DHR is called absent and no representation. The warrant sent to the execution was returned stating that the DHR did not turn up to identify the articles, due to which, the bailiff could not execute the warrant and saying so, returned. As per record, in the present report dated 20.01.2025, the bailiff has clearly mentioned that the DHR did not turn up to identify the articles to be attached and when the articles are not identified, it is not possible to attach them to execute the warrant as explained by the bailiff. Further, it appears that time and again, the DHR has been paying the process but not attending the execution, due to which this petition has been kept pending without any progress. Thus, it appears that the DHR is simply filing the process and leaving away without prosecuting the matter and in those circumstances, keeping the matter pending on the file of this court, without any progress for years together, does not serve any purpose and even today also, neither DHR nor his counsel are present to take up the proper steps in the matter, as such, this execution petition is liable to be dismissed for non prosecution. Accordingly, this Execution petition is dismissed for non prosecution. No costs.
