ex B.6 joint survey report undisputedly lot of encroachments extending to Ac.5.20 Guntas out of the said Ac.14 of land which was handed over to the defendant are found which speaks that even the title extent of 14 acres of land is not in possession of the defendant, since about Ac.5.21 Gts was already under encroachments.
31)No document filed and exhibited by the defendant leads to any interference or proof that the suit schedule property claimed by the plaintiffs is part of land allotted or sold to the defendant by the A.P
Housing Board whether it is 14 acres of land or the encroachments part of it and no part of record reveal that the housing Board has delivered the possession of the property to the defendant.

32)There appears to be some proceedings with regard to the rectification of the Block number etc., but the defendant himself as
Dw.1 categorically deposed in the cross examination that the MLA
Colony, Sri Venkateswara Co.op Housing Society has been shown in the northern boundary for the property claimed by the defendant and that he does not whether notices were given to adjacent land owners at the time of joint survey. It is also pertinent to note that the Dw.1 himself categorically further deposed that the encroachments are permanent in nature with properly formed roads, water connections and electricity connections and that there is a road from MLA Colony upto the northern boundary of the land of the defendant. Therefore, it is crystal clear that the suit property is totally different from the property claimed by the defendant and the plaintiff having proved his incidental title possession is entitled for the injunction sought for.
These issues are answered accordingly in favour of the plaintiff against the defendant.
33) ISSUE No. 4 : For the answers and findings on issue No. 1 & 2, the plaintiffs are entitled for the suit relief.
34) ISSUE No.5 : In the result, the suit is decreed with costs granting perpetual injunction restraining the defendants and any body claiming through it from causing interference with the possession of the plaintiff over the suit schedule property, otherwise than due process of law.
